Dear Jeremy:
The above -referenced site plan was approved on October 14, 2011. The site plan is approved for
the construction of a new 1,783 square foot Waffle House Restaurant located on Gateway Drive
in the Winchester Gateway Shopping Center in the Stonewall Magisterial District. Required site
improvements include the following:
Designated parking area with 30 spaces (including three handicap accessible), including
curb, wheelstops, striping and handicap access.
One screened dumpster area.
Sidewalks and landscaping as shown on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with six (6) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office
to schedule an on -site inspection. Do not hesitate to contact me if you have any questions.

Dear Jeremy:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff s comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments
1. Special Limited Power of Attorney Form. Please have the property owner sign the
attached Special Limited Power of Attorney Form prior to further review or approval.
This form should be notarized and completed to grant the applicant (you) with
authorization to represent them for this site plan.
2. Recorded Plat. Provide a recorded plat for parcel 54-A-39N.
3.. Owner Information. Revise the property owner information as indicated.
4. Parking Calculations. On the coversheet provide the required parking for parcel 54-A-
99C and ensure that taking away 29 existing parking spaces will leave the use with an
adequate parking calculation. Also, revise the calculation to show 18 required spaces not

5. Signage. On the coversheet indicate the type of signage proposed for this use.
6. Adjoining Properties. One of the site plan sheets needs to show all adjoining properties.
7. Ordinance References. On the coversheet revise the ordinance references as indicated.
8. Access. On sheet 3 the access easement for this parcel needs to be shown.
9. Dumpster Location. The dumpster needs to be removed from the front setback area.
10. Photometric Plan. Indicate if any outdoor lighting is proposed with this site plan.
11. Landscaping Plan. The following needs to be revised on the landscaping plan:
• The impervious area of the parking lot needs to be shown. The perimeter
landscaping for this site will be based on the square footage of the paved parking
area. The impervious area of sidewalk does not count towards this number.

Buildings shall comply with The Virginia Uniform Statewide Building Code and section 303 -
AAssembly Use Group of the International Building Code/2009. Other Code that applies is
I(C/ANSI Al 17.1-03 Accessible and Usable Buildings and Facilities and International Energy
Code 2009. Structural plans submitted for permit application shall be sealed by a Virginia
Licensed Design Professional.
Building shall comply with height and area requirements as allowed for type of construction in
TiO3, fBC 2009.
Approaches and door clearances for main exit/entrance shall comply with ANSI Al 17.1-03
Clearance required for two doors in series shall comply with ANSI Section 404.2.5.
Handicap parking shall comply with ANSI Al17.1-03. A minimum of one van accessible space
isrequired per 1106.5 IBC 09. Van accessible parking shall have a minimum of I width with
5'unloading area or a minimum of 8' unloading area with an 8' width per Section 502 ANSI.
IEC 1106.6 requires HC parking to be located on the shortest accessible route of travel from
adjacent parking to the accessible building entrance. Question as to the location and shortest
route.
Accessible transition from parking and accessible route into main entrance shall comply with
Al 17.1-003 for allowable slopes. Slopes exceeding 1:12 (5%) shall be constructed as a ramp.
Ramps shall comply with IBC Section 1010 and shall be provided with handrails on both sides
where exceeding 6" rise. Question as to accessible route to entrance. Please provide elevation
marks along accessible route.
Please note the requirements in Chapter 17 of BOCA for special inspection requirements on the
type of strut;hlre.( Soils; concrete ect..). Slabs with'gre' tef than 24" gravel or 8" earth requires
an engineer design.
