It does not require the county to create a new record or report that does not exist. Requests for information about a particular subject or lists of questions to be answered are not subject to the Act. We are not required to summerize information from existing records. Please review Staff s comments listed below and prepare a revised site plan which adequately addresses each concern. Review Comments: 1) Zoninp- District Buffer. On sheet 8, the zoning district buffer needs to be extended to incorporate the portion of the property that was added to the Sheetz property through a BLA. The fence also needs to be shown on sheet 6. 2) Dumpster Details. On sheet 12, there is a note about the trash enclosure having slats for screening; this is not permitted. The enclosure must be constructed with an opaque board -on -board fence or masonry wall (or similar material). 3) Photometric Plan. The photometric plan needs to be revised as follows: Provide notations that all lighting fixtures are full cut-off fixtures. Provide a detail for each lighting fixture that is shown in the luminaire schedule (catalog cuts and illustrations by manufacturers can be submitted in lieu of showing the fixtures on the site plan sheets). • Show the property boundary on the photometric plan and ensure that the lighting levels do not exceed 0.2 at the property boundary shared with the residential use. • The lighting levels for the canopy area cannot exceed an average maintained lighting level of twenty (20) foot-candles — the plan shows an average of 30. After you have revised the site plan, please resubmit two copies so that 1 may verify the information contained on the plan. 1 will need all approved review agency comment sheets and at least five copies of the final plan for approval. Specific responses to each comment are as follows: 1. Special Limited Power of Attorney Form. Please have the property owner sign the attached Special Limited Power of Attorney Form prior to approval of this site plan. This form should be notarized and completed to grant the applicant (you) with authorization to represent them for this site plan. The Special Limited Power of Attorney is attached. 2. Photometric Plan. A photometric plan needs to be provided with this submission. Please note that all outdoor lighting for this site needs to conform with §165-201-07. A photometric plan has been added to the plan set. 3. Sidewalk. A five foot sidewalk is required along the Route 7 frontage of the site and along Regency Lakes Drive. Crosswalks also need to be shown for all entrances. A 5' sidewalk and crosswalks have been added to the plans. 4. Existing Sign. The existing freestanding sign along Route 7 does not conform to the adopted sign regulations and must be removed from this project. The site is permitted to have one freestanding monument sign (25 feet in height/150 sf in size.) As the use is not changing, we believe the sign may remain.
