The above -referenced site plan was approved on January 20, 2009. The site plan is approved for the
development of a restaurant use located at 3416 Martinsburg Pike in the Stonewall Magisterial District.
This development consists of an existing structure (Clearbrook Woolen Mill) and a 2,180 square foot
addition. Required site improvements include the following:
- Construction of a parking lot with 49 spaces (including three handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
- A sidewalk along Martinsburg Pike (Route 11).
- One loading space and a screened dumpster area.
Buffers and landscaping as shown on sheet 6 of the plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providipg you with six (6)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for futare reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

We have received your revised site plan dated December 15, 2008 for the referenced project. It appears all of
our earlier review comments have been satisfactorily addressed. Please advise the owner of our approval. Also
please provide four (4) sets of approved construction plans with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 11 right-of-way. The
permit is issued by this office and will require a minimum processing fee, surety bond coverage, and the salary &
expenses of a State assigned Inspector. A copy of any/all recorded plats of dedication for drainage easements or
additional right-of-way required for implementation of this proposed project should be provided to VDOT prior to
issuance of any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty days to process and
issue. Should you have any questions, do not hesitate to call.

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site
plan is denied until the issues in this letter, as well as all issues of the other review agencies,
have been adequately addressed. Please review Staffs comments listed below and then
prepare a revised site plan which adequately addresses each com-ern.
Review Comments
I. Conceptual Layout. Remove the conceptual layout shown on sheet 2 as any future
improvements will need to be submitted on a future site plan.
2. Lighting. A detail for all proposed lighting needs to be provided in the site plan
3. Martinsburg Pike Landscaping. Label the berm on sheet 6.
4. Plant List. On sheet 6 in the plant list, revise. the size of the Yew and Holly to show
36 inches in height in addition to the three gallon container.
After you have revised the site plan, please resubmit two copies so that I may verity the
information contained on the plan. I will need all approved review agency comment sheets
and at least five copies of the final plan for approval. Comment sheets are required from the

Dear Ms. Perkins:
We received your comments dated July 8, 2008 and have addressed each as listed
below:
1. Note 11 has been revised on the cover sheet.
2. The existing right-of-way shown along route 11 will suffice for the construction
of the future improvements if the existing entrance shown to the site is closed
at that time. The closing of the existing entrance will occur during the future
road realignment and will eliminate the need for a right turn lane into the site
along route 11; therefore no additional right-of-way is necessary. This is all
per my discussions with Matthew Smith of VDOT in late September.
3. Per the meeting held September 19, 2008 with County Planning and Mr.
Chuck Dehaven, the current site plan proposed no improvements within the
location of the proposed realigned road. The new alignment will not affect the
proposed development shown. As agreed, right-of-way dedications will be
discussed when the proposed road realignment construction occurs.
4. Directional arrows are now shown in the parking areas.
5. A loading space is now provided.
6. The locations of pole lights are shown on the plan and the detail of the light
has been provided. Note 9 on the cover sheet indicates that the lighting
provided will conform to the "low impact lighting" proffer.

County Planning Department it was determined that the 10 foot buffer shall remain due

plan.

Review Comments
1. General Notes. On the coversheet, note 11 needs to be revised as indicated.
2. Martinsburg Pike. As indicated in the Frederick County Eastern Road Plan,
Martinsburg Pike is identified as an improved minor arterial road (U4D). This
plan needs to accommodate an additional lane on their portion of Martinsburg
Pike (lane, curb and gutter). A sidewalk needs to be provided along the
property's Martinsburg Pike frontage as well.
3. Hopewell Road Relocation. Hopewell Road is planned to be relocated as
indicated on sheet 2. Right-of-way to accommodate this improvement needs to be
preserved.
4. Directional Arrows. Provide directional arrows in the parking and driving areas
of the site.
5. Loadinp, Space. One loading space is required for this site.
6. Lightinp.. The site plan needs to show the location of any wall pack or pole
lighting located on the site as well as a detail for the proposed lighting. The type
of lighting needs to conform to the "low impact lighting" proffer from the
rezoning.

7. Martinsburg; Pike Landscaping,. The 20 foot landscape buffer needs to be
provided along the entire frontage of the site and extended as indicated on sheets
2 and 6. The berm also needs to be labeled.
8. Rear Buffer. The 10 foot buffer area along the rear of the site needs to be
provided with this site plan. Also, the plantings shown for this buffer do not meet
the proffer (deciduous trees and shrubs).
9. Parking, Lot Screening,. The headlight screening calculation on sheet 6 is not a
Frederick County Requirement. Evergreen hedges (36 inches) need to be
provided as indicated on sheet 6.
After you have revised the site plan, please resubmit two copies so that I may verify the
information contained on the plan. I will need all approved review agency comment
sheets and at least five copies of the final plan for approval. Comment sheets are
required from the following agencies: the Frederick County hgjmclions DepmIment, the
