I was asking Jeremy if the two plans were still active and if the owner was going forward with construction. If plans have
been completely dormant for a year we remove them from our system and new resubmissions are require.

Comment 4: Site Plan Size. Die site plan on Sheet 4 is too small. It appears that the lanclsc•aping and site plan
can be combined and shown on one Sheet (larger) and notes caul details could be provide(! on a separate sheet.
Response: The scale of the site plan has been revised from I" = 30' to I" = 20'.

Comment 6: Dumpster Area. the new dumpsler location needs to be separated from the parking area by a six
inch curb as well as a distance of fifiree feel (§165-27E(9)). Also, the location of fhe dunpster in regards to the
requirements of cormnent #8 that it will be impossible for a truck to pick up the trash. "I'lie fence detail for the
dimips'ter needs to be revised as indicated. lri regards to the existing Site, the property owner" heeds to move the
dlrmpsiers inside of the dumpsler enclosure as 1liel, are cm-rently sitihig next to the enclosure.
Response: Per our sleeting on Friday, August 22, 2008, the revised clunlpster area is acceptable.
Comment 7: Parallel Spaces. The parallel spaces are required to have isla mis at the ends (Trot striped). Also,
it appears that the loading areas and the three s7)arces next to Eckan'cl Circle are placed over the underground
larks. !here%ore, it appears that vehicles would need to be moved in orderfor the filling Qf the tanks, which is
not appropriate. Also, the striped island shown for llie sparces along the Side of the building reduce the driving
lame to less than 12 feel. It appears that many (lf lhese parallel spaces need to be removed.
Response: Per our sleeting, it was agreed that the parallel spaces along the cast side of the building were
acceptable based oil the proposed 15' drive lane. It was also agreed that the 3 parallel spaces along the west side
of the site were not needed due to the storage areas in both the office building and existing Gas Mart.
Comment 8: Loading Space. It is unclear how the relocated loading space will be used to unload merchandise
into the convenience store. It appears that ai truck will just park- adjacent to the building which will block
parking spaces to unload.
Response: Per our meeting, the loading space is acceptable as shown on the site plan.
Comment 9: Plan Requirements. Provide a north arrow and a graphic scale on the site plan.
Response: A north arrow has been provided.
Comment 10: Rcicacrd Circle. Eckara! Circle constant with the iniprovements from the Gas Mart site plan needs
to be widened as indicated. Also, the first entrcnc•e on Ecka rd Circle is one-wapv only and the siril ing and
curbing to block vehicles jr"om entering needs to be shown. 1l is unclear wh), the second entrance has been
modified, and it is also unclear wily a Iliird entrance is necessary
Response: Per our meeting and after reviewing the revised site plan, it was agreed that the shown revisions are
acceptable.
Comment 11: Sidewalks. Provide%shaicle Sidewalks asshown on sheet 4 and the sidewalk along Ec•kard Circle
needs to be continued.
Response: The sidewalks have been hatched as shown on sheet 4.
Comment 12: Zoning District l3rr['/er. A fu!! screen buf%er needs to be provided along the back property line
adjacent to the MH-1 Zoning. 71is bir�f r needs to consist of three trees per Teri linear feel as ire ll as a six foot
opaque clement. Please note that this bii1jer was not part ofthe Gas Malt Development as this portion of the
site was arclded at a later lime (lot consoli(lation).
Response: The zoning district buffer was approved and installed per the previously approved site plan. The
buffer was shows on sheet 4 of the previously submitted site plan.

Comment 13: Site Landscaping. Ais new development Ivill be removing six frees from the original
development that haven't been accounted for with this plan.
Response: The landscape plan has been I-evised to iICCOLII1t IOI- the tl-ces removed for the bUllding addition.
Cormnent ld: Lighting. Any building mounled or pole lighting needs to be shown on the plan along with
details.
Response: A lighting plan has been provided.
General Comment: After you have revised the site plan, please resubmit two copies so that I may verift the
information contained on the plan. I will need all approved review agency comment sheets and art least five
copies of the final plan for approval. Comment sheets are required from the following agencies: the Frederick
County Inspeclions Department, the Frederick Comrly Department o)"Public 1,Vorks (Counly Engineer), the
Frederick County Fire Marshal, the Sanitation Authority, and the Virginia Department of Transportation.
Response: We are in the process ofobtaining all agency approvals and will forward to your office once we
receive.

Dear Stephen:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site
plan is denied until the issues in this letter, as well as all issues of the other review agencies,
have been adcquatc!y addressed. Please review Staff s comments listed below and then
prepare a revised site plan which adequately addresses each concern.
Review Commen
l . Special Limited Power of Attorney Form. Please have the property owner sign the
attached Special Limited Power of Attorney Form prior to further review or approval.
This form should be notarized and completed to grant the applicant (you) with
authorization to represent them I'or this site plan.
2. FAR. The FAR on the covershect is incorrect; revise as indicated.
3. Setbacks. On the covershect, the provided setbacks need to be revised to show
where the new building will actually be sitting.
4. Site Plan Size. The site plan on sheet 4 is too small. It appears that the landscaping
and site plan can be combined and shown on one sheet (larger) and notes and details
could be provided on a separate sheet.
5. Adjoining Properties. The adjoining properties need to be labeled on the site plan.
6. Dumpster Area. The new dumpster location needs to be separated from the parking
area by a six inch curb as well as a distance of three feet (§ 165-27E(9)). Also, the
location of the dumpster in regards to the requirements of comment 48 that it will be
impossible for a truck to pick up the trash. The fence detail for the dumpster needs to
be revised as indicated. In regards to the existing site. the property owner needs to
move the dumpsters inside of the dumpster enclosure as they are currently sitting next
to the enclosure.
7. Parallel Spaces. The parallel spaces are required to have islands at the ends (not
striped). Also, it appears that the loading area and the three spaces next to Eckard
Circle are placed over the underground tanks. Therefore, it appears that vehicles
would need to be moved in order for the tilling of the tanks, which is not appropriate.

10. Eckard Circle. Eckard Circle constant with the improvements from the GasMart site
plait needs to be widened as indicated. Also, the first entrance Oil Eckard Circle is
Otte -way only and the striping and CUrbing to block vehicles from entering needs to
be shown. It is unclear why the second entrance has been modified, and it is also
unclear why a third entrance is necessary.
11. Sidewalks. Provide/shade sidewalks as shown on sheet 4 and the sidewalk along
Eckard Circle needs to be continued.
12. Zoninf; District I3uffer. A full screen buffer needs to be provided along the back
property line adjacent to the MI-1-1 Zoning. This buffer needs to consist of three trees
per ten linear feet as well as a six foot opaque element. Please note that this buffer
was not part of the GasMart Development as this portion Of the site was added at a
later time (lot consolidation).
13. Site Landscaping. This new development will be removing six trees From the
original development that haven't been acCOUilted for with this plait.
14. Lighting. Any bUlldillg 111o1I11tCd or pole lighting needs to be shown on the plan
along with details.
After you have revised the site plan, please resubmit two copies so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets
and at least Five copies of the Final plan for approval. Comment sheets are required from the
following agencies: the Frederick County Inspections Department, the Frederick County
Department of Public Works (County Engineer), the Frederick County fire Alarshall, the
