The above -referenced site plan was approved on February 23, 2009. The site plan is approved for the
construction of a new 16,590 square foot Church of the Latter -Day Saints located on Justes Drive in the
Shawnee Magisterial District. Required site improvements include the following:
• Construction of a parking lot with 172 spaces (including six handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
• A screened dumpster area and 54sf shed.
• Landscaping as shown on sheet 17 of the plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with four (4)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Greenway Engineering has received approvals from all supporting agencies for this project and is
hereby making request for final site plan review and approval. Attached are approvals from the
Winchester Regional Airport, VDOT, FC Public Works, FCSA, FC Inspections, and FC Fire and
Rescue. We have also included two sets of the current revised plans with this submittal.
With regard to FC Planning comments, we had submitted our responses to FC Planning back on
September 22, 2008 but unfortunately have not heard back with regard to acceptance to the
revisions or with additional comments. We have included a copy of this submittal package for
reference and a copy of the transmittal confirming that FC Planning received it.
With the submittal of the agency comments, the package should be complete. Please review and
approve this site plan as appropriate. Our client is planning on the start of construction in April
so we would appreciate an expeditious review if possible.

We have received your revised site plan dated January 20, 2008 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide three additional sets of approved
construction plans with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 9396
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

also reviewed the FAA's aeronautical study requiring the structure at the highest point be lighted with red obstruction lights in

We are in receipt of the conunents dated October 22, 2008 and offer the following responses.
The comments below are in the same order as the October comment letter.
Comment 1 Response: We have obtained the FAA Determination dated January 23, 2009 and
have attached the letter as requested. The report states that there is no hazard to air navigation
however requires that marking or lighting be provided per chapters 4,5 and 12 of the advisory
circular 70/7460-1 K Change 2. We have added a note to the cover stating this.
Comment 2-6 Response: Most of these notes were already a part of the cover sheet of the plans.
We have reviewed the notes and revised or added statements as necessary to meet the
requirements stated in the comments 2 through 5.
We have provided you with an updated cover sheet showing the revisions to the plans and a copy
of the FAA determination study. Please review and approve as appropriate. Contact us with any

Comment]: Special Limited Power of Attorney Form. Please have the property owner sign the
attached Special Limited Power of,4norney Form prior to further review or approval. This form
should be notarized and completed to grant the applicant (you) -0-ith authorization to represent
them for this site plan.
Response: Attached as requested.
Comment 2: Parking Calculations. The parking calculations on the coversheet only account for
seating. The parking also needs to account for any office areas or if any daycare uses are
proposed.
Response: office areas are occupied by people who will be involved in church activities
associated with the service and the seating count requirement. No daycare is proposed for this
church. Therefore, the parking calculations are sufficient.
Comment .3: Setbacks and Height. The proposed setbacks and height for the building need to be
shown on the coversheet.
Response: The actual building setback has been labeled on the Dimensional Plan sheet and cover

Conunent 4: Entrances. It is unclear why this site requires two entrances off of Justes Drive,
which is classified as a major collector road. The site should eliminate the Justes Drive entrance
and utilize one entrance off of the Rosa Lane extension.
Response: The two entrances meet the spacing requirements and also serve to eliminate
congestion in the parking area and onto Justes Drive when in between services. We feel this
design is acceptable and has not been changed.
Comment 5: Justes Drive and Rosa Lane. Sidewalks and curb and gutter should be provided
along Justes Drive and Rosa Lane as indicated on sheet 6. The plan also needs to show who is
responsible for the construction of the Rosa Lane extension.
Response: Justes Drive was recently completed for both the new Frederick County middle school
and elementary school. Since the road was built as a two-lane road with shoulders it is our
understanding that the road would remain as such. There is no intent to install curb and gutter
along this road, as it would cause unnecessary disturbance and costs because the road was not
originally designed to be a curb and gutter road. Therefore, we will not be providing curb and
gutter along the frontage of thus project.
With regard to the second comment, the notes regarding the Rosa Lane extension have been
removed, as this road was not intended. See response to Conunent #6 below. As this will be a
shared entrance between parcels 76-A-5B and 76-A-5A (church site), the first to develop will be
responsible for its construction. At this time, it appears LDS Berryville will be constructing this
shared entrance, as they will be the first to construct.
Comment 6: Rosa Lane. The easement for the Rosa Lane entrance needs to be recorded before
this site plan can be approved. This road also needs to be built to state standards as it will be a
future public road. Notes should be placed on the site plan as well as the plat for the easement
that this will be built to state standards and will be dedicated to VDOT at a later time.
Response: Additional research was completed regarding this road. It was determined that this
access road was only intended to be a shared entrance between parcels 76-A-513 and 76-A-5A
(church site). We have removed all notes regarding a future extension. The easement for this
shared entrance has already been recorded and already referenced on the plans. The reference can
be seen in gray scale text on sheet 7 — Site and Utility Plan. The shared entrance has been
designed to meet VDOT entrance standards but will not be dedicated to VDOT in the future.
Conunent 7: Si na e. The maximum height and size for the monument sign shown on sheet 6
needs to be provided on the plan.
Response: The proposed sign will be 6' high and has been labeled on sheets 6 and 7. A typical
detail (for reference only) has been shown on sheet 16. The architect will provide the actual
detail used for construction.
Comment 8: Dumpster Detail. Revise the dumpster detail on sheet 16 to show a board -on -board
gate.
Response: The dumpster detail on sheet 16 has been revised to reflect the requested dumpster
enclosure required by the client. The enclosure will be a brick facade wall to match the building

and will include a screened double gate. A detail for the dumpster area (for reference only) has
been included on sheet 16 of the plans. The architect will provide the actual detail used for
construction.
Comment 9: Landscaping. On sheet 17, the heightfor the parking lot shrubs at time of planting
needs to be revised to show 36 inches.
Response: The height for parking lot sluubs has been revised to 36".
General Comment: After you have revised the site plan, please resubmit two copies so that I may
verify the information contained on the plan. I will need all approved review agency comment
sheets and at least five copies of the final plan for approval. Comment sheets are required from
the following agencies: the Frederick County Inspections Department, the Frederick County
Department of Public Works (County Engineer), the Frederick County Fire Marshal, the
Sanitation Authority, the Virginia Department of Transportation, and the Airport Authority.
Response: The requested documents we have received to date have been enclosed.

attached Special Limited Power ol'Attorncy Form prior to further review or approval. This form
should be notarized and completed to grant the applicant (you) with authorization to represent
them for this site plan.
Response: Attached as requested.
Comment 2: Parking Calculations. The parking calculations on the coversheet only account for
seating. The parking also needs to account.for any office areas or if any daycare uses are
proposed.
Response: Office areas are occupied by people who will be involved in church activities
associated with the service and the seating count requirement. No daycare is proposed for this
church. Therefore, the parking calculations are sufficient.
Comment 3: Setbacks and Height. The proposed setbacks and heighl.for the building need to be
shown on the coversheet.
Response: The actual building setback has been labeled on the Dimensional Plan sheet and cover

Dear Mr. Smith:
We are in receipt of comments dated October 20, 2008 and offer the following responses.
Comments from Virginia Department of Transportation
Comment 1: The required sight distance at the proposed entrances needs to be shoii,n on the
landscape plan and in a profile view for the posted speed limit or design speed on Justes Drive.
Response: We have added sheet 18 to the plan set to provide the requested sight distance profiles.
Please note that the speed limit is not posted on Justes Drive. We also obtained a stamped approved
set of design plans for Justes Drive, which also does not specify the design speed. Without this
information, we assumed the design speed of 60 mph and provided the sight distance profiles with
those requirements.
Comment 2: Entrance needs to be labeled CG-11 on the plan sheet, addflow line and a note about
warping of the C&G to achieve drainage. Provide the VDOT standard detail sheet. Both entrances
need to be a minimum of 30'.
Response: Entrance has been labeled and flow line direction arrow added as requested. The entrance
at the VDOT right-of-way meets the 30' minimum width and the CG-11 standard detail is on the detail
sheet.
Comment 3: Provide drainage easements at pipe crossings on Rosa Lane to sheet 6.
Response: A storm drainage easement has been added for culvert DA-Cl crossing Rosa Lane.
Comment 4: Add CG-12's to both proposed enhances on the plan and label CG 12.
Response: CG-12's have been added to both proposed entrances as requested.

Comment S: Add a STOP bar (24" wide while thermoplastic line) and STOP sign (30" x 30",
mounting height minimum 7 feet) at both enhances. Also add the standards for both fi•oin the 2003
MUTCD manual for• placement, type and height.
Response: Stop sign and stop bar have been added to the plans. The MUTCD required notes have
been added to the detail sheets.
Comment 6: Provide MOT plan from the Virginia N,ork Area Protection Manuel showing 7-TC-4.0,

Response: MOT plan has been provided on sheet 16A.
Comment 7: On sheet 6 through 8, reference VDOT standard detail WP-2 for the tie-in to the existing
roadway pavement. Add the standard sheet to the plans. The area of milling and overlay for the
existing pavement should be indicated by shading on the plans.
Response: VDOT detail WP-2 has been referenced and the area of milling and paving has been
indicated on the plans. The WP-2 detail has been.added.te d -tzil sheet 16. -_
Comment 8: Show existing UD 4 on the plans.
Response: The expected future UD4 typical road section for Justes Drive is shown on sheet 8. A UD-
4 road section was not provided on the approved plans for Justes Drive so not provided.
Comment 9: For land disturbance greater than 10, 000 sq.ft. Erosion and Sediment control contactor
certification is required.
Response: A note has been added to sheets 4 and 5 regarding erosion and sediment control contractor
certification for disturbed areas greater than 10,000 sf.
Commen110: The future plan for this road is Urban 4 lane divided. You need to accommnodate for
C&G, sidewalk per county planning fr•oin centerline.
Response: We have accommodated for this future road by providing a 15' VDOT ROW reservation
along the Justes Drive frontage for any future needs by VDOT for expansion of Justes Drive.
Information can be found on sheets 6 and 7.
Comment I k Show design speed for Justes and station numbers.
Response: Justes Drive is not currently posted with a speed limit sign. The design speed for Justes
drive was not indicated on the approved VDOT plans dated 11/18/03. Road stationing can be found on
sheets 2 and 6.
Comment 12: Show typical section for widening Justes including pavement, C&G, utility ship,
sidewalk and ]'behind the sidewalk.
Response: A typical Justes Drive U4D section has been provided on sheet 8 for reference only. A
utility strip is not necessary within this subdivision as all currently platted properties (including this
subject property) are already recorded with a 35' general utility easement for use by all subdivision
property owners.

Response: We have accommodated for this future road, including the RTL, by providing a 15' VDOT

Comment 17: Provide pavement structure for tie in to Justes that meets or exceeds existing.

Dear Randy:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This
site plan is denied until the issues in this letter, as well as all issues of the other review
agencies, have been adequately addressed. Please review Staffs comments listed below
and then prepare a revised site plan which adequatcly addresses each concern.
Review Comments
1. Special Limited Power of Attorney Form. Please have the property owner sign
the attached Special Limited Power of Attorney Form prior to further review or
approval. This form should be notarized and completed to grant the applicant
(you) with authorization to represent them for this site plan.
2. Parking Calculations. The parking calculations on the coversheet only account
for seating. The parking also needs to account for any office areas or if any
daycare uses are proposed.
3. Setbacks and Height. The proposed setbacks and height for the building need to
be shown on the coversheet.
4. Entrances. It is unclear why this site requires two entrances off of Justes Drive,
which is classified as a major collector road. The site should eliminate the Justes
Drive entrance and utilize one entrance off of the Rosa Lane extension.
5. Justes Drive and Rosa Lane. Sidewalks and curb and gutter should be provided
along Justes Drive and Rosa Lane as indicated on sheet 6. The plan also needs to
show who is responsible for the construction of the Rosa Lane extension.

6. Rosa Lane. The easement for the Rosa Lane entrance needs to be recorded
before this site plan can be approved. This road also needs to be built to state
standards as it will be a future public road. Notes should be placed on the site
plan as well as the plat for the easement that this will be built to state standards
and will be dedicated to VDOT at a later time.
7. Signage. The maximum height and size for the monument sign shown on sheet 6
needs to be provided on the plan.
8. Dumpstei• Detail. Revise the dumpster detail on sheet 16 to show a board -on-
board gate.
9. Landscaping. On sheet 17, the height for the parking lot shrubs at time of
planting needs to be revised to show 36 inches.
After you have revised the site plan, please resubmit two copies so that I may verify the
information contained on the plan. I will need all approved review agency comment
sheets and at least five copies of the final plan for approval. Comment sheets are
required from the following agencies: the Frederick County Inspections Department, the
Frederick County Department of Public TVorks (Counly Fngineei), the Frederick Counry
Fire Marshall, the Sanitation Authority, the Virginia Department of Transportation and
the Ah-Port Authority.
