GENERAL CONSTRUCTION NOTES
1. The contractor shall furnish all materials, labor and equipment and
perform all work including restoration for the completed installation of
the utility systems and all other improvements shown or implied as
necessary for the completed facility ready for use. Unless otherwise
noted, specifications for all work to be in accordance with applicable
Standards and Construction Specifications of The Virginia Department of
Transportation, The Frederick County Sanitation Authority and
the contract documents.
2. The engineer has attempted to locate existing subsurface utilities; however,
such may exist that are not shown. The contractor shall exercise care in
this work so as to avoid damage to any utilities. Any damage shall be
the contractor's responsibility. The contractor shall notify oil utility
companies 72 hours prior to construction. Call "Miss Utility" 1-800-257-7777.
3. The contractor shall be responsible for all construction stakeout. All
dimensions, elevations and locations shall be verified in the field by
each contractor prior to beginning the work. The Engineer will
approve all cut sheets.
4. Any unusual subsurface conditions encountered during the course of the
work shall be immediately brought to the attention of the Engineer and/or
the Owner.
5. All grading for improvements to be confined to the project area. Any work
performed offsite is the Contractor's responsibility.
6. Contractor to obtain, at his expense, oil permits required of this work
and shall faithfully adhere to the permit conditions imposed.
7. All unpaved areas of the site which are disturbed by this construction
shall be provided with 6" topsoil, fertilized, seeded, compacted and
mulched. Seed bed to be watered and cared for as necessary to provide a
good lawn quality grass cover. Areas not graded shall be disced, leveled
and seeded to achieve lawn conditions.
8. Water and sewer lines are to be constructed in accordance with these plans
and specifications and shall additionally meet all requirements of the
Frederick County Sanitation Authority The contractor shall coordinate with
this agency and arrange for inspection as necessary.
9. Temporary termination of sewer lines shall be plugged watertight. The
end of the line shall be marked with a treated 2 inch x 4 inch post
extending at least 18 inches above the ground. The top 6 inches shall
be painted green, and the cut depth to the line invert shall be shown.
12. After removal of all topsoil, the subgrade should be proofrolled with approved
construction equipment prior to fill replacement. All subgrade areas shall
be stable prior to fill placement. All fill and base material shall be
compacted to 100% of the maximum dry density as determined by
ASTM D 698 (Standard Proctor). Landscaped areas shall be compacted to
90% of the maximum dry density as determined by the some Standard.
Compaction testing shall be performed by a qualified geotechnical engineer
registered in the Commonwealth of Virginia or a qualified representative
under direct supervision of the engineer.
13. Access for emergency vehicles must be maintained at all times. Temporary
street signs must be posted as construction begins. Access to fire
hydrants is not to be impeded at anytime by construction materials, parked
cars etc..
14. Manhole rims, valve boxes, etc. to be adjusted to match proposed elevations
shown in these plans.
15. If blasting is required the contractor is responsible for obtaining the
neccessary Frederick County Fire Marshall permits.
16. This project entails construction over and in close proximity to existing
gas main. The contractor will notify Shenandoah Gas Company (Phone No.
869-1 1 1 1) before excavating near this gas main.
17. All outdoor lighting must be shielded to prevent glare onto adjoining properties.
and road right—of—ways.
18. All utilities must be underground.
FIRE & RESCUE
1. Burning of land clearing debris requires a permit from the Fire Marshal. Burning of construction debris on site is prohibited.
2. Access for emergency vehicles must be maintained at all times during construction. Temporary street signs and
addresses must be posted as construction begins. Parked vehicles and staging of construction materials are prohibited
within 20' of fire hydrants. Fire Hydrants are not to be obstructed at any time.
EROSION CONTROL
1. Prior to initiating any land disturbing activity, it will be necessary to schedule an on —site pre —construction meeting with public
works staff to discuss the approved erosion and sediment control plan. No pre —construction meetings will be scheduled prior to
issuance of the land disturbance permit for the subject project.
2. Contractor to contact the public works department to schedule the required erosion and sediment control measures inspections
as indicated by the program administrator. If the erosion and sediment control measurers have been installed in accordance with the
approved plan, the Department of Public Works will grant approval to initiate land disturbing activities.
3. Prior to release of building permits, the following items shall be completed:
a) Subdivision shall be stabilized in accordance with the approved plan (i.e., road surface, stormwater conveyance system,
curb and gutter, sidewalks, channel linings, vegetative cover, stc.)
b) Submittal of certified as —built of thr subdivision which contains the following items: stormwater conveyance system, curb
and gutter, drainage channels and ditches, stormwater pond. A letter from the engineer —of —record shall be included with the
as —built which states that the subdivision has been constructed in accordance with the approved plan.
c) Individual subdivision lot grading plans shall be submitted by the builder at the time of the building permit application for
each lot proposed for construction.
4. Temporary and permanent erosion control structures and methods to be in accordance with the Virginia
Erosion Control Guidelines and local ordinances and to be utilized during the construction period.
5. All erosion control structures shown or as required during construction shall be continuously maintained
throughout the period in which areas are denuded. Areas shown to be surfaced are to have stone base installed
at the earliest possible date after establishing grade. No area is to remain denuded for more than 7 calendar days
when construction is not in progress.
6. Contractor to clean up and restore disturbed areas immediately upon completion of pipe —laying in the affected area.

setback from roadways as requiired for excavations. ?during excavations including ovefln r-dear and
stockpiles would be subjectin the excavation setback requirements as=*-cd bythe Fred�eri�ck County
Zoning Ordinance. The berms adjacent to Chapel Road X627) that were approved as pert of RZ#03-
06 would be considered view shed mitigation beans and are clearly ident ifted in the paoffer exhibits.
Th,e view shed nutiption beans and associated landscaping are not sabject to the 100 foot setback
fbr wwavations.
You may have the right to appeal this zoning determination within thirty (30) days of the date of this
letter in =ordance with Section 15.2 2311 of the Code of Virginia. This decision shall be final and
unappeasable if itis not appeased within t Arty (30) days. Should you choose to appeal, the appeal must
be filed- with the Zoning and the Board of Zoning (BZA) in accordance with
Article XXI, Section 165-155A(1) ofthe ]Frederick Cormty Zoning Ordinance. This provision regxiir�es

GENERAL CONSTRUCTION NOTES
1. The contractor shall furnish all materials, labor and equipment and
perform all work including restoration for the completed installation of
the utility systems and all other improvements shown or implied as
necessary for the completed facility ready for use. Unless otherwise
noted, specifications for all work to be in accordance with applicable
Standards and Construction Specifications of The Virginia Department of
Transportation, The Frederick County Sanitation Authority and
the contract documents.
2. The engineer has attempted to locate existing subsurface utilities; however,
such may exist that are not shown. The contractor shall exercise care in
this work so as to avoid damage to any utilities. Any damage shall be
the contractor's responsibility. The contractor shall notify all utility
companies 72 hours prior to construction. Call "Miss Utility" 1-800-257-7777.
3. The contractor shall be responsible for all construction stakeout. All
dimensions, elevations and locations shall be verified in the field by
each contractor prior to beginning the work. The Engineer will
approve all cut sheets.
4. Any unusual subsurface conditions encountered during the course of the
work shall be immediately brought to the attention of the Engineer and/or
the Owner.
5. All grading for improvements to be confined to the project area. Any work
performed offsite is the Contractor's responsibility.
6. Contractor to obtain, at his expense, all permits required of this work
and shall faithfully adhere to the permit conditions imposed.
7. All unpaved areas of the site which are disturbed by this construction
shall be provided with 6" topsoil, fertilized, seeded, compacted and
mulched. Seed bed to be watered and cared for as necessary to provide a
good lawn quality grass cover. Areas not graded shall be disced, leveled
and seeded to achieve lawn conditions.
8. Water and sewer lines are to be constructed in accordance with these plans
and specifications and shall additionally meet all requirements of the
Frederick County Sanitation Authority The contractor shall coordinate with
this agency and arrange for inspection as necessary.
9. Temporary termination of sewer lines shall be plugged watertight. The
end of the line shall be marked with a treated 2 inch x 4 inch post
extending at least 18 inches above the ground. The top 6 inches shall
be painted green, and the cut depth to the line invert shall be shown.
12. After removal of all topsoil, the subgrade should be proofrolled with approved
construction equipment prior to fill replacement. All subgrade areas shall
be stable prior to fill placement. All fill and base material shall be
compacted to 100% of the maximum dry density as determined by
ASTM D 698 (Standard Proctor). Landscaped areas shall be compacted to
907. of the maximum dry density as determined by the some Standard.
Compaction testing shall be performed by a qualified geotechnical engineer
registered in the Commonwealth of Virginia or a qualified representative
under direct supervision of the engineer.
13. Access for emergency vehicles must be maintained at all times. Temporary
street signs must be posted as construction begins. Access to fire
hydrants is not to be impeded at anytime by construction materials, parked
cars etc..
14. Manhole rims, valve boxes, etc. to be adjusted to match proposed elevations
shown in these plans.
15. If blasting is required the contractor is responsible for obtaining the
neccessory Frederick County Fire Marshall permits.
16, This project entails construction over and in close proximity to existing
gas main. The contractor will notify Shenandoah Gas Company (Phone No.
869-1 1 1 1) before excavating near this gas main.
17. All outdoor lighting must be shielded to prevent glare onto adjoining properties.

FIRE & RESCUE
1. Burning of land clearing debris requires a permit from the Fire Marshal. Burning of construction debris on site is prohibited.
2. Access for emergency vehicles must be maintained at all times duringg construction. Temporary street signs and
addresses must be posted as construction begins. Parked vehicles and staging of construction materials are prohibited
within 20' of fire hydrants. Fire Hydrants are not to be obstructed at any time.
EROSION CONTROL
1. Prior to initiating any land disturbing activity, it will be necessary to schedule an on —site pre —construction meeting with public
works staff to discuss the approved erosion and sediment control plan. No pre —construction meetings will be scheduled prior to
issuance of the land disturbance permit for the subject project.
2. Contractor to contact the public works department to schedule the required erosion and sediment control measures inspections
as indicated by the program administrator. If the erosion and sediment control measurers have been installed in accordance with the
approved plan, the Department of Public Works will grant approval to initiate land disturbing activities.
3. Prior to release of building permits, the following items shall be completed:
a) Subdivision shall be stabilized in accordance with the approved plan (i.e., road surface, stormwater conveyance system,
curb and gutter, sidewalks, channel linings, vegetative cover, stc.)
b) Submittal of certified as —built of thr subdivision which contains the following items: stormwater conveyance system, curb
and gutter, drainage channels and ditches, stormwater pond. A letter from the engineer —of —record shall be included with the
as —built which states that the subdivision has been constructed in accordance with the approved plan.
c) Individual subdivision lot grading plans shall be submitted by the builder at the time of the building permit application for
each lot proposed for construction.
4. Temporary and permanent erosion control structures and methods to be in accordance with the Virginia
Erosion Control Guidelines and local ordinances and to be utilized during the construction period.
5. All erosion control structures shown or as required during construction shall be continuously maintained
throughout the period in which areas are denuded. Areas shown to be surfaced are to have stone base installed
at the earliest possible date after establishing grade. No area is to remain denuded for more than 7 calendar days
when construction is not in progress.
6. Contractor to clean up and restore disturbed areas immediately upon completion of pipe —laying in the affected area.
7. All unpaved areas of the site which are disturbed by this construction shall be provided with 6" topsoil,

This letter is in response to your couespond�ence dated November 12, 2008, to the Zoning Administrator

Landscape bemas designed and planned for view shed mitigation are not required to meet the 1 o0 foot
setback from roadways as required for excavations. Mining excavations inchuft overburden and
stockpiles would be subjectio the excavation setback requirements asrequired bythe Frede ick County
Zoning OrdManc e. The berms adjacent to Chapel Road (Ri.627) that were approved as pant ofR7ZA3-
06 would be considered view shed mitigation bemis and are clearly identified in the proffer exhibits.
The view shed untigation. germs and associated lands�ng are not subject to the 100 foot setback
for excavations.
You may have the right to appeal thus• zoning determination within thirty (30) days of the date of this
letter in accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and
unappeasable if itis not appealed within. thirty (30) days. Should you choose to appeal, the appeal must
be filed with the Zoning and the Board of Zoning Appeais (BZA) in. accordance with
Article XXT, Section 165-155A(1) of the Frederick County Zoning Ordi�ce. This provision requires
the submission of an application font, written statement setting forth th,e decision being appealed, date
, of decision, the grounds for the appeal, b!ow the appellant is an aggdeved party, any oilier information
you oaay want to submit and a $300.00 filing fee, ($250.00 filing flee and. a $50.00 refundable sip
deposit). Once the appeal application is accepted, it wiill be schecluled for public timing and decision

EROSION & SEDIMENT CONTROL MINIMUM STANDARDS
1. Permanent or temporary soil stabilization shall be applied to denuded areas within seven days after final
grade is reached on any portion of the site. Temporary soil stabilization shall be applied within seven days to
denuded areas that may not be at final grade but will remain dormant for longer than 30 days. Permanent
stabilization shall be applied to areas that are to be belt dormant for more than one year.
2. During construction of the project, soil stockpiles and borrow areas shall be stabilized or protected with
sediment trapping measures. The applicant is responsible for the temporary protection and permanent
stabilization of all soil stockpiles on site as well as borrow areas and soil intentionally transported from the
project site.
3. A permanent vegetative cover shall be established on denuded areas not otherwise permanently stabilized.
Permanent vegetation shall not be considered established until a ground cover is achieved that is uniform,
mature enough to survive and will inhibit erosion.
4. Sediment basins and traps, perimeter dikes, sediment barriers and other measures intended to trap
sediment shall be constructed as a first step in any land -disturbing activity and shall be made functional
before upstream land disturbance takes place.
5. Stabilization measures shall be applied to earthen structures such as dams, dikes and diversions
immediately after installation.
6.Sediment traps and sediment basins shall be designed and constructed based upon the total drainage area
to be served by the trap or basin.
a. The minimum storage capacity of a sediment trap shall be 134 cubic yards per acre of drainage area and
the trap shall only control drainage areas less than three acres.
b. Surface runoff from disturbed areas that is comprised of flow from drainage areas greater than or equal to
three acres shall be controlled by a sediment basin. The minimum storage capacityof a sediment basin shall
be 134 cubic yards per acre of drainage area. The outfa/l system shall, at a minimum, maintain the structural
integrity of the basin during a twenty-five year storm of 24-hour duration. Runoff coefficients used in runoff
calculations shall correspond to a bare earth condition or those conditions expected to exist while the
sediment basin is utilized.
7.Cut and fill slopes shall be designed and constructed in a manner that will minimize erosion. Slopes that
are found to be eroding excessively within one year of permanent stabilization shall be provided with
additional slope stabilizing measures until the problem is corrected.
8. Concentrated runoff shall not flow down curt or fill slopes unless contained within an adequate temporary
or per channel, flume or slope drain structure.
9. Whenever water seeps from a slope face, adequate drainage or other protection shall be provided.
10. All storm sewer inlets that are made operable during construction shall be protected so that
sediment -laden water cannot enter the conveyance system without first being filtered or otherwise treated to
remove sediment
11.Before newly constructed stonmwater conveyance channels or pipes are made operations, adequate outlet
protection and any required temporary or permanent channel lining shall be installed in both the conveyance
channel and receiving channel.
12. When work in a live watercourse is performed, precautions shall be taken to minimize encroachment,
control sediment transport and stabilize the work area to the greatest extent possible during construction.
Nonerodible material shall be used for the construction of causeways and cofferdams. Earthen fill may be used
for these structures if armored by nonerodible cover materials.
13.When a live watercourse must be crossed by construction vehicles more than twice in any six-month
period, a temporary vehicular stream crossing constructed of nonerodible material shall be provided.
14. All applicable federal, state and local regulations pertaining to working in or crossing live watercourses
shall be met.
15, The bed and banks of a water course shall be stabilized immediately alter work in the watercourse is
completed.
16. Underground utility lines shall be installed in accordance with the following standards in addition to other
applicable criteria:
a. No more than 500 linear feet of trench may be opened at one time.
b. Excavated material shall be placed on the uphill side of trenches.
c, Effluent from dewatering operations shall be filtered or passed through an approved sediment trapping
device, or both, and discharged in a manner that does not adversely affect flowing streams or off -site
property.
d. Material used for backfilling trenches shall be properly compacted in order to minimize erosion and
promote stabilization.
e. Restabilization shall be accomplished in accordance with these regulations.
f.Applicable safety regulations shall be complied with.
17. Where construction vehicle access routes intersect paved or public roads, provisions shall be made to
minimize the transport of sediment by vehicular tracking onto the paved surface. Where sediment is
transported onto a paved or public road surface, the road surface shall be leaned thoroughly at the end of
each day. Sediment shall be removed from the roads by shoveling or sweeping and transported to a
sediment control disposal area. Street washing shall be allowed only after sediment is removed /n this
manner. This provision shall apply to individual development lots as well as to larger land -disturbing activities.
18,A/1 temporary erosion and sediment contra/ measures shall be removed within 30 days after final site
stabilization or after the temporary measures are no longer needed, unless otherwise authorized by the local
program authority. Trapped sediment and the disturbed soil areas resulting from the disposition of temporary
measures shall be permanently stabilized to prevent further erosion and sedimentation.
19. Properties and waterways downstream from development sites shall be protected from sediment
deposition, erosion and damage due to increases in volume, velocity and peak flow rate ofstormwater runoff.
All measures used to protect properties and waterways shall be employed in a manner which minimizes
impacts on the physical, chemical and biological integrity of rivers, steams and other waters of the state.
