The above -referenced site plan was approved on January 5, 2011. The site plan is approved for the
construction of Berm B located on the Carmeuse Natural Chemicals Site in the Back Creek Magisterial
District. Berm plantings shall be in conformance with sheet 4 of the site plan.
All requirements of the Frederick County Zoning Ordinance have been mct in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with five (5)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to
contact me if you have any questions or concerns.

I have reviewed the June 14, 2010 site plan for Berm B at the Carmeuse Natural
Chemicals site In Middletown for revegetating this berm with trees, as developed by
Patton, Harris, Rust & Associates.
I feel that this plan is acceptable as written. The curving nature of this berm and the
differing heights along its length will break up its visual appearance and have a more
natural look than the traditional berm construction of one perfectly straight berm of
uniform height. Adequate measures have been outlined for revegetating the berm with
appropriate tree species for the locality and proper planting procedures to insure their
survival and future growth.

I have reviewed the Carmeuse Chemicals site plan, revision date of February 20, for planting of
the existing and proposed berms with bees.
I feel this revision is acceptable and should accomplish the purpose of stabilizing these berms
and making them more visually attractive. I recomm�end the use of the smaller bare -rooted
seedlings as much as possible in these projects. While not providing the instant forest as larger
landscape trees, this twill. result in a cost savings over the larger trees and still provide an
effective visual screen.

This is a follow-up to Carineuse's correspondence dated May 2.8, 2009, and Otlt- recent
telephone conversation. The archeological survey was conducted and completed by Dr. Geier
who is a professor at Jaynes Madison University. The wort: that was done exceeded the recluest
of' a Phase I, including the digging of test pits and retrieving artifacts. To my knowledge. those
artifacts have been removed anct are curre.ntiy with Dr. Geier at James Madison L1r1ive.rsity.
From here. we understand there will be a further analysis of what was observed at and remo-ved
from the site. My general understanding of the work is that Dr. Gcier was particularly interested
in confirming previous writings which have stated the events and movement:, of troops that
occurred during thy- Battle of Cedar Creek. It is my understanding that Dr. Geier's work has. in
fact, con umed what had previously been written about those movements and activities daring
the battle. The historical work that was to be completed it the site has been finished, As you
know, Dr. Geier is a noted historian and will review Oic data, :_artifacts, and information further as

2) Bern Location. The coversheet indicates that the berm is on parcel 90-A-23; hon)ever, the key map has a proposed berm located
on panel 90 A-2 (appears to be part of Bern A). The detail on sheet 3 is also unclear where Berm B is actually located. Orr
the key map, the been location needs to he clarified (bubble the berg area) and the location of Bern A needs to be shonar as
well.
Sheets one and two have been updated as requested.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs continents listed below and prepare a revised site plan which adequately addresses
each concern.
Review Comments:
1) Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them for
this site plan.
2) Berm Location. The coversheet indicates that the berm is on parcel 90-A-23; however, the key
map has a proposed berm located on parcel 90-A-2 (appears to be part of Berm A). The detail on
sheet 3 is also unclear where Berm B is actually located. On the key map, the berm location
needs to be clarified (bubble the berm area) and the location of Berm A needs to be shown as
well.
