Since this letter we have found a miscommunication between myself and the Maintenance Regional Manager. The site plan date January 23, 1996 for #048-95 proposed Maintenance Building, is exactly that a Maintenance Building. We will not be using this building site for two 7'x 9' offices or a bathroom (public or otherwise). 99% of work done by the maintenance is ground work. The uses of the building are listed below: 1). Storage of bronze and materials use to maintain the cemetery. 2). To house equipment, backhoe, dumptruck, etc. 3). Minor repairs to equipment, such as tire repair, the changing of oil, etc. 4). Storage of raincoats, boots, filing cabinets, refrigerator, microwave, coffee pot, small table and chairs for employees to sit down at to take an half hour lunch break. The bathroom plumbing that is roughed in will be capped off at this time, do to no water and sewer on site. In the near future we are looking to build a new office building, at that time, we will contact for further zoning permits and ordinances. Please contact me with your commits. As we discussed, I feel . that the majority of the necessary site improvements have been made to approve of the zoning portion of a temporary Certificate of Occupancy (CO) for this building. The issuance of the final CO with be contingent upon the completion of the site work as illustrated on the approved site plan (Site Plan #048-95). In particular, this work involves the planting of 28 white pines. Such trees should be a minimum of 4-foot in height at time of planting, and set no more than 10 feet apart. As we discussed, I will require that the trees be planted, or a letter of credit be received by this department in the amount necessary to cover the plantings, by April 30, 1997. Receipt of the temporary Certificate of Occupancy is your acknowledgment of the conditions as stated above. Please contact me prior to April 30, 1997 so that a final site inspection may be conducted. As we discussed, the site plan (Site Plan 4048-95) that was approved on January 23, 1996. by Frederick Count}, was for a proposed Maintenance Building. Any deviation beyond the use of this structure for facilities maintenance is not in conformance with the approved site plan. Following our discussion, I believe that I now better understand the proposed use of this building, and the future plans for the memorial park. The use of this "Proposed Maintenance Building", as termed on the approved site plan, for two offices, a bathroom, and maintenance equipment will require the submission and approval of a revised site plan. As we discussed, different zoning ordinance, building codes, fire codes, and other requirements apply to maintenance buildings and structures containing offices. The following Frederick County Zoning Ordinance items will be required in order for the offices to located within this recently constructed structure: 1) The access road and the parking spaces should be paved with a minimum of double prime -and -seal treatment. 2) Parking spaces will be required and shall be delineated. The number of parking spaces is based on the number of employees to be using this building, plus I space per 250 square feet of office space. My preliminary estimate is that 3 parking spaces will be required. 3) ADA requirements will be required. This consists of 28 evergreen trees (4-foot high at time of planting.) It will also be necessary to gain the approval of the Sanitation Authority, Inspections Department, and the Fire Marshall. The satisfaction of the above (my comments and the other department comments) are required prior to occupying the maintenance building. As we discussed, a revised site plan submission will be required to facilitate office space use. The review fee for this revised site plan is $500.00. Based on my understanding of this project, I would advise you to contact your engineer (previously you used Greenway Engineering) and have them revise this site plan as necessary. It is important that you understand that the previously approved site plan was for a maintenance building.
