All required information must.be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. If any portion is not included or complete, the site plan application will not be accepted and returned to the applicant(s). It appears all our earlier review comments have been satisfactorily addressed. Please advise the owner of our approval. This approval rescinds our previous approval dated July 16, 1998. Please provide VDOT with five additional sets of revised plans for distribution. Subsequent to this review and approval, VDOT has revised the Minimum Standards of Entrances to State Highways Booklet (09/03/98). This serves to advise several geometric features within this project are now substandard and should be corrected to referenced revised standard whenever any additional future improvements are planned at this site location. The appropriate land use permit may now be applied for to cover work within the Route 11 right- of-way. This permit is issued by this office and will require a minimum processing fee, surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of the joint use agreement for the northernmost entrance to the site should be provided to VDOT prior to issuance of any land use permits. This site plan, for the development of a 1,678-square-foot convenience store with gasoline sales, meets all County requirements for development within the B2 (Business General) Zoning District. The site plan also calls for the provision of ten (10) parking spaces, parking lot landscaping, and an A Category zoning district buffer adjacent to the Ml (Light Industrial) zoned land to the west. The Frederick County Planning Commission approved a reduction in the entrance spacing requirements on November 4, 1998. I have provided you with three copies of the approved site plan. Please forward two approved copies to the property owner and advise them to keep an approved copy for their files and maintain an approved copy on the construction site. Once the site development has been completed, the owner should contact this office to schedule an on -site inspection. Ruddy, Planner II 4,0C, Subject: Bo's at Kernstown: Entrance Spacing Reduction Request - Revised Application Date: October 23, 1998 Revised request: Staff has received an updated site plan from the applicants showing the revisions to the entrance configuration as discussed during the October 21, 1998 Planning Commission meeting. The revised site plan increases the width of the central raised island, reduces the width of the southern entrance, and modifies the curb radius' on each side of the southern entrance. The proposed expansion to the entrance would still increase the level of the nonconformity of the entrance, reducing the entrance spacing to 43' from 55'. However, the width of the entrance has been reduced to approximately 56'. Planning Commission authority: Pursuant to Section 165-29B(1) of the Zoning Ordinance, the Planning Commission may allow other means of motor vehicle access which do not meet the above requirements. Such means may involve the use of entrances which physically linut or restrict left turns, methods which ensure one-way travel, or other methods. I have enclosed a copy of the site plan revisions for your review. The existing driveway is considerably less than this and would be considered to be legally nonconforming. However, any increase in the width of the entrance adjacent to the motel will increase the degree of nonconformity which is not permitted by the zoning ordinance. The existing entrance ay remain but may not move clo r to the existing motel entrance. The erosion and sediment control plan appears to adequately address the erosion control requirements. 2. Since the site is currently paved, no additional stormwater management will be required because of this development. We request that the existing storm sewer network be cleaned out and checked to ensure that the culverts are in good condition. If the culverts are deteriorated, we recommend their replacement if necessary. 3. You have indicated to us that you are requesting a pump and haul permit. The following comments are offered and should be addressed during the revision of this site plan. I have also marked the enclosed plan for your use. 1) Please provide the property information for the property across the Route 11 right-of-way. 2) Please provide a sidewalk connection from the Bo's facility to both the motel and the restaurant. 3) Please provide the height and dimensions of the signage to be used on this site. 4) Please provide a detail of the outdoor lighting fixtures and ensure that glare from the lighting does not extend beyond the property lines of this facility. 5) Please provide the height of the canopies, and ensure that the square footage of the canopies is included in the FAR calculations. 6) Please provide the posted speed limit of Route 11 and clearly show the entrances of both the motel and the restaurant. It should be noted that the minimum driveway spacing requirement along Route 11 is one hundred fifty (150) feet. The existing driveway is considerably less than this and would be considered to be legally nonconforming. However, any increase in the width of the entrance adjacent to the motel will increase the degree of nonconformity which is not permitted by the zoning ordinance. The existing entrance may remain but may not move closer to the existing motel entrance. 7) The issuance of a pump -and -haul permit by Frederick County is temporary and conditioned upon the Bo's facility connecting to a permanent sewer line at such time the Frederick County Sanitation Authority services this area. Based upon the square footage of the building, 8.4 spaces are required. Upon rounding this figure up, this equates to nine required spaces. 9) Please identify the location of the required loading space and make note of the loading space in the project notes. 10) Please extend the pavement section to the extent of the driveway improvements as marked. 11) I have provided you a copy of the revised handicap sign detail. Please incorporate this detail into the site plan. 12) Please ensure that the existing poles located towards the entrance are entirely within the raised island at the entrance to the facility. The exact location of the island is unclear on the site plan. 13) Please revise the number of shade trees in the plant list. Fifteen new plantings are locate on the site plan. This includes the two located on the raised islands directly in front of the building. Also, please ensure that the height at time of planting is included in the plant list. All of the landscape screening plantings must be a minimum of four feet in height at planting, and intended to reach a minimum of six feet in height at maturity. In addition, please provide the three -foot -high evergreen hedgerow adjacent to the adjoining properties as marked. This hedgerow should also be included in the plant list. After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. I will then need all approved review agency comment sheets and five copies of the final site plan for approval. Comment sheets are required from the following agencies: the Virginia Department of Transportation, the Frederick County Inspections Department, the Frederick County Engineer, the Frederick County Fire Marshal, and the City of Winchester Utilities.
