SITE PLAN CHECKLIST The checklist below indicates all the information. -that needs to be submitted as part of the site plan application. All required information must.be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. If any portion is not included or complete, the site plan application will not be accepted and returned to the applicant(s). Site Plan Package 1. One set of approved comment sheets are required from the following review agencies prior to final site plan approval. It is recommended that applicants contact the Department of Planning and Development to determine which review agencies are relevant to their site plan application. The new parking lot on this property is a violation of the Frederick County Zoning Ordinance. In accordance with Section 165-144 of the Frederick County Zoning Ordinance, any changes or improvements in the B-1 (Business Neighborhood) Zoning District require an approved site plan. There is no record in this office of a revised site plan for this parking lot; therefore, the presence of this parking lot constitutes a violation of the provisions of Section 165-144. This office will allow thirty (30) days from receipt of this letter to resolve this violation. Specifically, resolution of this violation may be accomplished by submitting a revised site plan for approval showing the improvements on this property. Failure to comply with the Zoning Ordinance will result in a criminal complaint being filed against you. You may have the right to appeal the above notice of violation within 30 days of the date of this letter in accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and unappealable, if it is not appealed within 30 days. Director This letter is in regard to our telephone conversation on April 8, 2003 concerning the berm on the Abundant Life Christian Center property. I have been forwarded a letter from Mr. Toni Trott with VDOT sent to VDOT by Rebecca Ragsdale with your department. The letter stated the following. "The Planning Department staff has reviewed the attached facsimile, dated March 4,.2003, regarding the drainage casement fronting on the Abundant Life Christian Center property. As you indicate in your correspondence, the church will be unable to construct the berm as illustrated on the County - approved Site Plan #046-98 for the property. The church's inability to construct the berm will not result in a zoning violation." Our concern has to do with future additioIls we plan to do make to the church facility. We are concerned that future building might require us to replace the berm or to compensate for it in some way. Would we be required at any future date to comply with zoning screening requirements? It Is Illy understanding that during our conversation you said that the berm/screenim-, ill questloll would be grand fathered and we would, therefore, never be required to reinstall screening regardless of further building on the property. Furthermore, you stated that the Abundant Life Christian Center would be willing to provide the County with the required fiends to guarantee the needed improvements. Staff believes that $16,000 would be a sufficient total for guaranteeing that these improvements are made. If you so desire, please provide staff with a check made out to the Frederick County Treasurer in the amount of $16,000. The County will deposit this amount and hold it until the improvements are made. It is also recommended that you submit a letter with the check. Staff will be able to approve the church for a temporary occupancy permit once you provide us with the check or with a bond.
