Enclosed is your approved Land Use Permit #855-04642 to cover the reconstruction
and maintenance of one commercial entrance at the referenced location.
Please ensure a copy of the approved permit assembly is kept at the job site whenever
working within the Route 277 right-of-way. I would also like to remind you of the need to
erect and maintain proper traffic control in accordance with our Virginia Work Area
Protection Manual.
Please give Mr. Dave Heironimus a call at (540) 722-3460 at least 48 hours in advance
of the start of construction to arrange for any necessary inspections.

RE: Approval of Waffle House - Rote.277 Site Development Plan #045-98
Dear Gary:
The Frederick County Planning Department administratively approved the above referenced site plan,
4045-98, on September 17, 1998. This site plan, for the construction of a 1,830-square-foot Waffle House
restaurant, meets all County requirements for development within the B2 (Business General) Zoning
District. The site plan also calls for the provision of thirty-three parking spaces and parking lot
landscaping. In addition, the provision of shared access via the existing entrance onto Route 277 is
consistent with the proffer statement approved in Rezoning #005-96.
As you and the property owner were advised during the site plan process, future road improvements
associated with the widening of Route 277 may require additional right-of-way from businesses located
along the road corridor. Please be aware that the current design of the site, in particular the access
driveway to the site, may be impacted by these future improvements.
I have provided you with several copies of the approved site plan. Please ensure that two approved copies
are forwarded to the property owner, and advise them to keep an approved copy for their files and
maintain an approved copy on the construction site. Once the site development has been completed, the
owner should contact this office to schedule a final site inspection.

RE: Review of Waffle House Site Development Plan 11045-98
Dear Gary:
I have had the opportunity to review the above referenced site plan received by our department on
June 25, 1998. The following comments, in addition to those marked on the enclosed plan, should
be addressed during the revision of this site plan:
A) Please incorporate information pertaining to the approved conditional rezoning of this
property, Rezoning 4005-96. In particular, show the approved proffers that are binding to this
property.
/2) Please revise the north arrow, as it appears to be pointing to the west.
3) Please correct the zoning information for the adjoining parcel P.I.N. 85-A-148. This property
contains both B 1 and B2 zoning.
4) Please provide a sidewalk connection between the Waffle House and the adjoining shopping
plaza. This connection should be made in the approximate location marked on the plan.
5) Please provide the detail and dimensions of the existing sign located on this property.
6) Please provide a detail of the proposed lighting and ensure that all lighting is controlled to
prevent glare beyond the Waffle House property line. A statement to this effect should be
included on the site plan.
7) Please revise the location of the dumpster pad. The dumpster should be located adjacent to
the dumpsters serving the adjoining Kentucky Fried Chicken and Western Steer facilities,
away from the front of the shopping plaza. Also, the concrete pad on which the dumpster is
located should be extended in front of the dumpster to form an apron protecting the pavement
in this area.
8) Within the B2 zoning district, the minimum landscaped area is 15 percent. Please incorporate

the landscaped area calculations for the Waffle House parcel into the project information and
delineate this area on the site plan. In addition, within the B 1 zoning district, the minimum
landscaped area requirement is 35 percent. Please provide the landscaped area calculations
for the adjoining Scully parcel. Any expansion of the gravel area to the rear of the Waffle
House parcel to promote drainage should only occur if the landscaped area is sufficient
enough to allow additional conversion of landscaped area. The landscaped area of the Scully
parcel should not drop below 35 percent, or the existing area of landscaped coverage. It may
be appropriate to maintain the existing landscaped area, or you may reseed this area upon
achieving the desired grade.
9) Please remove the proposed overhead power line and place this utility underground.
10) Please show the extension of the existing utility easement to the rear of the property.
11) The location and nature of all facilities necessary to meet Fire Code requirements shall be
approved by the Fire Marshal.
12) Please relocate the driveway accessing the Waffle House parking area as marked on the
enclosed plan. In order to accommodate the planned future expansion of Route 277, it will
be necessary to obtain additional right-of-way from properties fronting along Route 277.
Based upon the typical section previously forwarded to VDOT by the Frederick County
Board of Supervisors, it would appear as though the driveway, as originally designed, would
be impacted by future improvements. The relocation of the driveway reduces the future
impact any expansion of Route 277 would have on the Waffle House property and the
adjoining Scully property. At this time, it may be appropriate to eliminate the two parking
spaces located directly in front of the building. The number of parking spaces provided
continues to exceed the number of parking spaces required by ordinance.
12) Please summarize the parking requirements for the Scully property as marked in the project
information. This summary should consider the spaces lost in order to accommodate the
shared entrance design. The parking spaces located on the Scully property should be
accurately located. It may be necessary to provide additional pavement markings in this area,
as marked, to ensure safe circulation within the shared entrance. Also, a stop sign should be
located at the exit from the Waffle House facility to further promote safe circulation.
14) Please continue the evergreen hedgerow along the Route 277 frontage to ensure the screening
of headlights from the road right-of-way. In addition, this driveway is considered part of the
parking area. Therefore, shade trees should be located along its perimeter as marked. Also,
please extend the hedgerow along the east side of the parking lot, behind the building, to the
parking lot entrance.
15) The stormwater management plan, and the soil erosion and sedimentation control plan, shall
be approved by the Department of Public Works.

Please revise your site plan to reflect the comments specified in this letter and resubmit one copy for
my review. Once I have verified the information contained on the revised site plan, I will need all
approved review agency comment sheets and five copies of the final site plan for approval. Comment
sheets are required from the following agencies: the Virginia Department of Transportation, the
Frederick County Sanitation Authority, the Frederick County Inspections Department, the Frederick
County Engineer, and the Frederick County Fire Marshal.

Upon review of the subject site plan, we offer the following comments:

The stormwater run-off that drains to the south through the proposed curb cut
will concentrate the run-off to a point source discharge. A drainage easement will
be required across the Western Steer property to the existing stormwater pond at
the Comfort Inn site. Frederick County will also require a letter or an agreement
from the Comfort Inn granting their approval to route the additional run-off
generated by the Waffle House development into their existing stormwater
detention pond.
2. We recommend placement of a concrete apron in front of the dumpster pad to
prevent pavement failure during loading.
3. It is recommended that all slopes be sodded to prevent erosion upon reaching final
grades.
The drainage easement agreement and the letter from the Comfort Inn must be submitted
to this office prior to the issuance of a land disturbance permit.
Once these comments have been addressed, please submit two (2) copies of the site plan
for further review.
