It 1 SITE PLAN CHECKLIST The checklist below indicates all the information. -that needs to be submitted as part of the site plan application. All required information must -be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. If any portion is not included or complete, the site plan application will not be accepted and returned to the applicant(s). Site Plan Package 1. The revision to this site plan calls for the replacement of the hedgerow that was eliminated during the site preparation for the restaurant. This hedgerow was to be utilized as the landscaped element of the required full screen implemented to buffer the adjacent residential development. The "B" category zoning district buffer with a full screen, as detailed on the plan, is to be installed during the development of this site. This buffer is to be extended to the end of the existing hedgerow. I have previously provided you with several copies of the approved site plan. Please ensure that these approved plans have been forwarded to the owner, and advise the owner to keep an approved copy for their files and maintain an approved copy on the construction site. Job #845-98/01.00 Dear Sir: GENERAL CONTRACTOR: This letter is in response to the problem arising with the removal of some plants which were to be used as a buffer along Fox Ridge Lane at the above referenced project. The site plan did in fact stipulate that some existing plants along Fox Ridge Road were to remain, however, field conditions precluded us from doing so. As this project is not yet in its final stages, we are in the process of discussing alternate solutions with our site planner in order to comply with County ordinances. Lantz Construction is committed to provide our client with a final product, which they will be proud of for years to come. It will also provide the neighborhood with the advantages of an improved site and the community at large with an enhanced tax base. We are confident that the County will cooperate with us and with the Owner to complete this project in a manner satisfactory to all parties and at the same time meet all the required landscaping requirements. Frederick County's BZA Kicks KIIA7C's Bucket By JASON ENGLISH The Winchester Star The bucket of chicken was too big, and the opposition proved to be too much Tuesday, as the Frederick County Board of 'boning Appeals considered two ; ariance requests from a franchisee of KFC. The BZA denied one vari- ance request that would have allowed a 181-square-foot KFC sign in an area in which the Zoning Ordinance only allows 150 square feet. The extra 31 square feet was needed to accommodate a large bucket of chicken — the signa- ture logo of the popular chicken restaurant, Steve Gyurisin of G.W. Clifford & Associates, said. KRA Food Service LLC is open- ing a KFC franchise behind the Sheetz west of Fox Drive and just south of its intersection with U.S. 522 North. The local franchisee al- ready owns two other KFC restau- rants in Winchester, one on Pleas- ant Valley Road and the the other on Berryville Avenue. BZA members said not having the bucket on top of the sign wouldn't cause any undue hard- ship for KRA. KRA also requested a parking variance that would have allowed seven more parking spaces along Foxridge Lane. But after five neighbors in the adjacent Foxridge Townhomes — and the chairman of the Frederick County Planning Commission — spoke against the request, KRA withdrew its application before the Board of Zoning Appeals voted. "I encourage you to deny this request, there's an awful lot hap- pening on such a small site," Plan- ning Commission Chairman Charles S. DeHaven Jr. said. KRA is developing a 0.9-acre site that sits on a 5-acre tract ad- jacent to the. Sheetz convenience store. The site is already under construction Gyurisin told the BZA that the contractor mistakenly cleared a row of existing trees that were supposed to serve as a buffer between the restaurs and the townhomes. He said KRA has offered to resolve that issue by placing a 6-foot, landscaped hedgerow in the spot where the trees had grown. This site visit was in preparation for the upcoming Board of Zoning Appeals meeting. You have two variance requests on the agenda for this meeting. It was evident that, during the ongoing development of this site, the existing hedgerow that was to be utilized as a significant part of the required zoning district buffer had been eliminated. The site plan, which was presented to the Planning Commission on July 1, 1998, and approved on July 10, 1998, identified that the existing trees within the hedgerow were to remain. It further stated that the contractor was to coordinate the provision of the buffer with County Planning Staff These elements of the site plan concerning the buffer have clearly been disregarded. Clifford & Associates, Inc. 200 North Cameron Street Winchester, VA 22601 RE: Second Review of Kentucky fried Chicken Site Development Plan #032-98 Dear Ron: I have had the opportunity to review the above referenced site plan resubmitted to our department on r June 10, 1998, and again on June 23, 1998. The following comments are offered and should be addressed during the final revision of this site plan. 1) Ultimately, Foxridge Lane is to be designed and constructed to a standard that would enable the Virginia Department of Transportation to accept the road into the state system. KFC, along with future developers of the Russon property, does have an obligation to improve Foxridge Lane. At this time, the road may be designed and constructed, as stated in my previous letter dated June 2, 1998, to the limits of this particular development. To clarify the limits and the scope of responsibility associated with the development of the KFC, the road must be constructed to state standards to a point beyond the entrance to the KFC. VDOT approval of this plan must take these improvements into consideration. As part of this plan, you should also show the road extending beyond this entrance, along the existing driveway, and into the commercial property. This is to ensure that the future extension of Foxridge Lane to a state standard does not negatively impact the KFC development. In particular, the existing hedgerow proposed to be used as part of the required full screen. The elimination of any part of the existing hedgerow would necessitate the provision of a full buffer in the area between the right-of-way and the parking lot at this time. Please be aware that no subdivision of the Russon property, or future development beyond the KFC, may occur until the road serving the remainder of the property has been constructed or bonded to a standard that would enable acceptance into the state system. Some form of a letter from the property owner recognizing this commitment, in addition to notation on the site plan, would be appropriate. 2) The revision to the parking space calculations is acceptable. However, please highlight or hatch the cold storage area within the footprint that has been eliminated from the parking calculation. 107 North Kent Street - Winchester, Virginia 22601-5000 KFC Site Plan Review Page 2 June 25, 1998 3) Please increase the height of the Arborvitae used in the zoning district buffer from T to 6'. 4) As previously requested, please utilize pavement markings showing the one-way directional flow around the rear of the site. 5) Please revise the detail of the dumpster enclosure to provide for an opaque screen around the dumpster. Section 165-47D(2) of the Zoning Ordinance states that trash containers shall be properly screened or separated from dwellings. It has been consistently determined and implemented that a 6' high wooden stockade enclosure provides an opaque screen, properly screening the trash containers. Therefore, we require that this, or an equally effective opaque screen, is implemented at this site. Should you choose to implement a landscape screen, please increase the height at time of planting to 6' and decrease the distance between plantings. Plantings similar to the Arborvitae portion of the full screen would be effective. After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. I will then need all approved review agency comment sheets and five copies of the final site plan for approval. Comment sheets are required from the following agencies: the Virginia Department of Transportation, the Frederick County Sanitation Authority, the Frederick County Inspections Department, the Frederick County Engineer, and the Frederick County Fire Marshal. This plan has been approved by all Review Agencies except VDOT and a Land Disturbance Permit has been issued by Frederick County Public Works. I've attached copies of the approval letters for your file. The comments mentioned in the Public Works and FCSA approval letters are addressed on this set of plans. Concerning VDOT's approval, I've spoken to Barry Sweitzer and he is satisfied with the plan and ready to approve it except for your concerns about Foxridge Lane which relate to the plan for the Foxridge Lane extension, which is recorded with the deed. The Developer's attorney (Ben Butler) and I have discussed the recorded drawings of Foxridge Drive, which you attached to the staff comments, with Charles Maddox, who developed the Foxridge plan and presented it to The Planning Commission and Board of Supervisors. We all agree that the approved plan allows, but does not require, the owner of the Russon tract, to build the curved road if it is required to access a developed site to the north. As the KFC proposal does not require this new road, we are under no obligation to build it. Should it be required in the future, the entire Foxridge Lane will have to be reconstructed per VDOT requirements. We have made provisions for this future construction by ensuring all of the KFC Facilities are out of the curving road route. I've attached a plan that shows the KFC site plan super -unposed on the Foxridge Lane plans. If the curved road is never built, VDOT has determined that the KFC entrance configuration can remain and meets their requirements. I hope this answers any questions which you might have. Entry and Exit Signage Setbacks. As the ordinance allows for placement of these type of signs within the setback (Para 165-30-E) we request that they be allowed to be placed as shown. Setting these signs back 10 ft. would nullify their usefulness. 2. Dumpster Screening. We could find no ordinance requirement for screening the dumpster site. We have, however, due to the proximity of the RP zone added a white pine screen. I've also spoken to the contractor and they believe that the screening fence specified by KFC may include opaque slates. 3. 45' Parking Alignment. We continue to show the perpendicular parking configuration throughout the site. Angled parking is inefficient and as adequate area existing for 90' parking we have implemented it here. 4. Parking Calculation. We have revised our parking calculations to provide at least 1.4 spaces per 100 sq. ft. of restaurant area. The 319 sq. ft. cold storage area located at the rear of the restaurant is not included in the calculation. 5. Ingress/Egress. I've attached copies of the Deeds of Dedication which established the ingress and egress easements for entry to this site. We disagree that KFC has any obligation to improve Fox Ridge Drive. As the sketches, which you were kind enough to provide, show, Fox Ridge Lane, when initially designed and constructed, was intended to serve as access to multiple sites and, therefore, was dedicated as a public ingress/egress easement. When Russon develops the remaining acres north of KFC, which require the extension of Fox Ridge Drive, certain improvements may be required at that time. The proposed hedgerow must be 36 inches in height at the time of planting and located four feet on center. 18) With regards to the zoning district buffer, it is acceptable to utilize the existing hedgerow as the landscaped portion of the full screen. However, the hedgerow is deciduous in nature and only effective for a portion of the year. Therefore, evergreen plantings and the opaque element of the full screen must also be provided to achieve the function of the required buffer. Please ensure that the modified screening is acceptable to the Foxridge Homeowners Association. In addition, it would be acceptable to the County for the developer to modify the buffer shown in the hatched area by replacing the full screen element with landscape plantings of a variety agreeable to the developer. Should future development of Foxridge Lane necessitate the removal of portions of the existing hedgerow, the owner/developer of the KFC property is responsible for replacing the landscape screen. Please ensure that designs for the road take this hedgerow into consideration. A note to this effect should be included on the site plan.
