SITE PLAN CHECKLIST
The checklist below indicates all the information ..that needs to be submitted as part of the site plan
application. All required information must.be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Dear Gary:
We have received your revised site plan dated October 20, 1998 for the referenced
project. It appears all of our earlier review comments have been satisfactorily
addressed. Please advise the owner of our approval.
The appropriate land use permit may now be applied for to cover work within the
Route 739 right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue. Should you have any questions, do not hesitate to
call.

Dear Mike:
This letter is in regards to my developing out parcel #5 of
the Sunnyside Plaza Shopping Center.
Mark Smith of Greenway Engineering had a conversation with
Kris Tierney concerning a meeting with everyone involved in the
development of the out parcel. The subject of the conversation is
the issuance of a land disturbance permit. Kris said a meeting
would not be necessary if a letter could be sent pertaining to the
out parcel problem with VDOT and the Fox Drive entrance.
As owner of the out parcel, I would like for Frederick County
to issue a land disturbance permit for the out parcel. As you
know, a building permit does not have to be issued until the matter
of the Fox Drive entrance is satisfied by VDOT and the Frederick
County Planning Office. Even so, I would like to proceed with this
fact in mind.
The enormous conditions now required by VDOT is not
substantiated by the traffic study that was performed. I am in
hcpes that there will be no requirements imposed by VDOT in regard
to Lot 5 which the study warrants.
I hope for a quick response to this letter concerning a land
disturbance permit.

We have reviewed the traffic analysis dated July 27, 1998 as prepared by Callow Transportation
Consulting firm. In reference to Figure 1 of the report, we are unable to determine the source of
the numbers of vehicles entering and leaving the site via the access entrance onto Route 522,
please provide the source.
Considering the relatively high volumes of vehicles using Route 739 on a daily basis and the
ever increasing access requests received at VDOT, we require additional traffic counts taken at a
season of the year which more accurately reflects the peak hour volumes. An example is when
schools are operating and carrying that volume.
Please provide the requested information for use by VDOT Traffic Engineers at the District
Office in conducting a more appropriate review. 1.

RE: Approval of Frederick Plaza Site Development Plan #030-98
Dear Mr. Benham:
The Frederick County Planning Department administratively approved the above referenced site plan,
9030-98, on October 14, 1998. This site plan, for the development of two retail buildings totaling 6,000
square feet, meets all County requirements for development within the B2 (Business General) zoning
district. The site plan also calls for the provision of thirty-five (35) parking spaces, parking lot landscaping,
one loading space, and improvements to the driveway serving this parcel.
As you are aware, the Virginia Department of Transportation conditionally approved the site plan based
upon the applicant's commitment that only the current tenants of the shopping center are to be relocated
to the new retail building. The two vacant units adjacent to the Food Lion Store are not to be leased or
otherwise occupied by Food Lion or others until such time VDOT's engineering staff has determined,
through review of the data, the need for reconstruction of portions of Route 739, including left, right and
through lanes is finalized. Frederick County supports VDOT's position in this matter.
I have provided you with two copies of the approved site plan. Please keep an approved copy for your files
and maintain an approved copy on the construction site. Once the site development has been completed,
you should contact this office to schedule an on -site inspection. All site improvements, including any
improvements to Route 739 as determined by VDOT, must be completed prior to obtaining a Certificate
of Occupancy for this facility.

Dear Mr. Benham:
In response to your correspondence dated September 23, 1998 and in consideration of
construction schedules and engineering data reviews by VDOT's Traffic & Engineering
Staff personnel, I offer the following:
The owner agrees only the current tenants of the shopping center are to be relocated
to the new location on Lot 3. The two vacant units adjacent to the Food Lion Store
expansion not be leased or otherwise occupied by Food Lion or others until such
time VDOT's engineering staff has determined, through the review of data, the need
for reconstruction of portions of Route 739, including left, right and through lanes is
finalized.
Furthermore, VDOT requests a bond in the amount of S20, 000 for Route 739
reconstruction be set aside until such time a determination is made regarding the
need for adjustments to Route 739.
If this is agreeable, VDOT will be willing to work with Frederick County in granting your
building permit. Should you have any questions, please call.

This is to confirm our telephone conversation of today
regarding the above matter, wherein I advised that Frederick
County appears to be willing to grant a building permit to the
owner without any requirement for work on the highway, unless the
Department of Transportation requires same.
Furthermore, the owner is constructing a building for the
sole purpose of housing two of the current tenants of the
Shopping Center.
Furthermore, the owner agrees that the two units, being
vacated by the current tenants who are moving to the new location
on Lot 5, will not be leased nor will they be used by any other
tenant (other than Food Lion) until any road work required by you
has been completed by some party or until the two units are torn
down by Food Lion Js�, for its expansion. As a consequence, there
will not be any significant increase in the traffic to the
Shopping Center and Lot 5 as a result of the construction of the
new building.
In summary, as there will be no significant increase in
traffic as set forth above, will the Department of Transportation
agree not to require the County to require any improvements to
Fox Drive for the construction of said building for said two
tenants on Lot 5 (which also has an entrance onto Route 522).
Your help in this matter would be greatly appreciated.

Dear Mr. Benham:
In response to your correspondence dated September 23, 1998 and in consideration of
construction schedules and engineering data reviews by VDOT's Traffic & Engineering
Staff personnel, I offer the following:
The owner agrees only the current tenants of the shopping center are to be relocated
to the neiv location on Lot 5. The two vacant units adjacent to the Food Lion Store
expansion not be leased or otherwise occupied by Food Lion or others until such
time VDOT's engineering staff has determined, through the review of data, the need
for reconstruction of portions of Route 739, including left, right and through lanes is
frnali:ed.
Furthermore, VDOT requests a bond in the amount of S20, 000 for Route 739
reconstruction be set aside until such time a determination is made regarding the
need for adjustments to Route 739.
If this is agreeable, VDOT will be willing to wort: with Frederick County in granting your
building permit. Should you have any questions, please call.

Thank you for your letter of September 30, 1998.
On behalf of and as agent and attorney for Frederick Plaza
Land Trust, I hereby agree on behalf of said Trust the following:
1. In exchange for VDOT consenting to and Frederick County
granting a Building Permit to Frederick Plaza Land Trust for
construction on said Lot 5, Frederick Plaza Land Trust agrees
that only the current tenants of the Shopping Center shall be
relocated to the building being constructed on Lot 5 and that the
two vacant units adjacent to the Food Lion Store will not be
occupied by Food Lion or another until:
A. VDOT determines that the improvements of Route '739
should not be required for the development of Lot 5 as proposed,
or, `
B. VDOT determines that the improvements to Route 739
are required and the improvements are made and completed by Food
Lion or some other entity.
To provide assurance to VDOT that the vacant units in the
Frederick Plaza Shopping Center will not be occupied, Frederick
Plaza Land Trust will give VDOT a bond in the amount of
$20,000.00, which bond will continue until the two units in the
Shopping Center can be occupied pursuant to the above.

RE: Further Review of Frederick Plaza Site Development Plan 4030-98
Dear Gary:
I have had the opportunity to further review the above referenced site plan. This site plan was placed
on hold at the request of Mr. H. K. Benham on July 9, 1998. Subsequently, Mr. Jim Anderson has
requested that the review be continued in anticipation of an approval from the VDOT. In light of this
latest review, I am willing to issue a footing foundation only permit to the developer upon receipt of a
signed "proceed at your own risk" affidavit. However, the following comments, in addition to those
marked on the enclosed plan, must be addressed at this time.
1) Please note Fox Drive, Route 739, on the location map.
2) The proposed 5' boundary line adjustment of the property being developed must be completed
prior to final approval of this site plan. Please ensure that the surveyed description and acreage
of the property are consistent with the approved consolidation.
3) Thank you for providing additional detail pertaining to the shared driveway that this facility will
be using for its access and the Food Lion parking area. The driveway along which the retail
development will access Fox Drive must be separated from the existing parking area with raised
islands as marked on the original (and this) site plan review. Also, it would appear as though the
entrance to the development should be relocated, approximately 3' to the west to align with the
adjacent parking aisle.
4) Please ensure that the spacing of the shade trees provided along the front of the property, adjacent
to the parking area, does not exceed 40'. In addition, please specify the height/caliper size of the
landscaping at time of planting.
Please revise your site plan to reflect the comments specified in this letter and resubmit one copy for my
review. Once I have verified the information contained on the revised site plan, I will need all approved
review agency comment sheets and five copies of the final site plan for approval. Comment sheets are
required from the following agencies: the Virginia Department of Transportation, the Frederick County
Sanitation Authority, the Frederick County Inspections Department, the Frederick County Engineer, and
the Frederick County Fire Marshal.

Dear Mike:
This letter is in regards to my developing out parcel #5 of
the Sunnyside Plaza Shopping Center.
Mark Smith of Greenway Engineering had a conversation with
Kris Tierney concerning a meeting with everyone involved in the
development of the out parcel. The subject of the conversation is
the issuance of a land disturbance permit. Kris said a meeting
would not be necessary if a letter could be sent pertaining to the
out parcel problem with VDOT and the Fox Drive entrance.
As owner of the out parcel, I would like for Frederick County
to issue a land disturbance permit for the out parcel. As you
know, a building permit does not have to be issued until the matter
of the Fox Drive entrance is satisfied by VDOT and the Frederick
County Planning Office. Even so, I would like to proceed with this
fact in mind.
The enormous conditions now required by VDOT is not
substantiated by the traffic study that was performed. I am in
hopes that there will be no requirements imposed by VDGT in regard
to Lot 5 which the study warrants.
I hope for a quick response to this letter concerning a land
disturbance permit.

with the development of the existing shopping plaza and any obstructions within the driveway.
It may be appropriate to align the proposed entrances with existing travel aisles and provide
raised islands to clearly separate traffic circulation.
10) Please provide for the stacking of five (5) vehicles at each of the drive-thru windows. This
should be done without compromising circulation on the site.
11) With regards to the Phase H parking, please consider revising the parking as marked. It is my
understanding that improvements to Route 739 may be necessary as development continues
to occur along this road. Also, the Winchester Area Transportation Study (WATS) identifies
improvements to this stretch of Route 739. It would be appropriate to consider these future
improvements at this time.
12) Please eliminate the proposed anchored wheel stops and provide the required curb and gutter
with a drop inlet in the appropriate location. In this situation, there is no extraordinary
stormwater management concern that would necessitate their use.
13) Please show the location of the proposed shrub hedgerows.
14) Please provide the required "B" category zoning district buffer along the property adjacent to
the RP (Residential Performance) zoned land to the west of this site.
15) The stormwater management plan, and the soil erosion and sedimentation control plan, shall
be approved by the Department of Public Works.
Please revise your site plan to reflect the comments specified in this letter and resubmit one copy for
my review. Once I have verified the information contained on the revised site plan, I will need all
approved review agency comment sheets and five copies of the final site plan for approval. Comment
sheets are required from the following agencies: the Virginia Department of Transportation, the
Frederick County Sanitation Authority, the Frederick County Inspections Department, the Frederick
County Engineer, and the Frederick County Fire Marshal.

We have reviewed the preliminary site plan dated April 16, 1998 (received
April 23, 1998) for the referenced project. VDOT comments are as follows and as
shown in red on the enclosed plan sheets:

1) A left turn lane should be provided into the proposed site from southbound
Route 739 (Fox Drive). A copy of the VDOT comments for the Kentucky Fried
Chicken Site Plan is attached for use in aligning the lane. Also, provide a
pavement striping plan depicting control throughout the intersection.
2) Additional right-of-way dedication should be provided as shown for
appropriate radius and sign control location.
3) A standard VDOT stop sign should be provided.
4) Please provide a directional traffic split at the indicated location on Sheet 2
of the plans. Also, provide a viable plan to direct traffic toward Route 739
(Fox Drive) as the preferred collector. In April, 1997 a study was conducted
to determine the need for signalization at the intersection of Route 522 and
the Frederick Mall entrance. The warrants at that time did not meet the need
for signalization at the intersection. Furthermore, the existing geometrics do
not provide a condition conducive to signal installation:

• Not enough length between intersection and signalized Route
739 (Fox Drive) to allow for lane control.
• The existing crossover servicing the Mall entrance would
require extensive regrading as well as Route 522 lanes to be
regraded.
The previous comments all provide justification for directing site traffic toward
Route 739 for safer (signal controlled) access to and from Frederick Plaza
Expansion enterprises.
All miscellaneous notes shown in red on the plan sheets and on the attached
Entrance Permit Plan Check List should be addressed. When all the comments
have been addressed, please provide five copies of revised plans for review.

Upon review of the subject site plan, we offer the following comments:
1. Sheet 5 of 5
In conjunction with the diversion berm, place a drainage Swale to drain the
concentrated flow generated from the, west parking area. Since the flow will be
concentrated, a dedicated drainage easement will be required to convey the run-off
to the stormwater pond.
2. We recommend placing a silt fence along the pond perimeter to control the amount
of sediment draining into the existing pond.
Once these items have been addressed, submit two (2) copies of the revised site plan for
further review.
