SITE PLAN CHECKLIST
The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Dear Sir:
As previously discussed, at the beginning of this month, Mr. Michael M. Milarn retained the
services of Painter -Lewis, P.L.C. to prepare the site plan documents for the Milam's Landscaping
and Garden Center to be located at 2186 Northwestern Pike. After- several months of discussion
involving type of entrance design, pavement structure, parking layout, etc. Mr. Milam has
authorized us to proceed with the design. Pursuant to my discussions with Mr. Milam, this,
project had to be submitted by March 18, 1998. It was our intention to have these documents
prepared and submitted to the review agencies as of this date, however, due to some
discrepancies in the existing conditions and topographic information these documents can not be
properly completed.
I would like to assure you that Painter -Lewis, P.L.C. in association with Marsh & Legge
Land Surveyors, P.L.C. has done everything possible to have these documents prepared and
submitted by the March 18, 1998 deadline. Also, Mr. Milam has been very helpful in providing the
necessary information to expedite the completion of this project and authorized us to do all that is
required to have this plan completed by the Planning Commission meeting. Unfortunately, the
additional site observation and field surveying, that will be necessary to fulfill the requirements
associated with the site plan documents, will prevent the satisfactory completion of the project by
the specified date. Please be advised that the additional field surveying is scheduled to be done this
week and as soon as this information is received the site plan will be completed in turn. It is
anticipated that the site plan will be completed and submitted to the review agencies no later than
March 25, 1998

Dear Mr. Milam:
The Frederick County Planning Department administratively approved Site Plan #025-98 for the above
referenced site plan on May 18, 1998. This site plan is in conformance with the approved Conditional Use
Permit (#012-97) and meets all County requirements for development within the RA (Rural Area) zoning
district. The development of this property includes the provision of thirteen parking spaces, improvements
to the entrance and driveway, and both enclosed and outside display areas. The existing pole barn is not to
be used by the general public nor is it to be used as a display area.
I have provided you with two copies of the approved site plan. Please keep an approved copy for your files
and maintain an approved copy on the construction site. Once the site development has been completed, you
should contact this office to schedule an on -site inspection. All site improvements shown on the site plan
shall be completed prior to this operation being open for retail sales and prior to July 15, 1998. With this in
mind, please ensure that all improvements are completed in advance of the above date to allow sufficient time.

been satisfactorily addressed. Please advise the owner of our approval.
The appropriate land use permit may now be applied for to cover work within
the Route 50 right-of-way. The permit is issued by this office and will require a
minimum processing fee, surety bond coverage, and the salary & expenses of a
State assigned Inspector.
Once satisfactory application has been made, a permit will normally take
approximately thirty days to process and issue. Should you have any questions,

Dear Tim:
I have had the opportunity to review the above referenced site plan received by our department on
April 2, 1998. The following comments should be addressed during the revision of this site plan:
1) Please provide a description of the approved CUP for this business which includes a list of the
approved conditions.
2) Please show the location and dimensions of the proposed/existing sign.
3) Please increase the width of the driveway to a minimum of twenty-four (24) feet.
4) Please revise the parking calculations. The parking requirement for a retail nursery is one
space per 400 square feet of enclosed floor area, plus one space for every 3,000 square feet of
outside display area. The display area in the pole barn is wholly within the structure and
should be considered as enclosed floor area. While the pole barn may be open along its sides,
the display area is not outside of the building.
5) Please show the location of the office and public facilities for this operation. Any additional
parking and accessibility issues should be considered.
Please revise your site plan to reflect the comments specified in this letter and resubmit one copy for
my review. Once I have verified the information contained on the revised site plan, I will need all
approved review agency comment sheets and five copies of the final site plan for approval. Comment
sheets are required from the following agencies: the Virginia Department of Transportation, the
Frederick County Health Department, the Frederick County Inspections Department, the Frederick
County Engineer, and the Frederick County Fire Marshal.

VDOT conunents are as follows and as shown in red on the enclosed plan sheets:
1. VDOT General Notes Numbers 1 thru 8 (copy attached to plan) should be shown on
plan assembly. The preferred location is on the cover sheet.
2. ITE or acceptable volume counts (traffic) trip generation data should be provided.
3. A minimum 150' taper should be provided on the Route 50 WBL approach to the
entrance to establish a safer access to the site.
4. Why not install an ES-1 on the east end of the entrance culvert? A VDOT concern is
the use of an upright wall in the EW-1 which creates a safety hazard for errant
vehicles.
All miscellaneous notes in red should be addressed.
When all the above comments have been addressed, please provide five sets of the
signed plans for review.
