Dear Mr. Bancroft:
The above -referenced site plan was approved on April 1, 2009 (sheets 1, 7, 7A, 8 and 13). This site plan
is approved for revisions to Site Plan 408-08 which was approved on March 31, 2008. Specifically, this
site plan is for revisions to the Sovereign Village Recreation Center to conform to the proffers of
Rezoning # 14-08. Required site improvements include the following:
• A 30 foot x 50 foot swimming pool, a 3,024sf pavilion with bath house areas, check in/storage
area and four picnic tables.
• Sidewalks and deck areas as indicated on the plan.
• Construction of a parking lot with 39 spaces (including two handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
• A wrought iron type fence surrounding the pool area.
• A screened dumpster area.
• Landscaping as shown on sheet 13 of the plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with two (2)
copies of the approved site plan. An approved copy of the site plan must be kept on the construction site
throughout the development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or
concerns.

Mr. Hott:
The Board of Directors of the Sovereign Village Homeowners' Association discussed your proposal at length at our last
board meeting. We found nothing in it to cause us to change our position. Our letter reflects the kind of proposal we
would be willing to take to our membership.
Our main concern is and always has been with the size of the pool. The one in the proposal is still a full 30 feet short of
the size your department determined would be adequate to serve our community.
As for the recreation center, we have no complaints about the one as described in the original proffer. We consider it a
very desireable feature of the whole center. We see no benefit in trading a private facility for the opportunity to use a
public one.
If Manning and Ross and the county are interested in the Sovereign Village Homeowners' Association accepting a
recreation center, then they are going to have to make sure it contains enough desireable amenities to enable us to
secure a membership adequate enough to operate it successfully. These proposed changes do nothing to further that
end.

Having received your letter dated July 14, 2008, 1 am somewhat confused as it does not reflect what we discussed on
July 7, 2008.
The developer Manning and Ross, and to my understanding, is legally bound by the approved proffered plans to
construct a 3,000 s.f. Community Center, Pool and outdoor multi -court play courts.
If the Homeowners Association would like for the developer to construct a larger Pool, the developer has supported
constructing a 30' x 50' pool with a bath house and a multi -purpose court as a revision for the Recreation Center. This
revision would eliminate the 3,000 s.f. Community Center. As we also discussed, the Parks and Recreation Department
will have Community Center space as part of the 12 the Elementary School.
In addition, if the Homeowners Association is further interested in this revision, the Association would have to agree to
take ownership of the facilities when completed.
The developers would need a le f er of support from the Homeowners Associa"ion for the revised Recreation Center by
July 31, 2008.
If a letter is not received, the developer will have to proceed as per the approved proffered plans.

Dave Madison just called me to follow-up on our discussion yesterday. Dave is Greg Bancroft's partner in
Manning & Ross Development.. Dave said they are supportive to a slight revision to the rec center site which
would result in a mult-purpose court, and bath house and 30 by 50 pool. They, obviously, would want to obtain a
letter of support from the HOA if indeed the HOA preferred this revised rec facility. Dave would like to resolve the
rec center design within the next month so that they might move forward with any design changes and
construction.
Dave places the responsibility to secure the HOA support with us.
Dave is available should you wish to communicate with him and you move forward with the 'compromise' effort.

AN ORDINANCE AMENDING
THE ZONING DISTRICT MAP
REZONING 415-99 OF CHANNING DRIVE
WHEREAS, Rezoning 915-99 of Channing Drive was submitted to rezone 354.3 acres from RA
(Rural Areas) to RP (Residential Performance) and of22.0 acres from RA (Rural Areas) to B2 (Business
General) with the proffers submitted by the applicant. This property is located on the north side of
Senseny Road (Route 657), on both sides of Bean's Pond Lane, and adjacent to the Bedford Village,
Apple Ridge, Senseny Glen, and Carlisle Heights subdivisions, and is identified with Property
Identification Numbers 55-A-206, 209, 211, 213 & 65-A-30, 31, 39, 40 in the Stonewall Magisterial
District.
WHEREAS, the Planning Commission held a public hearing on this rezoning on November 3, 1999;
and
WHEREAS, the Board of Supervisors held a public hearing on this rezoning on December 8, 1999;
and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to be in
the best interest of the public health, safety, welfare, and in conformance with the Comprehensive Policy
Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors that
Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map to

Pursuant to Section 15.2 - 2296 Et Seq., of the Code of Virginia, 1950, as amended, and the

This article shall apply only to those properties currently owned by Lynnehaven, L.C., property
identification numbers 55-((A))-206, and 65-((A))-30, 31. The subject properties are more
particularly described as all of the land owned by Lynnehaven, L.C. as recorded in Deed Book 843
at Pages 415, 418, and 424 and reported to collectively contain 91.4 acres.
The conditions proffered are as follows:
A) AREA ZONED RP - 81.4 ACRES
1. MAXIMUM DENSITY
The total number of lots shall be limited so as not to exceed a 2.5 unit per acre density for the
entire subject area.
2. PROHIBITED UNIT TYPES
Townhouses, weak -link townhouses, and garden apartments, as defined in the Frederick County
Zoning Ordinance, shall not be permitted.
3. PEDESTRIAN WALKWAYS
Pedestrian walkways shall be provided in the master development plan in addition to required -
sidewalks. Nature trails shall be constructed by the applicant in open space areas, in dedicated
easements, and in tandem with the regional stormwater management network. Said trails shall
also link to similar trail systems in adjacent housing developments, and shall be six feet wide
with a wood chip or mulched surface. See Exhibit A attached.

4. SOLID WASTE
The owners of the subject property shall pay $100.00/mo. to Frederick County for the use of the
solid waste facility located on the Greenwood Volunteer Fire Company property and serving the
Greenwood/Senseny Road area. Said payment shall be made from the time Frederick County
encumbers and signs a new lease for the expansion of said facility, or acquires another facility
serving this general area, and shall continue for a period of ten years, or the term of said lease,
whichever is less.
B) AREA ZONED B2 - 10.0 ACRES

In the B2 area established by this rezoning, the maximum cumulative floor area of all buildings
in said B2 area shall not exceed 100,000 square feet.

Commercial structures within the proposed B2 area shall be faced with brick, drivet, or
architectural block on three (3) sides.
C) ENTIRE PARCEL
1. CHANNING DRIVE
Channing Drive is a new major collector which will be constructed along the eastern boundary
of the subject property. Channing Drive shall consist of an 80' dedicated right-of-way with two
12' lanes, along with any associated turn lanes required by the Virginia Department of
Transportation. This thoroughfare will be built in sections as warranted by adjacent
development. The following criteria establish when the property owner is required to extend
Channing Drive:

a) Each subdivision plan for residential housing adjacent to a portion of Channing Drive that has
not yet been constructed shall include the construction of the adjacent portion of said drive in
the subdivision plan.
b) The construction of the first section of Channing Drive, from Senseny Road to the proposed
B2 area, shall be included in the first site plan submitted for the B2 area if said road section
has not yet been constructed.
c) All of Channing Drive from Valley Mill Road to Senseny Road shall be constructed, open for
traffic and dedicated to Frederick County before the 475th residential building permit is
issued for any of the parcels listed in Article I of this proffer.
2. TRAFFIC SIGNALS
a) The installation of a traffic. signal at the intersection of Senseny Road and Channing Drive
shall be included in the first site plan submitted for the B2 area, if a traffic signal has not yet
been installed at said intersection should residential traffic meet signalization warrants. The
developer agrees to enter into a signal agreement with VDOT prior to final site plan approval.
b) The owners shall make a $25,000 cash contribution towards the installation of a traffic signal
at the intersection of Greenwood Road (Route 656) and Senseny Road (Route 657). This
contribution shall be made to the Virginia Department of Transportation upon their request
and upon approval by said department for the installation of this traffic. signal. In the event a
traffic signal is installed at said intersection before this contribution is made, the Virginia
Department of Transportation may request the transfer of said contribution towards
signalization at the intersection of Greenwood Road (Route 656) and Valley Mill Road
(Route 659). The developer agrees to enter into a signal agreement with VDOT prior to final
subdivision and/or site plan approval.
3. BRIDGE IMPROVEMENTS
There is currently a one -lane bridge on Valley Mill Road where it crosses Abrams Creek. The
owners of the subject property shall pay towards feasibility studies, engineering, or construction
of improvements to this crossing. These monies, paid to Frederick County, VA, are to be set
aside for said improvements, and may be considered by the county for matching funds. Said
payments shall be $100.00 per residential lot, at the time the initial building permit is issued for
said lot. The owner of the subject property shall be required to pay said monies until the
Virginia Department of Transportation awards a contract for a two lane expansion and
construction of these improvements on said bridge.
4. TURN LANES AND RIGHT OF WAY DEDICATION
a) Right and left turn lanes shall be constructed on Senseny Road at the intersection with
Channing Drive. Said lanes shall be constructed by the applicant at the time Chaining
Drive is connected to Senseny Road.

This article shall apply only to those properties currently owned by Robert A. Giles, et als, and
Manning and Ross, LLC, property identification numbers 65-((A))-39, 39A. The subject property
includes all of the land described as being owned jointly by Wanda G. High, Janita Giles, Robert A.
Giles, and Richard F. Giles as recorded in Will Book 79, page 317, and in Deed Book 889 at Page
741. Said property is further described by a survey by Curtis L. McAllister dated February 13, 1990
and is reported to contain in aggregrate a total of 152.20 acres. The subject property includes all of
the land now owned by Manning and Ross, LLC as recorded in Deed Book 948 at page 1760, and
contains 51.0 acres. The conditions proffered are as follows:
A) AREA ZONED RP - 140.2 ACRES
1. MAXIMUM DENSITY

pool and an outdoor multi -purpose playing court; the facade shall be constructed of brick, wood
product, masonry, or drivet. Said facility shall be open for membership by residents of all
subdivisions resulting from this Channing Drive Rezoning and shall also be open for
membership to all other area residents.
4. PEDESTRIAN WALKWAYS
Pedestrian walkways shall be provided in the master development plan in addition to required
sidewalks. Nature trails shall be constructed by the applicant in open space areas, in dedicated
easements, and in tandem with the regional stormwater management network. Said trails shall
also link to similar trail systems in adjacent housing developments, and shall be six feet wide
with a wood chip or mulched surface. See Exhibit A attached.
5. SOLID WASTE
The owners of the subject property shall pay $100.00/mo. to Frederick County for the use of the
solid waste facility located on the Greenwood Volunteer Fire Company property and serving the
Greenwood/Senseny Road area. Said payment shall be made from the time Frederick County
encumbers and signs a new lease for the expansion of said facility, or acquires another facility
serving this general area, and shall continue for a period of ten years, or the term of said lease,
whichever is less.

C) ENTIRE PARCEL
1. MANNING DRIVE
Channing Drive is a new major collector which will be constructed along the western boundary
of the subject property. Channing Drive shall consist of an 80' dedicated right-of-way with two
12' lanes, along with any associated turn lanes required by the Virginia Department of
Transportation. This thoroughfare will be built in sections as warranted by adjacent
development. The following criteria establish when the property owner is required to extend
Channing Drive:
a) Each subdivision plan for residential housing adjacent to a portion of Channing Drive that has
not yet been constructed shall include the construction of the adjacent portion of said drive in
the subdivision plan.
b) The construction of the first section of Channing Drive, from Senseny Road to the proposed
B2 area, shall be included in the first site plan submitted for the B2 area if said road section
has not yet been constructed.

c) All of Channing Drive from Valley Mill Road to Senseny Road shall be constructed, open for
traffic and dedicated to Frederick County before the 475th residential building permit is
issued for any of the parcels listed in Article I of this proffer.
2. STREETSCAPE
The main entrance road into the residential subdivision established on the Giles Farm property
shall have four travel lanes, and shall have a median strip at least 10 feet wide. Said roadway
shall be streetscaped with deciduous trees (at least one tree per 80 lineal feet), ground cover and
shrubbery as allowed by the Virginia Department of Transportation.
3. TRAFFIC SIGNALS
a) The installation of a traffic signal at the intersection of Senseny Road and Channing Drive
shall be included in the first site plan submitted for the 132' area, if a traffic signal has not yet
been installed at said intersection should residential traffic meet signalization warrants. The
developer agrees to enter into a signal agreement with VDOT prior to final site plan approval.
b) The owners shall make a $25,000 cash contribution towards the installation of a traffic signal
at the intersection of Greenwood Road (Route 656) and Senseny Road (Route 657). This
contribution shall be made to the Virginia Department of Transportation upon their request
and upon approval by said department for the installation of this traffic signal. In the event a
traffic signal is installed at said intersection before this contribution is made, the Virginia
Department of Transportation may request the transfer of said contribution towards
signalization at the intersection of Greenwood Road (Route 656) and Valley Mill Road
(Route 659). The developer agrees to enter into a signal agreement with VDOT prior to final
subdivision and/or site plan approval.
4. BRIDGE IMPROVEMENTS
There is currently a one -lane bridge on Valley Mill Road where it crosses Abrams Creek. The
owners of the subject property shall pay towards feasibility studies, engineering, or construction
of improvements to this crossing. These monies, paid to Frederick County, VA, are to be set
aside for said improvements, and may be considered by the county for matching funds. Said
payments shall be $100.00 per residential lot, at the time the initial building permit is issued for
said lot. The owner of the subject property shall be required to pay said monies until the
Virginia Department of Transportation awards a contract for a two lane expansion and
construction of these improvements on said bridge.
5. TURN LANES AND RIGHT OF WAY DEDICATION
a) Right and left turn lanes shall be constructed on Senseny Road at the intersection with
Channing Drive. Said lanes shall be constructed by the applicant at the time Channing
Drive is connected to Senseny Road.

This is to acknowledge receipt of your revised plans with latest revisions dated March 11, 2008
for the referenced project. The plans appear satisfactory and are approved. Please advise the
developer accordingly. Please provide 4 sets of approved construction plans with
signed seal for VDOT distribution.
I offer the following comments:
. A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
. Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
. Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department.
. All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
. The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
. The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
. Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
. Any signs to be installed will be in accordance with the Manual on Uniform Traffic Control
Devices (MUTCD) and the approved plans.
. I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility
of any pavement settlement.
. A copy of any/all recorded plats of dedication for drainage easements or additional right-
of-way required for implementation of this proposed project should be provided to VDOT
prior to issuance of any land use permit. Dedication should be made to the
Commonwealth of Virginia.
. A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation
of this proposed project should be provided for VDOT review prior to issuance of any

in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please

16. Landscaping Notes. On sheet 13, notes need to be provided that state (1) all planting shall
conform with §165-36B of the Frederick County Zoning Ordinance (Plant selection, planting
procedure, and maintenance), and (2) any plant substitutions must be approved in writing by the
Frederick County Planning Department.
After you have revised the site plan, please resubmit two copies so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for approval. Comment sheets are required from the following agencies: the Virginia
Department of Transportation, the Frederick County Inspections Deparhnent, the Frederick County
Engineer, the Freclerick County Fire Altarsllal, and the Freclerick County Sanitation Authority.

Re: Sovereign village Recreation Center
After review of the site plan dated December 18, 2008 and received on
January 7, 2009, the Parks and Recreation Department would offer the
following comments.
• The swimming pool size and decking would be of adequate size to
serve the residents of the Sovereign Village, Lynnhaven and Twin
Lakes Subdivisions. However, we are unable to comment on the pool
design due to the lack of detailed information.
• The support facilities would appear to be of adequate size. However,
the developer may want to separate the "check -in "component from
the "storage/ utilities and mechanical "functions and combine with the
"bath house".
• The developer may want to consider increasing the height of the
fencing and the style of fencing to deter unauthorized usage of the
facility.
• The swimming pool design and support facilities should meet all
Local, State and Federal Standards and Guidelines.

The Sovereign Village Homeowner Association's Board of Directors has been briefed by the
Frederick County Board of Supervisors, Frederick County Parks & Recreation, Frederick
County Planning Conunission, and the community's developer (Manning & Ross) on
proposed revisions to the original proffer for the Channing Land Bay. After considering the
revisions, the SVHOA Board would like to state that it would not oppose any proffer
revision that included the following points:
Pool open by July 4, 2009
Manning & Ross will own and operate pool Luntil at least January 1, 2011
Right of First Refusal for ownership transfer given to SV HOA for $0 fee simple, no
sooner than January 1, 2011.
• Records & accounting of monies and time required to run pool given at offer
time to SV HOA for review during 90 day decision period
• .SV HOA will accept or decline ownership within 90 days of offer.
$40-000-ftunds (1 year's estimated operating expenses) turned over with Pool
ownership
• 30'x50' Swimming Pool
• Zero depth entry for Handicap ramp only
• Pool depth, excluding ramp, to range from three feet to six feet. Includes (2)
two 50' lap lanes

arrive mid -December to the SVHOA members. It is recommended within that newsletter that
if individuals do not agree, then they should exercise their right to be heard by their county
government and make public coT.nment.
