Dear Mr. Berneburg:
The above -referenced site plan was approved on May 13, 2008. The site plan is approved for the
construction of a new 4,197 square foot McDonald's at the Rutherford Crossing Development located on
1Vlartlnsburg Pike in the Stonewall Magisterial District. Required site improvements include the
following:
• Construction of a parking lot with 61 spaces (including three handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
• Sidewalks as indicated on the plan.
• One loading space, a screenm screened dupster area and landscaping as indicated on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agcncies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owrner(s) should contact this office to schedule an on -site inspection. Do not hesitate tc

This is to acknowledge receipt of your revised plans dated January 11, 2008 for the referenced project.
The plans appear satisfactory and are approved. Please advise the developer accordingly. Please provide
2 set of approved construction plans with signed seal for VDOT distribution.

• Materials used and method of construction shall apply to current observed VDOT Road & Bridge

Department prior to inclusion into the Secondary Road System.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined length of
time. VDOT will also require 48 hours notice for inspections.

• A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to issuance of
any land usepermit. Dedication should be made to the Commonwealth of Virginia.

3. A Landscape Island has been provided as requested and noted on the "red lined" set of
plans on your returned plan sheets to us with your comment letter.
4. The Pole Height for the lot lighting is noted on the Photometric / Lighting Plan sheet,
additionally the note has been added to the sheet to reference sheet 79 of 88 Rutherford
Crossing Site Plan for Lot Lighting pole type information as we discussed.
5. The Landscaping to be provided by the overall developer (NV Retail) is noted on the
Landscaping Plan Sheet C-4 along with the note as requested concerning bonding.
The Virginia Department of Transportation (VDOT) comment letter has been provided to you Via

Dear Jeff:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Plan Sheets and Engineer Seal. The sheets fi-om the Rutherford Crossing site plan should not be
inserted in this plan. The information should be copied from these sheets and provided in this plan.
Also, the engineer needs to seal the coversheet of the plan.
2) Loading Space. The loading space is still shown ovel'top of the handicap spaces and needs to be
relocated. The removal of the teat from note 20 does not eliminate the loading space conflict. The
loading space could be located within the drive thm area.
3) Landscaped Island. A landscaped island needs to be provided as indicated on sheet C-1.
4) Lighting. On the lighting plan, the pole height needs to be specified.
5) Landscaping. The site plan states that, the landscaping along Martinsburg Pike and Merchant Street
will be provided by the developer. Clarify that the landscaping will be provided by the overall
developer of the center (specify a name) and note that the landscaping must be installed before
ivlcDonalds can open or will need to be bonded by the developer.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan
for approval. Comment sheets (approvals) are required from the following agency: the Virginia Deprn•hnent
of Transportation.

with -in the Rutherford Crossing Development and does not have any direct access to a state
highway, we feel no major comments, if any will be forthcoming from them.

If possible, would you please proceed with your review of the enclosed revised site plans that
have addressed the comments from the agencies listed above and as soon as the comment letter
is received from V.D.O.T., we will address their comments, if any accordingly and resubmit as

At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staffs comments listed below and then prepare a revised site plan which adequately addresses
each concern. -
Review Comments:
1) Subdivision. The site plan references two different property identification numbers, 43-A-99
and 43-A-100; our records indicate that this building is on 43-A-101 E. Indicate if further
subdivision is necessary for this site so that McDonald's is located on a separate lot. If so, the
subdivision needs to be completed before the site plan can be approved. If the property is
proposed to be leased, the ownership provided on the site plan application and the plan is
incorrect.
2) Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them for
this site plan.
3) Proffers. The proffers need to be included in the site plan.
4) Site Information. On the coversheet or on sheet C-1, the following site information must be
provided: PIN#, BRL's (minimum and actual), building height (aCtLlal), the FAR (.06) and the
landscaped area.
5) Parking Space Size. There are parking spaces shown on the plan as 162sf; ordinance requires
parking spaces to be a nlininlLun of 180sf.
6) Curb and Gutter. The parking spaces along the front of the building are required to have curb
and gutter (CG-6) and islands at each end.
7) Crosswalks. Provide a crosswalk at the site entrance as indicated on sheet C-1.
8) Adjoining Properties. All adjoining properties need to be shown on sheet C-1.
9) Dunlpster Location. A siX inch Curb needs to be provided between the parking space and the
dumpster area.
10) Loading Space. The loading space is shown overtop of the handicap spaces and needs to be

11) Lighting. Provide a detail of the light pole and fixture that will be utilized on the site.
12) Landscaping. The site plan states that the landscaping along Martinsburg Pike and Merchant
Street will be provided by the developer. Clarify that the landscaping will be provided by the
overall developer of the center (specify a name) and note that the landscaping must be installed
before McDonalds can open or will need to be bonded by the developer.
13) Berm and Sign. Label the berm along Martinsburg Pike and clarify that the monument sign
