The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on August 25, 2008. The site plan is for revisions to the previously approved Lots 4
& 5, Site Plan 1178-07. Revisions to the site plan include minor building modifications, phasing
modifications and parking modifications.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency continents from all relevant review agencies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Dear Candice:
Please find enclosed approvals from all required agencies. No additional changes have been made since
obtaining these approvals. In response to your comment letter regarding the above referenced project dated
May 28, 2008 we offer the following:
1. Comment: Parking Calculations: For the parking calculations on the coversheet,
the number of employees has been reduced but the amount of
warehouse area has not been reduced. The maximum number of
warehouse employees needs to be accounted for on the plan and it is
unclear how this number has dropped by 44 employees on the revised
plan.
Response: This is a speculative building so the specific uses at this point in time are
mostly unknown. We have provided in the tabulations the maximum number
of warehouse employees allowed based on the proposed parking, however,
common sense indicates that this number will never actually even be
approached. While we appreciate the flexibility this type of parking
requirement allows, it does create a bit of a challenge for spec buildings. As
shown, the warehouse area is parked at I per 500 sq.ft. which would allow
approximately 5 employees par unit. We are confident that we are providing
more than enough parking to accommodate all potential uses of this facility.

2. Comment: Office Uses: This revised plan shows additional second floor office
space in building 2. Indicate if this space is part of the office area on the
first floor. As stated previously and as indicated on the plan, only
offices allowed in the MI district will be permitted in these buildings
and most general office uses will not be permitted.
Response: The second floor office spaces are a part of the first floor areas, in other
words, these are not separate units. We have notified the developer from the
beginning of the use limitations For offices in the M I 'zoning district as well
as placing related notes to the cover and status sheets. MI zoning does
allow, however, "general business offices, including corporate, government
or otlicr offices not providing services to the general public on a regular basis
as the primary use" as well as "engineering, accounting, research,
management and related services" and "offices and storage facilities for
building construction contractors, heavy construction contractors and special
trade contractors" as we are sure you are well aware.

Planning Staff has reviewed the abovc-referenced site plan to detcrmine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments
listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:

the plan. 1 will need all approved review agency comment sheets and at least five copies of the final plan for
approval. Comment sheets are required from the following agencies: the Frederick County Inspections Department
and the Frederick Public H/orks Department.

Please find enclosed for your review five (5) sets of the Annandale Industrial Park —
Lots 4 & 5 site plan. The changes that were made were related to updated building
architecture and the clients desire to build Building II first. Because tllcsc changes
were so few, we assumed that this would qualify as a minor revision. If this is not
expectable please let me know. Additional sets have also been submitted to the City
of Winchester Utilities Department and Frederick County Public Works. If you have
