RE: Roofline Lighting at CVS
To Whom It May Concern:
On August 3, 2009, I visited the above -referenced property in response to an excessive lighting
complaint. Upon my inspection of the site, I found that the lighting around the roof line of CVS was
indeed too bright and illuminating onto surrounding properties. On August 4, 2009,1 met with a Mr.
Mike Nicklow and pointed out this issue with him. Mr. Nicklow assured me that the lights would be
turned off and will remain off until proper shielding is in place. If the lighting comes back on, this
will constitute a Zoning violation. Thanks for any assistance you may provide to reconcile this
matter.

Dear John:
The above -referenced site plan was approved on December 16, 2009. The site plan is approved for the
construction of a new 13,225 square foot CVS Pharmacy located at the corner of North Frederick Pike
(Route 522) and Westminster Canterbury Drive (Route 1318) in the Stonewall Magisterial District.
Required site improvements include the following:
• Construction of a parking lot with 84 spaces (including four handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
• A sidewalk along Westminster -Canterbury Drive and a 10 foot path along Route 522.
• One loading space and a screened dumpster area.
• Buffers and landscaping as shown on sheet 13 of the plan.
All requirements of the Frederick County Zoning Ordinance have been met-in-ihe-approved-site-plan,
including review agency comments from all relevant review agencies. I am providing you with six (6)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for futu.e reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on --site inspection. Do not hesitate to
contact me if you have any questions.

THIS DEED OF EASEMENTS, made and dated this 8th day of December, 2008,
by and between CVS 5750 VA, L.L.C., a Delaware limited liability company ("CVS" or, for
indexing purposes, the "Grantor"), FREDERICK COUNTY SANITATION
AUTHORITY ("FCSA"), the COMMONWEALTH OF VIRGINIA
("Commonwealth"), WESTBURY COMMONS CONSERVANCY, a Virginia
association ("Westbury") and ROBERT E. ITASSINGER and JOAN B. HASSINGER
(collectively referred to hereinafter as "Hassinger'). For purposes of indexing, CVS is
designated as Grantor, and FCSA, the Commonwealth, Westbury and Hassinger are
designated as Grantees.
RECITALS:
A. CVS is vested with fee simple title to that certain parcel of land lying and being
situate in Stonewall Magisterial District, Frederick County, Virginia, containing 2.2640 acres
(98,620 square feet), more or less, as more particularly described on that certain plat titled
"Boundary Line Adjustment & Lot Consolidation Between The Properties Of CVS 5750 VA,
L.L.C., a Delaware Limited Liability Company & Robert E. Hassinger & Joan B. Hassinger",
dated November 20, 2008, drawn by Elliott Ritchie, Jr., L.S. (the "BLA Plat"), a copy of
which is attached to and made a part of that certain Deed of Boundary Line Adjustment and
Lot Consolidation dated December 8 2008, of record in the Clerk's Office of the Circuit
Court of Frederick County, Virginia as Instrument No. 08 �I3�27rD (the "CVS Parcel")
known as Tax Map No. 53A-A-5.
B. Hassinger are the owners of that certain parcel of land adjacent to the CVS Parcel,
located on the South side of North Frederick Pike (U. S. Route 522), containing 0.5708 acres
(24,864 square feet), more or less, as more particularly described on the BLA Plat (the
"Hassinger Parcel") known as Tax Map No. 53A-2-D-C.
C. Westbury is the owner of certain lands adjacent to the CVS Parcel on die South,
designated as Open Space "B" on that certain plat titled "Final Subdivision Plat Westbury
Commons" dated April 24, 2006, drawn by Mark D. Smith, L.S., which plat is attached to
and made a part of that certain Deed of Dedication, Subdivision, Easement, and Conveyance
dated September 13, 2006, of record in die aforesaid Clerk's Office as Instrument No.
060017609 (the "Westbury Open Space").
D. CVS intends to create and impress certain easements upon certain portions of the
CVS Parcel, as more particularly described herein and on that certain plat titled "Easement
Plat CVS 5750 VA, L.L.C., a Delaware Limited Liability Company" dated November 20,
2008, drawn by Elliott Ritchie, Jr., L.S., a copy of which is attached hereto and incorporated
herein by reference as if set out in full (the "Easement Plat").
E. CVS intends to vacate that certain existing right of way located along the southern
side of North Frederick Pike on the Hassinger Parcel which right of way was reserved for the
benefit of the CVS Parcel in a deed recorded in the Clerk's Office of the Circuit Court of
Frederick County, Virginia in Deed Book 510 at Page 573 (the "Vacated Easement"), as
more fully set forth hereinafter.

NOW, THEREFORE, WITNESSETH: That for and in consideration of the premises
conveyed, and other good and valuable consideration deemed adequate at law, the receipt
and sufficiency of which is hereby acknowledged, the parties do agree as follows:
1. The Recitals are incorporated herein and made a material part hereof as if set out
in full.
2. CVS hereby grants and conveys unto FCSA that certain permanent, appurtenant
and perpetual water line casement located along the eastern side of Westrrrinster Canterbury
Drive, designated as "Water Easement Hereby Created" on the attached Easement Plat
("FCSA Easement #1" ). In addition, CVS hereby grants and conveys unto FCSA that
certain permanent, appurtenant and perpetual water line easement located along the southern
side of North Frederick Pike (U. S. Route 522) designated as ' 8' x 10' Water Easement
Hereby Created" on the attached Easement Plat ("FCSA Easement #21'). FCSA Easement
#1 and FCSA Easement #2 are sometimes hereinafter collectively referred to as the "FCSA
Water Easements". The FCSA Water Easements conveyed herein grant unto FCSA the
perpetual right to install and maintain an underground water line and above -ground hydrants
and fixtures, including the right to go on, over and upon the said permanent easements for the
purpose of maintaining, repairing and replacing the same as needed. CVS shall retain the
right to use the land which is subject to the FCSA Water Easements acquired herein in any
manner which shall not interfere with the use and enjoyment of said rights by FCSA. CVS
shall at all times have the right to cross over and upon the said FCSA Water Easements and
to use the surface over the FCSA Water Easements in such manner as will neither injure nor

interfere with the operation or maintenance of the water lines, except that no building or
other structure shall be erected over the FCSA Water Easements unless by mutual consent of
CVS and FCSA or their successors; provided, however, that fences, streets or parking areas
and improvements ancillary thereto shall be permitted. Whenever the enjoyment of its rights
hereunder requires FCSA to disturb the surface over the FCSA Water Easements, it shall be
the obligation of FCSA to restore the same to its condition prior to being so disturbed, at
FCSA's sole cost and expense.
3. CVS conveys to the Commonwealth that certain permanent, appurtenant and
perpetual storm drainage easement, designated as "20' Storm Drainage Easement Hereby
Created" on the attached Easement Plat (the "VDOT Easement"). The VDOT Easement
herein conveyed shall grant unto the Commonwealth the perpetual right to install and
maintain underground pipes for purposes of storm drainage, including the right to go on, over
and upon the said VDOT Easement for the purpose of maintaining, repairing and replacing
the same as needed. CVS shall retain the right to use the land which is subject to the VDOT
Easement acquired herein in any manner which shall not interfere with the use and
enjoyment of said rights by VDOT. CVS shall at all times have the right to cross over and
upon the said VDOT Easement and to use the surface over the VDOT Easement in such
manner as will neither injure or interfere with the operation or maintenance of underground
storm drainage lines, except that no building or other structure shall be erected over the

VDOT Easement unless by mutual consent of the parties or their successors; provided,
however, that fences, streets or parking areas and improvement ancillary thereto shall be
permitted. Whenever the enjoyment of its right hereunder requires the Commonwealth to

4. CVS conveys to Westbury the non-exclusive right to use that certain storm
drainage easement designated as "10' Storm Drainage Easement Hereby Created" on the
attached Easement Plat, as the same may be located, relocated or reconfigured by CVS from
time to time (the "Westbury Drainage Easement"). The Westbury Drainage Easement
conveyed herein grant unto Westbury the perpetual non-exclusive right to use in common
with CVS and others an underground storm water drainage line as the same is installed and
maintained by CVS. CVS shall retain the right to use the land which is subject to the
Westbury Drainage Easement acquired herein in any manner which shall not interfere with
the use and enjoyment of said rights by Westbury. CVS shall at all times have the right to
cross over and upon the said Westbury Drainage Easement and to use the surface over the
Westbury Drainage Easement in such manner as will neither injure or interfere with the use
of an underground storm water drainage line unless air alternative storm water drainage line
or right is provided or obtained by CVS for Westbury.
S. CVS hereby vacates, terminates and forever extinguishes the existing Vacated
Easement, as more particularly described on the attached Easement Plat.

more fully set forth hereinafter. The Hassinger BLA Parcels are designated as "Adjustment
Area #1 - 0.0478 AC" and "Adjustment Area 112 - 0.0390 AC" on the attached BLA Plat.
D. After conveyance of the Hassinger BLA Parcels to Hassinger, CVS intends to
consolidate its remaining lots or parcels of land so as to create that certain lot or parcel of
land containing 2.2640 acres (98,620 square feet), more or less, its more particularly set forth
on the attached BLA Plat, as more fully set forth hereinafter.
E. Upon acquisition of the Hassinger BLA Parcels, Hassinger intends to consolidate
and merge the Hassinger BLA Parcels into the Hassinger Parcel so as to create that certain lot
or parcel of land containing 0.5708 acres (24,864 square feet), more or less, as more
particularly set forth on the attached BLA Plat, as more fully set forth hereinafter.

conveyance of the Hassinger BLA Parcels is made subject to all easements, rights of way and
restrictions of record affecting the subject property; provided, however, that the foregoing

contractor, various County agencies and VDOT prior to initiation of work.
. Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
. Our review and comments are general in nature. Should conditions in the field exist such that
additional measures are warranted, such measures shall be completed to the satisfaction of the
Department.
. All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
. The contractor shall notify VDOT when work is to begin or cease for any undetermined length of time.
VDOT will also require 48 hours notice for inspections.
. The appropriate land use permits shall be obtained before any work is performed on the State's right-
of-way. The permit is issued by this office and will require a minimum processing fee, surety bond
coverage, and the salary & expenses of a State assigned Inspector.
. Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This is
the developer's responsibility.
. Any signs to be installed will be in accordance with attachments and at the VDOT Inspectors direction.
. I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled
completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of any pavement
settlement.
. A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permit. Dedication should be made to the Commonwealth of Virginia.

Dear John:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them for
this site plan.
2) Lot Consolidation and Access Easement. A lot consolidation needs to be done before this site
plan can be approved. The site plan should reflect the consolidated lots. The access easement
also needs to be created before the plan can be approved.
3) Proffers. The proffers from the rezoning need to be provided in the plan.
4) Building Materials. Provide a note about the proffered building materials.
5) Proffered Improvements. Revise the site plan to reflect the GDP from the rezoning.
6) Buffer Plant Type. On sheel3 under the plant list, remove the Forsythia and replace with atwo
inch caliper tree and revise the Dogwood to show a two inch caliper.
7) Landscape Plan Scale. Clarify the scale of the landscape plan.
8) Buffer Length. The buffer length is 540 feet, revise sheet 13.
9) Outdoor Lighting. Details of the site lighting (fixtures) need to be provided in the plan.

Dear John:
I appreciate the briefing that you and Mike Bryan gave me on July 24`I' concerning the
Bubbleworks/ Unger sites.
Subsequently, I have had time to review the full application at the county offices and
discuss it more fully with my engineering consultants, attorneys, and other property
owners in the neighborhood. We feel that consolidating the two properties, currently two
small scale neighborhood businesses and a single family home, is a bad idea. The
proposed building is out of scale with the neighboring single family homes and much too
close. Also, with such a disparity in uses, there should be a transitional use between a
large "big box" retail building and single family detached homes. This plan provides
Ilone.
Another serious concern is the increase of traffic on Westminster- Canterbury Drive. The
older citizens living in the Westminster- Canterbury retirement community already have
a difficult time navigating through this busy intersection. Placing a CVS here would acid
additional traffic, making it substantially more difficult for them.
The existing storm and utility easement on the BUbbleworks site needs to remain. It is
the only direct link to the existing facilities in the Route 522 right of way. The easement
could still serve a valuable purpose in the future and should remain in place. The up-
stream property owners are best served with this casernent.
This application is calling for too much on too small a property. 1t is the wrong place for
this use and completely ignores the interests of the surrounding neighborhood. It makes

You wonder if CVS even cares, when they submit such an aggressive application. This is
not the right site Ior a new CVS. There are other commercial properties up and clown
Route 522 that would not only better serve the needs of CVS, but would not significauti)
impact the existing residential homes. We will actively oppose the rezoning application
and work with our neighbors to ensure that the Planning Commission and Board of
Supervisors agree that it is inappropriate. I sincerely hope that your clients will
reconsider and look at better suited sites. Please ('eel free to contact me with any

4) Adjoining Properties. Label all adjoining properties and ensure that all entrances within 200 feet are
shown.
5) Entrance Spacing. Route 522 is an arterial road with a speed limit more than 35mph and the
spacing is 200 feet front all intersections and driveways. The spacing shown between the new
nce for the Continental Restaurant is far less than what is
entrance for the CVS and the existing entra
required by ordinance. This entrailce cannot be constructed as shown on the plan and the applicant

6) Si na e. The site plan shows a pylon sign at the site entrance. Per the revised sign ordinance, only
freestanding monument signs are permitted. The sign inay be up to 150sf and 25 feet in height as
pleasured from the grade level of the adjacent street to which the land upon the sign is located. Also,
freestanding signs are Iinlited to one per property and this plan shows one pylon and two "CVS"
signs.
7) BRL's and Buffers. Show and label the BRL's and the inactive/active buffer areas.
8) Sidewalk. The sidewalk along Route 522 should be relocated as indicated on sheet 2.
9) Crosswalks. Provide crosswalks as indicated on the plan.
10) Westminster Canterbury Drive. The curb and gutter and sidewalk along Route 1318 should be
extended to the southern property line as indicated on sheet 2.
11) Buffer Fence. The buffer fence needs to be extended to the property lines at each end.
12) Plant Type. On slice] 3 under the plant list, Conlnlon Floweringquincc is not a permitted plant type
and Viburnum is not permitted for screening.

13) Plant Size. On sheet 13, the deciduous trees must be a inininlunl of 2 inch caliper at time of planting.
14) Landscaping Note. Provide the following note: all plantings shall conform with § 165-36B of the
Frederick County Zoning Ordinance (Plant selection, planting procedure, and maintenance).
15) Tree Location. The cleciduous trees need to be provided along the front and side of the project
(522/1318) and not consolidated around two sides of the site. Trecs need to be placed in the parking
lot island and the island adjacent to the building needs to be landscaped, not concrete.
16) Buffer Length. The buffer length is 540 feet, not 510 feet.
17) Buffer Plantings. 'file zoning district needs to have three trees per ten linear feet. Within each ten
foot section, there needs to be two evergreen trees front the approved screening list and one deciduous
tree from the approved list. Clustering the trees and leaving gaps or providing single rows of trees in
some areas is not permitted.
18) Outdoor Lighting. Details of the site lighting (building mounted/pole) needs to be provided in the
plan.

this is to acknowledge receipt of your revised plans dated December 3, 2008 for the referenced project.
The plans appear satisfactory and are approved. Please advise the developer accordingly. Please provide
four (4) sets of approved construction plans with signed seal for VDOT distribution.
i offer the following comments:
. A preconstruction conference be held by -the engineer and/or developer with the attendance of the
contractor, various County agencies and VDOT prior to initiation of work.
. Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
. Our review and comments are general in nature. Should conditions in the field exist such that
additional measures are warranted, such measures shall be completed to the satisfaction of the
Department.
. All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe
or drainage easement.
. The contractor shall notify VDOT when work is to begin or cease for any undetermined length of time.
VDOT will also require 48 hours notice for inspections.
. The appropriate land use permits shall be obtained before any work is performed on the State's right-
of-way. The permit is issued by this office and will require a minimum processing fee, surety bond
coverage, and the salary & expenses of a State assigned Inspector.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This is
the developer's responsibility,
. Any signs to be installed will be in accordance with attachments and at the VDOT Inspectors direction.
. I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled
completely with C.R. Type 21-6 Stone, This will greatly reduce the possibility of any pavement
settlement,
. A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permit. Dedication should be made to the Commonwealth of Virginia,

proposed site plan will not have an impact on operations at the Winchester
Regional Airport. The proposed development does lie within the airport's
airspace however it falls outside of the airport's Part 77 close in surfaces.
