warehouse and reload facility located on 21 acres within the Shawnee Magisterial District.

to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept
for future reference, and an approved copy must be kept on the construction site throughout the

This is to acknowledge receipt of your plans with latest revisions dated 1 /24/08 for the
referenced project. The plans appear satisfactory and are approved. Please advise
the developer accordingly. We have already received sufficient sets of approved
construction plans with signed seal for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with
the attendance of the contractor, various County agencies and VDOT prior to
initiation of work.
• Materials used and method of construction shall apply to current observed VDOT
Road & Bridge Specifications applicable during construction of this development.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along
the street to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for
inspections.
• Land use permits will not likely be required since no work is proposed on VDOT
roadway ROW. If that should change, the appropriate land use permits shall be
obtained before any work is performed on the State's right-of-way. The permit is
issued by this office and will require a minimum processing fee, surety bond

coverage, and the salary & expenses of a State assigned Inspector.
• Any entrances constructed from the referenced street(s) shall meet VDOT
minimum standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with the approved plans and the
Manual on Uniform Traffic Control Devices (MUTCD), 2003 Edition.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way
be backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the
possibility of any pavement settlement.
• A copy of any/all recorded plats of dedication for drainage easements or
additional right-of-way required for implementation of this proposed project
should be provided to VDOT prior to issuance of any land use permit.
Dedication should be made to the Commonwealth of Virginia.
• A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided for VDOT review
prior to issuance of any land use permit.

In response to your comment letter regarding the above referenced project dated August 11, 2008 we offer the
following:
1. Comment: Tree Credits: The landscaping berm located southeast of the property is a
required component of the design, and is in addition to the landscaping
requirements associated with the square footage of the impervious surfaces
on the site. As such, the trees on the existing berm many not be counted
towards a tree credit. Please increase the proposed number of trees to meet
the minimum requirements (a total of 122 trees according to the most recent
impervious surface and parking calculations).
Response: Tile number of trees proposed perimeter trees has been edited as requested.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
ggranted.7 At this time, administrative approval cannot be granted. "i his site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staff's continents listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:

6. Comment: Impervious Surfaces: Gravel areas are counted as an impervious
surface, and perimeter landscaping is required as per County Code
§165-27.E. (11) (a). These required plantings are in addition to those
required in other sections of the County Code.
Response: The landscaping calculations have been done to include all gravel areas as
impervious. Please note that we are asking for credits for the existing trees
along the landscape berm to the southeast of the site. With these credits, we
are proposing 60 more trees than is required for perimeter landscaping.
Please reference the computations on the Landscaping Plan for more details.
7. Comment: Outdoor Storage: As per County Code §165-33, all outdoor storage
must be screened with berm, board on board fence, or six-foot
evergreen trees.
Response: A six foot board on board fence has been added to the perimeter of the
project to allow for outdoor storage.
8. Comment: Berm Details: Include a detail of all proposed buffers and berms,
including the berm along the CSX railroad screening the site from the
residential properties.
Response: There are no proposed berms associated with this plan. The existing berm
with landscaping buffer has also been labeled as such and landscaping plan
edited for clarity.
9. Comment: Rail Spur: Clarify the location of the proposed rail spur and tie-in to
the CSX line by using a bold version of the railroad track symbol. Also,
if the existing rail spur is to be removed or abandoned, include a note
on the plan to that affect.
Response: The layout and linetypes of the proposed and existing rail have been
designed per CSR's directive. A look at the Rail Spur Profile Sheets may
help in clarifying of the proposed tie-in placement. There is no existing rail
spur related to this site.
10. Comment: Sidewalks: Include a sidewalk along the parking lot, and to the
warehouse office entrance. Space on both sides of the sidewalk should
be grass with landscaping. Crosswalk striping should be shown as
marked on plans.
Response: A crosswalk, sidewalk and associated grass areas have been added to the
plans in accordance.
11. Comment: Gravel Areas: Include a four foot strip of grass along the northeastern
side of the driveway connecting the two parking areas. On the
southeastern side, include at a minimum, a four foot grass strip between
the road and the sidewalk, and another four foot strip of grass between

the sidewalk and the beginning of the gravel lot to assure safe refuge for
pedestrians, and better control of internal vehicular traffic.
Response: Grass areas have been added as requested. Please note that all newly
proposed grass areas or twenty feet or wider.
12. Comment: Loading Areas: Loading areas may have a gravel surface as long as
only two such areas are proposed and both are separate from the
parking area (Frederick Comity Code §165-28.B.(4)). The three
proposed loading spaces along the front of the building niust have a
paved surface. lIowever, since they are separate from the parking area,
curb and gutter will not be required.
Response: After meeting with the client, much of the architecture of the building has
been edited. Several man doors and one loading space has been eliminated
as shown on the updated plans.
13. Comment: Traffic Movement: Include one-way arrows and stop bar on the
pavement along the front parking area as marked on the plans.
Response: All areas have been designed to allow for a two way movement. A stop bar
at either end has been added for clarity.
14. Comment: Curbing Details: In addition to the paving details shown on sheet 16,
include details for curbing referenced in the plan. Note that the curb
and gutter is required around the parking areas.
Response: Typical VDOT CG-6 Detail has been added to the plans as requested.
15. Comment: Landscaping: Indicate graphically the location of any existing trees to
be kept. Consider landscaping between gravel lots and sediment basin.
Response: The existing landscape buffer has been labeled as requested and proposed
tree line is now shown. All existing buffer trees are to remain in place. While
landscaping between the lots and the sediment basin would have been
acceptable per the original plan, edits to the length of the track and the
associated grading now make this option unfeasible.

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. Thus
site plan is denied until the issues in this letter, as well as all issues of the other review
agencies, have been adequately addressed. Please review Staff s comments listed below
and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1. Parcel Information: Include parcel information for the CSX property and the parcels
identified as Lots 2 and 5.
2. Building Restriction Lines: Show the property's Building Restriction Lines graphically
and include label.
3. Limits of Clearing and Grading: Show the limits of clearing and grading graphically
and include label.
4. Frogale Court: Include note stating posted speed limit on Frogale Court.
5. Legal References: Provide legal information for all existing easements.

County Fire Marshal, and the Frederick County Sanitation Authority.

Buildings shall comply with The Virginia Uniform Statewide Building Code and Sections 311,
(S Storage) and Section 304 (B Business) of the International Building Code/2003. Other Code
that applies is ICC Al 17.1-3-03 Accessible and Usable Buildings and Facilities. Accessible
parking and signage per USBC 1106.8.
All construction shall meet T503 and T601/T602 of the International Building Code. Proposed
47331 sq ft office/warehouse is totally sprinkled as required (per site plan). Egress doors shown,
as well as area of refuge noted as required. Wall ratings shall extend 10' in all directions of
landing. Storage and business area FF are accessible. Accessible Van parking as required.
Signage per USBC 1106. Accessible route to entrance from parking appear to be accessible as
required.
Engineer design required for slabs if fill exceeds 24" of clean sand or gravel or 8" dirt. Plan
indicates fill in excess of 5' under slab.
Special inspection requirements of Chapter 117 of IBC shall apply to this type of structure. (soils,
concrete, compaction, steel etc.)
