was getting ready to expire. Mark said to make him a copy of the site plan and charge
him. I also made another copy of site plan for department. Mark Cheran resigned both
site plans giving them another S year before expiring.

This is to acknowledge receipt of your revised plans dated August 18, 2008 for the
referenced project. The plans appear satisfactory and are approved. Please advise the
developer accordingly. The provided two sets of approved construction plans with signed
seal are sufficient for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
• Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to
the satisfaction of the Department prior to inclusion into the Secondary Road System.
See attached plan approval attachments.
All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.

• At this time a Land Use Permit will not likely be required since the roadway is not yet
accepted in the State secondary system. If conditions change, the appropriate land
use permits shall be obtained before any work is performed on the State's right-of-
way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector.
• Any signs and markings (i.e., 30x30 stop sign and 24" thermoplastic stop bar) to be
installed will be in accordance with the MUTCD 2003 Edition and at the VDOT
inspector's direction.

I have reviewed the FAA's determination regarding the prol:T,D::,E:d building/warehouse for K. P. Realty,
Muskoka Court. According to the FAA, the proposed building will not be a hazard to air rT 3vigation
therefore it is not a requirement to light the proposed structure with obstruction lights.
Please note that any changes in the maximum height of thirly-five (35) feet AGL or 760 fleet AMSL as
submitted to the FAA, would require a separate review by this office and the FAA. This would include
any/all appurtenances (i.e. HVAC systems, antennas, vent �;tac:ks, etc) that would exceei. the height
previously listed.
In addition, the determination study does not include any temporary construction equipment such
as cranes, derricks, etc. that exceed the submitted height:. The LISO of equipment dul ing
construction requires a separate 7460-1 to be filed with the :AA with a copy forwarded to this office for
record and to ensure compliance by the contractor.

The Federal Aviation Administration has conducted an aeronautical study under the provisio is of 49 U.S.C.,
Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerr ing:

This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking
and/or lighting are accomplished on a voluntary basis, we recoiiimend it be installed and maintained in
accordance with FAA Advisory circular 70/7460-1 K Change 2.
This determination expires on 01/02/2010 unless:
(a) extended, revised or terminated by the issuing office.
(b) the construction is subject to the licensing authority of the Federal Communications Commission
(FCC) and an application for a construction permit has been filed, as required by the FCC, within
6 months of the date of this determination. In such case, the determination exl,ires on the date
prescribed by the FCC for completion of conshuction, or the date the FCC denies the application.
NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETEnA 'INATION
MUST BE POSTMARKED OR DELIVERED TO THIS OFFICE AT LEAST 15 DAYS PRIOR TO THE
EXPIRATION DATE.
This determination is based, in part, on the foregoing description which includes specific coordinates, heights,
frequency(ies) and power. Any changes in coordinates, heights, and frequencies or use of greater power will
void this determination. Any future construction or alteration, including; increase to heights, dower, or the
addition of other transmitters, requires separate notice to the FAA.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staff's comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments
1. Special Limited Power of Attorney Form. The Power of Attorney form was not attached to the
revised site plan submission.
2. Parking Spaces. The parking spaces at the side of the building do not meet County requirements.
The spaces need to be paved and have curb along the front of the spaces as well (not wheelstops).
3. Outdoor Storage. An outdoor storage lot needs to be screened by a six foot board- on -board fence
or by a double row of evergreen trees around the fence. A chain link fence covered by fabric does
not qualify as screening.
After you have revised the site plan, please resubmit two copies so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for approval. Comment sheets are required from the following agencies: the Frederick
Comity Itrspections Department, the Frederick County Department of Public ff orks (County Engineer),
the Frederick County Sanitation Authority, the Virginia Department of Transportation and the An7-)ort
Authority.

We received your comments dated April 7, 2008 and have addressed each one as listed
below:
The Power of Attorney form has been completed and is attached.
2. The site data has been revised as noted on the cover sheet.
3. The cover sheet now states that the proposed uses must be permitted within
the M1 zoning district under number 1 and number 5 of the general notes.
4. The parking calculations show the required number of parking for warehouse
use just below the required office use parking. There will be one warehouse
employee therefore the total required parking, as shown, is 13 spaces.
5. The parking area on the side of the building is now shown as paved with a
curbed island at the end now shown on sheet 2.
6. The proposed edge of pavement is now labeled on sheet 2.
The outdoor storage area is enclosed by an 8 foot high chain link fence with
an opaque fabric covering over it. The same will be used for the gates as
shown on sheet 2.
The lighting details and locations are now shown on sheet 2.
9. The deed book and page numbers are shown on all existing on site JUIL 2008
easements.

erosion problems such as steep fill slopes, in addition address stabilization of SUCK areas.
3. All slopes that are steeper than three horizontal feet to one vertical foot will require a
slope stability analysis performed by a Clualified gcotechnical engineer. Please note that
the slope stability analysis will be required prior to land disturbance permit approval.
ShOuld grading changes be required in order to achieve slope stability after site plan
approval, a revised site plan will be required prior to granting a land disturbance permit.
