1. Property Ownership. The site plan states that the property owner- is
Winchester Sonic but the property has not changed hands and is still owned
by WIN, LLC. The property will have to transfer to Winchester Sonic before
the site plan can be approved.
Acknowledged.
2. Si na e. The Master Development Plan for the property prohibits
freestanding signs along Route 7; only buildlllg mounted signage can be
utilized. Remove the freestanduig sign shown on the site plan.
We have eliminated the sign along Route 7.
3. Parking Spaces. The site plan states that there are 47 parking spaces, only 44
are shown.
There are 44 parking spaces provided (25 spaces required).
4. Adjoining Propene . The adjacent property is vacant.

from commercial to vacant.
5. Sidewalks and Crosswallss. Shade the sidewak along the private road,
provide handicap ramps at the entrance and provide a crosswallc. The private
road needs to be labeled as well.

10. Shrubs/Parking Screening. The gap In the shrubs Indicated on the
landscaping plan needs to be filled in.

This is to acknowledge receipt of your plans dated 12/07/07 for the referenced
project. The application for site plan for this property appears to have significant
measurable impact on Route 7, the VDOT facility which would provide access to the
property. Estimated traffic for the site is included within the overall Traffic Impact
Analysis (TIA) dated 6/17/05. Present entrance is adequate for proposed improvements.
Should business ever expand in the future, entrance may need to be upgraded.
The plans appear satisfactory and are approved. Please advise the developer accordingly.
Please provide 2 sets of approved construction plans with signed seal for VDOT
distribution.
I offer the following comments:
* A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
* Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department.
* The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections
No VDOT land use permits will likely be required since no work is shown on any VDOT
roadway ROW. Should there be any impact on the adjoining Route 7, the appropriate land use
permits shall be obtained before any work is performed on the State's right-of-way. The
permit is issued by this office and will require a minimum processing fee, surety bond
coverage, and the salary & expenses of a State assigned Inspector.
x A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation
of this proposed project should be provided for VDOT review prior to issuance of any land
use permit.

The above -referenced site plan was approved on March 24, 2008. The site plan is approved for the
construction of a new 1,728 square foot Sonic restaurant located on Gateway Drive off of Berryville Pike
(Route 7) in the Winchester Gateway Development. Required site improvements include the following:
Construction of a parking lot with 44 spaces (including two handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
A screened dumpster area.
Landscaping as shown on sheet 4 of the plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with four (4)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is

This is to acknowledge receipt of your plans dated 12/07/07 for the referenced
project. The application for site plan for this property appears to have significant
measurable impact on Route 7, the VDOT facility which would provide access to the
property. Estimated traffic for the site is included within the overall Traffic Impact
Analysis (TIA) dated 6/17/05. Present entrance is adequate for proposed improvements.
Should business ever expand in the future, entrance may need to be upgraded.
The plans appear satisfactory and are approved. Please advise the developer accordingly.
Please provide 2 sets of approved construction plans with signed seal for VDOT
distribution.
I offer the following comments:
A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.

satisfaction of the Department.
The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections

This office has received the request for a preliminary design review. Unfortunately our office
does not do preliminary reviews. The IIealth Department does require a Plan Review for the
Sonic to be located at Gateway, Winchester, VA. This letter is to inform you that the information
listed below must be received by the Frederick County IIealth Department no later than 30 days
prior to the facility opening. It also serves to notify you that before issuing a food service permit
for the facility the following must be completed:
1. Complete application received and plan review. As well as an $80 fee must be
paid "$40 for permit and $40 for plan review fee."
2. A complete list of food suppliers and vendors must be submitted "this may be
given to the Environmental IIealth Specialist at time of construction inspection".
3. Water supply and sewage information "letter or bill" stating the facility is on
public water.
4. Our office must receive a site plan and floor plan.
5. Information regarding floor, wall, and ceiling material.
6. A copy of the menu.
7. Trash and/or grease disposal method.
8. Model #'s and Specifications sheets of all equipment "Commercial."
9. Insect and rodent control information.
10. A member of our office must conduct a construction inspection sometime during
the final stages of construction of the restaurant. A representative from this office
may stop by to make sure things are going according to plan.
11. At least one week before opening the establishment, a member of our office needs
to perform a pre -opening inspection. Any violations found during this inspection
need to be corrected before a permit can be issued.
12. Our office must receive a copy of the Certificate of Occupancy as issued by the
Building Department.

In order to obtain a permit to operate a food- service establishment, the following items must
be submitted to the -local health department (see address list) for review and approval:
1. Application: A completed copy of the Commonwealth of Virginia Application for a Department of
Health Permit.
2. Construction plans and specifications: A copy of the construction plans and specifications (refer to
General Construction Guidelines for Food Service Establishments) along with a -$40 non-refundable
plan review fee. Plans submitted must -be complete as described ;in. this publication. Plans that are
incomplete or illegible willbe returned to the applicant for correction.
3. Menu: A copy of the food establishments proposed menu including state of delivery of food items.
(example: chicken breasts, frozen breaded patties; shrimp, fresh; slaw, preshredded, etc.)
4. Equipment list: (cut sheets) explaining the type, model, and specifications of equipment.
STEPS IN THE PLAN REVIEW PROCESS INCLUDE:
1. Plans and all attached materials will be reviewed by the Health Department, allow approximately 14 to
30 working days review of the plans depending upon the complexity of the proposed facility and follow-
up required.
2. The Health Department during' or following the plan review period may request a Plan Review
Conference. This is an opportunity for the Health Department to present necessary changes or additions
in the construction plans as proposed as well as "trouble shoot" the anticipated needs of the food service
establishment. This is a menu -specific process that may assist you in avoiding operational difficulties in
the future.
3. The Health Department may require pre -construction inspection of the facility. This also applies to
facilities that are being remodeled and may be done as part of the plan review. process.
4. All review comments. and required changes will be returned to the applicant by certified mail, (Note: Be
certain the Health Department has your correct mailing address).
5. A construction inspection will be conducted during the construction phase. Any additions or changes
in proposed plans must be submitted to the Health Department for approval as they occur.
6..A final inspection will be conducted -prior to opening for business after a Certificate of Occupancy has
been issued by the local Building Official. A permit fee of $40 is required prior to opening. Upon
satisfactory completion of the Health Department inspection, the establishment will -be issued a permit
and allowed to open.
7. The Annual Food Service Permit will not be issued to newly constructed or extensively remodeled
establishments until the Building Official has issued a Certificate of Occupancy. A copy of the
Certificate of Occupancy shall be. forwarded to the Health Department.

Plamiing Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Property Ownership. The site plan states that the property owner is Winchester Sonic, but the
property has not changed hands and is still owned by WIN, LLC. The property will have to
transfer to Winchester Sonic before the site plan can be approved.
2) Signage. The Master Development Plan for the property prohibits freestanding signs along
Route 7; only building mounted signage can be utilized. Remove the freestanding sign shovm on
the site plan.
3) Parking Spaces. The site plan states that there are 47 parking spaces, only 44 are shown.
4) Adjoining Property. The adjacent property is vacant.
5) Sidewalks and Crosswalks. Shade the sidewalks along the private road, provide handicap
ramps at the entrance and provide a crosswalk. The private road needs to be labeled as well.
6) Informational Signs. Label signs for the drive-thru and provide the height and size of each.
7) Outdoor Seating/Canopy. Label the seating area/canopy as indicated on sheet 2.
8) Landscaping Plan. The site requires 17 deciduous trees and the landscaping plan only accounts
for 12.
9) Tree Locations. There are trees shown on the landscaping plan that are in the pavement as well
as near light posts.
10) Shrubs/Parldng Screening. The gap in the shrubs indicated on the landscaping plan needs to be
filled in.

December 18, 2007
Project Description
The purpose of this project is to develop a site for a new restaurant building in the Winchester Gateway
shopping area. This site is located on Route 7 East of Winchester in Frederick County, Virginia.
Construction will consist of a 1,728 sq. ft. restaurant building, the necessary parking, and sediment
control measures. The parcel is a total of 0.9 acres and 0.84 parcel will be disturbed during
construction. The total impervious area created by this development will be 0.62 acres.
Existing Site Conditions
Current slopes range from 1 to 7 percent. There are existing curb and gutter at the northern boundary
of the site and an entrance to the site. There is an existing retaining wall along the southern boundary
of the site. The drainage areas of the pre and post -development can be seen in the Culvert Calculations
attaclunent and also on the site plan. Both the existing and proposed slopes of the site slope toward the
southeast corner. The existing slopes of the site will help to reduce erosion on to adjacent properties.
Currently, the site is a vacant lot that was created as part of the master development of the Winchester
Gateway Shopping area.
Adjacent Areas
The adjoining property to the east, west, and north is also zoned B-2, all of which have very similar
terrain characteristics as this site. The adjoining property to the south is VA Route 7 (Berryville Pike)
zoned RA and consist of residential dwellings. Details of the ownership of areas adjacent to the
developers land are shown on the plans. The undeveloped area to the west is currently drained toward
the southwest corner of the site and then to the east. E&S Controls will be place as shown on the plan.
Offsite Areas
No Off -site areas will be disturbed by the development of this site.
Soils
The main onsite soil groups located on this site are 9B Clearbroolc Channery Silt Loam and 41D
Weikert-Berk Charulery Silt Loam. This soil information can be seen on Sheet 3 of the site plan.
Clearbroolc Chamlery Silt Loam soils are moderately deep, somewhat poorly drained. The surface layer
consists of 3 inches of dark brown chamrery silt loam. The subsoil, from 7 to 23inches is very
channery silt clay loam. The depth to soft shale bedrock is about 27 inches. These soils have a
moderate erosion hazard. These are in the hydrologic soils group D.
41D Weikert-Becks channery silt loam soils are moderately deep, well drained, and have slow runoff.
The surface layer consists of 3 inches of silt loam. The subsoil, from 3 to 16 inches is extremely
charmery silt loam. The depth to acid shale bedrock is about 15 to 30 inches. These soils have a severe
erosion hazard. These soils are in the hydrologic soils group C and D
Critical Areas
There are currently no critical areas associated with this site.

Erosion and Sediment Control Measures
1.0 General
1.1 Description:
A. Work Included: Erosion and sediment control operations and devices required for this work are
indicated on the drawings and include but are not necessarily limited to:
1. Installation of temporary control devices;
2. Maintenance of temporary control devices;
3. Temporary forms of stabilization;
4. Installation of permanent control devices;
5. Removal of devices and site restoration.
1.2 Standards:
A. The following codes and standards, latest editions form a part of this specification, to the extent of
all provisions applicable to the work required for this project, and as specifically referenced
herein.
1. All work shall comply with the Virginia Erosion and Sediment Control Handbook and as
amended by local codes and regulations.
2. VDOT Specifications and Standards.
1.3 Protection:
A. Use all means necessary to protect all materials incorporated into the work of this section before,
during and after installation. In the event of damage, immediately make all repairs and
replacements necessary to the approval of the Owner's Representatives and at no additional cost to
the Owner.
B. Maintain and protect all benclunarks, monuments and similar reference points and, if they are
displaced or destroyed by these operations, replace same as directed at no additional cost to the
Owner.
1.4 Permits:
A. The owner will secure certificates and permits and pay for all fees required by local codes and
regulations. The contractor shall ensure that value of the erosion and sediment control work to
include maintenance and all seeding of disturbed areas shall be included in the overall project
performance bond.
2.0 Execution
2.1 General Requirements:
A. Limit grading to only those areas involved in current construction activities. Limit length of time
for exposure of unprotected graded areas. Permanent stabilization of graded areas shall be done
within seven days after construction. If permanent stabilization cannot be provided, temporary
seeding, mulching or other forms of stabilization shall be provided.
B. Construction of the devices shall agree with the details shown on the plan subject to modifications
thereof that the Inspector deems advisable. Regardless, the sediment control devices shall comply
with all requirements of the Virginia Erosion and Sediment Control Handbook. They shall remain
in place until all surfaces within the project are stabilized such that siltation will not occur; i.e., all
upstream areas from the control devices have vegetation established, mulch in place or furnished

pavement completed. All temporary erosion and sediment control measures shall be removed
within 30 days after final site stabilization or after the temporary measures are no longer needed,
unless otherwise authorized by the local program authority. Trapped sediment and the disturbed
soil areas resulting from the disposition of temporary measures shall be removed off site or
permanently stabilized to prevent further erosion and sedimentation (4VAC50-30-40 Minimum
Standard No. 18).
C. The Contractor agrees to hold the Owner or any of its agents harmless from any and all liability or
damage that may arise from a violation of the siltation ordinance and agrees to indemnify them
against any loss.
D. Underground utility lines shall be installed in accordance with the following standards in addition
to other applicable criteria (4VAC50-30-40 Minimum Standard No. 16):
1. No more than 500 linear feet of trench may be opened at one time.
2. Excavated material shall be placed on the uphill side of trenches.
3. Effluent from dewatering operations shall be filtered or passed through an approved sediment
trapping device, or both, and discharged in a mariner that does not adversely affect flowing
streams or off -site property.
4. Restabilization shall be accomplished in accordance with these regulations.
5. Applicable safety regulations shall be complied with.
E. Soil Stabilization: Permanent or temporary soil stabilization shall be applied to denuded areas
within seven days after final grade is reached on any portion of the site. Temporary soil
stabilization shall be applied within seven days to denuded areas that may not be at final grade but
will remain dormant (undisturbed) for longer than 30 days. Permanent stabilization shall be
applied to areas that are to be left dormant for more than one year (4VAC50-30-40 Minimum
Standard No. 1).
During construction of the project, soil stockpiles and borrow areas shall be stabilized or protected
with sediment trapping devices (i.e., silt fence). Contractor is responsible for the temporary
protection and permanent stabilization of all soil stockpiles on site as well as borrow areas and soil
intentionally transported from the project site (4VAC50-30-40 Minimum Standard No. 2).
Stabilization measures shall be applied to earthen structures such as dams, dikes, and diversions
immediately after installation (4VAC50-30-40 Minimum Standard No. 5).
Permanent Stabilization: A permanent vegetative cover shall be established on denuded areas not
otherwise permanently stabilized. Permanent stabilization shall not be considered established
until a ground cover is achieved that, is uniform, mature enough to survive and will inhabit
erosion (4VAC50-30-40 Minimum Standard No. 3).
Permanent Stabilization: All disturbed areas not paved will receive at a minimum 4" of topsoil if
required (see Topsoiling STD &SPEC 3.30) and be seeded as follows:
125 lbs. Minimum of three (3) up to five (5) varieties of bluegrass from the approved list for
use in Virginia.
20 lb. Amrual Rye per ac.
1000 lbs. 10-20-10 Fertilizer per ac.
3 tons agricultural limestone per ac

Permanent seeding will occur as a final phase of construction.
Temporary Stabilization: Seeding to stabilize areas left denuded for more than seven days, but not
yet at final grade shall be as follows:
60 lbs. German Millet per ac. (May through August 15)
60 lb. Annual Rye per ac. (August 15 through April)
450 lbs. 10-20-20 Fertilizer per ac.
3 tons agricultural limestone per ac
2 tons straw mulch per ac.
Seeded areas to be watered and cared for as necessary to provide grass emergence.
F. Description of Controls:
Control will be exercised through sequence of land disturbing operations, limiting duration of
exposure of unstabilized areas and installation and maintenance of physical control devices
coordinated with sequence of construction. Details for the standards referenced below are
included on the plans. The devices to be used on the site are also shown on the drawings and
include the following:
1. Construction entrances - (STD & SPEC 3.02) There is a high potential for tracking mud on to
adjacent roads during wet site conditions. Construction entrances are needed at the location
shown on the plans to clean the tires of vehicles and equipment exiting the job site.
2. Silt Fence - (STD & SPEC 3.05-2) Silt fencing shall be placed along the down -slope side to
filter sediments before runoff exits the construction area.
Stornn Drain hilet Protection- (STD &SPEC 3.07) Storm drain inlet protection shall be
installed immediately following installation of stormwater controls or prior to construction
activities for existing storm drains, to prevent sediment from entering the storm drains
G. Sequence of Land Disturbing Activities:
1. General: All applicable mechanical controls are to be constructed as the first item of work.
Following their completion, rough grade, finish grade, and install appropriate erosion and
sedimentation aids. Before newly constructed stormwater conveyance channels or pipes are
made operational, adequate outlet protection and any required temporary or permanent channel
lining shall be installed in both the conveyance channel and receiving channel (4VAC50-30-40
Minimum Standard No. 11). Retain control devices until final stabilization of all areas or as
directed by the Inspector.
Sequence of Construction:
a. First Phase:
1. Construction entrance;
2. Install inlet protections at existing structures 3, 4, 5
3. Install structures 1 & 2;
4. Install culverts 1 & 2;
5. Install silt fence, where applicable.
b. Second Phase:
1. Rough grade
2. Install utilities.

H. Maintenance Program: All control measures are to be inspected daily by the site superintendent
or his representative. Any damaged structure should be repaired at the close of the day. Inlet
protection devices and silt fencing should be cleaned at 50% capacity and spread on -site where
practical. Control structures shall not be removed until all areas above have been finally
stabilized and seeded areas established. No control shall be removed without the site
inspector's prior approval. The daily control measure inspections by the contractor shall be
documented to indicate findings and corrective action taken. These reports shall be submitted
to the authorities once every two week's basis. Where sediment is transported onto a paved or
public road surface, the road surface shall be cleaned thoroughly at the end of each day.
Sediment shall be removed from the roads by shoveling or sweeping and transported to
stockpile areas. Street washing shall be allowed only after sediment is removed in this manner.
(4VAC50-30-40 Minimum Standard No. 17).
3.0 Stormwater Management:
All new on -site storm structures have been sized to pass the post development 10-year storm event
using the Rational Method. Storm sewer and inlet sizing calculations are provided in Attachment B.
The site drains through a series of culverts to an existing 7'X7' box culvert under VA Route 7. The
culvert design calculations can be found in Attachment B of this report. The stornwater management
calculations for the site is part of Winchester Gateway shopping center and can be found in
Stormwater Management Report for Winchester Gateway prepared by Greenway Engineering dated
May 5, 2005. The Winchester Gateway storrnwater management calculations demonstrated the peals
runoff from this site precedes the peals runoff the 484 acres upstream enough that the peak at the 7'X7'
box culvert is not increased. Therefore no additional detention is required.

We've prepared plans for Sonic at Winchester Gateway, which will be located north of VA Route 7 (Berryville
Road), approximately 0.3 miles east of exit 315 Intelstate 81, Winchester, Frederick County. The site will include
a 1,720 square foot commercial restaurant building with the required amount of parEng. The total disturbed
area for this site is 0.9 acres. The Developer- plans to begin work ii spring 2008.
The project site will drain through a series of storm inlets and culverts to a small on -site SWM pond and outfall
to the existung twin 7' x7' box culvert under VA Route 7. The stormwater management for the project site is
part of Winchester Gateway Stormwater Management calculation report prepared by Greenway dated May 5,
2005.
