The above -referenced site plan was approved on May 28, 2008. Tile site plan is approved for the
construction of a new 4,227 square foot Chick-fil-A Restaurant at the Rutherford Crossing Development
located on Martinsburg Pike in the Stonewall Magisterial District. Required site improvements include
the following:
Construction of a parking lot with 60 spaces (including three handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
Sidewalks as indicated on the plan.
One loading space, a screened dunlpster area and landscaping as indicated on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments front all relevant review agencies. 1 am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Dear Ms. Perkins:
On behalf of our client, Chick-fil-A, please find our responses to the comments provided by your office for the
above referenced project on February 26, 2008. The comments have been addresses and responded to as follows:
Comment 1: The site plan references property identification number 43-A-100; our records indicate that this
building is on 43-A-101 E. Indicate if further subdivision is necessary for this site so that Chick-
fil-A is located on a separate lot. If so, the subdivision needs to be completed before the site
plan can be approved. If the property is proposed to be leases, the ownership provided on the
site plan application and the plan is correct.
Response 1: Lot is not to be subdivided. The property identification number has been revised to read 43-A-
101 E. The property is to be leased. The property owner information has been revised to reflect
the information on the Power of Attorney Form.
Comment 2: Please have the property owner sign the attached Special Limited Power of Attorney Form prior
to further review or approval. This form should be notarized and completed to grant the
applicant (you) with authorization to represent them for this site plan.
Response 2: The Power of Attorney Form has been completed and included in this package.
Comment 3: The proffers need to be included in the site plan.
Response 3: Proffers have been included in the site plan set on sheet C-4.4.
Comment 4: The sheets included in the submission were backwards from the index on the coversheet.
Response 4: Sheets included in submission have been reversed and are in the correct order per the original
sheet index.
Comment 5: On Sheet 2, note F needs to be revised to state that a certificate of occupancy will not be
provided by Frederick County unless the plants are installed or a monetary guaranty has been
provided for the landscaping.
Response 5: "file requested note regarding the certificate of occupancy has been provided on sheet 1.1,
Section F- Plant Material, Note IX.
Comment 6: On Sheet 2, notes need to be provided that state (1) All planting shall conform with 165-36B of
the Frederick County Zoning Ordinance (Plant selection, planting procedure, and maintenance),
and (2) Any plant substitutions must be approved in writing by Frederick County Planning
Department.
Response 6: The requested note specifying all plant material work must conform with section 165-36B has
been provided on sheet 1. 1, Section — Scope of Work, Notes A & B.

Comment 7: The landscaping needs to be broken up into sections for clarification. The required interior and
perimeter landscaping need to be provided under one section; the Route I 1 buffer landscaping
needs to be provided under another section. All other ornamental landscaping provided in
addition by chick-fil-A needs to be under another section.
Response 7: The landscape schedule has been revised and broken out specifying the plant material used to
comply with ordinance requirements and additional landscaping that has been provided. Please
see sheets L-1.0 and L-1.1.
Comment 8: All evergreen shrubs for parking space screening need to be 36 inches in height at time of
planting.
Response 8: The landscape schedule has been revised to reflect the required height of 36" for the evergreen
shrubs screening the parking lot.
Comment 9: Evergreen shrubs need to be provided as indicated on sheet L-1.0.
Response 9: Evergreen shrubs have been provided and are the required 36" height.
Comment 10: Label the berm along Martinsburg Pike.
Response 10: The berm along Martinsburg Pike has been labeled as requested. Please sec sheet C-3.0.
Comment 11: On sheet T-1.0, details of all lighting being proposed with the site need to be shown. Also, the
lighting note needs to be revised to state the following: All outdoor lighting must be shielded to
prevent glare onto adjoining properties and road right -of --ways.
Response 11: Lighting note has been revised to read: All lighting must be shielded to prevent glare onto
adjoining properties and road right-of-ways. Proposed lighting fixture details have been added.
Please see sheet T-1.0.
Comment 12: On sheet C-4.1, the detail for the refuse enclosure needs to be provided.
Response 12: The refuse enclosure foundation detail is shown on sheet C4.1.
Comment 13: On sheet C-2.0 under general notes, the following needs to be revised: note 4 needs to be
completed before the site plan can be approved, the front setback (south) minimum is 50 feet,
not 35 feet, and the minimum one-way driving lane is 12 feet, not nine feet. A note needs to be
provided that states: All utilities must be underground.
Response 13: Required setback numbers have been revised per reviewers comment. Also a note has been
added to the plans stating all utilities must be underground (note 11, sheet C-2.0).
Comment 14: The parking area adjacent to McDonald's does not match what is on the McDonald's plan or the
original approved site plan. The Chick-fil-A shows curb and gutter around the spaces, but the
other plans show these spaces connecting. Sec the highlighted area on sheet C-2.0.
Response 14: The proposed curb and gutter has been shifted so no improvements have been shown on the
McDonald's property. This design has been approved by the developed as an acceptable
resolution.
Comment 15: A landscape island is required at the end of all parking bays. An island need to be provided as
indicated on sheet C-2.0.
Response 15: A 5 foot landscape island has been added to the end of the parking bay. Please see sheet C-2.0.

Comment 16: A stop/yield sign needs to be provided or painted on the asphalt at the end of the drive thru.
Response 16: A proposed painted yield sign has been added at the end of the chive-thru. Please see sheet C-
2.0.
Comment 17: Provide a crosswalk at the site entrance as indicated on sheet C-2.0.
Response 17: Two (2) crosswalks have been added at the site entrances as indicated in mark-up. Please see
sheet C-2.0.
Comment 18: On sheet C-2.0, the wall mounted calculation provided (1.5/]LF) is not a Frederick County
ordinance. Frederick County's wall mounted sign states: 20% of the face of the wall not to
exceed 200sf. The size of all directional and informational signage needs to be provided and
these signs cannot exceed five feet in height, directional signage cannot exceed five square feet
and informational signage cannot exceed ten square feet. The signage calculations also indicate
there is one freestanding monument sign proposed (D). This site is permitted to have one
freestanding monument sign not to exceed 12 feet in height and 50 square feet in size located at
the site entrance. The symbol D for this sign is shown on the building but it listed as a
freestanding sign. The height and size of the pre -sell menu board (31) need to be provided and
the size of sign 23 needs to be provided.
Response 18: Size and height of pre -sell board and menu board have been added. Additionally, signage
calculation chart has been revised per the current signage survey prepared by Clayton Signs,
Inc., date November 10, 2007. Please see sheet C-2.0.
Comment 19: The loading space cannot be within the driving lanes; another location needs to be provided.
Also, the loading space needs to be striped.

Comment 20: Provide a north arrow on sheet C-2.0.

Dear Mr. Simpson:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Subdivision. The site plan references property identification number 43-A-100; our records indicate
that tills building is on 43-A-101E. Indicate if further subdivision is necessary for this site so that
Chick-fil-A is located on a separate lot. If so, the subdivision needs to be completed before the site
plan can be approved. If the property is proposed to be leased, the ownership provided on the site
plan application and the plan is incorrect.
2) Special Limited Power of Attorney Form. Pleasc have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should be
notarized and completed to grant the applicant (you) with authorization to represent them for this site
plan.
3) Proffers. The proffers need to be included in the site plan.
4) Sheet Index. The sheets included in the submission were backwards from the index on the
coversheet.
5) Landscape Specifications. On sheet 2, note F needs to be revised to state that a certificate of
occupancy will not be provided by Frederick County unless the plants are installed or a monetary
guaranty has been provided for the landscaping.
6) Landscaping Notes. On sheet 2, notes need to be provided that state (1) All planting shall conform
with § 165-36B of the Frederick County Zoning Ordinance (Plant selection, planting procedure, and
maintenance), and (2) Any plant substitutions must be approved in writing by the Frederick County
Planning Department.
7) Landscaping Schedule. The landscaping needs to be broken up into sections for clarification. The
required interior and perimeter landscaping need to be provided under one section; the Route 11
buffer landscaping needs to be provided under another section. All other ornamental landscaping
provided in addition by Chick-fil-A needs to be under another section.
8) Plant Size. All evergreen shrubs for parking space screening need to be 36 inches in height at time of
planting.
9) Shrubs. Evergreen shrubs need to be provided as indicated on sheet L-1.0.
10) Berm. Label the berm along Martinsburg Pike.
11) Lighting Plan. On sheet T-1.0, details of all lighting being proposed with the site need to be shown.
Also, the lighting note needs to be revised to state the following: All outdoor lighting must be

Site Details. On sheet C-4.1, the detail for the refuse enclosure needs to be provided.
Site Plan General Notes. On sheet C-2.0 under general notes, the following needs to be revised:
note 4 needs to be completed before the site plan can be approved, the front setback (south) minimum
is 50 feet, not 35 feet, and the minimum one-way driving lane is 12 feet, not nine feet. A note needs
to be provided that states: All utilities must be underground.
Parking Area Curb and Gutter. The parking area adjacent to McDonald's does not match what is
Oil the McDonalds plan or the original approved site plan. The Chick-fil-A shows curb and gutter
around the spaces, but the other plans show these spaces connecting. See the highlighted area on
sheet C-2.0.
Landscaped Islands. A landscape island is required at the end of all parking bays. An island needs
to be provided as indicated on sheet C-2.0.
Drive Thu. A stop/yield sign needs to be provided or painted on the asphalt at the end of the drive
thru.
Ci-osswallcs. Provide a crosswalk at the site entrance as indicated on sheet C-2.0.
Si Jna e. On sheet C-2.0, the wall mounted calculation provided (1.5/1 LF) is not a Frederick County
ordinance. Frederick County's wall mounted signage states: 20% of the face of the wall not to exceed
200sf. The size of all directional and Informational signage needs to be provided and these signs
cannot exceed five feet in height, directional signage cannot exceed five square feet and informational
signage cannot exceed ten square feet. The signage calculations also indicate there is one
freestanding monument sign proposed (D). This site is permitted to have one freestanding monument
sign not to exceed 12 feet in height and 50 square feet in size located at the site entrance. The symbol
D for this sign is shown on the building but is listed as a freestanding sign. The height and size of the
pre -sell menu board (31) need to be provided and the size of sign 23 needs to be provided.
Loading Space. The loading space cannot be within the driving lanes; another location needs to be
provided. Also, the loading space needs to be striped.
North Arrow. Provide a north arrow on sheet C-2.0.

After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan
for approval. Comment sheets (approvals) are required from the following agencies: Frederick County Fil-e
Mcn-steal, Freclel•ick County Deparnnent of Builcling Inspections, Frederick County Department of Public
YVorks, Frederick County Department of G.I.S., Frederick County Sanitation Authority, the Health
Department, and the Virginia Department of Transportation.
