The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan_ It is recommended that applicants
contact the Department of Planning & Development to determine which review
agencies' are relevant to their site plan application. A list of potentially relevant

The Frederick County Department of Planning and Development administratively approved the above -referenced
site plan on December 19, 2005. The site plan is approved for the construction of a new six story 100 room hotel
along Millwood Pike (Route 50 East) in the Shawnee Magisterial District. Required site improvements include the
following:
• Construction of a parking lot with 102 spaces (including five handicap accessible spaces and 36 interior
parking spaces), including curb and gutter, striping, handicap access, dumpster site, two loading spaces
and landscaping.
• A 5' sidewalk along Route 50 and Tulane Drive.
• A Zoning District Buffer (a portion shared) along the adjacent College Park Subdivision.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including
review agency comments from all relevant review agencies. I am providing you with five (5) copies of the
approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the
owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction
site throughout the development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or concerns.

This is to acknowledge receipt of your revised plans with latest revisions dated December 16, 2005 for the referenced
project. The plans appear satisfactory and are approved subject to correction of the items noted below. Please advise the
developer accordingly. Please provide 6 sets of approved construction plans with signed seal for VDOT
distribution.
The following comments need to be addressed on the final plans submitted for VDOT distribution:
1. On sheet 2, indicate the STOP sign dimension as 30"00", since VDOT is no longer accepting the minimum
size of 24"x24".
2. On sheet 2, reconfigure the lanes and pavement marking on Tulane Drive, Route 797 as follows:
a. Move the double yellow centerline marking to provide 13 feet from edge of curb to centerline southbound (out to
Route 50), and 23 feet face of curb to centerline northbound (in from Route 50).
b. Add turn lane markings per VDOT standard PM-3 for the right turn lane at the entrance to the
site at 12 feet from face of curb, i.e. skip white line along the taper and solid white line along the turn
lane, plus turn lane arrows.
3. On sheet 2, indicate all pavement markings on Tulane Drive to be thermoplastic pavement marking material
Type B, Class 1.
4. On sheet 7, update VDOT standard PB-1, page 107.01, to the latest version REV. 7/05.
5. On sheet 7, add VDOT standard PM-3, p. 1301.88.

I offer the following general comments relative to the approval of these site plans:
. A preconstruction conference be held by the engineer and/or developer with the attendance of the contractor,
various County agencies and VDOT prior to initiation of work.
. Materials used and method of construction shall apply to current observed VDOT Road & Bridge Specifications
applicable during construction on VDOT right-of-way.
. Our review and comments are general in nature. Should conditions in the field exist such that additional measures
are warranted such measures shall be completed to the satisfaction of the Department.
. All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe or drainage
easement.
. The contractor shall notify VDOT when work is to begin or cease for any undetermined length of time. VDOT
will also require 48 hours notice for inspections.

expenses of a State assigned Inspector.
• Any traffic control signs to be installed will be in accordance with Manual of Uniform Traffic Control Devices
(MUTCD) and these plans.
I suggest any utilities and/or storm sewer placed within the VDOT right-of-way be backfilled completely with C.R.
Type 121-B Stone. This will greatly reduce the possibility of any pavement settlement.
A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of any land use permit.
Dedication should be made to the Commonwealth of Virginia.
A copy of any/all RECORDED PLATS of dedication to public use (the County of Frederick) for drainage
easements or additional right-of-way required for implementation of this proposed project should be provided for
VDOT review prior to issuance of any land use permit.

We offer the following responses for you letter dated June 30, 2005.
/� 1. Provide adjoining information for the properties located on the opposite side
P 1 U of Millwood Pike, as well as the complete information for the properties
across 1'ulane Dr'
Adjoining property information has been updated.
2. On Shcet 2 show the I3RL's for Route 50 and Tulane Drive; also, include the
o:�'crs
35' BIU- off of Tulane in the setback section of the project summary.
BRL's have been added to plan.
3. On Shect 2 under the notes, the max sign area is shown as 150 sE. I'Ilis
needs to be revised to 100 sf because this is not a francliisc hotel.
Signage note has been revised.
4. The handicap spaces need to be moved to the parking area connected to the
sidewalk by the building.
Es Cross walk striping has been added to connect handicap parking to
sidewalk by the building.
5. On Shect 2, the gate leas a note that states "opaque swinging gates". This

statement needs to be clarified that the gates are to be board -on -board. Also,
it appears that sheet 6 of 6 shows this as having a retaining wall "D", but a
detail for this wall has not been provided.
Dumpster screen note has been added to call out board -on -board
gates. Required detail has been added for retaining wall.
6. On sheet 4, provide a notation under the maintenance section that any plant
substitutions must be approved in writing by the Frederick County Planning
Department. Also, under the planting schedule, state that. the 1-Iollies need to
be at least 36" at time of planting.
Note has been added to plan. Planting schedule calls for Howes to be
36" at time of planting.

7. Only the block wall is shown along 64A-2-10 (Kacklcy property). 'I'lie full
screen, including plantings, needs to extend along the entire property line.
Also, there is a gap between the zoning district buffer sections as I have
indicated on the landscape plan.
Plantings have been extended long entire property line.
8. The shared inactive buffer on the College Park properties needs to be vacant
except for plantings. 'I'hcre is a portion of the arbor and a ramp within the
buffer that needs to be removed so the lnactlVC buffer is vacant except for
plantings. Also, the gap where the existing ramp/arbor (w]Zich need to be
removed) needs to be replaced with trees.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval,cannot be granted. This site plan is denied until the
issues in this letter. as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Revic", Comments:
1) Adjoining Properties Information. Provide the adjoiner information for the properties located
on the opposite side of Millwood Pike, as well as the complete information for the properties
across Tulane Drive.
2) Building Restriction Lines. On Sheet 2 show the BRL's for Route 50 and Tulane Drive; also,
include the 35' BRL off of Tulane in the setback section of the project summary.
3) Signage. On Sheet 2 under the notes, the max sign area is shown as 150sf. This needs to be
revised to 100sf because this is not a franchise hotel.
4) Handicap Spaces. The handicap spaces need to be moved to the parking area comlected to the
sidewalk by the building.
5) Dumpster Screening. On Sheet 2, the gate has a note that states "opaque swinging gates". This
statement needs to clarify that the gates are to be board -on -board. Also, it appears that sheet 6 of
6 shows this as having a retaining wall "D", but a detail for this wall has not been provided.

6) Landscaping Plan. On Sheet 4, provide a notation under the maintenance section that any plant
substitutions must be approved in writing by the Frederick County Planning Department. Also,
under the planting schedule, state that the I Iollies need to be at least 36" at the time of planting.
7) Zoning District Buffer. Only the block wall is shown along 64A-2-10 (Kackley property). The
full screen, including plantings, needs to extend along the entire property line. Also, there is a
gap between the zoning district buffer sections as I have indicated on the landscape plan.
8) Inactive Buffer. The shared inactive buffer on the College Park properties needs to be vacant
except for plantings. There is a portion of the arbor and a ramp within the buffer that need to be
removed so the inactive buffer is vacant except for plantings. Also, the gap where the existing
ramp/arbor (which need to be removed) needs to be replaced with trees.

We've prepared plans for a 100 room hotel at the corner of US Route 50 and Tulane Drive. This is the former
Hardee's site. No restaurant or meeting rooms are proposed. In addition to the parking lot shown, a parking
area is provided beneath the existing structure. 36 spaces are located in this garage.
The existing site has access to both Route 50 and Tulane Drive. This plan proposes the Route 50 access be
closed completely.
Water and sewer service is extended from existing adjacent City of Winchester service. A new private grinder
pump station is proposed for sewer service. A new manhole on the existing line is proposed. A portion of the
existing sewer easement will be vacated.
All site storm sewer is routed to an existing inlet at Route 50. As most of the site is currently paved, the post
development discharge is not increased over existing. There is no sheet flow discharge from the site. The
underground parking area is drained by a private sump pump.
The dumpster pad is also located below grade, at the end of the driveway access to garage.
A 6 foot brick/block wall is provided along the east and portions of the northern property line for security and
screening. A shared landscape buffer is provided along the western portion of the northern property line. The
remaining landscaping meets the County ordinance requirements.
All utilities "U be extended under ground.
