The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

Hi Kurt -
Late yesterday afternoon (June 15, 2006) 1 received your request to allow a site modification to the Harwell Food
Service site plan (Site Plan # 40-05) which would replace a portion of curb and gutter with a header curb. While
your letter of request was dated April 21, 2005, Planning staff had only learned of the issue yesterday, June 15,
2006. Staff has reviewed the approved site plan, applicable ordinances, and the requested modifications
identified in the April 21, 2005 letter. It has been determined that the installation of curb and gutter is clearly an
ordinance requirement and the suggested resolution does not meet this ordinance requirement. Therefore, we are
unable to accept the request for modification.
Recognizing that the remaining improvements identified on the approved site plan have been satisfactorily
constructed, and in an effort to expedite the zoning approval for a Certificate of Occupancy, we would accept the
posting of a $10,000 monetary guarantee with the commitment that the approved curb and gutter (as depicted on
site plan #40-05) be installed by August 30, 2006. Upon receipt of this monetary guarantee, this department will
offer our approval for issuance of the Certificate of Occupancy.
As you are aware, the site plan review and approval process is utilized to illustrate coordination and conformance
with applicable ordinances. Any deviations from the approved site plan should be presented to staff in advance of
implementation to seek assurance that ordinance requirements continue to be satisfied. We strongly encourage
both the engineers and the contractors to contact this office in advance of implementing site improvements which
deviated from the approved site plan. Failure to seek approval in advance may result in violations of the
ordinance.

Dear Kurt:
I am in receipt of your site plan modification request, dated August 29, 2006, seeking
approval for an on -site improvement which deviated from approved site plan 440-05 for
Harwell Food Service. As explained in your letter, on -site grade variations were realized
which made it difficult to implement the site plan -approved curb and gutter along the
parking lot perimeter, immediately adjacent to the building's entrance. You have
confirmed that the field -adjusted use of header curb, without the gutter pan, continues to
provide for proper parking lot drainage.
Please accept this letter as acceptance and approval of the field adjustment to the curb
and gutter improvement.
Please note that in the future, should site plan revisions be necessary, it is important that
you seek approval from the County Planning Department prior to Constructing such
improvements which do not conform to the approved site plan.

Onsite Construction Modification Request
Dear Mr. Lawrence:
On behalf of our client, Harwill Food Service, we are requesting approval for onsite construction
modifications to the above referenced site plan approved by the County on August 29, 2005. To
compensate for an onsite grade variation and to assure a more uniform drainage and an esthetically pleasing
look from the building to the parking lot header curb was installed along the sidewalk adjacent to the
building. The approved plan calls for the use of reverse curb in this area. The use of header curb does not
altering drainage patterns and allows the parking area to drain as designed.

Onsite Construction Modification Request
Dear Mr. Lawrence:
On behalf of our client, Harwill Food Service, we are requesting approval for onsite construction
modification to the site plan approved by the County on August 29, 2005. The contractor installed header
curb CG-2 along the building instead of the approved 6" reverse curb and gutter CG-6R. This was done to
offset a grading modification on the plan to allow for proper drainage from the building to the parking lot.
The CG-2 was installed along with the required sidewalk to compensate for this grade difference and does
not compromise the integrity of the parking lot design. All parking lot drainage will conform to the
approved site plan design.

Comments from Frederick County Planning
Comment 1: Loading Spaces. Snipe the actual loading spaces.
Response: All loading spaces have been striped.
Comment 2: Outdoor Storage. Provide a statement that outdoor storage is prohibited in the large area
labeled loading area.
Response: A note to prohibit outdoor storage in the loading space has been provided.
Comment 3: Showroom. It is unclear what file difference is between the showroom and the area labeled
accessory retail. If items that arc for sale to the general public are in the showroom, which makes that
area retail as well. Also, since the main entrance is located in this area, it appears that items located within
both the accessory retail and showroom areas would be available to anyone. The products sold as well as
the layout need to be clarified as this is all industrial district, not a commercial district, and retail uses are
very limited.
Response: The area labeled "Accessory Retail" on the site plan will display small wares, such as pots,
pans, utensils or other general kitchen items that the public may occasionally buy. Sales to the general
public are a small fraction of Harwill Food Service's business. The area labeled as "Showroom" is where
items such as 10 burner stoves, large coolers and food staging tables are displayed. These items are almost
exclusively sold to commercial businesses in the food service industry.
Comment: Comment sheets are required from the following agencies: the Frederick County Department
of Public Works (County Engineer).
Response: Approval from the Frederick County Department of Public Works is pending and will be
forwarded to your office once it is received at Greenway Engineering.

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have been
adequately addressed. Please review Staff's comments listed below and then prepare a revised
site plan which adequately addresses each concern.
Review Comments:
1. Loading Spaces. Stripe the actual loading spaces.
2. Outdoor Storage. Provide a statement that outdoor storage is prohibited in the large
area labeled loading area.

Dear Mr. Gottshall:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site
plan is denied until the issues in this letter, as well as all issues of the other review agencies,
have been adequately addressed. Please review Staffs comments listed below and then
prepare a revised site plan which adequately addresses each concern.
Review Comments:
1. Special Limited PoNver of Attorney Form. Please have the property owner sign
the attached Special Limited Power of Attorney Form prior to further review or
approval. This form should be notarized and completed to grant the applicant
(you) with authorization to represent them for this site plan.
2. Magisterial District. This property is located within the Stonewall Magisterial
District, not Gainesboro.
3. Surveyed Boundaries. The surveyed boundaries need to be provided on the site
plan.
4. Retail Use. On the coversheet under proposed use, use the term "accessory retail
(no more than 15%)", instead of just retail.
5. Building Height. On the coversheet, the actual height of this building needs to be
provided.
6. Utilities and Lighting. On the cover sheet, there needs to be a statement that all
utilities must be underground and that lighting must be shielded to prevent glare
on adjoining roads and properties.
7. Adjoining Uses. On sheet 5, many of the adjoining properties are listed as
"industrial"; some of these properties are vacant. Also, any entrances within 200'
of this property need to be shown.
8. Roads. Provide the route numbers and speed limits for McGhee Road and
Lakesville Circle. Also, the VDOT comment stated that this portion of McGhee
Road is not in the state system yet. McGhee Road will have to be dedicated to
VDOT before a Certificate of Occupancy will be granted for this site.

9. Office/Retail Areas. On Sheet 5, show where the office and retail areas are
located within the building.
10. Loading Spaces. The spaces shown on the plan are only 12' x 35'; loading
spaces need to be a minimum of 12' x' 45'. Also, the loading spaces should be
located adjacent to the loading dock, not the other side of the pavement. The
loading spaces shown on the plan appear to be truck parking spaces and not actual
loading spaces.
11. Outdoor Storage. It is unclear what the large paved area located by the loading
dock will be used for. Please clarify if it will be used for any outdoor storage or
truck parking. If any parking or outdoor storage is going to occur, this area needs
to be screened appropriately.
12. Dumpstei- Area. The proposed dumpster is labeled "recessed dumpster". All
dumpsters require a six foot board -on -board opaque screen. Please clarify what a
recessed dumpster is and provide a detail for the dumpster screening.
13. Parking Lot Landscaping. A three foot high opaque evergreen hedge. row is
required along the parking spaces that face the road. Also, the parking
landscaping needs to be all deciduous, the red cedars need to be revised to a
deciduous tree or be in addition to the required trees.
14. Tree Location. There is a tree that is very close to the curb by the first entrance
that needs to be pushed back (needs to be a minimum of three feet from the curb).
Also, trees need to be incorporated into the hedge row along the parking area
facing McGhee Road as I have depicted on the landscape plan.
After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets
and at least five copies of the final plan for final administrative approval. Comment sheets
are required fi•om the following agencies: the Frederick County Inspections Department and
the Frederick County Department of Public 11"07-ks (Count)) Engineer).
