Dear Evan:
The Frederick County Department of Planning and Development administratively approved the
above -referenced plan on May 28, 2002. The site plan meets all requirements for development in
the RA Zoning District. There are no adverse comments by any of the required review agencies;
however, any future comments by these agencies should be addressed promptly. Please remember
to provide a copy of the access easements when they are recorded. Below is a list of the primary
improvements of this development:
• Construction of a 195-foot-high lattice -type unmanned telecommunications tower.
• Marking and lighting of the tower as required by the Winchester Regional Airport.
• A 14.5-foot vertical clearance for emergency vehicle access as required by the Fire
Marshal.
• Planting of an evergreen landscaped screen on the northeast side of the tower site.
Subsequent screening should be installed if determined necessary by Planning
Department staff to ensure communication facilities are not visible from adjoining
properties and roadways.
I am providing you with six copies of the approved site plan. Please forward these to the appropriate
representatives. Furthermore, please advise the owner that a copy should be kept for future reference
and an approved copy must be kept on the construction site throughout the development process.

Please find attached one copy of the Hunting Ridge Tower site plan for your approval. This plan
has been revised to address the setback table and setback line descriptions that we discussed.
Please note that the entire tower structure (the triangle) has been located at 21 V which places the
entire structure behind the required setback line. Please also note that we provided an internal
distance line to indicate the proximity of the tower from the internal lot which far exceeds the 50'
setback requirement.
Please revise this final revision and advise me if we can prepare final sets for your signature. I
will contact Mr. Doshi once I have heard from you and advise him accordingly. Thank you for

Response: No accessory structures are proposed with these plans and the proposed height of the tower is
noted in the C.U.P. on sheet 1 of 3.

Response: We have added I lunting Ridge Road and its speed limit to the plans.
Comment 9: Please add the location of all utilities on the property.
Response: No existing utilities are present near the proposed tower facility.

Response: Necessary access and utility easements will be recorded upon construction completion.

Response: No environmental features will be impacted from this project and we have added a note to sheet
1 of the plans.

Response: We have labeled the existing residence and garage.

The site plan proposes wire fencing witich would not provide any screening.
Response: 6' evergreen screening will be placed on any side of the tower facility visible from residences,
roads, and public rights -of -way.

Dear Sir:
The Winchester Regional Airport Authority offers the following comments on the above
referenced site plans as conditions to be included for approval of this site plan:
1. Although not required by FAA, structure should be marked and lighted in
accordance with FAA Advisory Circular 7017460-1 J, Obstruction Marking and
lighting, Chapters 4, 8 -(M-Dual) & 13
2. Consideration should be given to the owner/operator of the Timber Ridge
Airport which is a private airport located approximately four nautical miles
from two of the towers as to possible impact on that facility.
These comments are based on the review provided by our engineering firm, Delta
Airport Consultants, Richmond, Virginia. They have determined that this proposed tower
does not penetrate any FAR Part 77 surfaces therefore there should be no impact on
current or future operations at the Winchester Regional Airport.
Final comment is withheld pending review of the FAA's determination on the
aeronautical study. If the above referenced conditions along with any other comments
outlined in the FAA's aeronautical study are met, the Winchester Regional Airport
Authority has no objections to this conditional use permit.

Thank you for the recent submission of the above -referenced site plan. I have completed a review of the plan
and Would like you to address a few issues in a revision. 1 have enclosed a red -lined copy of the site plan to
clarify the concerns of staff. Please note the comments i have made below:
Please provide a space labeled, "Approved by the Zoning Administrator," and a statement that says
the site plan is valid for Five years.
2. Please remove the owner's certificate space regarding a subdivision and Manning & Ross as the
developers.
3. Please add the CUP approval letter elated March 14, 2002.
4. Please provide the PIN for all adjoining properties.
5. Please correct the setback information included in the project information tableto include the required
setbacks and those proposed. Please inclicate thata waiverwas approved for reduced setbacks. Please
label the setbacks to all property lines on the site plan. Also, the proposed setback in the CUP
application is 237' to the Robert's property and the plan is proposing 21 1'.
6. Please provide the location and specifications for any outdoor lighting.
7. Please provide the proposed height ofall buildings and structures, including the tower, on the property.
8. Please add adjoining roads and their speed limit.
9. Please add the location of all utilities on the property.

Dear Mr. Doshi:
This letter is to confirm action taken by the Frederick County Board of Supervisors at their meeting on
March 13, 2002. Your application, Conditional Use Permit #05-02 for a 195-foot lattice -type
telecommunications tower with a waiver of the setbacks to the internal parcel boundary lines was approved
with the following conditions:
All Zoning Ordinance requirements and review agency comments shall be addressed and complied
with at all times.
2. The tower shall be available for co -locating personal wireless services providers.
A minor site plan shall be approved by the County.
4. The tower shall be removed by the applicant or property owner within twelve (12) months of
abandorunent of operation.
In the event a telecommunications tower is not erected within twelve (12) months of the approval
of this Conditional Use Permit, then the CUP will be deeded invalid.
6. Issuance of CUP #05-02 shall make the Conditional Use Permit (CUP# 19-01) previously issued for
an adjoining property (same property owner) invalid.
