application. All required information must be submitted priorto the final approval of any site plan. The
Department of Planning and Development will review the application to ensure that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and returned to

Dear Mr. Hale:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on April 26, 2002. The site plan is approved for the construction of a 6,910-square-
foot building addition, a 446-square-foot building addition, and a spiral freezer.
Frederick County has agreed that the City of Winchester will handle all building permits for this project,
because the existing building is located within the City. However, the Frederick County Department of
Planning and Development will be inspecting the site prior to the issuance of an occupancy permit. Prior
to the approval of an occupancy permit, the two existing lots must be consolidated into one lot.
I am providing you with one copy of the approved site plan. Three additional copies have already been
picked up by Mr. Scott Mark. Please be advised that a copy should be kept for future reference and an
approved copy must be kept on the construction site throughout the development process. Once site
development is complete, and before occupancy, the owner should contact this office to schedule an on -
site inspection.

Attached are six (6) sets of revised plans for the Rich Products site plan review.
These plans have been revised per your latest comments to include the following:
1. A note has been added to C00, C 100 and C 101 that the internal lot
boundary will be vacated prior to obtaining a Final Certificate of
Occupancy.
2. Additional Real Estate and Zoning information was added to adjacent lots.
3. A note was added to describe the removal of an existing fence which is
located within the new building footprint.
We have employed Marsh and Legge surveyors to prepare a survey for the lot boundary
adjustment and expect it to be completed soon, (long before the building is completed).
Upon notice that this plan is approved by your office, we plan to submit building plans
for a building permit.

Thank you for your recent submission of the above -referenced site plan. I have completed my review of this site
plan and I offer several comments. Please look over the comments listed below and prepare a revision of the site
plan for my review. I am providing you with a red -lined copy of the site plan to assist you. The revision should
adequately address all of the comments listed below.
Review Comments
(1) Engineer's Seal and Signature. A Virginia certified engineer, architect, or land surveyor must sign and
seal the site plan to verify its validity. Please ensure that this is done for all pages of the site plan.
(2) Property Identification Number. Your site plan and the County's Tax Map are in conflict with one
another. First of all, the site plan does not show where Lot 54-A-60 is located. According to the
County's maps, the parcel of land is located immediately to the west of Lot 54-A-60A. The site plan
shows this to be the City. In addition, the County's records indicate that the property identified by PIN
54-A-60 is owned by Arctic Freezer, Incorporated and the property identified by PIN 54-A-60A is
owned by Ryder Truck Rental, Inc. Please discuss this concern with me and make all necessary
revisions.
(3) Adjoining Property Information. Please provide the use, PIN, owner, and zoning information of all
adjoining properties. The site plan now only provides some of the adjoining properties' PINs.
(4) Setbacks. Please show all setback lines (building restriction lines) on Page C101.
(5) New Parking Layout. The proposed addition appears to impact the existing parking arrangement.
Please provide a detailed plan that shows the proposed parking layout, after the building addition is
constructed. The number of parking spaces should reflect the parking information and calculations
shown on Page C00.

(6) Site Entrances. Please show the location of all existing and proposed entrances to the site from North
Kent Street.
(7) Scale of Location Map. Please provide the scale of the location map which is shown on Page C00.
(8) Zoning Administrator Approval Box Statement. Please provide a statement to the effect that the site
plan shall be valid for five years from the date of approval. This statement should be shown next to the
Zoning Administrator Approval Box on Page C00.
(9) Jurisdiction Boundary Line. You have labeled the City of Winchester as Frederick County and
Frederick County as the City of Winchester. Please correct the jurisdictional boundary line on all pages
of the site plan.
(10) Speed Limit and Route Number. Please provide the posted speed limit and route number of North
Kent Street.
(11) Fire Code Improvements. Please show the location of all fire lanes, fire hydrants, and any other
features required by the Frederick County Fire Marshal.
(12) Lighting. Please provide a statement to the effect that all lighting shall be shielded and directed away
from adjoining properties and roads to prevent glare.
(13) Utility Relocation. Please provide a statement on the site plan that all new utilities shall be located
underground. The power lines on the utility poles that are proposed to be relocated should be put
underground for this development.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on
the plan. I will then need all approved agency comment sheets and five copies of the final site plan for approval.

Frederick County Building Inspections Department, Frederick County Public Works Department,
Frederick County Fire Marshal, Virginia Department of Transportation (VDOT), Frederick County

Per your request, I have reviewed the Board of Supervisors document dated April 9, 2002. The
Stellar Group, General Contractor and Designer for the referenced project, is in agreement with
the document. However, we would like to clarify that the Civil Plan review, which includes the
issuance of an Erosion Settlement permit, will be provided to The Stellar Group by the Frederick
County Building Department. We would also like to stipulate that for the remainder of the project,
all other permitting and inspections will be coordinated through the City of Winchester, VA
Building Department.
Please inform the City of Winchester, VA Building Department that we are in agreement and will
commence with the permitting process as soon as possible.

After review of the submitted site plan and conducting a April 9, 2002 joint meeting between the
Building Code Officials and Fire Code Officials of Frederick County and Winchester I would
like to submit the following:
The two additions with a total of 7,376 Sq. Ft. will be connected to the existing (approx.
80,000 sq. ft), manufacturing and storage facility that has a City of Winchester address at
801 North Kent Street.
2. Code enforcement of the existing building and systems would fall under the City of
Winchester for Building Code, Property Maintenance Code and Fire Prevention Code
Provisions of The Virginia Uniform Statewide Building Code.
With the above information having been reviewed and agreed upon by the enforcement
personnel of both Localities and pending the agreement confirmation from the permit holder and
owner as set forth within the Sept. 9 1998, Resolution. (Copy Enclosed) I request that building
permits, plan review and code enforcement shall be then delegated under the enclosed resolution
to the City of Winchester. This should also include all fees related to building permits.

RESOLUTION AUTHORIZING THE CHIEF BUILDING OFFICIAL TO ENTER INTO
AGREEMENTS WITH CHIEF BUILDING OFFICIALS OF ANY JURISDICTION
WITHIN THE COMMONWEALTH ADJOINING FREDERICK COUNTY FOR
ENFORCEMENT OF THE VIRGINIA UNIFORM STATEWIDE BUILDING CODE
On motion, duly made by Charles W. Orndoff, Sr., seconded by W. Harrington Smith, Jr.,
and upon the notes as hereafter recorded, it is hereby RESOLVED, that the Chief Building Official
for the County of Frederick, Virginia., is authorized to enter into agreements with the Chief Building
Official of any jurisdiction within the Commonwealth adjoining Frederick County for the enforcement
of the Virginia Uniform Statewide Building Code concerning structures which are, or are to be,
partially located in such respective adjoining jurisdiction and partially located within Frederick
County, with the following limitations: any such agreement shall be also entered into by the building
permit applicant and owner of such property, binding themselves, their heirs, successors, and assigns
to such agreement, and, if such agreement provides that enforcement of the aforesaid building code
shall be the responsibility of the building officials of the respective adjoining jurisdiction, such
agreement shall indemnify and save harmless Frederick County and/or its building officials from all
responsibility or liability for enforcement, failure to enforce, or improper, incomplete, or incompetent
enforcement of such building code.

Dear Mr. Hale:
Thank you for your recent submission of the above -referenced site plan. I have completed my review of this site
plan and I offer several comments. Please look over the comments listed below and prepare a revision of the site
plan for my review. I am providing you with a red -lined copy of the site plan to assist you. The revision should
adequately address all of the comments listed below.
Review Comments
(1) Engineer's Seal and Signature. A Virginia certified engineer, architect, or land surveyor must sign and
seal the site plan to verify its validity. Please ensure that this is done for all pages of the site plan.
(2) Property Identification Number. Your site plan and the County's Tax Map are in conflict with one
another. First of all, the site plan does not show where Lot 54-A-60 is located. According to the
County's maps, the parcel of land is located immediately to the west of Lot 54-A-60A. The site plan
shows this to be the City. In addition, the County's records indicate that the property identified by PIN
54-A-60 is owned by Arctic Freezer, Incorporated and the property identified by PIN 54-A-60A is
owned by Ryder Truck Rental, Inc. Please discuss this concern with me and make all necessary
revisions.
(3) Adjoining Property Information. Please provide the use, PIN, owner, and zoning information of all
adjoining properties. The site plan now only provides some of the adjoining properties' PINS.
(4) Setbacks. Please show all setback lines (building restriction lines) on Page C 101.
(5) New Parking Layout. The proposed addition appears to impact the existing parking arrangement.
Please provide a detailed plan that shows the proposed parking layout, after the building addition is
constructed. The number of parking spaces should reflect the parking information and calculations
shown on Page C00.

(6) Site Entrances. Please show the location of all existing and proposed entrances to the site from North
Kent Street.
(7) Scale of Location Map. Please provide the scale of the location map which is shown on Page C00.
(8) Zoning Administrator Approval Box Statement. Please provide a statement to the effect that the site
plan shall be valid for five years from the date of approval. This statement should be shown next to the
Zoning Administrator Approval Box on Page C00.
(9) Jurisdiction Boundary Line. You have labeled the City of Winchester as Frederick County and
Frederick County as the City of Winchester. Please correct the jurisdictional boundary line on all pages
of the site plan.
(10) Speed Limit and Route Number. Please provide the posted speed limit and route number of North
Kent Street.
(11) Fire Code Improvements. Please show the location of all fire lanes, fire hydrants, and any other
features required by the Frederick County Fire Marshal.
(12) Lighting. Please provide a statement to the effect that all lighting shall be shielded and directed away
from adjoining properties and roads to prevent glare.
(13) Utility Relocation. Please provide a statement on the site plan that all new utilities shall be located
underground. The power lines on the utility poles that are proposed to be relocated should be put
underground for this development.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on
the plan. I will then need all approved agency comment sheets and five copies of the final site plan for approval.
Comments sheets are required from the following agencies:
Frederick County Building Inspections Department, Frederick County Public Works Department,
Frederick County Fire Marshal, Virginia Department of Transportation (VDOT), Frederick County
Departnent of Parks & Recreation, Frederick County Sanitation Authority, and the City of Winchester
