You responded with a letter dated March 19, 2003, indicating that the parking lot would be finished by April 20, 2003. 1 have inspected the property and have noted that the parking lot paving has been completed in accordance �x ith the approved site plan. However. the required landscaping has not yet been installed. I understand, from speaking with your staff at the restaurant, that it is your intent to complete the landscaping. Ir4accordance with Section 165-1451 of the Frederick County Zoning Ordinance, businesses requiring approved site plans should complete all required improvements shown on the approved site plan prior to occupancy of the property. Therefore. the relocation and occupancy of the restaurant on the property prior to all site improvements being completed constitutes a violation of the provisions of Sections 16501451. Resolution of this violation may be accomplished by providing the parking lot improvements as required by the approved site plan. If it is not possible to complete the improvements within thirty days. three estimates for cost of completion of the improvements should be submitted. The estimates will be used to determine the amount required for a guarantee bond to the County to ensure that the parking lot improvements are completed. This office will allow 30 days from receipt of this letter to resolve this violation. Failure to comply with the Zoning Ordinance in this time period will result in a criminal complaint being filed against you. The Frederick County Assessors Office has issued the new PIN# as 42-5-C1. This has been changed on the site plan. 2. The speed limit for Route 522 has been provided on the plans. 3. The Deed Book and Page number have been provided for the existing access easement. The easement is delineated by a dashed line on the plans. 4. The traffic flow has been delineated on the plans. 5.
