application. All required information must be submitted prior to the final approval of any site plan. The
Department of Planning and Development will review the application to ensue= that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and retumed to

The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on August 28, 2002. The site plan meets all requirements for development in the B2
Zoning District. Currently, there are no adverse comments by any of the required review agencies;
however, any future comments by these agencies should be addressed promptly. Below is a list of the
primary improvements of this development:
• Construction of a 2,981 square -foot building for a fast-food restaurant with a drive-thru
window.
• 48 paved parking spaces, including two handicapped spaces.
• Planting of 23 shade trees and 21shrubs.
• Measures to ensure no parking on the concrete access road across the Sheetz property
I am providing you with four copies of the approved site plan. Please forward these to the appropriate
representatives. Furthermore, please advise the owner that a copy should be kept for future reference
and an approved copy must be kept on the construction site throughout the development process. Once
site development is complete, the owner should contact this office to schedule an on -site inspection.
This is required prior to the issuance of an occupancy permit by the Department of Building Inspections.

We are in the process of obtaining site plan approval for an Arby's restaurant behind your Sheetz store at Fox
Lane and Route 522 in Frederick County, VA. The access to this site is through an ingress/egress easement
over the existing driveway to the west of the convenience store. The County Planning Staff has requested the
driveway be marked for "no parking" as shown on the enclosed plan. The Arby's developer would be
responsible for marking the curb in question per the County Fire Marshal requirements. Please let me know if
Sheetz, Inc. has any objection to the proposed no parking designation.

We have received your revised site plan dated July 1, 2002 (received July 8, 2002) for the
referenced project. It appears all of our earlier review comments have been satisfactorily
addressed. Please advise the owner of our approval. Also please provide eight (8) sets
of approved construction plans with signed seal for VDOT distribution.
Please note this approval is contingent with the use of existing access to Route 739, Fox
Drive, by ingress/egress over the Sheetz Lot. VDOT will request a more detailed entrance
plan via a portion of Fox Ridge Lane and the proposed interparcel connector as identified by
VDOT comment on the Final Master Development Plan for Foxe Towne Plaza.
The existing entrance for ingress/egress through the Sheetz site is satisfactory for current
use by the Arby's Restaurant. However, care should be exercised to maintain existing VDOT
facilities in a clean and operational condition.

We've revised the Arby's site plan as requested but for the no parking requirement, your comment #1. Your
request would require KRA to post signs or strip a driveway which they do not own. As the County approved
the site plan for Sheetz, it may be that the County is in the best position to enforce a no parking requirement.
The changes that were made include:
1. Clarifying the grass label as "existing grass".
2. The stray object at the northwest corner of the site has been removed.
3. A note requiring the contractor to have the directional sign location reviewed by Planning prior to
its installation has been added.
4. The intersection to the future motel has been tightened up.
5. We've removed the future parking from this plan. The master planning process will determine
whether parking can occur on this driveway.
6. The 75'/25' zoning buffers are applicable to the development of the Holiday Inn site. The Arby's
site provides the required 150' inactive area buffer with a 50' active area.
Finally, the note pertaining to phasing of the access drive to Fox Ridge Lane was in error. The intent is to
provide the alternate means of ingress and egress upon development of the motel site. The Holiday Inn site
plan actually provides the construction details for that road. The VDOT approval recognizes this timing of
development.

I have received the Arby's site plan revision with changes per the Planning Department's preliminary
comments and have a few items to add. I have enclosed a red -lined copy of the site plan to clarify
these concerns. Please note the comments I have made below.
1. Measures to ensure "no parking" should be installed on the concrete access road.
2. Please eliminate "GRASS" from the site plan. It is shown on the site plan in the western
parking lot.
3. Also. on the northwestern corner of the lease area for Arby's, I have circled an object that
should be removed or information provided as to its purpose.
4. Please ensure that directional signs are placed so that they are clearly visible to all traffic.
Staff may verify that placement is appropriate at the time of site inspection.
You have shown possible future development of the rest of the site on this site plan. There
are a few concerns to note with the future parking lot configuration. The future parking
along the interparcel connector shows spaces requiring drivers to back onto the connector.
Staff highly discourages this type of parking. Also, staff recommends that the intersections
be squared off and yield/stop signs placed.

Thank you for getting me your comments on Arby's. We've revised the plans and we've enclosed a set for
your approval. Our specific responses are as follows:
1. Stonewall magisterial district has been specified.
2. Currently the entire parcel is owned by KRA. The lease lines shown are for planning purposes
only, ensuring each use is able to satisfy the ordinance requirements within the specified
development area.
3. A copy of the ingress/egress agreement with Ferris is enclosed here. I believe you will also find a
copy in your KFC site plan file.
4. The driveway through Sheetz is shown. This layout is shown per the approved site plan.
5. We've shown stop signs and flow arrows where appropriate throughout the site.
6. At the end of the 300 foot public access, VDOT requires a turn around area for its maintenance
vehicles. The geometry shown has been approved by the Edinburg residency. I've enclosed a copy
of the document which dedicated 300 feet of Fox Ridge Lane for public use.
7. The plan references a note specifying the maximum sign dimensions for the pedestrial signs. All
other directional signage is less than five feet high and 4 sq ft.
8. The posted speed limit of 37 is 65 mph. However no access is proposed on Route 37.
9. A VDOT CG-6 detail is provided.
10. Except for the water and sewer easement, no other easements are required. All storm facilities are
privately maintained and the property is one parcel owned by one entity.
11. A hedge exists there currently.
12. The owner does not want a buffer from Route 37. Maximum visibility is desired.
13. The reference to developed site area has been deleted.
14. We've revised the parking calculations to reference restaurant use. 1.4 spaces per 100 s.f is
required.
15. We've revised our landscaping summary to reflect the 640' perimeter.
16. We've referenced drive-thru stacking as requested.

Building shall comply with The Virginia Uniform Statewide Building Code and Sections 303, A
(Assembly) of the BOCA National Building Code/1996. Other Code that applies is CABO
Al 17.1-92 Accessible and Usable Buildings and Facilities.
The maximum slope across the HC parking and unloading shall not exceed 2% grade. All required
egress from the buildings shall comply with CABO A117.1-92 .
Please note that the kitchen drainage shall only route though the grease interceptor not the entire
plumbing discharge from the building. Please indicate the pipe connection of other waste systems
down stream from the interceptor..
Design Professional lic. in VA shall seal the plans submitted for permit application and special

We've received comments on the Arby's Restaurant from all agencies, but Planning. I understand that the
issue of the Master Planned cul-de-sac has come up, but I'd like to get the Arby's plan ready for approval, once
that issue is resolved. We are working now with VDOT on a modified vehicle turn around area. We would
like to install that new entrance as part of the Holiday Inn development. It is our opinion that the Arby's site,
being far removed from Fox Ridge Lane, would benefit little from an entrance there.
Please let me know when we can expect comments from Planning on the Arby's.

Thank you for the recent submission of the above -referenced site plan. I have completed a review of the plan
and would like you to address a few issues in a revision. I have enclosed a red -lined copy of the site plan
to clarify the concerns of staff. Pleasc note the comments I have made below.
Review Comments
1. Stonewall is the correct magisterial district, please correct this on the plan.
2. Will this property be subdivided along the `lease lines' or will it remain one parcel? If it is to remain
one parcel, please provide the appropriate lease agreement for our files.
3. Also, please provide a copy of the access easement across the Shcetz property.
4. Please provide the dimensions and details of the concrete access road from Pox Drive to the Arby's
site, including entrance details.
5. Please provide arrows to indicate the proposed flow of traffic around the site. With the newly
proposed interparcel connector, is the Sheetz access road still going to be used? Consideration
Should be given to safety at the intersection of the access road and interparcel connector.
6. The site plan indicates a VDOT turn -a -round; please explain exactly what is proposed.
7. Please provide the height and dimensions of any proposed signs.
8. Please provide the exact location and posted speed limit of Route 37.
9. Please provide details for the proposed curb and gutter.
10. Please provide the location and width of all casements, including access, utility, and drainage
easements.

WHEREAS, the DECLARANT is the owner in fee simple of
the real estate shown on the attached plat drawn by Douglas C.
Legge, C.L.S., dated January 15, 1991, known as Foxridge, which
property is further\ described on the Final Master Development
Plan of Foxridge as f' ed in the Office of the Frederick County
Department of Planning and Development. This is a portion of
the real estate conveyed to the DECLARANT by two (2) deeds, the
first dated December 21, 1990, from Earl S. Bailey, Jr., et ux
of record in the Office of the Clerk of the Circuit Court of
Frederick County, Virginia, in Deed Book 754, at Page 1121, and
the second dated December 19, 1990, from Michael D. Carpenter,

1 et ux, of record in the aforesaid Clerk's Office in Deed Book
754, at Page 1126; and,
WHEREAS, the property is subject to a Deed of Trust,
dated December 21, 1990, of record in the aforesaid Clerk's
Office in Deed Book 754, at Page 1133, to secure First American
Bank of Virginia, a certain indebtedness described therein; and,
WHEREAS, said real estate, as shown on the aforesaid
attached plat, has been subdivided into lots for the
construction of townhouses thereon, and the attached plat shows
accurately the metes and bounds of the subdivided land, together

with the dimensions of each lot thereof and also shows certain
surrounding lands in said Subdivision to be used as common open
space, parking areas, drainage easement, buffer protection
easement, water and sewer easement, and utility easement and

constitute a portion of that development known as Foxridge and
which common open space and parking areas shall be owned and
maintained by the Foxridge Homeowners Association upon the terms
and conditions set forth hereinafter; and,
WHEREAS, the DECLARANT now desires to subdivide the
same into lots to be known as Foxridge. The subdivision of said
real estate, as it now appears on the aforesaid attached plat,
is with the free consent and in accordance with the desires of
the undersigned DECLARANT, Trustee and Beneficiary, and the i
i parties hereto further desire to subdivide the aforesaid real
estate in accordance with the provisions of "The Virginia Land
Subdivision Act" as are applicable and in force and effect as of

We've prepared a site plan application for an Arby's Restaurant on the KRA Properties land at the intersection
of Fox Drive (Route 723) and US Route 522. A KFC Restaurant currently exists on this site, fronting on Fox
Drive. The Arby's site is immediately north of the Sheetz.
Access to the site is via the same easement utilized by the KFC, across the Sheetz site. The entrance shown
was anticipated by Sheetz. A driveway curb was provided.
Water and sewer are extended from the Fox Ridge subdivision property line. Gas, electric and telephone
services are also available.
The ultimate development of the site is shown on the Key Map (sheet 2). The site plan for the Holliday Inn
Express is underway, with plan submission anticipated by 1 May. The office area is still being studied, but we
hope to follow up with a site plan for that area in the near future. As the development pattern of the site is
known, including how the access, utility services and stormwater management will be provided, we request
that the master plan requirement for this site be waived.
