The property, zoned RA (Rural Areas), is located at 225 Caldwell Lane (Rt. 717), directly behind the AC Self Storage facility, south of Papermill Road (Rt. 644). This property is identified with P.I.N. 63-44C in the Shawnee Magisterial District. Action - Recommended Approval with Conditions Chairman DeHaven said that he would abstain from all discussion and voting on this item due to a possible conflict of interest and he turned the chair over to Vice Chairman Thomas, Planner David Beniamino reported that the proposed conditional use permit (CUP) is for a landscape contracting business on a five -acre parcel. He stated that there are no structures on site and no new structures will be constructed as part of the CUP. Planner Beniamino stated that the staff is recommending that a six-foot opaque fence be erected to screen the eastern edge of the property from residential uses. Furthernore, the proposed use shall employ no more than ten employees at any one time and the site will not contain more than nine vehicles stored on the premises; no sales of nursery stock will take place on site. Planner Beniamino read a list of recommended conditions, should the Commission find the use to be appropriate. Mr. Michael M. Artz with Artz & Associates, Inc., PLC and Mr. Edwin R. Elvira, the property owner, were present to answer questions from the Commission. The applicant's stated use of the property was to store nursery stock and to park business vehicles on the site; the business vehicles included delivery trucks and a vehicle used to transport a bobcat or other similar equipment. No structures were planned, due to the fact that no drain field sites were available on the property. Mr. Artz reported existing water runoff problems stemiming from drainage issues on the adjoining AC Self -Storage site; this runoff was impacting an adjoining property to the southeast (Mrs. Marie Evans at 170 Harrison Lane). Mr. Artz stated that the Mr. Elvira has agreed to help mitigate the runoff problems, even though his property is not a contributing factor. He explained that recent discussions between the County's engineers, the excavator for the AC Self -Storage site, and the applicant have resulted in the development of a future, mutually -beneficial agreement whereby the applicant will provide a drainage easement on his property in exchange for an access easement through the AC Self -Storage facility's commercial entrance. A member of the Conunission pointed out the unsightly appearance of the property because it contained junk and equipment. Mr. Elvira stated his intentions to clean up and organize the site with the approval of the CUP. However, a diversion berm may be utilized in lieu of the wire support silt fence. 2) The updated erosion and sediment control ordinance requires that the outfall system for the proposed stormwater/sediment basin shall maintain stnictural integrity for a 100-year design storm of 24 hour duration. (See attached ordinance, page 5). 3) Verify that an adequate channel exists downstream of the proposed stormwater pond for the release from the outfall pipe. Provide a drainage easement across the property, or, verify that an adequate channel exists and that the stormwater leaves the site as sheet flow. Provide downstream topo to verify the channel outfall. 4) There is a discrepancy reflected on the plans as to the type of pipe utilized for the proposed stormwater pond. The stormwater riser structure shall be concrete. All channels and the proposed pond shall have at least two (2) percent grade fall or additional means will be required to prevent an issue with standing water on the site. 5) During construction of the pond, it will be necessary to provide wire support silt fence downstream to control erosion runoff. 107 North Kent Street o Winchester, Virginia 22601-5000 0 0 AC Storage Comments Page 2 August 22, 2002 6) Place a note on the plan which indicates that if at any time during construction, we receive complaints about mud being tracked onto Route 717 (Caldwell Lane), we will require that a wash bay be installed to wash the mud off of all vehicles exiting the site. 7) Provide a channel to drain the proposed stormwater from Curb B-B into Channel C-C. Provide additional contours to ensure that the proposed stormwater flows from Channel A- A drains into the curb B-B. 8) Provide finished floor elevations for the proposed self -storage units and the existing one (1) story building. It will be necessary to ensure that adequate drainage exists within the units to prevent storm water from ponding within the site. 9) Provide temporary and permanent seeding specifications on the plans in accordance with the VESCH Standards 3.31 and 3.32, respectively. Include the seeding rates in the specifications. In accordance with the VESCH Standard 3.35, provide mulching specifications as well.
