The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on January 29, 2003. The site plan meets all requirements for development in the B2
Zoning District. Currently, there are no adverse comments by any of the required review agencies.
however, any future comments by these agencies should be addressed promptly. Below is a list of the
primary improvements of this development:
• Construction of a 51,996 square -foot three-story building for use as a hotel.
• 84 Parking spaces, including 4 handicapped spaces.
• Planting of 45 trees and 56 shrubs.
• Supplemental plantings as deemed necessary by staff within the required Category B
Buffer along Foxridge Lane. These plantings will be required prior to the issuance of
a Certificate of Occupancy.

representatives. Furthermore, please advise the owner that a copy should be kept for future reference
and an approved copy must be kept on the construction site throughout the development process. Once
site development is complete, the owner should contact this office to schedule an on -site inspection.
This is required prior to the issuance of an occupancy permit by the Department of Building Inspections.

We've revised the Holiday Inn site plan per your comments of 5 December 2002. The changes are:

�3 We've updated the environmental feature summary. The limits of disturbance are shown on sheet
2 (woodlands) and sheet 4 (steep slopes). The summary is provided on sheet 2. We've also

Dear Mr. Mislowsky:
I have completed a review of your plan and would like you to address a few issues in a revision. Please note
the comments I have made below.
You have shown possible future development of the remainder of the site on this site plan. The future
parking along the interparcel connector shows spaces requiring drivers to back onto the connector
road. This is not allowed by the zoning ordinance. Please remove this from the site plan.
Please note that all road improvements associated with this parcel should be completed at the time the
motel site is developed. Curb and gutter is required on the northern side of the interparcel connector.
The environmental features located on the site should be noted on the site plan in the project summary
table, in square feet, along with the percentage of these features to be disturbed. The location of these
features and Nvh ich areas are to be disturbed should be noted on the site plan as well. (The information
that is provided on the master plan regarding steep slopes and woodlands disturbance.) Note #3 on
Sheet 3 should be replaced.
4. Please indicate along with the other buffer and screening information that Category B buffers are
required; also indicate the type of screen provided. Please make a note on the site plan that the screen
along Foxridge Lane may need to be supplemented with plantings as required by the planning staff to
provide adequate screening against the townhouses.
Please provide information regarding whether or not a road name is required for the interparcel
connector and if road sign will be required. Provide the location of any road name signs proposed.

We have revised the plans per your comments of 22 October. I've enclosed a set here for your approval.
The changes include:
1. The Master Plan is referenced on the cover sheet.
2. The site plan reference for adjoining properties has been provided on sheet 2.
3. We intend to construct the connector through "Lot 4" as part of the Holiday Inn development. We
have noted such on the plan. However, only the pavement will be installed at this time. As the
nature of the development on Lot 4 is unknown, it does not make sense to install curb and gutter,
except at the entrances on Fox Ridge Lane and across from Arby's. We believe this conforms to
requirements of the Master Development Plan.
4. Arrows have been provided throughout the parking area.
5. The property may be subdivided, but that decision has not yet been made. A waiver to the
subdivision ordinance is required to subdivide the property as shown.
6. We've referenced the appropriate note regarding sign sizes.
7. Easements required, if the property is subdivided, have been shown.
8. A hedge has been provided along the Lot 4 line. Please note the elevation of the Route 37 ramp is
significantly higher than the proposed parking lot and therefore the screening hedge is not required.
9. As indicated previously, the type of development which might occur on Lot 4 is not known.
However, we do not believe the Master Plan restricts parking on the connector road and such may
be provided with that site development.
10. We've clarified the developed area notations in the project summary.
11. 12'x45' loading spaces are shown.
12. All setbacks and yards are noted.
13. The posted speed limits on all roads are shown.
14. An environmental disturbance summary is provided. The limits of disturbance are shown on the
plan.
15. The buffer and screens are noted on the plans. Sections are provided as appropriate.

We have received your revised site plan dated July 30, 2002 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide 6 sets of approved construction plans with
signed seal for VDOT distribution.
This approval is granted by VDOT for the plan as presented, accessing the site via Foxridge
Lane on a 300' long dedicated right-of-way set aside for public use.
During the review process including an MDP and a site plan, VDOT has indicated the
mentioned 300' R/W should be extended an additional 30' to provide adequate space for turn
around movement of maintenance vehicles.
Since the additional space has not been provided, this section of Foxridge Lane would not be
acceptable for inclusion into VDOT's Secondary System of Highways and therefore could no t
be maintained by VDOT.

VDOT Land Use Permit would not be required. However, the construction contractor should

Upon review of the subject site plan, we offer the following comments:
1. The plan indicates a conventional stone construction entrance. If we determine that a problem
exists during construction with mud being tracked off -site, we will require the installation of a
wash bay on -site to wash the wheels of the vehicles leaving the site.
2. The stormwater management report appears to adequately address on -site run-off issues.
We offer no additional comments. Therefore, we recommend approval of the subject site
plan.

Thank you for the recent submission of the above -referenced site plan. I have completed a review of the
plan and would like you to address a few issues in a revision. I have enclosed a red -lined copy of the site
plan to clarify the concerns of staff. Please note the comments I have made below.
Review Comments
Please provide reference to the master development plan for the site, providing its name, file
number, and approval date.
2. Please include the site plan numbers and approval dates for the KFC site and the Arby's site.
3. Please note that all road improvements associated with this parcel should be completed at the time
the motel site is developed. This includes the VDOT turn -a -round and the interparcel connector.
4. Please provide arrows to indicate the proposed flow of traffic around the site. Consideration should
be given to safety at the intersection of the access road and interparcel connector.
5. Will this property be subdivided along the `lease lines' or will it remain one parcel?
6. Please provide the height and dimensions of any proposed signs.
7. Please provide the location and width of all easements, including access, utility, and drainage
easements.
8. Please provide a evergreen hedge along the perimeter of the parking lot on the Route 37 side and
along the perimeter of the parking that shines onto Lot #4.
9. You have shown possible future development of the rest of the site on this site plan. There are a few
concerns to note with the future parking lot configuration. The future parking along the interparcel
connector shows spaces requiring drivers to back onto the connector. Staff highly discourages this
type of parking. Also, staff recommends that the intersections be squared off and yield/stop signs
placed

10. In the project summary table, please clarify what the distinction is between "developed parcel area"
and "developed site area."
11. Please note that all loading spaces should be 12 feet in width and 45 feet in length.
12. Please provide the location of all required setbacks and yard areas.
13. Please provide the posted speed limit of adjacent roads.
14. The environmental features located on the site should be noted on the site plan in the project
summary table, in square feet, and the percentage of these features to be disturbed. The location of
these features and which areas are to be disturbed should be noted on the site plan as well.
15. Please provide the location of required buffers and screening, indicating which buffer is required and
providing cross sections or profiles.

We have received your revised site plan dated July 30, 2002 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide 6 sets of approved construction plans with
signed seal for VDOT distribution.
This approval is granted by VDOT for the plan as presented, accessing the site via Foxridge
Lane on a 300' long dedicated right-of-way set aside for public use.
During the review process including an MDP and a site plan, VDOT has indicated the
mentioned 300' R/ W should be extended an additional 30' to provide adequate space for turn
around movement of maintenance vehicles.
Since the additional space has not been provided, this section of Foxridge Lane would not be
acceptable for inclusion into VDOT's Secondary System of Highways and therefore could no t
be maintained by VDOT.
Also, since the existing entrance of Foxridge Lane is in place and satisfactory to serve the site, a
VDCY'f Land Use Permit would not be required. However, the construction contractor should
exercise caution to maintain the VDOT facility in a clean road condition and maintain through
traffic throughout construction phases.

Previously we had submitted a site plan for a new motel at Foxe Towne Plaza, off of Fox Drive. That
application was returned for lack of a Master Development Plan. That Master Plan has been prepared and
comments from review agencies received. That information has been forwarded to Planning under separate
cover. We request that you now accept our Holiday Inn Express site plan for review. Two copies are provided
here with the completed application and fee.
The layout shown is in compliance with the Master Plan, providing for construction of a driveway from the
existing Arby's to Fox Ridge Lane. An additional easement is provided at the intersection with Fox Ridge to
allow VDOT maintenance vehicles to turn around.
The water and sewer lines shown have been installed as part of the Arby's plan. The stormwater management
pond shown will serve this development and a future office use on Lot 4.
The entire 5.649 acre parcel remains one tract of land, owned by KRA Properties. Lease lines are shown for
planning purposes only, to ensure each use satisfies its associated ordinance requirements.
We believe our plan provides all improvements required by the zoning ordinance and look forward to its
