We are in receipt of a reduction request for the above -referenced Letter of Credit. Please reduce
Letter of Credit Number 1275 in the amount of $60,000.00 to $4,000.00 as a portion of the work -
related construction activities have been completed to the satisfaction of the Subdivision
Administrator and the Frederick County Public Works Civil Engineer. Reduction in the Letter of
Credit reflects the costs associated with stabilization of the site in accordance with the approved

Dear Mr. Hodgson:
This letter is in regards to our meeting on December 18, 2003, with the Frederick County Department
of Planning and Development, Building Official, County Engineer, Fire Marshal, and the Assistant
County Administrator. The topics of discussion at this meeting were intended to resolve any possible
zoning and building violations at the Sportsplex site, and to better understand the necessary steps
which you must accomplish in order to open and operate the facility.
You were advised of a number of significant building issues that require additional coordination with
the Fire Marshal and the Building Official. You will need to deal directly with their respective
departments to address their issues.
In terms of the Planning Department's outstanding issues for the Sportsplex project, most significant
is the required parking for the facility. As we discussed, the expanded occupancy loads of the snack
bar area raised concern in terms of the necessary on -site parking requirements. We agreed that the
establishment of a maximum occupancy load of 30 persons within the designated snack bar area
would resolve the on -site parking concern. Accordingly, notations regarding the maximum occupancy
load should be included in the building permit file, and a notation on the site plan shall establish a
maximum number of 30 seats within the snack bar area. In a similar nature, the maximum seating
associated with the coffee kiosk would be ten seats, and should be noted accordingly.
In order to satisfy the parking requirements for your various special events (trade shows, conference
and banquet facilities, etc.), you have elected to enter into a shared parking agreement with two
adjoining properties, rather than providing actual parking on site. This shared parking agreement shall
be in accordance with Section 165-27 B of the Frederick County Zoning Ordinance. Per the ordinance
requirements, the agreements shall be in a lease form and include authorized signatures of the property
owners, identification of the number of parking spaces available, and the times when the parking
spaces will be available for use. As we discussed, these shared parking spaces will not be available
unless the business on the site of the parking is closed. For example, if you intended to utilize the
CarQuest parking lot, CarQuest must be closed prior to your use of the parking lot. Please provide
the Planning Department with a copy of the executed shared parking agreement for review and
approval. Notations regarding the shared parking arrangement, as well as copies of the executed
shared parking agreements shall be attached to the site plan Additionally, notations shall be included

on the site plan stating that special event uses shall not operate without the necessary shared parking
being available for use.
Please be advised that this office will not grant any zoning approvals or authorize any occupancy
permits for any uses at the Sportsplex site until these issues have been resolved. Any events or
programs at this site without zoning approval will be a violation of the Frederick County Zoning
Ordinance

i (5) When the required spaces are based on a number of employees, students, seats or
other factor that can vary over time, the spaces required shall be based on the
I maximum possible number.
(6) Parking spaces based on floor area shall be determined based on the gross total
floor area devoted to each separate use on the site.
^' B. Shared parking. Required parking spaces may be located on a lot other than the lot
containing the use under the following circumstances:
(1) Parking for a use on a lot may be located on an abutting lot if the zoning of the
abutting lot is the same as the lot containing the use.
(2) When shared parking is provided on abutting lots, the total spaces provided shall
equal the sum of the number required for each use sharing the parking.
(3) When shared parking is provided on abutting lots, means of pedestrian access shall
be provided between each use sharing the parking and the parking area.
(4) When shared parking is provided on abutting lots, a lease, easement or other form
of agreement shall be executed among the property owners sharing the parking
assuring the use of the required parking spaces and assuring proper maintenance of
the parking area. Said agreement shall be submitted to the Zoning Administrator
for review and approval.
C. Parking space size. All required parking spaces shall be at least 180 square feet in size
and shall be no less than nine feet in width.
D. No part of a tractor, truck, tractor truck trailer, semitrailer, bus or dump truck shall be
parked or stored within the RP Residential Performance District, the R5 Residential
Recreational Community District or the MH1 Mobile Home Community District. Any
truck with a total length of 25 feet ,or greater shall not be parked or stored within the RP,
R5 or MHl Zoning Districts. [Amended 6-9-1993]
E. Parking lots. Parking spaces shared by more than one dwelling or use, required for any
use in the business or industrial zoning district or required for any institutional,
commercial or industrial use in any zoning district shall meet the following requirements:
(1) Surface materials. In the RP Residential Performance District, the R4 Residential
Planned Community District, the R5 Residential Recreational Community District,

the MI-I1 Mobile Home Community District, the B1 Neighborhood Business
District, the B2 Business General District, the B3 Industrial Transition District, the
M1 Light Industrial District, the M2 Industrial General District and the MS
:... Medical Support District, parking lots shall be paved with concrete, bituminous
concrete or similar materials. Such surface materials shall provide a durable, dust -
and gravel -free, hard surface. The Zoning Administrator may allow for the use of
other hard -surface materials for parcels located outside of the Sewer and Water
Service Area if the site plan provides for effective stormwater management and
efficient maintenance. In such cases, parking lots shall be paved with a minimum
of double prime -and -seal treatment or an equivalent surface. [Amended

It has been brought to my attention that Spotsplex may have some zoning issues. In this letter I
will make an attempt to clarify the intent of Sportsplex programming.
B-3 zoning, indoor sports facilities, is not addressed in detail. The ordinance is vague at best.
These issues need to be addressed and changes made by either change in ordinance, special use
or conditional use.
Sportsplex has been a work in progress for over 5 years. My vision was to provide our area with
an indoor facility that would provide our area youth and families a place to play sports and be
active in a family setting. During my research and study of feasibility it became clear that sports
alone would not support such a facility. Therefore, for this facility to be feasible, it was necessary
to investigate other sources of potential revenue to enhance the indoor sports facility.
I have been soliciting Frederick Co. supervisors and the parks & rec. department, for the past 3
years for financial and usage support in bringing this community project to reality. To this date I
have received no support other than " It's a great idea we could really use such a facility".
Without public support is has become even more important to find accessory sources of income
related to indoor sports to support this project. The following activities are planned for
Sportsplex:

Senior Citizens Day Programs
Church, Corporate & Civic Programs
Civic Fundraising Programs

Sportsplex is truly a multipurpose sports and event enter. Multipurpose is the only way this
facility can be successful.
In addition to the activities within Sportsplex, our community will benefit from the additional
employment, revenues to businesses, as well as the taxes generated by other uses in this facility.
I am requesting support from all govermnent agencies in any way possible. I truly need your
support.
The only exit plan I have at this time if any of my sources of revenue are rejected by our local
agencies is to convert this building to a climate controlled warehouse facility. Not the best
choice for the community.

delineated the requirements for additional "shared" parking. The uses are
separated into two categories. One being those uses allowed with only the
onsite parking being made available. These uses include those for which
further clarification has been provided by Ron Hodgson. A copy of that
description is attached. The other category of uses being those large assembly
types for which shared parking will need to be made available.
The parking calculation has been adjusted to include the shared parking
currently secured and a note describing the location of those spaces is also
provided.

The Frederick County Department of Planning and Development administratively approved the above- referenced plan
on November 5, 2002. The site plan meets all requirements for development in the B3 Zoning District. Currently.
there are no adverse comments by any of the required review agencies; however, any future comments by these
agencies should be addressed promptly. Below is a list of the primary improvements of this development:
Phase I:
• Construction of a 57,750 square -foot building for indoor recreation use.
• Construction of 217 parking spaces, 8 handicap spaces, and 1 loading space.
• A landscape plan including the planting of 80 trees and 91 evergreen shrubs.
• Installation of a concrete dumpster pad with opaque fencing and leyland cypress to provide
screening.
Phase II:
• Construction of 21,000 square -foot building.
• Construction of 32 parking spaces.
I am providing you with five copies of the approved site plan. Please forward these to the appropriate representatives.
Furthermore, please advise the owner that a copy should be kept for future reference and an approved copy must be
kept on the construction site throughout the development process. Once site development is complete, the owner
should contact this office to schedule an on -site inspection. This is required prior to the issuance of an occupancy
permit by the Department of Building Inspections.

We have revised the site development plan per your comments of 7 October. The changes include:
1. The emergency access lane has been shifted to the west to avoid the loading area. Also please note
a dumpster pad has been placed adjacent to the loading area. In addition to the board fencing, a
leyland cypress evergreen screen is also provided.
2. A section of the emergency access lane is provided on sheet 4 of the plans.
3. We've extended the sidewalk to the southern parking area.
4. Arrows showing the traffic flow path are shown.
5. The maximum sign area has been revised.
6. The phase 2 building and parking areas have been clearly designated.
7. Please note the new boundary along the west side of the building. I understand this property line
adjustment will be approved this week.

Since the initial submittal of the Sportsplex site plan, we've revised the building location, shifting it to the west
side of the site. Your comment have been addressed on this new plan. The changes are:
1. The plans are signed.
2. The magisterial district has been corrected.
3. The scale of sheet 3 has been corrected.
4. The adjoining property information has been added.
5. North arrows have been added to the plan sheets.
6. The boundary restriction lines are shown.
7. A note regarding future improvements to 1-81 and its possible impact on this site has been added.
8. The speed limit of all adjoining roads is provided.
9. There will be a pedestal sign at the southeast corner of the site. It is not clear at this time what form
the building mounted signage will take. We understand separate permits will be required for
signage.
10. 250 parking spaces are required. 250 parking spaces are proposed in two phases.
11. Hedgerows have been provided at the north and south property lines along the parking lots.
We have not yet received all of the review comment sheets. We will provide them to you upon receipt.

2) Provide a Rip Rap overflow area for the proposed berms to act as a sediment trap and

3) I have attached a copy of the new land disturbance permit application. It will be necessary
to ensure that all policies indicated are adhered to for this, and, all future developments.

Thank you for the recent submission of the above -referenced site plan. I have completed a review
of the plan and would like you to address a few issues in a revision. I have enclosed a red -lined copy
of the site plan to clarify the concerns of staff. Please note the comments I have made below.
Review Comments
Please remember to sign the engineer's seal on all pages of the final site plan.
2. Please correct the magisterial district to reflect the correct one, Shawnee District.
3. Please clarify what the scale is on sheet 3 of 6.
4. Please add the adjoining use, zoning, and Property Identification Number (PIN#) of all
adjoining properties.
5. Please add north arrows to the site plan.
6. Please add boundary restriction lines to the site plan and correct the setback information table
to reflect that the required rear setback is 50' against I-81. Also, please indicate what the
proposed setbacks are to all property lines on the site plan.
7. With regards to I-81, the master development plan and subdivision design plan for the
Commonwealth Business Park both contain language that this site may be affected by the
widening of 1-81. I think it is appropriate to include that on this site plan as well. Additional
landscape buffering along the rear property line against the interstate would be appropriate
as well.

I've enclosed plans and supporting information as necessary for a development on lot 3 of the
Commonwealth Business Center. The site is at the end of Commonwealth Blvd., just north of the cul-
de-sac. The proposed Sportsplex will be built in two phases. The first phase of 57,750 sq ft will include
a complete build out of the parking, utility and storm drainage improvements. The pad area for the
20,900 sq ft expansion will be graded to drain, but fill materials will be placed anticipating future
development.
A standard VDOT CG-9D entrance provides the only access to the site. No stormwater flow will be
directed to the Commonwealth Blvd. right-of-way.
All drainage from the site is carried to a detention pond along the Interstate 81 right-of-way. The pond
mitigates flows from the 10 year storm to below predevelopment levels. The downstream 36" culvert is
more than adequate for these flows.
Paved access is provided to the north and west side of the building. An emergency access drive is
provided on the south side of the building. No vehiclar access is provided on the east side.
Water and sewer extensions provide fire hydrant coverage and fire suppression system service. Gravity
sewer service is provided from an existing manhole at the end of Commonwealth Blvd.
