Dear Ron:
The Frederick County Department of Planning and Development administratively approved the above -referenced
site plan on June 13, 2003. The site plan is approved for the construction of a 2,757 square foot bank at the
corner of the Millbrook High School access road and Berryville Pike. The site plan satisfies all of the
landscaping, parking, drive-thru lane, and other requirements of the Frederick County Zoning Ordinance.
Furthermore, the entrances to the site were approved by the Frederick County Planning Commission during their
April 16'h meeting. All relevant review agencies have provided approval of the project. As approved by the
Planning Commission, a right -in only entrance is provided off of the westbound lane of Berryville Pike at a
distance of 118 feet from the intersection. In addition, a single entrance is provided off of the access road for
Millbrook High School.
I am providing you with four copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an
approved copy must be kept on the construction site throughout the development process. Once site development
is complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to contact
me should you have any questions or concerns.

New building shall comply with The Virginia Uniform Statewide Building Code and Section 304,
use group B (Business), of the BOCA National Building Code/1996. Other Code that applies is
CABO Al 17.1-92 Accessible and Usable Buildings and Facilities. Building permit is required for
the sign located at the front of property.
Demolition permit and asbestos inspection is required to remove the existing structure on site.
HC access appears to be in compliance however note that a max. 2% slope is allowed across the
parking and unloading area.
Special inspection requirements of Chapter 17 of BOCA shall apply to this type of structure.

We have received your revised site plan dated April 25, 2003 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also please provide five (5) sets of approved construction plans with
signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 7 right-
of-way. The permit is issued by this office and will require a minimum processing fee, surety
bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all
recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of any
land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

We've revised the site plan per comments received from the review agencies. I've enclosed a copy here for
your review. The changes include:
1. Revision of the entrance on Route 7 to provide a "Right In" only.
2. Pavement details for the road widening have been added. Please note, the on site pavement is
specified on sheet 2, in the legend, as 8" aggregate and 2" asphalt.
We also offer the following comments.
1. The 4" curb detail (CG-7) is shown as this curb is required along the Route 7 widening due to the
45 mph speed limit. The site plan notes where the CG-7 is to end and the CG-6 begins, as required
by VDOT.
2. The Hetz Holly's are "rounded" plants growing to a height of 4-5 feet. I've enclosed a spec sheet
for your reference. To allow these plants to grow to their full height and width, we believe the 5'
on center spacing is required. We understand that planting these shrubs too close can affect
survivability. We believe the 5' o.c. spacing is sufficient and will allow the Holly's to develop
fully.
I have many of the agency approvals but am waiting for FCSA and VDOT. Once I receive them all, I will
forward them to your office.

We have enclosed a site plan application package for a branch bank on the north side of Berryville Pike
(Route 7) at the Millbrook High School access road. As you know the access road is currently under
construction. The site plan design was based on the roadway design plans. The utilities and entrances

In addition to those improvements necessary to support the bank operation, the sewer and water lines are
extended north to the next property. Additionally, a fire hydrant has also been required.
We've shown the necessary erosion controls to prevent loss and transport of sediment, and all of the
storm structures are designed for the ten year storm.
The existing set backs and easements are shown as well as the landscaping and screening required by the
Frederick County Zoning Ordnance. We believe we've satisfied all of the site plan requirements.

Thank you for the recent submission of the above -referenced site plan. Prior to administrative approval
of the site plan, all of Staffs concerns must be adequately addressed. These concerns are as follows:
REVIEW COMMENTS:
1) Curb Details. Please remove the 4" tall curb details from page 4 of 5. The Frederick County
Zoning Ordinance requires at least 6" tall curb.
2) Proposed Entrances. The proposed entrance to Route 7 (Berryville Pike) does not comply with
the entrance spacing requirements of the Frederick County Zoning Ordinance (see Section 165-
29). The proposed entrance to the Millbrook Drive satisfies the minimum spacing requirement;
however. staff encourages the use of a shared entrance with the parcel to the north. The existing
60' ingress/egress easement along the north property line could be used for this purpose.
3) Evergreen Hedge Row. Planting the proposed shrubs 5' O.C. may not completely screen on -site
headlights. Please determine if the proposed shrubs (Hetz Hollies) need to be planted closer
together in order to provide a complete screen (continuous evergreen hedge row). Typically,
hedge rows are planted 21/2' to 3' O.C.
4) Pavement Details. Please provide typical pavement details on page 5 of 5.
Staff has scheduled a public meeting with the Planning Commission on April 19, 2003 to discuss the
apparent transportation concerns with the site plan. Furthermore, the Planning Commission will consider
your request to waive the entrance spacing requirement for the proposed entrance along Berryville Pike
(Rt. 7) during this meeting.

I've enclosed a plan which shows a new entrance location to the bank site off of the High School Access Road.
I believe our previous location did meet the 150' separation, but it was close. We have shifted the entrance
towards the school about 18'. This provides the 70 foot separation to the entrance to the north (at the
ingress/egress easement) and at least the 150 foot separation to the Route 7 turn lane.
The Millbrook contractor can install these entrances the first week of April, so I need to have you confirm the
locations shown are acceptable fairly quickly.

The Frederick County Department of Planning & Development has reviewed the request to waive
the County's spacing standard for the above -referenced development. At this time a waiver cannot
bz! considered. A reasonable effort must be made to satisfy the required entrance spacing
requirements of the Frederick County Zoning Ordinance first. It appears that the existing 60-foot
ingress/egress easement can be utilized for access to the Millbrook High School Access Road.
Furthermore, access to Route 7 appears possible with a shared entrance with the eastern adjoining
property. Please make every possible attempt to make these entrance modifications.

We are submitting a site plan for a new branch bank on Route 7, just east of Denny Lane. The plans show a
right in/right out entrance on Route 7, east of the High School Access Road. This entrance is shown on the
High School road plans and, as I understand it, is being installed with that road's construction. This entrance
does not meet the County's entrance spacing requirements.
The Bank of Clarke County believes this entrance is critical to their operation. In fact, the lease agreement is
contingent on its installation. Therefore, as this entrance will be a right in/right out only, and meets VDOT's
entrance requirements, on behalf of the Bank, we request a waiver to the County's spacing standard. The
separation provided will be 120 feet. A copy of our site plan application package is attached.
