site plan on June 13, 2003. The site plan is approved for the construction of several building additions to the
existing Irongate facility located on Fairfax Pike in the Opequon Magisterial District. The site plan satisfies all
of the landscaping, parking, travel aisle, and other requirements of the Frederick County Zoning Ordinance. The
plan is also consistent with the proffer statement, dated February 6, 2001. All relevant review agencies have
provided approval of the project.
I am providing you with three copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an
approved copy must be kept on the construction site throughout the development process. Once site development

Dear Timothy:
I have had the opportunity to review the above -referenced site plan which you recently submitted to the
Department of Planning & Development. Staff has several concerns, which are listed below for your
consideration. Please look over these comments and then prepare a revised site plan which adequately
addresses each issue. I suggest that we schedule a meeting to go over these issues when we are both
available to do so. The first four of Staff's review comments are illustrated on the attached site plan.
Review Comments:
1) Screening of Proposed Outdoors Storage Areas. Outdoor storage is required to be completely
screened from adjoining properties and roads. Please provide full screening of these proposed
areas as required. If the intent is to preserve the existing evergreen screen in the front of the
property, then please show the screen on the site plan and provide language for clarification
purposes.
2) Number of Entrances/Driveways. Please eliminate one of the three entrances/driveways to the
property. Staff suggests removing one of the two southern entrances/driveways. Section 165-29
(9), Number of driveways, only allows one entrance/driveway on parcels that do not meet the
spacing requirements for entrances/driveways.
3) Proffer #2 - Common Shared Buffer & Screening Easement. Please provide the necessary
legal documentation of the required common shared buffer and screening easement. The proffer
requires at least 400 feet (350'inactive & 50'active) between the subject property and the parcels
identified by PINs 86-A-179C and 86-A-12. Typically, a plat is provided and then recorded for
common shared buffer & screening easements.
4) Access within Employee Parking Area. Staff suggests that a north travel aisle within the
employee parking areas be provided for better movement and access for employees.

5) Property Identification Number (PIN). Please correct the property identification number
found in the "Parcel Information" section of the site plan (Pagel/l0). The correct PIN of the
property is 87-A-12.
6) Magisterial District. Please correct the magisterial district information found on the site plan.
The property is within the Opequon Magisterial District, not Back Creek.
7) Site Layout Plan & Demolition Plan. Please separate the demolition plan (existing
improvements) from the site layout plan by creating a new page of the site plan. The fusing of
the two as presented is very difficult to read.
8) Proffer Statement. Please include the proffered conditions on the site plan. A copy of the
proffer statement is attached with this letter for your assistance.
9) Proposed Telecommunication Tower. The Frederick County Board of Supervisors must
approve all commercial telecommunication towers. The fact that the proposed
telecommunication tower is identified on the site plan with a lease lot implies that it will be a
commercial telecommunication tower. Please either remove the proposed tower or apply for a
Conditional Use Permit.
10) Proposed Truck Maintenance Facility. Please clarify on the site plan that the proposed truck
maintenance facility will only be used by the trucks operated by Irongate. Proffer #1 restricts
all other types of uses.
11) Surface Materials. Please provide concrete, bituminous concrete, or similar material for all
loading areas, maneuvering areas, and driveways. Gravel surface does not satisfy the
requirements of the Frederick County Zoning Ordinance.
12) Loading Spaces. Please show the location of all proposed loading spaces.
13) Cemetery. It appears that the proposed fabrication material storage area will completely
surround the existing cemetery. What type of cemetery is it? How will family members and
other people interested in visiting the cemetery access it? Is there adequate buffer and screen
between the material and firel storage? Is the fence existing or proposed? Who will maintain
the cemetery? How will stormwater impact the cemetery? Please address these concerns.
14) Inactive & Active Elements of North Buffer. The inactive and active elements of the Category
C buffer, along the north property line, are reversed. The inactive element should be the area
closest to the property line. Please correct as necessary.

15) Woodland Areas. Please identify all woodland and steep slope areas. Those that exist can be
shown on the existing conditions and demolition page.
16) Plant Species & Specifications. Please provide the species of all proposed plants; the height
of all proposed evergreen plants (at planting); and the caliper of all deciduous plants (at
planting).
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies
of the final plan for final administrative approval. Comment sheets are required from the following
agencies: Frederick County Inspections Department; Frederick County Engineer; Frederick County
Fire Marshal; Frederick County Health Department; the Virginia Department of Transportation.

Building additions shall comply with The Virginia Uniform Statewide Building Code and Sections
311, use group S ( Storage) for the truck maintenance building and 306, use group F (Factory)
for the additions to the shop of the BOCA National Building Code/1996. Other Code that applies
is CABO A] 17.1-92 Accessible and Usable Buildings and Facilities. The tanks and tower shall
comply with use group U (Utility) section 312 of BOCA and NFPA 30 and 58.
Demolition permit is required to remove the existing structures.
Please note the requirements for firewalls under section 707 of BOCA if Height and area
limitations are not met.
HC parking and access appears to in compliance for the shop building however it is not shown for
the truck maintenance building . Please note that all required egress man doors shall be accessible
to the exterior of the building. Section 1110.2.1 Exception # 1 (the ADA 20% rule for
renovations and addition) shall apply.
Design Professional lic. in VA shall seal the structural plans submitted for permit application and
special inspection requirements of Chapter 17 of BOCA shall apply to this type of structure.

PROFFER STATEMENT

INTRODUCTION
The subject parcel contains 49.69 acres, Currently 48.26 acres are zoned RA and 1.43
acres are zoned M-1. Adjacent property is zoned RA. The owner desires to rezone an
additional 14.43 acres within the parcel to M-1.
The intended purpose for the rezoning would be to allow the expansion of the existing
metal fabrication business of Irongate, Inc. The owner is willing to proffer a limit on the
type of use permitted on the proposed M1 zone.
Pursuant to the applicable provisions of the Frederick County Zoning Ordinance, the
undersigned applicant proffers that in the event that the Board of Supervisors of
Frederick County shall approve Rezoning Application # 02-01 for the rezoning of
14.43 acres on Parcel 87-((A))-12 from RA to M1, development of this particular 14.43
along with the existing 1.43 acres currently zoned M1 will be in conformity with the
terms and conditions set forth in this document. These terms and conditions may be
subsequently amended or revised by the owner of the property with permission from
the Frederick County Board of Supervisors in accordance with Frederick County codes.
These proffers shall be binding on the owner and their legal successors or assigns.
PROFFERS
1. The land and any improvements thereto will be expressly used for a metal
fabrication business as permitted under the M1 zoning.
2. The owner shall enter into a common shared buffer and screening easement
agreement between properties identified as Tax Map 87-A-12 and 86-A-179C to
satisfy the requirements of Section 165-37D(4) of the Frederick County Zoning
Ordinance. This buffer shall incorporate a minimum buffer between the two
parcels of 400 feet. The common shared buffer and screening easement
agreement shall be executed prior to the issuance of a building permit for
improvements on parcel 87-A-12.
Monetary Contribution to Frederick County Service Organizations
The owner of Parcel 87-((A))-12 will donate or will cause to be donated to the Stephens
City Fire and Rescue Company No. 11 the sum of $1000.00 for impacts to fire and
rescue services. This sum will be paid upon receipt of the first building permit issued
subsequent to the approval of this rezoning for any proposed structure.
The conditions proffered above shall be binding on the heirs, executors, administrators,
assigns, and successors in the interest of the owner. In the event that the Frederick
County Board of Supervisors grant this rezoning and accepts these proffers, then these
proffers shall apply to the land rezoned in addition to the other requirements of the
Frederick County Code.
