At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Continents: 1) Site and Zoning Data. On the coversheet under site and zoning data, there is a reference to an approved plan for "Preston Business Center Master Development Plan". This is not a County - approved plan and references to it need to be removed. 2) Adjoining Properties. On sheet 3, revise the data for 64-A-45N as indicated. 3) BuildinlZ Restriction Lines. On sheet 3, remove the 25' BRL from the buffer/environmental corridor area. 4) Office Area. On sheet 2, it states that there is office area on the site. ]'his area has not been shown on sheet 3. 5) Accessory Residential. The existing house is proposed to accommodate a SOOsf office and the rest is planned to be used for accessory residential. The square footage of the structure being used for residential needs to be labeled on sheet 3 and the labeling of the building needs to labeled as accessory residential and provide a reference to note 4 on sheet 2. 6) ParkinjZ Space Numbers and Loadinp, Spices. The parking spaces provided on the revised site plan do not meet ordinance requirements. There are spaces placed in the middle of pavement areas and spaces provided adjacent to loading areas. Parallel spaces are acceptable at the end of the units; however, if the units are not long enough to accommodate a full sized space, a parking lot for these spaces will be required. Also, the spaces associated with the office need to be placed next to the office and have curb and gutter. 7) Silzna.-e. The landscaping sheet only indicates a 5mph sign. Indicate ifthis use wants a business sign. 107 North Kent Street, Suite 202 • Winchester, Virginia 22601-5000 0 Mr. Paul Davis Bowman Consulting Group RE: Site Plan 09-06 August 29, 2006 Page 2 8) Dumpster Screening. The dumpster needs to be screened with a six foot board -on -board fence. 9) Security Fencing. A six foot security fence is required around the self storage site (§ 165-44G), the security fence provided connects to the retaining wall which does not appear adequate to serve as the security fence. If the retaining wall is to serve as the security fencing it needs to be six feet n height from the finished grade to the top of the hand rail. 10) Self StorajZe Landscaping. Plantings are required along the rear of the site in accordance with § 165- 44F(3)). 11) Plant Numbers and Schedule. The plantings required for § 165-27E(1 1) are separate than what is required for § 165-44F(3); counts for both requirements need to be provided on sheet 20 and shown on sheet 19. Also, the plant schedule needs to be separated between buffer trees and the trees required for perimeter and self storage landscaping. 12) Zoning District Buffers. The 100' Category A buffer requires a 75' inactive portion (adjacent to residential) and a 25' active portion. The landscaping associated with the buffer must be located within the inactive buffer. Also, there is a six foot opaque element required as part of the full buffer. This opaque element can be a six foot board -on -board fence, berm or wall. 13) Lease Agreement. A lease agreement for the self -storage units needs to be reviewed and approved by this Department before the site plan can be approved. 14) Special Limited Power of Attorney Form. The Special Limited Power of Attorney form was not included with the submitted package. After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. I will need all approved review agency comment sheets and at least Five copies of the final plan for approval. Comment sheets are required from the following agencies: the Frederick County Lishections Department, the Frederick Cotmty Fire Mcn4shal, the Frederick Cotmty Sanitation Authority, and the Virginia Department of TransI)ortation. This plat was recorded with instrument #060000004. 4. "Site Use. The site plan is called "Preston Business Center" and the zoning tabulations and application submitted stetted That the use is office ivar•ehouse. In a phone conversation, you stated that the site was actually self•slorage with accessary residential (existing house). The name of the site plan should reflect the use (Preston Self Storage); revise the plan to show the correct use. " Response: The name of the plat has been changecl to Preston Self Storage. 5. "Site and Zoning Data. On the coversheet under site and zoning data, there is a reference to an approved plan for "Preston Business Center Master Development Plan ". This plan was never approved by Frederick County and this site falls under the approved plan for Airport Business Center AIDP. " Response: This note on Sheet 1 of the plan has been changed. 6. "Zoning Tabulations. On sheet 2 under zoning tabulations, the follolving needs to be revised: ■ Remove density calculation; MI is based on FAR not density. ■ Open Space Tabulations — Change RP to All]. ■ Parking Calculations — self-slorage has a parking calculation of one space per 5,000sf of floor area that has not been accounled for. ■ Buffet- Area —Remove the statement about single - .family dwellings since it does not apply to this plan. ■ Open Space Calculations — the calculations provided are confil.sing (Open Space 91, 112, etc.) and have already been provided under- this zoning tabulations section. These calculations also conflict wilh other open space calculations. This table shows a total open space area of 3.09 acres and the other open space requirement shoit,n states that 5.02 acres are required" Response: The Zoning Tabulations on Sheet 2 have been revised as you have requested. Please refer to Sheet 19 for cletails of all buffers that are required. 7. "General Notes. On sheet 2, the folloiving notes need to he added/provided: ■ All ouldoor• lighting must be shielded to prevent glare onto acjoining properties and road right-of=hays. Ms. Candice C. A note needs to be provided that the accessory dvvelling can only be occupied by the owner of the business, an employee or a ivalchmcm. Response: The General notes on Sheet 2 have been amended to include the items you have requested. The note requesting shielded lighting has been arranged to include a continent from the airport authority. 8. "Adjoining Properties. On sheet 3, all adjoining properties need to include ov>>nei s name, property idenlificalion number, legal reference and use. " Response: The adjoining properties have been noted to include all the current information available on the current tax map and Courthouse record. 9. "Building Restriction Lines. On sheet 3, label the 75'.ji•onl BRL. Response: The front BRL has been labeled on Sheet 3 10. "Office Area. On sheet 2 it states that there is office ateu on the site. This area has not been shoitm on sheet 3. " Response: The office area referred to is a nominal area within the existing structure. We have no information at this time as to how this will be contained. The area of 500 SF is in excess of what the owner anticipates his office need to be. 11. "E.tisting Driveway. The existing driveway for the site goes into the Preslon Place development; indicate if this is actually an easement. " Response: There is an existing pond malntenanec casement but not one that includes the driveway. 12. "Pavement Details. A pavement detail needs to be provided for• the development. Also, on sheet 2 there is a streel detail. Since Muskoka is already built it, seems the detail is not needed unless alleralions are required by VDOT to the road " Response: A new pavement detail is shown on Sheet 2. 13. "Utilities. The plan shoivs waler being provided to the house but not a sevver line. Shovv the location of the sewer- line or the drainfield for the house. If the residence is currently on a ch•ainfield (public seiner encouraged), a Health Department Comment is required. " Response: A sewer lateral is now shown leaving the south side of the existing structure and connecting into the existing sanitary sewer. Ms. Candice C. Perkins June 12, 2006 Page 4 of 6 14. "Parking Lot and Driving Lames. If the house is going to become the office in addition to an accessory dwelling, it needs to have a parking lot that meets our standards. The house also needs to have a direct driving lane to it ivilh a minimum width of 24', so patrons don't have to tivecrve around storage units tofind the office. " Response: The driveway to the existing structure has been delineated with fire lane striping. Parking bays have been provided for the office use and the storage use. 15. "Parking Space Numbers and Loading Spaces. The parking sImices.for the office area and the self storage units have not been shown on sheet 3. On sheet 2 it states that there are a total of three parking spaces provided, one ol•which is handicap Accessible. The calculations on sheet 2 are incorrect. The office area requires one sp7ace for• 250sf'and the self storage requires one space per 5, 000sf of floor area. The handicap s1maces are only based on 2% of the total when you have more than 501 parking s1)ace•s (please see SS165-27E6). Sheet 2 also states that there are 101 loading s1mices provided; all loading spaces need to be delineated with striping. " Response: We have marked out the parking available and indicated the driveways between the buildings. As per our conversation on the phone of late, we have indicated direction arrows to be marked on the asphalt. This will indicate a 9' loading area in front of each unit and a single one-way drive island down the middle. 16. "Pavement Setbacks. The pavement along the eastern side abuts the property line; a five foot setback for pavement is required. " Response: The edge of pavement has been moved back 20' on this edge and the setback shown and labeled on Sheet 3. 17, "Si na e. Provide the location of any pr•ol)ose'd signs, along with the height and size. " Response: Signage is shown on Sheet 19, the landscape plan. 18. "Stream Location. The plan indicates an zlevation of 797.00. It will be necessary to ensure that the wall will allow for subsurface drainage. A building permit shall be applied for and obtained from the Inspections Department prior to construction of the retaining wall. 2. You have indicated DI-7 inlet structures on the site. The county requires the use of type III grates for safety purposes. Please note that the opening of a DI-7 is wide enough to allow someone's foot to slip in which, in turn, could cause an injury. Indicate that a Type III grate shall be used. Ditch Section F-F has a velocity which exceeds 5.0 feet per second based on your calculations. Although your erosion and sediment control narrative indicates the use of some check dams, it may be necessary to utilize erosion mattig in order to establish adequate vegetation. Verify that the existing channel located below the grading is adequately constructed to prevent erosion during storm events once the improvements have been performed. 4. The plan specifies the use of silt fence without wire reinforcement. With the exception of single family dwelling construction, the use of regular silt fence for commercial or subdivision projects is not permitted in Frederick County. The county requires the use of wire reinforced silt fence or a diversion berm for perimeter control. Because of the concentrated flow from the channel in the area located along the east side of the site it will be necessary to install a sediment trap. Silt fence will not be adequate to accommodate the drainage flow in the drainage channel. 107 North Kent Street - Winchester, Virginia 22601-5000 Preston Business Center Page 2 May 9, 2006 Once these comments have been addressed, SLlbmlt one (1) Copy of the revised plan for further review. At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments: 1) Property Identification Numbers. The site plan states that the properties to be developed are 64-A- 45 and 64-A-45J. The map on the coversheet includes 64-A-45, 64-A-45J, 64-A-450 and 64-A-45N. Revise the vicinity neap to show the properties actually being developed. Also, the property shown as 64-A-45N appears to be owned by a company called SSM, LLC. Please verify that this property is owned or controlled by Mr. Latham. 2) Site Area. Many ofyour calculations are based on 20.1 acres, which is the total area of64-A-45, 64- A-45J, 64-A-450 and 64-A-45N. It appears that only 64-A-45 is being developed with this site plan, which is only 11.12 acres. Revise the site plan to show the correct numbers. 3) Lot Consolidation. A lot consolidation will be required before this site plan can be approved. 4) Site Use. The site plan is called "Preston Business Center" and the zoning tabulations and application submitted stated that the use is office warehouse. In a phone conservation, you stated that the site was actually self storage with accessory residential (existing house). The name of the site plan should reflect the use (Preston Self Storage); revise the plan to show the correct use. 5) Site and Zoning Data. Oil the covei•sheet Undei• site and "zoning data, there is a reference to an approved plan for "Preston Business Center Master Development Plan". This plan was never approved by Frederick County and this site falls under the approved plan for Airport Business Center MDP. 6) ZoninjZ Tabulations. On sheet 2 under zoning tabulations, the following needs to be revised: • Remove density calculation; M 1 is based on FAR not density. • Open Space Tabulations — Change RP to M 1. • Parking Calculations — Self storage has a parking calculation of one space per 5,000sf of floor area that has not been accounted for. • Buffer Area — Remove the statement about single family dwellings since it does not apply to this plan. • Open Space Calculations —The calculations provided arc confusing (Open Space # 1, #2, etc.) and have already been provided under this zoning tabulations section. These calculations also conflict 107 North Dent Street, Suite 202 o Winchester, Virginia 22601-5000 R • • Mr. Paul Davis Bowman Consulting Group RE: Site Plan 409-06 March 22, 2006 Page 2 with the other open space calculations. This table shows a total open space area of3.09 acres and the other open space requirement shown states that 5.02 acres are required. 7) General Notes. On sheet 2, the following notes need to be added/provided: • All outdoor lighting must be shielded to prevent glare onto adjoining properties and road right-of- ways. • Individual units shall not exceed 1,OOOsf in size. • Unit Spacing — 30'. • A note needs to be provided that the accessory dwelling can only be occupied by the owner of the business, an employee or a watchman. 8) Adjoining Properties. On sheet 3, all adjoining properties need to include owner's name, property identification number, legal reference and use. 9) BuildinI4 Restriction Lines. On sheet 3, label the 75' front BRL. 10) Office Area. On sheet 2 it states that there is office area on the site. This area has not been shown on sheet 3. 11) Existing Driveway. The existing driveway for the site goes into the Preston Place development; indicate if this is actually an easement. 12) Pavement Details. A pavement detail needs to be provided for the development. Also, on sheet 2 there is a street detail. Since Musl<oka is already built it, seems the detail is not needed unless alterations are required by VDOT to the road. 13) Utilities. The plan shows water being provided to the house but not a sewer line. Show the location of the seNver line or the drainfield for the house. If the residence is currently on a drainfield (public sewer encouraged), a Health Department Comment is required. 14) Parking Lot and Driving Lanes. If the house is going to become the office in addition to an accessory dwelling, it needs to have a parking lot that meets our standards. The house also needs to have a direct driving lane to it with a minimum width of 24', so patrons don't have to weave around storage units to find the office. 15) Parking Space Numbers and Loading Spaces. The parl<ing spaces for the office area and the self storage units have not been shown on sheet 3. On sheet 2 it states that there are a total of three parking spaces provided, one of which is Handicap Accessible. The calculations on sheet 2 are incorrect. The office area requires one space for 250sf and the self storage requires one space per 5,000sf of floor area. The handicap spaces are only based on 2% of the total when you have more than 501 parking spaces (please see § 165-27136). Sheet 2 also states that there are 101 loading spaces provided; all loading spaces need to be delineated with striping. 16) Pavement Setbacks. The pavement along the eastern side abuts the property line; a five foot setback for pavement is required. 17) Signaae. Provide the location of any proposed signs, along with the height and size. 18) Stream Location. It appears that a stream flows through the rear of' the property. Provide the location as Nvell as the required riparian buffer. 19) Retaining Wall. Provide the height of the retaining walls. 20) Dunipster Location. A dumpster needs to be provided for the site. 0 0 Mr. Paul Davis Bowman Consulting Group RE: Site Plan #09-06 March 22, 2006 Page 3 21) Security Fencing. A six foot security fence is required around the self storage site (§ 165-44G). 22) RV Parking Area. Many self storage sites have RV storage areas. Indicate if this site is planning to have RV parking/storage. 23) Self Storage Landscaping. Self storage facilities have a separate landscaping requirement (§165- 44F(3)) that has not been incorporated into this plan. The site also requires one tree per l 0,000sf of impervious surface. 24) Zoning District Buffers. The rear of this property (adjacent to Greathouse) requires a zoning district buffer. It appears that sheet 2 recognized the required 100' distance, but sheet 19 does not show any buffers. If it is the intent to utilize a 50' woodland screen for the buffer, it needs to be shaded and supplemented as indicated on sheet 19. 25) Buffer Plantings. Calculations for the zoning district buffer need to be provided on sheet 20. The length of the buffer needs to be provided along with the number of trees required for this buffer. The plantings provided for this buffer do not meet ordinance requirements. The buffer must contain three trees per ten linear feet (1/3 deciduous). The landscaping provided consists mainly of ornamental shrubs (which cannot be used in buffer) and deciduous trees. A six foot high fence or berm is also required (provide detail). 26) Landscaping Notes. On sheet 20, notes need to be provided that state (1) all planting shall conform with § 165-36B of the Frederick County Zoning Ordinance (Plant selection, planting procedure, and maintenance), and (2) any plant substitutions must be approved in writing by the Frederick County Planning Department. Also, the plant schedule is labeled for townhouses. 27) Special Limited Power of Attorney Form. Please have the property owner sign the attached Special Limited Power of Attorney Form prior to further review or approval. This form should be notarized and completed to grant the applicant (you) with authorization to represent them for this site plan. After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan for approval. Comment sheets are required from the following agencies: the Freclerick County Inspections Department, the Frederick Colr))ty Depart))lent of Public ifhorks (C'ounij, Engineer), the Freclerick Counly Fire iWarshal, the Frederick Colmly Sanitation Authority, glad the Vll'gll)la Depariment q 1mmsj-)ol'1a1lon.
