Upon reviewing the associated site plan, and more specifically the Westminster Canterbury Drive entrance's location and design, staff has determined that the entrance as located does not comply with the Zoning ordinance, nor is a Planning Commission waiver available. This section of the ordinance states that "new driveways shall align with existing or planned driveways". The ordinance states that the alignment shall be required only if the resulting alignment is safe and meets the requirements of VDOT. It appears that the alignment of the entrances on \\lestminster-Canterbury Drive would be safe, unless VDOT specifies otherwise. Our department does concur that only the entrance onto Westminster -Canterbury Drive is subject to this requirement; not Sunnyside Plaza Drive since it is a private street. The current entrance shown onto Westminster-Canterbruy Drive on the submitted site plau does not qualify fora waiver. The Planning Commission can only waive the entrance alignment requirement \vhen it meets the specifications of § 165-2913. This section of the ordinance states that Planning Commission can allow other means of access that do not meet the requirements of §165-29A. Other means as described by the ordinance involve entrances \vhich physically limit or restrict left turns or entrances that ensure one way travel. The entrance shown Oil the submitted CVS site plan is a standard entrance that allows two-way traffic, and therefore does not qualify for a waiver. The letter you submitted also stated that the entrance as shown is needed to allow for the least amount of grade change and to meet the parking space requirement. These two issues do not negate the entrance alignment requirement and any entrances for this property onto Westminster-Cauterbury Drive need to align with the existing entrances on the opposite side of the road. Your letter states that "The entrances for the CVS need to align with the existing entrances on the opposite sides of Westminster Canterbury Drive and Sunglow Court (Sunglow Court is actually named Sunnyside Plaza Drive). Along with this letter you will find a drawing of the proposed site layout. The centerline of the entrance onto Westminster -Canterbury Drive is offset from the existing entrance to the car wash by approximately 50 feet. This is a design condition caused by the topography of the CVS Pharmacy site. In order to gain access to the store, this entrance must be as far south on Westminster -Canterbury Drive as possible. This affords the least amount of grade change between the existing street and the proposed store. Even as the entrance is designed, the slope of the entrance is approaching ten percent. Aligning this entrance with the car wash en- trance will result in an unacceptably steep driveway slope and the loss of parking spaces such that the minimum number of parking spaces required by code is not met. It appears to me that the entrance onto Sunnyside Plaza Drive is not subject to the require- ments of Section 165. Sunnyside Plaza Drive is a private street which provides access to the Sunnyside Plaza businesses. Please schedule this for Planning Commission action at the earliest possible time. Sidewalk: A 5' wide sidewalk has been added along the entire site frontage of Westminster -Canterbury Drive. Improvements including sidewalk has not been required by VDOT along Route 522. 6. Utility Strips: A 3' grass strip has been added between the back of curb and the edge of the sidewalk (per VDOT specifications). The detail on Sheet: 8 has been revised to reflect this change. 7. Crosswalks: Crosswalks have been shown on the plans. 8. Handicap Access: The error with the wheelstop locations at the handicap access ramp has been revised. 9. Ramps: Two CG-12 ramps have been shown at the site entrance off of Sunnyside Plaza Drive. 10. Loading Space: The loading space striping has been shown on the plans. 11. Entrance Alignment: The two proposed site entrances cannot be shifted to align with existing entrances across Westminster -Canterbury Drive and Sunnyside Plaza Drive. The existing site topography and the grading issues involved prevent such alignments. Please refer to the Site Grading Plan (Sheet: 4). 12. Landscaping Plan: The location of the proposed 25 Cotoneasters is to be in the landscape area directly in front of the CVS building entrance. This is illustrated by a hatch over the area. 16. Tree Location: The proposed trees have been relocated to the center of the islands. 17. Hedge Row: An additional hedge row has been added to the western end of the retaining wall. 18.
