In reference to the above project, you contacted Mr. John R. Riley, Jr., County
Adminlsti-ator, seeking guidance on an entrance issue. Upon reviewing the associated
site plan, and more specifically the Westminster Canterbury Drive entrance's location
and design, staff has determined that the entrance as located does not comply with the
Zoning ordinance, nor is a Planning Commission waiver available. The most appropriate
course of action would be to seek a variance from the Board of Zoning Appeals.

Re: Waiver Request for Entrance Alignment for the CVS in Sunnyside
Dear Mr. Lewis:
The Planning Department is in receipt of your letter dated April 13, 2006 requesting a waiver for the entrance
alignment requirement specified in § 165-29A(12) of the Frederick County Zoning Ordivancc. This section of the
ordinance states that "new driveways shall align with existing or planned driveways". The ordinance states that the
alignment shall be required only if the resulting alignment is safe and meets the requirements of VDOT. It appears
that the alignment of the entrances on \\lestminster-Canterbury Drive would be safe, unless VDOT specifies
otherwise. Our department does concur that only the entrance onto Westminster -Canterbury Drive is subject to this
requirement; not Sunnyside Plaza Drive since it is a private street.
The current entrance shown onto Westminster-Canterbruy Drive on the submitted site plau does not qualify fora
waiver. The Planning Commission can only waive the entrance alignment requirement \vhen it meets the
specifications of § 165-2913. This section of the ordinance states that Planning Commission can allow other means
of access that do not meet the requirements of §165-29A. Other means as described by the ordinance involve
entrances \vhich physically limit or restrict left turns or entrances that ensure one way travel. The entrance shown
Oil the submitted CVS site plan is a standard entrance that allows two-way traffic, and therefore does not qualify for
a waiver. The letter you submitted also stated that the entrance as shown is needed to allow for the least amount of
grade change and to meet the parking space requirement. These two issues do not negate the entrance alignment
requirement and any entrances for this property onto Westminster-Cauterbury Drive need to align with the existing
entrances on the opposite side of the road.

In reference to your letter dated March 23, 2006, 1 am requesting a waiver from the entrance
alignment requirements of Section 165-29A(12) of the Frederick County Zoning Ordinance.
Your letter states that "The entrances for the CVS need to align with the existing entrances
on the opposite sides of Westminster Canterbury Drive and Sunglow Court (Sunglow Court is
actually named Sunnyside Plaza Drive).
Along with this letter you will find a drawing of the proposed site layout. The centerline of the
entrance onto Westminster -Canterbury Drive is offset from the existing entrance to the car
wash by approximately 50 feet. This is a design condition caused by the topography of the
CVS Pharmacy site. In order to gain access to the store, this entrance must be as far south
on Westminster -Canterbury Drive as possible. This affords the least amount of grade change
between the existing street and the proposed store. Even as the entrance is designed, the
slope of the entrance is approaching ten percent. Aligning this entrance with the car wash en-
trance will result in an unacceptably steep driveway slope and the loss of parking spaces
such that the minimum number of parking spaces required by code is not met.
It appears to me that the entrance onto Sunnyside Plaza Drive is not subject to the require-
ments of Section 165. Sunnyside Plaza Drive is a private street which provides access to the
Sunnyside Plaza businesses.
Please schedule this for Planning Commission action at the earliest possible time. If you have

Enclosed please find revised plans for the CVS Pharmacy site plan identified as
SP-06-06. The plans have been revised to address the comments made by you and the
Frederick County Planning Department staff in your letter dated February 16, 2006.
The comments concerning the site plan have been addressed as follows:
1. Lot Consolidation: The lot consolidation is being conducted and shall be submitted
for signature upon its completion.
2. Parking Spaces: The parking calculations have been revised on Sheet:1.
3. Site Data: The 50' BRL has been added to the notes on Sheet:1.
4. Project Overview: The property information on the project overview has been
revised on Sheet:1.
5. Sidewalk: A 5' wide sidewalk has been added along the entire site frontage of
Westminster -Canterbury Drive. Improvements including sidewalk has not been
required by VDOT along Route 522.
6. Utility Strips: A 3' grass strip has been added between the back of curb and the
edge of the sidewalk (per VDOT specifications). The detail on Sheet: 8 has been
revised to reflect this change.
7. Crosswalks: Crosswalks have been shown on the plans.
8. Handicap Access: The error with the wheelstop locations at the handicap access
ramp has been revised.
9. Ramps: Two CG-12 ramps have been shown at the site entrance off of Sunnyside
Plaza Drive.
10. Loading Space: The loading space striping has been shown on the plans.
11. Entrance Alignment: The two proposed site entrances cannot be shifted to align
with existing entrances across Westminster -Canterbury Drive and Sunnyside Plaza
Drive. The existing site topography and the grading issues involved prevent such
alignments. Please refer to the Site Grading Plan (Sheet: 4).
12. Curb and Gutter: CG-6 has been added to the entire site frontage of
Westminster -Canterbury Drive.

13. Directional Arrows: The directional pavement arrows have been revised.
14. Trash Enclosure: The gates specified are faced with opaque 18 gauge corrugated
steel deck panels. They have been specifed because of their durability and
appearance. The dumpster enclosure detail has not been revised to reflect board on
board gates.
15. Landscaping Plan: The location of the proposed 25 Cotoneasters is to be in the
landscape area directly in front of the CVS building entrance. This is illustrated by a
hatch over the area.
16. Tree Location: The proposed trees have been relocated to the center of the
islands.
17. Hedge Row: An additional hedge row has been added to the western end of the
retaining wall.
18. Special Limited Power of Attorney Form: The form has been sent to the owner
for completion and will be submitted upon completion.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
gencies, have been adequately addressed. Please review Staffs comments
well as all issues of the other review a
listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Sidewalk. Route 522 is classified as a major arterial road. in accordance with §144-18, sidewalks are
required along all arterial roads. Please provide a sidewalk along CVS's portion of Route 522.
2) Entrance Alignment. In accordance with §165-29A(l2), "new driveways shall align with existing or
planned driveways". The entrances for the CVS need to align with the existing entrances on the opposite
sides of West►ninster Canterbury Drive and Sunglow Court.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the
plan. I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required from the following agencies: the Frederick County Inspections Deparhnent, the
Frederick County Department of Public Works (County Engineer), the Frederick County Fire Marshal, the
Frederick County Sanitation Awhority, and the Virginia Department of Transportatior?.

Dear John:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Lot Consolidation. A lot consolidation needs to be done before this site plan can be approved.
2) Parking Spaces. On Sheet 1 under general notes, the parking calculations show parking for
office and retail. This use is considered completely retail and the parking needs to show only
that calculation.
3) Site Data. On the coversheet, the 50' BRL needs to be shown under site data.
4) Proiect Overview. On the project overview on the cover sheet, the legal reference for all
adjoining properties must be shown, and there is one property that has not been identified.
5) Sidewalk. The sidewalk needs to be extended along Westminster Canterbury Drive as indicated
Oil the plan, as well as provided along CVS's portion of Route 522; also a five foot sidewalk is
recommended.
6) Utility Ships. A two foot grass strip is required between the sidewalk and the curb; sheet 3
needs to be revised to show this, as well as the detail on sheet 8.
7) Crosswalks. Provide crosswalks as indicated on the plan.
8) Handicap Access. I -IC spaces are shown near the main entrance to the CVS, but it is unclear
how they will get onto the ramp due to the location of some of the wheelstops. One HC space
does not have a wheelstop, but the striped isle adjacent to it does.
9) Ram s. Ramps need to be shown on the entrance on Sunglow Court.
10) Loading Space. The loading space shown next to the building needs to be striped.
11) Entrance Alignment. The entrances for the CVS need to align with the entrances on the
opposite sides of Westminster Canterbury Drive and Sunglow Court.

12) Curb and Gutter. Curb and gutter needs to be continued along this site's entire frontage of
Westminster Canterbury Drive.
13) Directional Arrows. Some of the arrows should be moved as indicated, and additional arrows
should be shown as indicated.
14) Trash Enclosure. On sheet 12, the trash enclosure detail seems to indicate that the gates are
steel; the gates should be board -on -board. If the intent for the gates was to be board -on -board,
please label them.
15) Landscaping Plan. The plant list states that 25 Cotoneaster's are being used for ground cover;
the location of these plants is not shown on the plan.
16) Tree Location. On sheet 9, there are two islands that have one tree each and the trees are both
located at the end of the island. Two trees should be provided on these islands, or the one tree
should be centered on the island.
17) Hedu Row. On sheet 9, the hedge row should be extended as indicated.
18) Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them for
this site plan.
After you have revised the site plan, please resubmit one cop), so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for approval. Comment sheets are required from the following agencies: the Frederick
County Inspections Department, the Frederick County Department of Public Works (Count); Engineer), the
Frederick County Fire Marshal, the Frederick County Sanitation Authority, and the Virginia Department of
Transhoriat ion.
