application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it If any portion of the application is not complete, it will be returned to the

(1} One (1) set of approved comment sheets are required from each relevant review

The Frederick County Department of Planning and Development administratively approved the
above -referenced site plan on March 6, 2006. The site plan is approved for the construction of a
retail and auto parts installation business on a site located off of Sulky Drive in the Shawnee
Magisterial District. This construction includes the following:
2,000 square feet of retail space
4 bay garage (7,334 sq. ft.)
600 square feet of office area
The site plan meets all requirements for development in the B2 (General Business) Zoning
District. All relevant review agencies have approved the project at this time. I am providing you
With four (4) copies of the approved site plan. Please forward these copies to the appropriate
representat ive(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office

Dear Mr. Artz:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This
site plan is denied until the issues in this letter, as well as all issues of the other review
agencies, have been adequately addressed. Please review Staffs comments listed below
and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1. Magisterial District. The correct magisterial district for this project is
Shawnee.
2. Adjoining Properties. The adjoining properties need to provide the acreage.
The lots across Sulky Drive to the West need to be displayed with proper
detail.
3. Driveways. The distance to the existing driveway to the North needs to be
displayed on the site plan.
4. Landscaping. The evergreen hedges need to be displayed on the site plan as
having a three foot height. The quantity also needs to be displayed
(measurements are three foot off center).
5. General Notes. Within the General Notes section of the plan, include
notations that `all utilities will be underground,' and `all outdoor lighting must
be properly shielded to prevent glare onto adjoining properties and road right
of ways.'
6. Loading Space. The loading space is required to display all dimensions.
7. Setbacks. The required setbacks on the cover sheet need to be reversed.
8. Proposed Use. This use has an installation component with it, which needs to
be included on the cover sheet.

9. Parking. The warehouse parking provided needs to change to reflect what is
required by the Frederick County Zoning Ordinance (one space per
employee).
10. Designated Waste Disposal Area. The dumpster pad needs to display a
fence detail. The dumpster pad location should ensure that car parking will
not be negatively affected by the placement of it. The concrete pad that the
dumpster will sit on needs to be shown on the plan.
11. Structure Detail. Please display location and dimensions of the uses in the
building warehouse/garage bays/office/showroom. The warehouse is shown
at more than half the structure (5,400 sq. ft.), which would mean that
warehousing is the primary use. Warehousing is not a permitted use in this
zoning district and needs to be reclassified as a garage bay area or made
smaller to be classified as accessory (25% or less).
12. Sidewalk. Curb and gutter need to be placed along the sidewalk that adjoins
the building.

This is to acknowledge receipt of your revised plans with latest revisions dated December 5, 2005 for
the referenced project. The plans appear satisfactory and are approved sirbiect to correction of the
items noted below. Please advise the developer accordingly. Since Sulky Drive has not yet been
accepted into the State Secondary System, a land use permit will not likely be required. Please
provide 2 sets of approved construction plans with signed seal for VDOT distribution.
The following comments need to be addressed on the final plans submitted for VDOT distribution:
1. On sheet 2, indicate the radius of curb return at the entrance to Sulky Drive. It appears to be 25
feet.
2. On sheet 2, add a note at the entrance to Sulky Drive as follows: CG-12 accessible ramps shall
be provided as directed by the VDOT inspector.
3. On sheet 2 with regard to sight distance along Sulky Drive, a minimum of 280 feet would be
required for 25 mph design speed. Please re-evaluate the sight distance to the south which
appears from our field review to be in excess of 300 feet and update the plans accordingly.
4. On sheet 6, provide the latest VDOT standard details for standard CG-I I (REV. 7/01) and
PB-1, Sheet 2 of 4 (REV. 7/05). See the attached Instructions for Downloading VDOT
Road and Bridge Standards.
I offer the following general comments relative to the approval of these site plans:
A preconstruction conference be held by the engineer and/or developer with the attendance of the
contractor, various County agencies and VDOT prior to initiation of work.
Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
Our review and comments are general in nature. Should conditions in the field exist such that
additional measures are warranted, such measures shall be completed to the satisfaction of the
Department prior to inclusion into the Secondary Road System.
All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a
pipe or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any undetermined length of
time. VDOT will also require 48 hours notice for inspections.
If any work is to take place on VDOT right-of-way, the appropriate land use permits shall be

obtained before any work is performed on the State's right-of-way. The permit is issued by this
office and will require a minimum processing fee, surety bond coverage, and the salary &
expenses of a State assigned Inspector.
If mailboxes are to be placed along the roadway fronting lots, a minimum of 4' sliall be between
the edge of pavement and the front of mailbox as shown on VDOT standard RFD-1 (REV. 7/04).
A} n y entrances constructed from the referenced street(s) shall meet VDOT minimum standards
since Sulky Drive will be proposed for acceptance into the State Secondary System.
Any signs to be installed will be in accordance with attaehments.
I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled
completely with C.R. Type 121-B Stone. This will greatly reduce the possibility of any pavement
settlement.
A copy of any/all recorded plats of dedication for drainage easements or additional right -of way
required for implementation of this proposed project sliould be provided to VDOT prior to
issuance of any land use permit. Dedication sliould be made to the Commonwealth of Virginia.
A copy of any/all RECORDED PLATS of dedication to public use (the County of Frederick) for
drainage easements or additional right-of-way required for implementation of this proposed
project should be provided for VDOT review prior to issuance of any land Use permit.

Other Code that applies is ICC/ANSI Al 17.1-98 Accessible and Usable Buildings and
