The Department of Planning and Development will review the application to ensure that it is
complete. If any portion is not included or complete, the site plan application will not be accepted

I represent Preston Place Apartments in an effort to obtain a Certificate of
Occupancy for their recently completed building near Airport Road in Frederick County.
Pursuant to our recent discussions, it is my understanding that representatives of
the Planning and Development Commission will view the property on Friday, August 8
in the afternoon to determine if there is substantial progress in building a fence behind
this unit. In the event that progress has been made, a certificate of occupancy would be
issued on Friday, August 8, 1997 so that individuals may move into these units. We
anticipate the fence will be completed the following week.

Zoning Administrator shall also have the authority to delegate various
administrative responsibilities to other members of the county staff.
B. The Zoning Administrator shall have the authority to order, in writing,
the remedy of any noncompliance with this chapter. The Zoning
Administrator shall also have the authority to bring legal action to
ensure compliance, including injunction, abatement or other
appropriate action or proceeding.
C. The Zoning Administrator shall also have the authority to make
interpretations concerning the application of the requirements in this
chapter. Interpretations of the Zoning Administrator may be appealed to
the Board of Zoning Appeals following procedures set forth in this
chapter.
§ 165-5. Compliance required; required permits.
A. No building or structure shall be used, occupied, developed, located,
relocated, constructed, reconstructed, enlarged or structurally altered
except in compliance with the terms and provisions of this chapter and
any other applicable ordinances and regulations. Compliance shall
require the issuance of a permit by the Director of Code Administration.
B. No land shall be used, occupied or developed or lots created or altered
except in compliance with the terms and provisions of this chapter and
any other applicable ordinances and regulations.
C. Any person who proposes to construct or alter any building or use or
alter the use of any building, structure or land shall apply for a permit
from the Director of Code Administration. Such application shall
include all information necessary to determine if the requirements of
this chapter have been met. The Director of Code Administration shall
submit this application to the Zoning Administrator, who shall certify
whether the proposed use is in compliance with this chapter. If such
proposed use is not in compliance with this chapter, the Director of
Code Administration shall refuse to issue a permit for the use.
D. No use or structure shall be occupied until a certificate of occupancy
has been issued by the Director of Code Administration. No certificate
of occupancy shall be issued unless all requirements of this chapter
have been met.

Dear Mr. McNamara:
The Frederick County Planning Department administratively approved revisions to Site Plan #039-96
for the above referenced project on January 28, 1997. This site plan was revised to lower pavement
elevations, change finished floor elevations, lower sanitary sewer and water lines, lower storm sewer
pipes, reconfigure the erosion and sedimentation control basin, change Netherfield Court to Leafield
Court, and redesign the landscaping plan. All other improvements identified in my letter dated
November 1, 1996 still apply to this project.
I have provided you with two copies of the approved site plan. Please provide a copy to the general
contractor to maintain on -site and keep a copy for your records. Please advise the general contractor
to contact this office to schedule inspections as necessary to obtain Occupancy Permits. Please
contact me if I may answer any questions regarding this letter.

Recently, our department contacted you to discuss the need for a new road name in the above
referenced development. Specifically, Netherfield Court has been utilized in the Preston Place
apartment complex located on the south side of Airport Road; therefore, this road name is not
available for other areas of the county or the City of Winchester. Your suggested road name of
Leafield Court has been reviewed and is acceptable. This name will be reserved for this development
for the purpose of providing structure numbers.
Our department will not require you to resubmit new site development plans that reflect this change;
however, this change should be reflected on any plat, deed, or other information requiring legal
recordation. Our department will require this information on subsequent site development plans
should there be a revision to the approved design for this project. By copy of this letter, I am
advising the project manager of this road name change. Please ensure that all required street signs

As requested, we have reviewed your revised site plan dated August 1, 1996 for the
referenced project. The plan appears satisfactory as submitted and is approved contingent
upon Preston Place being designated as private and a note being added to the plan
indicating the street will be maintained by some entity other than the Virginia Department
of Transportation. The owner should understand this street cannot be considered eligible
for addition to the State Secondary Road System.
Additionally Frederick County should be aware traffic generated by this project will hasten
the need for a traffic signal at the Route 522/642 intersection.
If it becomes necessary for the developer to perform any work within the Route 642
right-of-way, he will be required to obtain a land use permit to cover same. The permit is
issued by this office and will require a fee and surety bond coverage.

I have had an opportunity to review the revisions for the above referenced site plan, received by our
department on December 23, 1996. As you know, a site plan for this project was approved by
Frederick County on October 31, 1996. The approved site plan has been revised to lower pavement
elevations, revise finished floor elevations, lower water and sewer lines, revise stormwater pipes,
revise the erosion and sedimentation control plan, change one of the street names, and revise the
landscaping plan. In order for our department to approve this new design, the following information
needs to be provided:
1) Revise the landscaping plan to provide 11 additional screening border trees. The number of
plantings required and provided do not jibe.
2) Provide an approved review agency comment from the County Engineer.
3) Provide five copies of the final revised site plans that include your name and date on the
Professional Engineer Seal.

The overall design of this plan is adequate; however, there are some minor revisions that will need

Preston Place Apartments - Phase II
Dear Mr. Watkins:
Attached is a copy of a letter dated October 23, 1995, in reference to the above outlining the
Airport Authority's position on the continuing development of Preston Place Apartments.
After the development of Phase I, there has been growing increase in traffic on Airport Road
and the Airport itself has experienced an increase in vandalism and trespassing. An
expansion of the population density for that area will only attribute to these problems.
The Airport Authority strongly urges Frederick County to enforce prior recommendations
that were agreed upon by Mr. McNamara, President, Castle Development, as stated in a
letter dated September 16, 1992, (see attached).

the September 2nd Planning Commission meeting by the Winchestex Regional
Airport Authority and others pertaining to the perceived and real noise and fly-
over nuisance created by the relatively close proximity of the air port to the
proposed apartments. -
Castle Development Corporation, as Managing General Partner of Preston
Placc Associates, L.P., hereby agrees to:
• Require all residents to sign a separate document notifying the resident of the
probable aircraft noise and Fly -over nuisance,
• Prominently post warnings with specific regard to the proximity of the airport
and probable aircraft noise and fly -over nuisance on all advertisements,
brochures and promotional materials,
• Construct all buildings so as to minimize interior noise by complying with the
Virginia Power Energy EfEciency Standards which includes extra insulation,
double glazed windows, insulated steel exterior doors and heat pm-nps for air
conditioning. These enemy standards are required by the Virginia Depwtmerat
+ of Housing and Community Development under the Tax Credit Program
which they administer.
We look forward to working with the County and the Airport Authority to
make Preston Place Apartments a cm=unity everyone is proud of.

EASEMENT AGREEMENT
KNOW ALL MEN BY THESE PRESENTS that the undersigned, SILVER
COMMUNITIES, INC., a Virginia corporation, as the owner of a fee
simple estate (hereinafter referred to as "Grantor"), for and in
consideration of the sum of Ten Dollars ($10.00) in hand paid,
the receipt and sufficiency of: which is hereby acknowledged and
confessed, does hereby GRANT, BARGAIN, SELL and CONVEY UNTO C.
DOUGLAS ADAMS and FERN L. ADAMS, husband and wife (hereinafter
collectively referred to as "Grantee"), an easement on the real
estate located in the Shawnee Magisterial District, Frederick
County, Virginia, described in Exhibit "A" annexed hereto and
hereby made a part hereof (said real. estate hereinafter being
referred to as the "easement area") for the purpose of
permitting Grantee to use the easement area as a vegetable
garden and general yard use for the••benefi:t'of the adjacent
property owned by Grantee and described in Exhibi. ''B" attached
hereto -(the Grantee's Parcel")
It is understood and agreed that this easement is solely
for the purpose of granting an easement for a vegetable garden
and general yard use in the easentent area for the benefit of the
Grantee's Parcel. It is furthe.7 understood and agreed that at
such times the easement area is not being used by Grantee for a
vegetable garden, Grantee sh l.l. plant and maintain grass in
',.i:•. sole responsibility to keep and
easement area. Grantee has
maintain, at their expense, the easement area free from
unsightly weeds and/or overgrowth and Grantee shall maintain the
same at all times, except those portions of the easement area
used by Grantor for the purposes set forth below. Grantee shall
not erect, install or maintain any structures or improvements on
the easement area.
Notwithstanding anything to the contrary contained herein,
Grantor shall have the right to use portions of the easement
area for fencing, berming, mounding, landscaping, and other
similar uses in connection with Grantor's development and use of
Grantor's property adjacent to the easement area. To the extent
portions of the easement area are so used by Grantor for such
purposes from time to time, the easement and rights granted to
Grantee Herein shall be limited and restricted accordingly, and
Grantor's use of such areas shall be free and clear of such
easement rights of Grantee. To the extent feasible andrantor
practical (in connection with Grantor's development),
shall locate berm and other such improvements on the eastern
portion of the easement area and will. at.t�'mpt t(-
).nterference with Grantee's use of the easement area.
The Grantor her -by reserves the right to grant easements to
utilities or service which may intersect or transect the
easement granted her( ender.

assigns, for the benefit of Grantee's Parcel, in perpetuity.
Grantee shall indemnify, defend and hold harmless the
Grantor and its successors and assigns from and against any and

actions and causes of action arising out of or resulting from
Grantee's use and enjoyment of this easement, including, without
limitation, any and all claims and actions for personal or
bodily injury, including death, to any person, and damage to the
property of any party.
