WITNESSETH:
WHEREAS, Adams Family Partnership is the owner of that certain property
lying in Shawnee Magisterial District, Frederick County, Virginia, as more particularly
shown on that certain plat of Elliott Ritchie, Jr., Land Surveyor, dated November 30,
1999, known as Final Plat of a Division of a Portion of the Land of Adams Family
Limited Partnership, a copy of which is attached hereto and by this reference made a
part hereof, and
WHEREAS, said property is a portion of the land conveyed to the party of the
first part by Deed dated May 23, 1994 and recorded in the Clerk's Office of the Circuit
Court for Frederick County, Virginia in Deed Book 826, at Page 479; and
WHEREAS, said subdivision has been approved in accordance with the laws of

Enclosed you will find a copy of the Site Plan proposed for Powell's Plumbing. The comments you
provided, have been addressed appropriately. however, two of the comments have not been
changed with respect to the site plan. The first makes reference to your comment #5 concerning
the truck staging area. Please note that the truck staging area will serve as an area to unload track
vehicles on gravel so as not to damage the asphalt parking area. Comment #7 concerns the
planting size of the proposed plants in the plant list on sheet 4. The planting size has been indicated
according to the caliper of the Deciduous trees and the height of the Evergreen trees. Should these
sizes prove to be inadequate or you develop any additional comments or questions please feel free

Dear John:
I have had the opportunity to review the revised site plan which was submitted to our department on
January 18, 2000. The following comments should be addressed and included in a revision of this site
plan.
Please insure that the site plan contains the correct Property Identification Number (PIN) and
owner information. Real estate records indicate that the parcel number is 64-A-45J and that the
owner is Powell's Investments, LLC, of 214 Waterloo Court, Winchester, VA, 22602.
J�. Please eliminate the statement regarding free-standing lighting found in Number 11 of the
General notes. Number 13 of the construction notes is adequate.
r. In the parking calculation, please indicate the total number of company owned vehicles to be
located at this site and provide a sufficient number of parking spaces. A minimum of one space
must be provided for each company vehicle to be parked on the property.
�. As opposed to a six (6) foot chain length fence with plastic opaque slats, please provide a six (6)
foot board on board fence to provide effective screening of the trash receptacle. Please provide
a detail of the board on board fence.
5. In essence, a truck staging area is a parking area and must be paved with the appropriate surface
material. Furthermore, the installation of curb and gutter is required around the perimeter of the
parking area per section 165-27E.(3) of the Frederick County Zoning Ordinance. Appropriate
perimeter and interior landscaping is required for all parking areas. The parking perimeter is
approximately 400 ft., which yields a total of 10 shade trees. Please adjust the site plan and
landscape notes as needed.

6. Sheet 4 does not appear to correspond to Sheet 2. On Sheet 4, the rear parking configuration
is different and the trash receptacle has been relocated. Please resolve all conflicting information
on these sheets.
7. In the Plant List on Sheet 4, please indicate the size of all vegetation in terms of feet and inches.
8. Please delineate the location of all fire lanes on the subject property in accordance with the
requirements of the Fire Marshal or provide a statement which addresses this requirement.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need all approved review agency comment sheets and five copies of
the final site plan for approval. Comment sheets are required from the following agencies: the Virginia
Department of Transportation, the Frederick County Sanitation Authority, the Frederick County
Inspections Department, and the Frederick County Fire Marshal.

We have received your revised site plan dated 01/18/00 (received 01/20/00) for the
referenced project. It appears all of our earlier review comments have been
satisfactorily addressed. Please advise the owner of our approval. Also please
provide six (6) additional sets of approved construction plans with signed
seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the
right-of-way. The permit is issued by this office and will require a minimum processing
fee, surety bond coverage, and the salary & expenses of a State assigned Inspector. A
copy of any/all plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior
to issuance of any land use permits. Dedication should be made to the Commonwealth
of Virginia.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue. Should you have any questions, do not hesitate to
call.

I have had the opportunity to review the above -referenced site plan submitted to our department on
December 6, 1999. The following comments should be addressed and included in a revision of this site
plan. I have also marked the enclosed plan for your use.
1 Please provide'a recorded plat of the subdivision necessary to form the subject parcel.
2 Please clarify the nature of the outdoor storage area. In accordance with Section 165-33.A.,
please note that all outdoor storage areas in industrial districts must be appropriately screened
from roadways and adjoining properties by a fence, wall, or by screening. Alternatively, if the
area will be used for parking, please note that an appropriate surface treatment must be applied.
Please state the proposed use of the building and identify each of the proposed uses within the
building footprint.
4 Please ensure that information regarding the location of all easements, including access, utility and
drainage easements, are displayed on the site plan.
Please delineate the location of all fire lanes on the subject property in accordance with the
requirements of the Fire Marshal.
6. Please provide information on the site plan regarding the parking and storage of company -owned
vehicles.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need all approved review agency comment sheets and five copies of the
final site plan for approval. Comment sheets are required from the following agencies: the Virginia
Department of Transportation, the Frederick County Sanitation Authority, the Frederick County
Inspections Department, the Frederick County Engineer, and the Frederick County Fire Marshal.
