The purpose of this memo is to record the allowance made regarding the parking requirements for
the above referenced site plan. The approved site plan for this development included a new sanctuary
for the church, as well as additional parking to accommodate the sanctuary. Based on a 200-seat
sanctuary as specified on the plan, 67 parking spaces were provided. However, when the building
official, John Trenary, conducted an occupancy count, the number of seats in the sanctuary was 305.
Based on the new occupancy, 102 parking spaces are required.
Pastor RonNeffexplained that the church installed additional pews as an afterthought, which affected
the occupancy count. The option of a shared parking agreement was explored. Unfortunately, a
shared parking agreement could not be reached because the potential adjoining property is zonedMI.
The zoning ordinance does not allow for shared parking on parcels which are zoned differently.
In light of the fact that parking is more than adequate based on the current Sunday attendance, the
parking situation will be allowed to remain as is. Allowance for this modification was approved by
the Department of Planning and Development Director on October 5, 2000. Pastor Neff has
submitted a letter of the church's obligation to expand the parking when necessary.

Dear Amy,
In reference to our meeting concerning the seating capacity
of our new church and the number of parking spaces we presently
have, this letter that you requested is for the purpose of
confirming our intention of adding additional paved parking
spaces in the future as they become needed.
To date, we are presently averaging 80-90 people in attendance
in our largest service of the week, using about one half of our
available parking.
We do plan to accomodate anticipated growth in our parking
facilities and otherwise.

site plan on December 16, 1999. This site plan, for the construction of a 5,270-square-foot addition to an
existing church, meets all County requirements for development within the RA (Rural Areas) Zoning District.

The application of V. V. Cutshaw, Trustee, Pentecostal Holiness Church,
requesting a front yard variance for the Church on the premises designated as
Deed Book 313, Page 49, fronting US Route 11, north, Stonewall Magisterial District.
Action - Granted
The Secretary read the application to the Board.
Rev. Charles Perrine, minister representing the Pentecostal Holiness Church,
appeared before the Board and told them they were planning to enlarge the
Sanctuary so that the Church would have room to grow and become more effective
in the community.
The Chairperson stated that most of the Board members had inspected the
property. She said there was some question about adding eighty-five (85) feet
towards the highway. She stated this eighty-five (85) feet would cause the Church
to extend beyond the parsonage.
Mr. Christianson stated he had a concern about the Church building extending
beyond the parsonage. He explained he thought buildings should be kept in line
and that the Church should not extend beyond the parsonage.
Rev. Perrine argued that they needed the space in order to fulfill the needs
of the community. He told the Board they had to add to the front of the existing
Church because the septic system was behind the Church and they had planned to
put in some recreation facilities for the members.
A discussion was held on this extention of the Church beyond the parsonage.
Mr. Swift brought up the fact that the application stated forty-four feet
(44') relief was being planned and that the plat stated thirty feet (30'). He
said that these two figures did not agree and they should be clarified.
Rev. Perrine stated that the plat was correct and there must have been an
error on the application. He asked if the Board could change the number so that
it could be voted on at this meeting.

A discussion was held on whether the Board could change the application.
Mr. Swift stated that the application should not be changed once it is
turned in to the Zoning Administrator and advertised.
It was discussed that perhaps the Board could table the application so that
Rev. Perrine could fill out another application.
Rev. Perrine stated that since exceptions had been made to let two applications
be heard even though they were applied for after the cut-off date, he saw no
reason why the numbers on the application couldn't be changed so that the Church
would not be delayed.
Mr. Adams said he didn't think it would be right to change the numbers on the
application since it had been advertised for a public hearing with the information
available on the application.
Miss Stefen stated that no one had inquired about the variance and that the
figures do not get advertised in the newspaper.
Rev. Perrine stated that he had contacted each adjoining property owner and
they were all one hundred percent in favor of the Church addition.
The Board discussed this application further.
The Chairperson announced that in the staff comment in the agenda it
stated a thirty (30) foot variance.
Upon motion made by Ralph Wakeman, seconded by Robert Hockman and approved
by the following vote: Christianson - ABSTAIN
Hockman; Wakeman; Adams; Chairperson - YES
BE IT RESOLVED, That the Board of Zoning Appeals for the County of Frederick,
Virginia does hereby grant a thirty (30) foot set back variance No. 020-77 to
V. V. Cutshaw, Trustee, Pentecostal Holiness Church.

Dear John:
I have had the opportunity to review the above referenced site plan submitted to our department on October
14, 1999. The following comments should be addressed and included in a revision of this site plan. The
submitted plan is also marked with these comments.
Please reference the variance application number (#020-77, granted 10-18-77) applicable to this
property. County records indicate that the church received a 30' front yard variance. Clearly state the
30' variance in the General Notes and delineate this setback on the site plan.
Please note that the parcels located across the Route I 1 right-of-way should be identified by the
following PINS: 44B-1-8A, 44B-1-10A, 44B-1-11A and 44B-1-12B. Furthermore, the zoning for
PIN 44-A-50 is M1. Real estate records also indicate that the owner of parcel 44B-1-8A is Elouise
R. Sirbaugh. Note that PIN 44-A-51 is an adjoining property and provide the use and zoning for this
parcel on the site plan.
Please show all applicable setbacks (front, side, and rear yards) as stated in the project summary. It
appears as though the 50' side and rear setbacks have not been met for the proposed sanctuary.
Please state the location and nature of any proposed outdoor storage. If none is proposed, please
provide a note to this effect on the site plan.
Please provide information regarding the location of outdoor trash receptacles. If none are proposed,
please provide a note to this effect on the site plan.
6. Please state the height and square footage of the existing brick church on the site plan.
Please show the locations of all entrances on adjoining roads within 200 feet of the existing entrance.
This includes those entrances located across the Route 11 right-of-way.
Please show the size of all existing sewer and water lines.

9. Please place a T hedge row along the parking area to mitigate the impact of vehicle headlights on the
adjoining residential property. Please refer to the mark-up plan for clarification on the placement of
this hedge row.
10. In order to insure safe and efficient traffic circulation, please show pavement markings at both ends
of the interior parking spaces. This will eliminate one parking space from that row which will need
to be relocated. Please refer to the mark-up plan for clarification on the placement of these markings.
11. Please show the location and width of all casements, including access, utility, and drainage casements.
12. Please show the location and dimension of all ramps designed for handicap access.

We have received your revised site plan dated July 20, 1999 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also please provide seven (7) sets of approved construction plans
with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route I I
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.
