SITE PLAN CHECKLIST
The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is
complete. If any portion is not included or complete, the site plan application will not be accepted
and returned to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

We have reviewed the plan you recently provided which reflects as -built conditions of
the Route 694 reconstruction in conjunction with the referenced project.
I have enclosed a copy of the plan with our comments marked relative to the necessary
right-of-way dedication along Route 694 and the drainage easement adjacent to the
Route 522 intersection. The plan should also identify the existing drainage/utility
easement shown on the plat prepared by Marsh & Legge, P.L.C. which is recorded in
the County Clerk's Office at State Highway Plat Book 9, Page 389. 1 have also
enclosed a copy of the deed and plat for your reference. I also ask the plan reflect the
existing pavement, shoulder, and right-of-way widths.
Once revised please resubmit four (4) copies of the plan for our files. Once complete,
this should allow you to also have the required survey plat and deed prepared which
accurately reflects by meets and bounds a description of the right-of-way dedication.

Dear Mr. Holtzman:
This department has received numerous complaints regarding the exterior lighting at the above
referenced property. I visited the site on October 24, 1996, at approximately 8:45 PM and
verified the validity of the complaints. As property owner of this site, you are responsible for
compliance with all local zoning ordinances.
During my visit, I observed the glare generated by this site from approximately one mile away.
Traveling north on North Frederick Pike, at approximately one mile south of the site, I observed
a significant glare on the horizon. At approximately 8/10 of a mile from the site, I was able to
see the light bulbs from the 1000-watt, pole -mounted light fixtures. At 4/10 of a mile from the
site, I viewed the pack lights on the canopies. I will also point out that the intensity of the glare
from these lights significantly decreases night visibility as the lights blind the Route 522 North
vehicular traffic.
The glare generated by this site is also deemed a nuisance to the surrounding residential
properties. Living and sleeping quarters in the adjacent properties are engulfed with so much
light that the interior rooms are well -lit even during the late hours of the night.
The Frederick County Zoning Ordinance (Chapter 165-35.A) states that "Outdoor lighting shall
be arranged to deflect glare a-,vay from adjoining properties and public streets. Sources of light
on a lot shall be hooded or controlled to prevent glare beyond the lot line."

I have determined that this site does not comply with Chapter 165-35.A of the Frederick County
Zoning Ordinance. In telephone conversations on Monday, October 21, Tuesday, October 22,
and Friday, October 25, 1996 with a representative from the Holtzman Oil Corporation office, I
informed him of the numerous complaints concerning these lights. This letter reaffirms the
violation.
This office will give you 15 days to comply with the Zoning Ordinance. Compliance may be
achieved by directing the pole lamps to the ground, and reducing the high intensity of both the
pole lamps and the canopy lamps. Failure to comply may result in a criminal complaint being
filed against you.
You may have the right to appeal this notice of violation within 30 days in accordance with
Section 15.1-496.1 of the Code of Virginia. This decision shall be final and unappealable if not
appealed within 30 days.

Thanks for your prompt action in getting the pole lighting adjusted at the Convenience Center.
I was finally able to get out this weekend and take another look at the lighting. There has
definitely been some improvement in terms of reducing the direct glare that confronted travelers
on both the north and southbound lanes of Route 522 from the pole mounted lights. There is still
a lot of light that spills over both the north and south bound lanes, and even into the fields across
Route 522, from the canopy. This does not seem to present a hindrance to visibility for traffic
under favorable weather conditions and in fact, under normal circumstances, probably increases
drivers' visibility.
As we have discussed, there have been complaints that in foggy conditions, the glare produced as
a result of spill -over light from your site makes for very poor visibility and driving conditions.
We'll have to wait and see what sort of impact turning the poles has had on this problem. If
complaints continue, we may need to look at ways to reduce the remaining spill -over from the
canopy on the road and adjoining properties.
My hope is that we do not receive additional complaints and we can both move on to other
business.

Thanks for again meeting Mr. Shickle and me at the convenience center. I think it was the most
productive way of dealing with this situation. Having now seen the Clayton's residence at night
firsthand, we can all agree that there is indeed an unacceptable amount of light hitting the upper
half of the house. Hopefully, this can be corrected by redirecting the focus of the pole lights at
the northwestern (right -rear pole when facing the property from Route 522).
If you would give me a call or send a letter to let me know when you have had an opportunity to
make the necessary adjustments to the lights, I'll check out the results and speak with the
Claytons to see if they feel the problem has been eliminated.
I'm sure it will be possible to keep your site adequately lighted while at the same time not
neuatively affecting the Clayton's residence.

On Oct. 28, 1996 your department sent Mr. Holtzman a notice of violation stating that the
lighting at the Amoco Convenience Center on Hwy 522 was in violation of the county
ordinance governing outdoor lighting. Specifically, Mr. Ioltzman was told he had 15
days to comply with the notice by "directing the pole lamps to the ground, and reducing
the high intensity of both the pole lamps and the canopy lamps".
My property adjoins the convenience center on the southeastern side of Hwy 522. My
problem with the lighting is that the pole lamps facing our house are aimed in such a way
that the light shines on the side and front of the house and in two of our upstairs bedrooms.
The pole lights also light up the front of our property. While it appears Mr. Holtzman may
have redirected some of the pole lights, the lights facing my property do not appear to
have been redirected or reduced in intensity.
While I certainly understand the need for adequate lighting at a business which is open all
night, I think something could be clone to redirect the lighting to deflect the light and glare
from my adjoining property. I understand from Mr. Lawrence of your staff that Mr.
Holtzman and Mr. Richard Shickle of the Board of Supervisors plan to meet soon to
discuss the lighting situation at this .location. I would be happy to have these gentleinen
visit my property to see the effects of the lighting firsthand.

to ensure the full protection of the health and safety of the users
of those elements.
(7) The Subdivision Administrator shall review each final subdivision
plat and deed of dedication to ensure that the requirements of this
section are met.
§ 165-35. Nuisances.
Any use of land or structures which creates the following nuisances shall be
prohibited. In addition, the following standards shall be met:
A. Glare. Outdoor lighting shall be arranged to deflect glare away from
adjoining properties and public streets. Sources of light on a lot shall
be hooded or controlled to prevent glare beyond the lot line. Sources
which produce harmful glare or ultraviolet rays, including arc welding
or acetylene torches, shall be completely screened from view
sufficiently to be imperceptible beyond the lot lines.
B. Radiation hazards. No use shall be allowed which creates radiation
emissions which are hazardous to the health and safety of the general
public. No uses shall be allowed which discharge radioactive materials
into the atmosphere, soils or bodies of water. All uses handling
radioactive materials shall conform with applicable local, state and
federal regulations.
C. Electromagnetic interference. No use shall be allowed which creates
electric disturbances which would adversely affect the operation of
equipment beyond the lot line of the use.
D. Vibrations. No use shall be allowed which creates any vibration
discernible for three (3) minutes or more in any one (1) hour. In no
case shall vibrations exceed a maximum peak particle velocity of five -
hundredths (0.05) inch per second.
E. Fire hazards. No use shall be allowed which does not conform with all
applicable fire codes and the Frederick County Code concerning fire
hazards and the storage of explosives.
F. Air pollution. No use shall be allowed which does not conform with the
regulations of the Virginia State Air Pollution Control Board concerning

Thank you so much for meeting me at the Cross Junction Amoco location on
Tuesday evening. I appreciate you taking the time to come out to look at the lights
and discuss the problem with me. I was delighted to hear you say that you were not
concerned about the way the lights were on the two sides or the back of the property.
It was obvious that we were not really spilling that much light over outside the parking
area, but the area the light was spilled onto was owned by us.
To reiterate your concerns, you said your biggest concern was the lights that
were spilling onto Rt 522. We agreed to change the direction of the area lights on the
two front corners to try to divert some of the light back onto the lot and away from the
road. Sometime during the next two weeks, I will have Chris Runion bring his crane
to the location, lift the poles, and turn the lights. Once the poles are turned we will
redirect the lights in an effort to keep them off of Rt 522.
1 would like to note that at the scales in Middletown, the Dept. of Highways
light the entire 181 corridor on both sides with the same type of lights v4e_ are using at
Rt 522. Thus, I do not believe there should be a safety hazard caused by the lights
since the state uses this same lighting.
I am sorry you have had complaints from some people, but as you well know
we cannot satisfy everyone. In our opinion, the lights create a safety factor for our
customers. Many people, especially women, do not go places at night where it is not
well lit. We wanted to attract all customers into our new location at all times of the
day and evening.

I'm writing to confirm our agreement concerning the above, and to thank you for taking the time
to meet me out at the Amoco site.
As we discussed, the objective is to try and tone down the lighting at the site or redirect it in such
a way so as to reduce the amount of lighting that spills over onto Route 522. This creates a
significant amount of glare for both north and southbound traffic. Of greatest concern are the
two poles located at the front of the site. As we agreed, once you have had an opportunity to
rotate these two poles inward toward the property, we can take another look and see how much
that improves the current situation. If this doesn't achieve the desired reduction of off -site
lighting, it may be necessary to look into what we can do with the canopy lighting as well.
We certainly understand your desire for a well -lit site and would not expect you to diminish the
level of nighttime visibility on your property. I'm sure you understand that we must, at the same
time, try to ensure the safety of the traveling public and the peaceful enjoyment of neighboring
property owners.

Dear Kris:
As I stated in my letter to you on November 16, 1996, we would turn the lights
at Xpress Stop on Rt 522 on the front corners of the lot to help reduce the light
shining out onto Rt 522.
On November 25, 1996, we went to Xpress Stop late in the evening and lifted
the light poles, turned them and readjusted the lights. Once the poles were turned, it
did in fact throw more light out on the side property next to our store. Both areas
however, are owned by us. It did reduce to some extent, the light that reflects onto
Rt 522. There is still some light reflecting there, but as I stated in my earlier letter, I
do not believe it is as much as you have on 181 at the Middletown scales. I hope this
change will satisfy all those concerned and allow us to get on with our business.
Thank you for your help in this matter and for taking the time to meet with me
at the site to examine the lighting. If you would like to meet me there one evening to
see the lights since they have been turned, just give me a call and we can set up a
time.

This is to confirm the results of our site meeting held October 7, 1996 at the referenced project. Present at this meeting
with you were Mr. G. B. Foltz (your contractor), Mr. R. B. Childress and myself of VDOT. It was agreed some field
adjustments to the Route 694 improvements were needed.
Using the north right-of-way line of Route 694 as a starting point and working south, locate the existing shoulder break
point and build a 4' wide shoulder, two 12' wide lanes will be constructed using the previously approved typical section
of 8" 21-B stone, 6" BM-2, and 165 lbs./s.y. of SM-2A asphalt. A 4' wide shoulder will then be constructed south of
the above pavement section.
Some adjustments to the center line location may be necessary as these roadway adjustments will be moved southward.
Center line adjustment will have to be kept to a minimum so as not to affect the intersection with Route 522.
Demolition of the newly constructed store entrance curb & gutter, on Route 694, may be necessary in order to tie into
the re-established horizontal and vertical centerline of Route 694. An entrance curb & gutter offset of 10' from face of
pan to edge of pavement must be maintained as shown in Section "D", Page 4 of 5 of the approved plans.
Field adjustments will be made, as necessa; to establish a consistent cross section at the tie-in with existing Route 694.
In order to maintain the above roadway typical section, it may be necessary for your company to dedicate additional
right-of-way to VDOT.

Eric Lawrence, Frederick County Department of Planning and Development
Steven Melnikoff contacted the Department of Planning and Development at this time to
acknowledge requirements for the Holtzman Oil/Amoco Convenience Center project. Mr.
Melnikoff informed Eric Lawrence that VDOT will approve of the issuance of an occupancy
permit at this time. Mr. Melnikoff indicated that VDOT and Holtzman Oil has reached an
agreement that will facilitate the completion of the planned road improvements. Part of the
agreement is that the Holtzman facility only use the entrances on Route 522. All other entrances
shall be blocked with heavy construction equipment, temporarily, and permanently by the
erection of a chain fence.

Dear Mr. Holtzman:
On September 26, 1996, I conducted a site inspection of the above referenced site. During this
inspection, I was reviewing compliance with the approved site plan (4032-95). Numerous
elements on the approved site plan were not reflected on site.
In order to obtain an occupancy permit, the following Site Plan elements must be satisfied:
1) Completion of the landscaping as specified. The planting schedule contains: 7 Red
Maples and 11 Willow Oaks, minimum sizes of 1" cal.@ 4' high at planting.
2) Installation of curb and gutter around the entire parking lot, including the west and south
parking lot borders.
3) Completion of the pavement marking. Directional arrows should be painted at both
Route 522 entrances.
4) Grading and stabilization of all disturbed areas.
5) Handicapped parking space that complies with ADA requirements. As provided on site,
the curb ramp is blocked by the parked vehicle. The ramp should be accessible from the
striped area. Also, the signage should state "van -accessible".
6) Completion of the driveway paving at Route 694.
It is also required that all Virginia Department of Transportation requirements be satisfied.
Previous correspondence with VDOT indicated that road improvements to Route 522 and Route
694 should be completed prior to the issuance of an occupancy permit. The same is attached. We

await approval from VDOT on this matter.
As the site appears to satisfy most public safety concerns, the Department of Planning and
Development is able to approve the issuance of a temporary occupancy permit, contingent upon

The Frederick County Planning Department administratively approved Site Plan #032-95 for
Amoco Convenience Center on December 8, 1995. The approved site plan calls for the
construction of a 3,500 square foot convenience store, the installation of two fuel pump islands
that are covered by a 3,024 square foot canopy that is 16 feet in height and three truck fueling
pumps that are covered by a 1,920 square foot canopy that is 16 feet in height, the provision of
a paved parking and maneuvering area to contain curb and gutter, 15 regular parking spaces,
one disabled parking space with appropriate signage, concrete sidewalks, and perimeter parking
lot landscaping, the installation of a concrete dumpster pad that will be completely enclosed by
a six foot high wooden fence with a latched gate, the installation of underground fuel tanks,
septic tanks, and a grease trap, the provision of a tire air filling station, the provision of a
telephone booth, underground storm water management improvements, and all appropriate
erosion and sedimentation control measures.
I have provided Mr. Stephen M. Gyurisin of Gilbert W. Clifford & Associates with three copies
of the approved site plan. Mr. Gyurisin will provide you with two copies of the approved plan
to allow you to provide the contractor with an on -site copy and keep a copy for your records.
As you know, the Virginia Department of Transportation (VDOT) agreed to allow approval of `
this site plan prior to the completion of plans for the improvements to North Frederick Pike
(Route 522) and Cumberland Trial Road (Route 694). This approval was granted with the
understanding that all road improvements would be complete and approved by VDOT prior to
the issuance of an occupancy permit for this facility. Frederick County will honor this
agreement.

We have received your revised site plan dated November 17, 1995 for the referenced project.
It appears all of our earlier review comments have been satisfactorily addressed. The plan is
therefore approved as submitted. However, I would like to point out our review or approval
does not include the right turn lane improvement along Route 522 in front of the Alkier's
Property. As we have previously discussed, this Department will fund and construct the right
turn lane improvement. We are just beginning our review of this portion of the plan. Once
the design of the right turn lane is finalized we will schedule its construction.
Please advise the owner of our approval. A land use permit may now be applied for to cover
the right-of-way improvements. The permit will require a minimal processing fee, surety
bond coverage and the salary & expenses of a State assigned inspector. In addition a drainage
easement deed and plat to cover the necessary drainage easement adjacent to the Route 522
and 694 right--of--way will be needed. I have enclosed a copy of our Standard RW-203 Deed
which may be used as a guide. Once the deed and plat has been prepared, please submit to
this office for review. The drainage easement will need to be taken care of prior to issuance of
a land use permit. In order to issue the permit, we will require four (4) additional sets of the
plans. For your information a permit of this nature takes approximately thirty (30) days to
process and issue once satisfactory application has been made.

During C. E. Maddox's meeting with Bill Bushman, where the pavement
widening issues on Va. Route 694 and the U.S. Route 522 S.B.L. north of the
intersection were discussed, Mr. Bushman requested that we determine the
existing pavement thickness on Va. Route 694. We have obtained two samples,
both along the centerline of Va. Route 694. The first, located 42 feet west of the
U.S. Route 522 southbound lane edge of pavement, indicated 6" of aggregate base
and 2" of asphalt. The second sample, located 24 feet west of the first, indicated a
5" aggregate base and 2" of pavement.

As requested, we have reviewed the above referenced project's site plan dated March 27, 1995. Our
comments may be found on the enclosed plans marked in red and as follows:
1.) All curb & gutter within the Route 522 right-of-way shall be VDOT Standard CG-7.
2.) The two (2) entrances on Route 522 will need to be tied together with curb & gutter as noted.
3.) The proposed entrance gutter will need to be changed to type R.C.P. and end section provided.
The culvert should be lengthened to tie-in to a DI-1 drop inlet set within the island and DI-3
& pipe stub to the DI-1 provided to drain the new curb & gutter between the entrances.
4.) The Route 522 entrance widths will need to be increased to provide 50' of pavement from the
face of gutter pan to face of gutter pan. You may also want to consider longer radii on these
entrances.
5.) The existing cut slope along portions of Routes 522 and 694, will need to be removed and
adequate side ditch and shoulder provided. A 6' wide stone shoulder on Route 694 and 10'
wide paved shoulder on Route 522 will be adequate. The pavement design of the Route 522
shoulder shall be 6' of aggregate material Type I, 21-B and 2" asphalt concrete Type IM-lA.
6.) You indicated earlier the proposed entrance on Route 694 will be the primary truck access.
The existing width (18') and pavement section (prime & seal surface) of Route 694 will not be
adequate to accommodate this additional truck traffic. Therefore, the roadway will need to be
improved to provide at least a 24' wide plant mix surface from Route 522 to the west side of
the proposed entrance. Additional right-of-way can be provided on the project side of the
roadway if necessary to accommodate the widening.
Additionally, a right turn lane and adequate taper will be required On south bound Route 522
at the Route 694 intersection to facilitate additional truck traffic. A 50' radii should be provided
on the new connection. The existing entrances and drainage in the northwest quadrant of the
intersection will need to be considered in your design.

Typical sections of the improvements to Route 694 and the Route 522 right turn lane will need
to be added to the plan.
7.) The pavement section of the Route 694 improvements, entrances, and all turn lanes shall consist
of the following:
Surface = 165 lbs. per s.y. Asphalt Concrete Type SM-2A
Base = 6" Asphalt Concrete Type BM-2
Sub Base = 8" Aggregate Material Type I, 21-B
8.) A note absolving the Department of any liability or maintenance responsibilities for the on site
detention basin will need to be added to the plan.
9.) The enclosed VDOT standards will need to be incorporated in the plan.
10.) Existing sight distances, speed limits and referenced will need to be added to the plan.
11.) Additional items as marked will need to be addressed.
Please revise and resubmit four (4) copies for further review. Should any changes be deemed
necessary, please design them to meet or exceed the above recommendations.

The purpose of this letter is to provide you with a detailed listing of all outstanding issues
associated with the above referenced site plan. All outstanding issues need to be addressed prior
to final site plan approval of this project.
1) Virginia Department of Transportation
I have contacted Bob Childress to discuss the proposed improvements to North Frederick Pike,
Cumberland Trial Road, and the Amoco Convenience Center site. It appears that the best way
to approach this is to receive an approval for the improvements associated with the convenience
center site (i.e. commercial entrance design, drainage, etc.) and an approval for the other
improvements. Bob Childress has agreed to provide two letters of approval once all design
issues associated with each improvement have been satisfied. I will need an approval from
VDOT for the proposed improvements associated with the convenience center prior to the
issuance of a building permit. The VDOT has asked Frederick County to insure that the other
improvements are in place prior to the issuance of an occupancy permit for this project.
Frederick County will honor this request.
2) Planning and Development
I reviewed Sheet 2 of 5 that you provided me in relation to the preliminary review comments
in the July 6, 1995 letter from Jean Moore. It appears that the majority of these comments have
been addressed; however, there are still some issues that are outstanding. These issues are as
follows:
a) General Information - The cover sheet needs to contain the name, address, and telephone
number of the owner and developer, as well as your signature on the Engineer's Seal.

b) Property Identification Numbers - My research has indicated that several land divisions
were recently approved on the Yost property. As a result of this, new P.I.N.'s have
been assigned. Please revise the site plan to remove the "Parcel A" and substitute TM
6-A-75I, and remove "Parcel B" and substitute TM 6-A-75H.
c) Amoco Convenience Center Sign - The information on the revised site plan is confusing.
It appears as a sign that is 261 square feet without a specified height. Please provide a
detail for this sign as your firm did on the Holtzman Oil project on Martinsburg Pike.
d) Details - The details for enclosing the dumpster and for the pavement types need to be
provided unless they appear on another sheet.
e) Easements - Easements have been provided for drainage and utilities; however, a width
was not specified for the utility easement. Please provide this information.
f) Buffer and Screening - A "B Category Buffer" has been provided along the southern and
western property lines. This information needs to be redrafted so that the buffer starts
at the property lines and moves inward. I believe that you will find that the 200 feet
distance can be met which will not require additional plantings. Please revise the buffer
type and provide the total distance, as well as the inactive and active portions of the
buffer area.
3) Building Inspections
Our department has not received a comment from the Building Inspections Department at this
time. John Trenary stated that his department has not received a copy of the site plan for review
to date. Please insure that this information is provided.
4) County Engineer
I met with Ed Strawsnyder to discuss his review comments dated June 8, 1995. Ed stated that
he needed to discuss comments #1 and #2 with you to insure compliance. Please contact Ed if
he has not contacted you at this time.
5) Fire Marshal
The Fire Marshal has approved the site plan.

6) Environmental Health Department
I contacted Doug Daily to determine his status since his last comment dated September 6, 1995.
Doug stated that he has not received a revised site plan that addresses the four comments from

Virginia SEWAGE
HANDLING AND DISPOSAL REGULATIONS (§4.23 13.8. and

B.9.). Hopefully the
information provided

help
eliminate the confusion.

Pumps must be provided with controls for automatically
starting and stopping the pump based on water level. Where
float type controls are used, it is preferred that separate ON
and OFF control floats be used. (When single ON/OFF floats
have been used it has been much more difficult to adjust the

Dear Mr. Mislowsky,
In reference to the subject site plan, please note the following comments:
1) The sewage disposal system is to be installed according to health department
permit number CS-94-491 (copy enclosed) and the Sewage Handling and Disposal
Regulations and not according to the plan entitled "Enhanced Flow Distribution
System".
2) The water use and design flow calculations are incorrect. Please reference
my letter to John Trenary dated November 9, 1994 which outlines specific design
flow and water use figures upon which approval of the drainfield site was
approved by me. A copy of this letter was included in the site plan package.
3) The site plan must show the location of the proposed grease trap, septic
tanks, and pump station, none of which should be located under an asphalt
driveway or other driveway or parking lot unless they are protected from traffic
and fitted with suitable access risers for all components. Note that cleanouts
are required every 50 feet in the sewer line.
4) The site plan shows a 7.783 acre proposed tract of land on which the
establishment is to be constructed. An easement will be required to include all
components of the sewage disposal system outside of the proposed tract. The
easement must include 20 feet on all sides of the components to allow for
construction. The health department construction permit cannot be released until
this is received if this new tract is created.
5) A public water system is proposed for the facility. Ms. Yost has been
advised. This will include the requirement for a dedicated well lot which must
be shown on the site plan.
