SITE PLAN CHECKLIST The checklist below indicates all the information that needs to be submitted as part of the site plan application. All required information must be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. If any portion is not included or complete, the site plan application will not be accepted and returned to the applicant(s). Site Plan Package 1. The approved site plan calls for the creation of a religious retreat that will include a 7,200 square feet chapel, two lodges that will provide a total of 72 rooms, seven parking lots that will be paved with prime and double seal and will contain a total of 199 regular parking spaces, 9 disabled parking spaces with appropriate signage and access, landscaping, sidewalks, and outdoor lighting fixtures, a private sewage treatment plant, a 10,400 square feet field house, a 2,100 square feet pavilion, three retreat cottages, one staff cottage, 20 cabins, a camper staging area, two bath houses, a pump house, a well house, two outdoor dumpster areas that are completely enclosed with a six foot high board fence and latched gate, recreational facilities, a dry hydrant to be accessed by a crushed stone road, a facility sign that will not exceed 100 square feet in area, a stormwater detention facility, and all appropriate erosion and sedimentation control measures. Page 2 God's Glory Land SP #031-95 REVIEW EVALUATIONS (Continued): Public Works: The County Engineer issued a Land Disturbance Permit in October 1994 to allow for rough grading of this site. Final approval of the engineered site plan is pencling review of the drainage analysis and its relationship to the design of' the on -site stornlwater cletention facility. Dire Marshal: The Dire Marshal has approved the (alglnecred site plan. The applicant has provided two means of' ingress/egress, a road system capable ol' supporting emergency equipment, and a dry hydrant located adjacent to a pond that will provide a water supply for fire fighting purposes. Health Department: The Health Department has advised the applicant that a permit will need to be applied for and issued prior to the establishment of, camp sites at this site for recreational vehicles. The Health Department will also monitor food service and general sanitation through their TES Program for tourist establishments. Department of Environmental Quality: The Department of Environmental Quality (DEQ) has approved and issued Virginia Pollution Discharge Elimination System (VPDF7S) Permit No. VA0088871 to the applicant for sewage discharge. The issuance of this permit requires the applicant to provide information to DEQ periodically for monitoring purposes. Planning; Department: 1) Project History Conclitional Use Pernlit #i001-94 for God's Glory Land was approved by the Frederick County Board of Supervisors on May 26, 1994. Nine conditions were placed on this permit, of which, three warrant discussion with the Planning Commission. Condition ##1 requires file applicant to receive approval of the engineered site plan through a formal review process; Condition #{2 requires the applicant to receive approval of the phasing plan; and Condition ##4 restricts the use of the wastewater treatment plant to one specil'ic parcel of* land. Page 3 God's Glory Land SP #031-95 REVIEW EVALUATIONS (C.OI1t11111ed): 2) Facility Design: The overall design of' the religious retreat meets the intent of the Conditional Use Permit, as well as the requirements of the review agencies. The applicant has met with the review agencies to ensure that the engincerecl site plan is in conformance with the various regulations. At this time, the only review agency that has not formally approved the engineered site plan is the County Engineer. The County Engineer is working with the project engineer to ensure that the proposed stormwater management facility is properly designed and constructed. 3) Floodplain Disturbance: Section 165-3113(l) of the Frcdcrick County Zoning Ordinance states that; "The Zoning Administrator, with the approval of the Planning Commission, may allow C11SlUrballce of slllall areas in the floodplain fOr plll'pOSCS of' recrcatioll, C0IISCI-VatIO11, 1Ih1111CS or StOI'lll\Valet' Illallagelllellt. The Administrator may allow the construction of recreational facilities or roads in the tloodplain." The engineered site plan calls for the disturbance ol' 0.35 acres (or 15,250 square feet) of area defineCI as HOOdplain for the purposes ol* constructing the Stornlwater management facility and the fire service road to access the dry hydrant. Stall recommends that the Planning Commission provide the Zoning Administrator with the allthOrlty to allow this disturbance to ensure that these improvements arc located in the appropriate areas. 4) Wastewater "Treatment Facility The applicant has received a VPDES Permit for the use of this facility as required by DEQ. However, condition #4 limits the use of this facility to one parcel. The proposed site plan inclicates that there arc four parcels which comprise the land area for this facility. A plat of coil solication has been prepared and signed -off by the Subdivision Administrator. The applicant will proceed with recordation once all reviews have been satisfied and the Planning Commission has recommended approval of this plan. Several conditions placed on this operation require action other than review agency approval prior to final approval of this site plan. I will describe the required action associated with each condition. Condition #1 This condition requires a formal review and approval of the engineered site plan by the Frederick County Planning Commission prior to final administrative approval. The next available meeting that this can occur is the September 20, 1995 meeting of the Planning Commission. In order to make this deadline, I will need to receive all review agency comments and 20 copies of the site plan by September 6, 1995. A 35mm slide will need to be prepared for this plan as well. This slide should reflect the information indicated on Sheet 1 of 3. I do not need the 35mm slide by September 6, 1995; however, I will need it soon thereafter. A Phase Plan has been submitted as part of the site plan review; therefore this information will be provided to the Planning Commission when the 20 site plans are submitted by September 6, 1995. Please prepare a 35mm slide that reflects the information shown on the Phase Plan. Condition #4 This condition restricts the use of the wastewater treatment plant to one specific parcel of land. This is a requirement for any private treatment facility within Frederick County. Because of this requirement, as well as the building setback requirements, a plat of consolidation has been prepared for the four parcels that comprise the project area. This consolidation plat has been signed by -the Subdivision Administrator but has not been legally recorded. A copy of the recorded plat will need to be submitted to our department prior to final site plan approval. Please provide our department with the information required to make the September 6, 1995 Planning Commission meeting. If the Planning Commission recommends approval of this site plan, I will need you to submit five copies of the final site plan that address the comments specified in this letter, as well as all other review agency comments. Kiracolk Fire Marshal I have completed my review of the Conditional Use Permit Application for God's Gloryland located on Rt. 704 in Frederick County. Since the mid 1970s there has been a migration of people from cities and urban areas back to the woodlands and rural areas. Homes, recreational areas, and large camps have been built in increasing numbers in the "Urban Wildland Interface" areas of our state. The fire service has learned a hard lesson in dealing with fires in these areas, that being, the ineffectiveness of conventional firefighting techniques in the wildland environment. As a result of these lessons we approach new developments of this nature with a strong emphasis on fire prevention and building an infrastructure conducive to fighting wildland fires. For that reason, I am asking for the following conditions as contingencies for approval of this application: 1. A second and independent point of access is needed. This limits the chance of fire blocking access to the site and evacuation from the site. Two egress points also enable ingress by the fire dept. as evacuation of patrons is taking place. 2. Install a warning signal or siren of some type that can be an emergency signal for all patrons to assemble at a k, determined point or evacuation. All occupiable structures on the site must have addresses or numbers and a plan showing these numbers must be given to the Gore Volunteer Fire Company and the Fire and Rescue Dept. 6. Provide a 20, all weather access to the existing pond on the southern corner of the property. At this location a dry hydrant should be installed to facilitate water supply for firefighting. 7. All structures, including retreat cottages, staff cottages, pavilians, and bath houses must have a 30' perimeter of "green space" kept clear of combustibles at all times to give the fire dept. a defensible space. \ 8. Buildings cannot be constructed on poles with open foundations. This eliminates the potential for leaves and other fuels to accumulate beneath buildings. ,Vi 9. Any buildings in which patrons will be sleeping must be equipped with working smoke detectors at all times during occupancy. 10. At a location easily accessible by staff, fire fighting tools such as shovels, rakes, and axes must be stored. This should be coordinated with representatives of the -Virginia-' Forestry Dept. along with some training in forest fire suppression. 11. There must be very strict rules and enforcement of the rules on outside camp fires and bon fires. Staff of this facility must be aware of these rules as well as patrons utilizing the facility. The treatment plant will be a packaged extended aeration system. The flow for the ultimate number of people proposed for this facility (350 people) is 17,500 gallons per day. This is based on the daily water consumption rate from the Health Department of 50 gallons per day per camper. Due to the flow and the type of treatment necessary a Class III licensed operator will be required to operate the plant. The treatment plant will operate most efficiently when the flow to the plant meets the design capacity. Due to the nature of the operation of this retreat, there will be times when there is low flaw or even no flow. During low flow periods, the operator will have to chlorinate and continuously aerate thQ waste In order to meet the discharge limits. If there are times that there Is no flow, the plant wAl serve as a storage tank and hold the flow until it can be treated when there is flow. Should problems arise with meeting the effluent standards during the winter because of very low flow for extended periods, a temporary pump and haul condition could be used to prevent violation of the discharge permit requirements. District Eng.Virginia Department of Health The preliminary design meeting was held on -site adjacent to the drilled wells. 'The items discussed were as follows: Water System: (Domestic only, no fire protection is included) Two wells have been drilled and flow tested. Well pumps with pitless adapters have been installed as follows: 1. (west) 5HP, 25 gpm, 325 ft 2. (east) 3HP, 20 gpm, 400 ft A 1/4" pvc air line should be added to each well and have an air connection for checking water level in the well. The air line should extend below the normal drawdown level in the well and operates like a bubbler line that can be used with a hand-held meter to determine water level. The well lots should be dedicated legally with recorded well plat submitted to the VDH. The normal well lot size extends 50' in each direction. Well #2 is located 42' from the edge of roadway, and a exception should be requested of VDH for this distance. Your surveyor Mr. Bruce Edens of Greenway, Inc. should prepare the plats, and your attorney should record the dedicated plat. Enclosed is a dedication example for your attorney to use. Water from each well has been tested for bacteria and the results should be submitted to Mr. Hughes for consideration. The VDH looks at these results to determine if chlorine addition will be required. The wells will require a series of bacteria tests over a 6-month period to determine the influence of surface water on the quality of the groundwater. Samples should be taken following significant rainfall as this is the time when surface water will most affect the groundwater. Additional samples were taken on July 31, 1995 and sent to the VDH lab in Richmond for chemical analysis. The results of these tests should be submitted to Mr. Huglies at the VDH to determine the concentration of iron and whether green sand filtration will be required. The results of these tests will most significantly affect the design because the green sand filters require more building space. The water system electrical connection shall be 240 volt, single phase, and shall be extended from the lodge to the water building. The size of the electrical service will be determined by Mr. Matthews and indicated on the drawings. The water system controls shall include for protection of the well pumps in case of low water level in the well. The controls shall include a current loss type pump shutoff device which eliminates the need for additional electrical probes in the well. Both well pumps shall be designed to run simultaneously, whether or not chlorination is necessary. If chlorination is required, it will be added to the common water line from the wells, prior to the storage tank. Water system alarms shall include well low level, storage tank high level, low level, hydro tank low pressure, and water tank freezing temperature. The controls shall include a local light and horn. The system capacity shall be sized as follows: 48 Bedroom lodge @ 130 gpd/room = 6240 gpd 12 Campsites @ 100 gpd/site = 1200 gpd Laundry/Bathhouse = 2000 gpd Total = 9440 gpd Design for 10,000 gpd ERC = 10,000/400 = 25 (Equivalent Residential Connection) Storage capacity = 200 x 25 = 5000 gallon 8'� x 14' Long or 6'� x 24' Long The storage tank shall be designed as an aboveground tank with internal heater for frost protection. In later conversation with Mr. Adams, he would like to place the storage tank and the hydro tank inside of the building along with the booster pumps and water piping. The size of the building would be approximately 20' wide by 24' long to enclose all of the equipment. The building location should be located along the south edge of Adam Drive near the intersection of Abraham Avenue. All weather access to the building is available from Adam Drive. An alternative is to place the face of both tanks into the building and provide insulation and internal heating for the tanks on the outside of the building. The storage tanks shall have an internal coating as approved by the VDH and shall be ANSI/NSF 61 certified. The booster pumps and hydro tank should be sized using the formula as follows: Q = 11.4N0.144 = 11.4 (25)0.544 = 66 GPM This flow rate should be verified with the building plumbing engineer based upon actual fixture counts including the bathhouse, pool, lodge and campsites. Booster pumps will be sized to meet the demand and be specified with 3500 rpm pump rotation. Booster pump controls shall include lead, lag operation based upon pressure in the hydro tank and shall automatically alternate after each cycle. Hydro tank cycle time 3-5 minutes 264 gallons/cycle Useable factor = 0.22 Actual Tank capacity = 264/0.22 = 1200 gallon • 4'� x 14' Long 5'� x 10' Long 5.5'� x 8' Long Specify non -tank type air compressor to maintain the adequate air pressure in the hydro tank. The water building floor drains shall be piped to grade outside the building and should not flow across the dedicated well lots. The water distribution system should be submitted to the VDH for approval and should include plan and profile views of all water mains. These plans were prepared by Greenway, Inc. and should be stamped by a registered professional engineer. Greenway should have someone to stamp the drawings and submit to the VDH. The information should include specifications on water distribution piping that has already been installed. Sewage System Inverts on last manhole before the sewage treatment plant should be verified and benchmarks available for setting the plant. The package plant foundation should excavated below ground and fill brought in to cover the tankage to approximately 1' from the top. The design capacity is 10,000 gallons per day to match the projected water usage. The overall treatment plant dimensions are 40' L x 10' wide x 12' deep. The package treatment plant shall have 2 sections for low flow (< 5000 gpd), and design flow of 10,000 gpd. Fine air bubble diffusion shall be provided to assure compliance with the effluent limits set by the DEQ. The electrical system will require a separate meter from the power company (Potomac Edison) and shall be 240 volt single phase. System Alarms shall include high water level in the surge tank, blower failure to start in the surge tank, aeration tank, and post aeration tank. A local alarm light and horn shall be provided. A reversing type 5" � comminutor shall be provided at the influent to the surge tank. Flow metering will be estimated using a staff gauge provided in the chlorine contact tank. Automatic flow metering will not be provided. A tablet chlorinator and a tablet dechlorinator shall be provided following the clarifier. The sanitary sewer system should be submitted to the VDH for approval and should include plan and profile views of all sewer mains. These plans were prepared by Greenway, Inc. and should be stamped by a registered professional engineer. Greenway should have someone to stamp the drawings and submit to the VDH. The information should include specifications on gravity sewer piping and manholes that have already been installed. The location for the discharge point on back creek should be shown on the overall site plan. An operator building shall be provided with a minimum of 20 square feet of bench space and 50 square feet in size. Final Total Residual Chlorine (TRC) Effluent Limitations and Monitoring Requirements 1. a. No more than 3 of all samples for TRC taken after the chlorine contact tank and prior to dechlorination shall be less than 1.0 mg/l for any one calendar month. b. No TRC sample collected prior to dechlorination shall be less than 0.6 mg/l. c. These TRC concentrations may be lowered where the permittee has demonstrated adequate disinfection. 2. Beginning with the permit's effective date and continuing until the facility is expanded, or until the permit's expiration date, whichever occurs first, the hourly average concentration of TRC in the final effluent after dechlorination shall not exceed 0.54 mg/l: Upon approval of plans and specifications, construction of the 0.0175 MGD treatment facilities, and issuance of a Certificate to Operate, and continuing -until the permit's expiration date, the hourly average concentration of TRC in the final effluent after dechlorination shall not exceed 0.31 mg/l. 3. When the TRC concentration in the final effluent exceeds the concentration in B.2., the permittee shall take immediate steps to achieve the required TRC concentration. If the TRC concentration in B.2. is exceeded, the permittee shall also take within one hour after the original sample measurement at least one additional sample measurement for TRC. If the average of the two samples does not meet the TRC concentration in B.2., then additional sampling and/or adjustments may be made by the permittee within the one hour period with the objective of achieving the required TRC concentration. For purposes of this permit if more than one sample measurement is taken during the one hour period and the average of all these samples still exceeds the TRC concentration in B.2., only the original sample will be considered for permit violation. When the average of these samples meets the TRC concentration in B.2., this shall be considered as being in compliance. The permittee shall report all results of the above monitoring program to the appropriate DEQ, water Division Regional Office with the monthly DMR. Permit No. VA0088871 Part I Page 4 of 6 4. The permittee shall operate the dechlorination facilities in a manner which will ensure continuous compliance with the TRC concentration in B.2., but not to the extent that will result in violations of other permitted effluent characteristics or the Water Quality Standards. 5. Quantification Levels shall be as follows: Effluent Characteristic Quantification Level Ammonia-N 0.2 mg/1 2. Compliance a. Monthly Average Limit Compliance with the monthly average limitations for Ammonia-N shall be determined as follows: All data below the specified quantification level (QL) shall be treated as zero. All data equal to or above the QL shall be treated as it is reported. An arithmetic average shall be calculated using all reported data, including the defined zeros. This arithmetic average shall be reported on the DMR-and compared to the monthly average limit for determination of compliance. If all data are less than the QL, an "NQ" shall be reported on the DMR. "NQ" means not quantifiable at the level required by this permit. b. Daily Maximum Limit Compliance with the daily maximum limitations for Ammonia-N shall be determined as follows: The highest single value of data that is equal to or above the QL shall be reported on the DMR and compared to the daily maximum limit for determination of compliance. If all data are less than the QL, an "NQ" shall be reported on the DMR. "NQ" means not quantifiable at the level required by this permit. • Permit No. VA0088871 Part I Page 6 of 6 D. Other Requirements or Special Conditions 1. A plan of action for ensuring continued compliance with the terms of this permit shall be submitted to: Department of Environmental Quality Valley Regional Office P.O. Box 268 Bridgewater, Virginia 22812 when the monthly average flow influent to the sewage treatment plant reaches 95 percent of the design capacity authorized in this permit for each month of any three consecutive month period. The plan of action shall be received at the Valley Regional Office no later than 90 days from the third consecutive month for which the flow reached 95 percent of the design capacity. The plan shall include the necessary steps and a prompt schedule of implementation for controlling any current or reasonably anticipated problem resulting from high influent flows. Failure to timely submit an adequate plan shall be deemed a violation of the permit. 2. The permittee, in accordance with the Sewerage Regulations, shall obtain a Certificate to Construct (CTC) and a Certificate to Operate (CTO) from the DEQ, Water Division prior to constructing wastewater treatment facilities and operating the facilities respectively. The permittee shall submit for approval an operations and Maintenance (O&M) Manual to: Department of Environmental Quality Valley Regional Office P.O. Box 268 Bridgewater, Virginia 22812 Noncompliance with the CTC, CTO; or O&M Manual shall be deemed a violation of the permit. 3. A Class IV licensed operator is required at this permitted facility. 4. In accordance with the requirements of VPDES application Form 2E, the permittee shall complete and submit Item IV of Form 2E for each outfall, no later than two years following the permits effective date, or the commencement of discharge if later than the permit's effective date. Following an evaluation of the required information, this permit may be modified or, alternatively, revoked and reissued in order to incorporate additional or different permit conditions. Permit No. VA0088871 Part II Page 1 of 3 MONITORING AND REPORTING A. Sampling and Analysis Methods 1. Samples and measurements taken as required by this permit shall be representative of the volume and nature of the monitored activity. 2. Unless otherwise specified in the permit all sample preservation methods, maximum holding times and analysis methods for pollutants shall comply with requirements set forth in Guidelines Establishing Test Procedures for the Analysis of Pollutants Under the Clean Water Act as published in the Federal Register (40 CFR 136). 3. The sampling and analysis program to demonstrate compliance with the permit shall at a minimum, conform to Part I of this permit. 4. The permittee shall periodically calibrate and perform maintenance procedures on all monitoring and analytical instrumentation at intervals that will insure accuracy of measurements. B. Recording of Results For each measurement or sample taken pursuant to the requirements of this permit, the permittee shall record the following information: 1. The date, exact place and time of sampling or measurements; 2. The person(s) who performed the sampling or measurements; 3. The dates analyses were performed; 4. The person(s) who performed each analysis; 5. The analytical techniques or methods -used; and 6. The results of such analyses and measurements. C. Records Retention All records and information resulting from the monitoring activities required by this permit, including all records of analyses performed and calibration and maintenance of instrumentation and recording from continuous monitoring instrumentation, shall be retained for three (3) years from the date of the sample, measurement, report or application. This period of retention shall be extended automatically during the course of any unresolved litigation regarding the regulated activity or regarding control standards applicable to the permittee, or as requested by the Director, Department of Environmental Quality. Additional Monitoring by Permittee If the permittee monitors any pollutant at the location(s) designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring shall be included in the calculation and reporting of the values required in the monitoring report. Such increased frequency shall also be reported. E. Water Quality Monitoring The Director, Department of Environmental Quality may require every permittee to furnish such plans, specifications, or other pertinent information as may be necessary to determine the effect of the pollutant(s) on the water quality or to ensure pollution of State waters does not occur or such information as may be necessary to accomplish the purposes of the Virginia State Water Control Law, Clean Water Act or the State Water Control Board's Permit Regulation. The permittee shall obtain and report such information if requested by the Director, Department of Environmental Quality. Such information shall be subject to inspection by authorized State and Federal representatives and shall be submitted with such frequency and in such detail as requested by the Director, Department of Environmental Quality. F. Reporting Requirements 1. The permittee shall submit to the Department of Environmental Quality, Water Division Regional Office, at the following address by the loth of each month for the preceding month's performance, an original monitoring report. In addition, a monthly report covering the facility's general operational data may be required. If this report is required, the permittee will be so notified. If, for any reason, the permittee does not comply with one or more limitations, standards, monitoring or management requirements specified in this permit, the permittee shall submit to the Department of Environmental Quality, Water Division Regional Office with the monitoring report at least the following information: a. A description and cause of noncompliance; b. The period of noncompliance, including exact dates and times and/or the anticipated time when the noncompliance will cease; and C. Actions taken or to be taken to reduce, eliminate, and prevent recurrence of the noncompliance. Whenever such noncompliance may adversely affect State waters or may endanger public health, the permittee shall submit the above required information by oral report within 24 hours from the time the permittee becomes aware of the circumstances and by written report within five days. The Department of Environmental Quality, Water Division Regional Office Director may waive the written report requirement on a case by case basis if the oral report has been received within 24 hours and no adverse impact on. State waters has been reported. 3. The permittee shall report any unpermitted, unusual or extraordinary discharge which enters or could be expected to enter State waters. The permittee shall provide information specified in Part II.F.2.a-c. regarding each such discharge immediately, that is as quickly as possible upon discovery, however, in no case later than 24 hours. A written submission covering these points shall be provided within five days of the time the permittee becomes aware of the circumstances covered by this paragraph. Unusual or extraordinary discharge would include but not be limited to (1) unplanned bypasses, (2) upsets, (3) spillage of materials resulting directly or indirectly from processing operations or pollutant management activities, (4) breakdown of processing or accessory equipment, (5) failure of or taking out of service, sewage or industrial waste treatment facilities, auxiliary facilities or pollutant management activities, or (6) flooding or other acts of nature. If the Regional Office cannot be reached, the Department of Environmental Quality maintains a 24-hour telephone service in Richmond (804-527-5200) to which the report required above is to•be made. Permit No. VA0088871 Part III Page 1 of 10 MANAGEMENT REQUIREMENTS A. Change in Discharge or Management of Pollutants 1. Any permittee proposing a new discharge or the management of additional pollutants shall submit a permit application at least 180 days prior to commencing erection, construction, or expansion or employment of new pollutant management activities or processes at any facility. There shall be no commencement of treatment or management of pollutants activities until issuance of a permit. 2. All discharges or pollutant management activities authorized by this permit shall be made in accordance with the terms and conditions of the permit. The permittee shall submit a new application 180 days prior to all expansions, production increases, or process modifications, that will result in new or increased pollutants. The discharge or management of any pollutant more frequently than, or at a level greater than that identified and authorized by this permit, shall constitute a violation of the terms and conditions of this permit. 3. The permittee shall promptly provide written notice of the following: a. Any new introduction of pollutant (s), into treatment works or pollutant management activities which represents a significant increase in the discharge or management of pollutant(s) which may interfere with, pass through, or otherwise be incompatible with such works or activities, from an establishment, treatment works, or discharge (s), if such establishment, treatment works,' or discharge(s) were discharging or has the potential to discharge pollutants to State waters; and, b. Any substantial change, whether -permanent or temporary, in the volume or character of pollutants being introduced into such treatment works by an establishment, treatment works, pollutant management activities, or discharge(s) that was introducing pollutants into such treatment works at the time of issuance of the permit. • Permit No. VA0088871 Part III Page 2 of 10 C. Any reason to believe that any activity has occurred or will occur which would result in the discharge on a routine or frequent basis of any toxic pollutant which is not limited in the permit, if that discharge will exceed the highest of the following "notification levels": (1) One hundred micrograms per liter (100 µg/1); (2) Two hundred micrograms per liter (200 µg/1) for acrolein and acrylonitrile; five hundred micrograms per liter (500 µg/1) for 2, 4-dinitrophenol and for 2-methyl-4, 6-dinitrophenol; and one milligram per liter (1 mg/1) for antimony; (3) Five times the maximum concentration value reported for the pollutant in the permit application; or (4) The level established in accordance with regulation under Section 307(a) of the Act and accepted by the Director, Department of Environmental Quality. d. Any activity has occurred or will occur which would result in any discharge on a non -routine or infrequent basis of a toxic pollutant which is not limited in the permit if that discharge will exceed the highest of the following "notification levels": (1) Five hundred micrograms per liter (500 µg/1); (2) One milligram per liter (1 mg/1) for antimony; (3) Ten (10) times the maximum concentration value reported for that pollutant in the permit application; (4) The level established by the Director, Department of Environmental Quality. Such notice shall include information on: (1) the characteristics and quantity of pollutants to be introduced into or from such treatment works or pollutant management activities; (2) any anticipated impact of such change in -the quantity and characteristics of the pollutants to be discharged from such treatment works or pollutants managed at a pollutant management activity; and (3) any additional information that may be required by the Director, Department of Environmental Quality. • C. Permit No. VA0088871 Part III Page 3 of 10 Operator Requirements 1. If specified in Part I of this permit, the permittee shall employ or contract at least one operator who holds a current wastewater license appropriate for the permitted facility or the pollutant management activity. 2. The permittee shall notify the Department of Environmental Quality, Water Division Regional Office in writing whenever he is not complying, or has grounds for anticipating he will not comply with the requirements in the above paragraph. The notification shall include a statement of reasons and a prompt schedule for achieving compliance. Treatment Works Operation and Quality Control 1. Design and operation of facilities and/or treatment works and disposal of all wastes shall be in accordance with the application filed with the Department of Environmental Quality and in conformity with the conceptual design, or the plans, specifications, and/or other supporting data approved by the Director, Department of Environmental Quality. The approval of the treatment works conceptual design or the plans and specifications does not relieve the permittee of the responsibility of designing and operating the facility in a reliable and consistent manner to meet the facility performance requirements in the permit. If facility deficiencies, design and/or operational, are identified in the future which could affect the facility performance or reliability, it is the responsibility of the permittee to correct such deficiencies. 2. All waste collection, control, treatment, management of pollutant activities and disposal facilities shall be operated in a manner consistent with the following: a. At all times, all facilities and pollutant management. activities shall be operated in accordance with the terms and conditions of the Certificate To Operate (CTO) and/or approved Operation and Maintenance (O&M) Manual, if applicable, and in a prudent and workmanlike manner so as to minimize upsets and discharges of excessive pollutants to State waters. b. The permittee shall provide an adequate operating staff which is duly qualified to carry out the operation, maintenance and testing functions required to insure compliance with the conditions of this permit. 192 E. F. G. Permit No. VA0088871 Part III Page 4 of 10 C. Maintenance of treatment facilities or pollutant management activities shall be carried out in such a manner that the monitoring and/or limitation requirements are not violated. d. Collected sludges shall be stored in such a manner as to prevent entry of those wastes (or runoff from the wastes) into State waters, and disposed of in accordance with this permit or plans approved by the Director, Department of Environmental Quality. Adverse Impact The permittee shall take all feasible steps to minimize any adverse impact to State waters resulting from noncompliance with any limitation(s) and/or conditions specified in this permit, and shall perform and report such accelerated or additional monitoring as is necessary to determine the nature and impact of the noncomplying limitation(s) and/or conditions. Duty to Halt Reduce Activity or to Mitigate 1. It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this permit. 2. The permittee shall take all reasonable steps to minimize, correct or prevent any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health or the environment. Structural Stability The structural stability of any of the units or parts of the facilities herein permitted is the sole responsibility of the permittee and the failure of such structural units or parts shall not relieve the permittee of the responsibility of complying with all terms and conditions of this permit. Bypassing Any bypass ("Bypass - means intentional diversion of waste streams from any portion of a treatment works") of the treatment works herein permitted is prohibited unless: 0 Permit No. VA0088871 Part III Page 5 of 10 1. Anticipated Bypass - If the permittee knows in advance of the need for a bypass, the permittee shall notify the Department of Environmental Quality, Water Division Regional Office promptly at least 10 days prior to the bypass. After considering its adverse effects the Department of Environmental Quality, Water Division Regional Office Director may approve an anticipated bypass if: a.' The bypass is unavoidable to prevent a loss of life, personal injury, or severe property damage ("Severe Property Damage" means substantial physical damage to property, damage to the treatment facilities which causes them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production.); and b. There are no feasible alternatives to bypass, such as the use of auxiliary treatment facilities, retention of untreated waste, or maintenance during normal periods of equipment down -time. However, if a bypass occurs during normal periods of equipment down -time, or preventive maintenance and in the exercise of reasonable engineering judgment the permittee could have installed adequate backup equipment to prevent such bypass, this exclusion shall not apply as a defense. 2. Unplanned Bypass - If an unplanned bypass occurs, the permittee shall notify the Department of Environmental Quality, Water Division Regional Office as soon as possible, but in no case later than 24 hours, and shall take steps to halt the bypass as early as possible. This notification will be a condition for defense to an enforcement action that an unplanned bypass met the conditions in Part III.G.1. above and in light of the information reasonably available to the owner at the time of the bypass. H. Conditions Necessary to Demonstrate an Upset A permittee may claim an upset as an affirmative defense to an action brought for noncompliance for only technology -based effluent limitations. In order to establish an affirmative defense of upset, the permittee shall present properly signed, contemporaneous operating logs or other relevant evidence that shows: 1. That an upset occurred and that the cause can be identified; Permit No. VA0088871 Part III Page 6 of 10 2. The facility permitted herein was at the time being operated efficiently and in compliance with proper operation and maintenance procedures; 3. The permittee submitted a notification of noncompliance as required by Part II.F. above; and 4. The permittee took all reasonable steps to minimize or correct any adverse impact to State waters resulting from noncompliance with the permit. I. Compliance With State and Federal Law Compliance with this permit during its term constitutes compliance with the State Water Control Law and the Clean Water Act except for any toxic standard imposed under Section 307(a) of the Clean Water Act. Nothing in this permit shall be construed to preclude the institution of any legal action under, or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any other State law or regulation or under authority preserved by Section 510 of the Clean Water Act. J. Property Rights The issuance of this permit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Federal, State, or Local Laws or regulations. K. Severability The provisions of this permit are severable. L. Duty to Reapply At least 180 days before the expiration date of this permit, unless permission for a later date has been granted by the Director, Department of Environmental Quality, the permittee shall submit a new application for a permit. M. Right of Entry The permittee shall allow authorized State and Federal representatives, upon the presentation of credentials: N. Permit No. VA0088871 Part III Page 7 of 10 1. To enter upon the permittee's premises on which the establishment, treatment works, pollutant management activities, or discharge(s) is located or in which any records are required to be kept under the terms and conditions of this permit; 2. To have access to inspect and copy at reasonable times any records required to be kept under the terms and conditions of this permit; 3. To inspect at reasonable times any monitoring equipment or monitoring method required in this permit; 4. To sample at reasonable times any waste stream, discharge, process stream, raw material or by-product, and, 5. To inspect at reasonable times any collection, treatment, pollutant management activities or discharge facilities required under this permit. For purposes of this section, the time for inspection shall be deemed reasonable during regular business hours, and whenever the facility is discharging or involved in managing pollutants. Nothing contained herein shall make an inspection time unreasonable during an emergency. Transferability of Permits This permit may be transferred to another person by a permittee if: 1. The current owner notifies the Department of Environmental Quality, Water Division Regional Office 30 days in advance of the proposed transfer of the title to the facility or property; 2. The notice to the Department of Environmental Quality, Water Division Regional Office includes a written agreement between the existing and proposed new owner containing a specific date of transfer of permit responsibility, coverage and liability between them; and 3. The Department of Environmental Quality does not within the 30-day time period notify the existing owner and the proposed owner of the State Water Control Board's intent to modify or revoke and reissue the permit. Such a transferred permit shall, as of the date of the transfer, be as fully effective as if it had been issued directly to the new permittee. • LJ 0. Public Access to Information Permit No. VA0088871 Part III Page 8 of 10 All information pertaining to permit processing or in reference to any source of discharge of any pollutant, shall be available to the public, unless the information has been identified by the applicant as a trade secret, of which the effluent data remain open public information. All information claimed confidential must be identified as such at the time of submission to the Department of Environmental Quality and/or EPA. Otherwise, all information will be made available to the public. Notwithstanding the foregoing, any supplemental information that the Department of Environmental Quality may obtain from filings made under the Virginia Toxics Substance Information Act (TSIA) shall be subject to the confidentiality requirements of TSIA. P. Permit Modification The permit may be modified when any of the following developments occur: 1. When additions or alterations have been made to the affected facility which require the application of permit conditions that differ from those of the existing permit or are absent from it; 2. When new information becomes available about the operation, pollutant management activity or discharge covered by this permit which was not available at permit issuance and would have justified the application of different permit conditions at the time of permit issuance; 3. When a change is made in the promulgated standards or regulations on which the permit was based; 4. When it becomes necessary to change final dates in compliance schedules due to circumstances over which the permittee has little or no control such as acts of God, materials shortages, etc. However, in no case may a compliance schedule be modified to extend beyond any applicable statutory deadline of the Clean Water Act; S. When a variance is requested and after the granting of the variance by EPA; 6. When an effluent standard or prohibition for a toxic pollutant must be incorporated in the permit in accordance with provisions of Section 307(a) of the Clean Water Act; 0 • Permit No. VA0088871 Part III Page 9 of 10 7. When changes occur which are subject to "Reopener Clauses" in the permit; 8. When the permittee requests the Director, Department of Environmental Quality to allow "net limitations" to take into account pollutants in the permittee's intake water and the Director, Department of Environmental Quality agrees to allow the use of net limitations; 9. When changes occur in the development and implementation of a pretreatment program; 10. When the level of discharge of or management of a pollutant not limited in the permit exceeds applicable Water Quality Standards or the level which can be achieved by technology -based treatment requirements appropriate to the permittee; 11. When the permittee begins or expects to begin to use or manufacture any toxic pollutant not reported in the application; and 12. When other States were not notified of the change in the permit and their waters may be affected by the discharge. Q. Permit Termination After public notice and opportunity for a hearing, the permit may be terminated on any of the following grounds: 1. The permittee has violated any regulation or order of the State Water Control Board, any condition of a permit, any provision of the Law, or any order of a court, where such violation results in a release of harmful substances into the environment or poses a substantial threat of release of harmful substances into the environment or presents a hazard to human health or the violation is representative of a pattern of serious or repeated violations which in the opinion of the State Water Control Board, demonstrates the permittee's disregard for or inability to comply with applicable laws, regulations or requirements; 2. The permittee has failed to disclose fully all relevant material facts or has misrepresented a material fact in applying for a permit, or in any other report or document required under applicable laws or regulations; 3. The activity for which the permit was issued endangers human health or the environment and can be regulated to acceptable levels by modification or termination of the permit; or 0 ! Permit No. VA0088871 Part III Page 10 of 10 4. There exists a material change in the basis on which the permit was issued that requires either a temporary or a permanent reduction or elimination of any discharge controlled by the permit necessary to protect human health or the environment. R. Civil and Criminal Liability Except as provided in permit conditions on "bypassing" (Part III.G.), and "upset" (Part III.H.) nothing in this permit shall be construed to relieve the permittee from civil and criminal penalties for noncompliance. S. oil and Hazardous Substance Liability Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject under Section 311 of the Clean Water Act or Sections 62.1-44.34:14 through 62.1-44.34:23 of the Law. T. Unauthorized Discharge of Pollutants Except in compliance with this permit, it shall be unlawful for any permittee to: 1.
