The checklist shourn below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved carnment sheets are required from each relevant review

PURPOSE OF NOTICE: To seek public comment on a draft permit from the Department of
Environmental Quality that will allow the continued release of treated wastewater into a water
body in Frederick County, Virginia.
First Public Notice Issue Date: (to be supplied by newspaper)
PUBLIC COMMENT PERIOD: 30 days following first public notice issue date
PERMIT NAME AND NUMBER: Virginia Pollutant Discharge Elimination System Permit —
Wastewater (VA0089010) issued by DEQ, under the authority of the State Water Control Board

PROJECT DESCRIPTION: Catholic Diocese of Arlington, VA has applied for reissuance of the
referenced permit. The applicant proposes to release water treatment system filter backwash
water at an average rate of 241 gallons per day into Opequon Creek, UT in Frederick County in
the Upper Opequon Creek watershed. A watershed is the land area drained by a river and its
incoming streams. The permit will limit the following pollutants to amounts that protect water
quality: solids and pH.
HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: DEQ accepts comments and
requests for public hearing by e-mail, fax or postal mail. All comments and requests must be in
writing and be received by DEQ during the comment period. Submittals must include the names,
mailing addresses and telephone numbers of the commenter/requester and of all persons
represented by the commenter/requester. A request for public hearing must also include: 1) The
reason why a public hearing is requested. 2) A brief, informal statement regarding the nature and
extent of the interest of the requester or of those represented by the requestor, including how and
to what extent such interest would be directly and adversely affected by the permit. 3) Specific
references, where possible, to terms and conditions of the permit with suggested revisions. DEQ
may hold a public hearing, including another comment period, if public response is significant and
there are substantial, disputed issues relevant to the permit.

Sorry I'm so slow in getting back to you.
Both the Matan Project and ElliotUWilson Project have been terminated by the clients.
Donovan Trucking was at the goal line. Lauren wanted a FCSA easement recorded before she would approve
the plan revision. The client was not convinced that he was required to do that, so we sent the plans to John
Whitacre at FCSA for an official comment on the easement recordation. We have yet to hear back from John on
this matter. It has been sometime now since we sent him the plan, I will try to follow up with him next week.

We are in receipt of the comments dated January 26, 2007 and offer the following responses:
Comments from Frederick County Planning and Development
Connnew 1: Subdiyls'uon. It appears that this parcel (44-A-75) has a total of 20 acres and consists of'tlle
area on both sides of Yardnlasier Court: this 8.69 acre portion lleeds to be subdivided before the site plan
can be approved.
Response: The subdivision plat has been prepared and submitted for agency review. A copy will be
provided for review and approval under separate submission.
Comment 2: Sidewalk. A sidewalk needs to be provided along Martinsburg Pike and a HC ramp jar the
sidewalk as well.
Response: The installation of sidewalks along Martinsburg Pike is not it required conclition of the approved
Master Development Plan or proffers for this development. 'file Martinsburg Pike (U.S. Rt. 1 1) road
improvements and the entrance for Yardmaster Court have been constructed in compliance with the
approved Min-tinsburg Pike/Yardmaster Court improveillent plim, which is in accordance with the approved
IvIDP. The VDOT and County approved Mm-tinsburg Pike/Yardmaster Court improvement plan clid not call
for handicap ramps or sidewalks; therefore the developer has complied with this obligation.
Comment 3: Building Sidewalk. T he building sidewalk should be revised as indicated on sheet 8.
Response: 'file sidewalk configuration as shown on the site plan provides for it 6' green space area along
the parking area. This green space area will allow the developer to provicle additional landscaping elements
over and above the required parking lot landscaping if clesired. A 6' strip is consistent with VDOT's
minimum separation of' sidewalk and curb for the purpose of landscaping.
Continent 4: Site Entrance. The entrance into fie development off o/' Yardmaster is large crud then it
pinches down to 22 feet. There needs to be a 24 foot driving lane included within the parking lot which
could be acconunodaled as indicated on sheet 8. /1 is also muclear whl, the entrance will have C'G-6, then
go to a gravel shoulder theft back to the CG-6 for the parking lot: the enln'e entrance should have CG-6.
Response: 'file entrance has been revised to provicle the minimum 24' driving lane and CG-6 has also been
provided along both sides of the entrance lane. Driving lanes within the parking lot have been increased to
24' as requested.

Comment 5: Low Level Berm. The 2 foot berm( needs to be provided along Martinsburg Pike.
Response: 'I'lie site grading as shown sloes provide for the required minimum 2' berm along Martinsburg
Pike.
Comment 6: Martinsburg Pike Landscaping, rill in the gap within this buf filr as indicnled on sheet 14.
Response: The Landscape Plan has been revised accordingly.
Comment 7: Details. Provide a derail for the berms (two feel d si.r feet) and the Martinsburg Pike
sidewalk on the plan.
Response: Both berm cletails have been provided on the Landscape Plan.
Comment 8: Proffers. Include the GDP wilh the proffers on sheet 2.
Response: The GDP has been added to sheet 2.
Comment 9: Tree Location. On sheet 14, move the interior tree into the island (is unheated.
Response: The interior tree has been moved to the island.
Comment /0: Tree Type. The zoning district buffer is listed as having Dogwood frees as its deciduous
component: a dnfferenl species of fee should be msedibl• the bil&r•.
Response: 'File Dogwood trees have been replaced with Sugar Maplcs.
Comment I1: Plant Sizes. Oil street 14 in the plant list, all deciduous frees need to have the caliper listed
and the Juniper needs to be three feet.
Response: Please see the revised plant list.
Comment 12: Outdoor Lighting. The plan indicates that no outdoor lighting is proposed on this site.
Outdoor lighting will be necessar" for this site (winter nronllis, etc.): provide the location and IYpe/height
of all outdoor lighting (wall pack, pole).
Response: Again, no outdoor lighting is being proposed with this plan. Any lighting that the developer
may deem to be necessary shall be designed and properly shielded for glare as required in 165-35A (please
see outdoor lighting note on cover sheet) and shall be addressed by a separate lighting plan.
Comment 13: Special Limited Power of Altornev Form. Please have the properf- owner sigh the attached
Special Limited Power of Aftornev Form prior to fin•ther review or approval. Thisr•n Jon should be
notarized and completed to gran/ the applicant (you) with authorization to represent them for• this site plan.

Dear Eric:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staff's comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:
i) Subdivision. It appears that this parcel (44-A-75) has a total of 26 acres and consists of the area
on both sides of Yardmaster Court; this 8.69 acre portion needs to be subdivided before the site
plan can be approved.
2) Sidewalk. A sidewalk needs to be provided along Martinsburg Pike and a I1C ramp for the
sidewalk as well.
3) Building Sidewalk. The building sidewalk should be revised as indicated on sheet 8.
4) Site Entrance. The entrance into the development off of Yardmaster is large and then it pinches
down to 22 feet. There needs to be a 24 foot driving lane included within the parking lot which
could be accommodated as indicated on sheet 8. It is also unclear why the entrance will have
CG-6, then go to a gravel shoulder and then back to the CG-6 for the parking lot; the entire
entrance should have CG-6.
5) Low Level Berm. The 2 foot berm needs to be provided along Martinsburg Pike.
6) Martinsburg Pike Landscaping. Fill in the gap within this buffer as indicated on sheet 14.
7) Details. Provide a detail for the berms (two feet & six feet) and the Martinsburg Pike sidewalk
on the plan.
8) Proffers. Include the GDP with the proffers on sheet 2.
9) Tree Location. On sheet 14, move the interior tree into the island as indicated.
10) Tree Tvpe. The zoning district buffer is listed as having Dogwood trees as its deciduous
component; a different specious of tree should be used for the buffer.

Subject: Yardmaster Court Office/Warehouse - VDOT Contingent Approval
We have received your site plan dated December 1, 2006 for the referenced project. Please
advise the owner of our approval contingent upon showing CG-6 curb at the entrance to the
warehouse. Also please provide five (5) sets of approved construction plans with signed seal
for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route it
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

Subject: Yardmaster Court Office/Warehouse - VDOT Contingent Approval
We have received your site plan dated December 1, 2006 for the referenced project. Please
advise the owner of our approval contingent upon showing CG-6 curb at the entrance to the
warehouse. Also please provide five (5) sets of approved construction plans with signed seal
for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 11
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.
