Also Mobile Shelters, Inc. has ceased operations at the Clearbrook location. Due to these circumstances, Mr. Seym-our feels that it would be futile to proceed with the approved site plan not knowing what may be the future use of the property and is requesting release of Letter of Credit #8385-2. If there is any future development on this site, it will require anew site plan and a new monetary guaranty to be established to receive a Certificate of Occupancy ("CO"). I offer the following points for clarification, and note that upon satisfying these points, the Planning Department would endorse your requests to open for business in April. (1) The updated site plan, revisions dated 2/21/07, that Greenway Engineering has now submitted to the Department of Planning and Zoning. Presuming that no adverse comments are received from the review agencies, this site plan appears to be in an approvable form; (2) The Department will enable you to post a monetary guarantee (i.e. Letter of Credit - LOC), in lieu of paving the parking lot so that your business may open by April; (3) The Department will maintain this LOC for up to 12 months, essentially enabling you to defer paving the parking lot in hopes that Hopewell Lane will be accepted into the state road system, at such time access to your property will need to be re-evaluated; (4) At the end of this 12 month period, tentatively March 31, 2008, the County will determine if the parking lot paving must be implemented or if an additional 12 month deferment is warranted. It is noted that full compliance with the ADA (Americans with Disabilities Act) regulations will require: a paved parking space (as indicted on your site plan), proper signage and markings clearly indicating that the space is reserved for handicap persons/vehicles, as well as a smooth hard surface transition from the parking space to the office building; (8) No permit is necessary to pave the handicap parking space; and (9) The parking area pavement should be in compliance with the details offered in the site plan. Engineering confirmation that the existing gravel meets the intent of the compacted subgrade is necessary should you wish to place an SM-2A overlay over the existing gravel parking area. I met with Mr. Bishop on Tuesday to discuss his nursery site plan. A few items warranted clarification: size of the outdoor display area for his plant/fruits; location and construction details of an ADA parking space; parking lot details (asphalt / curb and gutter); and extension of the parking area asphalt to connect with the existing asphalt cul-de-sac directly north of the site. We agreed that the asphalt/curb and gutter improvements (i.e. parking area and connection to the northern cul-de-sac) could be bonded for a 12 month period. At the end of the 12 month period, we would assess the site to determine if other improvements may be pending (Hopewell Lane a state road / new prospect for the subject parcels' primary use ) which may enable an additional 12 month bonding. For planning purposes, the Bishops should expect to be paving the parking lot prior to Spring 2008. Our discussion with the Bishops is similar to a discussion I had with Mark Smith last week. There's not necessarily a note to be placed on the site plan. It's more an understanding that once the site plan is approved, the Bishops will need to post Letter of Credit with the County as assurance that the asphalt/C&G will be completed within 12 months time...
