The plans Include Sheets 1 of 2 through 2 of 2 titled "Seo Property, Sand Filtration System, Frederick County, Virginia", and dated September 1997. The specifications are contained on the plan sheets. The project consists of the installation of a 300 gallon per day septic tank -sand filter system consisting of a septic tank, 13 gpm recirculation pump station, two 40 square foot sand filters, and chlorination, dechlorination, and post -aeration facilities. Discharge from the project will be to Opequon Creek, Potomac River Subbasin, Potomac River Basin. Based upon our review, the subject plans and specifications provide sufficient Information for the proper Installation of the proposed units. These plans and specifications are acceptable to this Department with the condition that a copy of the maintenance contract with a person/firm capable of performing the required maintenance be provided prior to the Issuance of the certificate to operate. The maintenance contract must provide, as a minimum, the conducting of effluent testing, complete repair of the treatment system within a specified time period following notification of needed repair, and remain effective for at least 24 months with provisions to renew through the duration of the NPDES General Permit. The contract must be kept In force at all times and renewed upon expiration. The attached information provides more details on the above -mentioned condition. This document constitutes your Certificate to Construct under the general permit that has been Issued. Upon completion of this project, you are required to submit a Statement of Completion (see Enclosure 1) as prepared by the installation contractor and obtain a Certificate to Operate prior to placing the system into operation. Application stated that a "video store" is the proposed use. Application stated that the site was zoned "B 1 ". Staff initiated first review of preliminary site plan. August 12, 1997 Planning staff completed preliminary site plan review #1. The review identified 28 specific items that are required to be shown on the site plan. Letter mailed to the applicant's engineer, Dave Walsh of PHR&A. Red - lined site plan included in mailing to further identify necessary site plan information. August 18, 1997 (Approximate date of conversation). Dave Walsh of PHR&A contacts this office to confirm receipt of letter. During this conversation, staff and Mr. Walsh agreed as to how the identified comments of August 12th letter will be addressed, August 22, 1997 Engineer faxed a revised parking lot layout and landscape plan to the Planning Department for comment. Telephone conversation between Staff and Engineer followed fax receipt. September 19, 1997 Staff receives letter dated September 17, 1997, from Mark Petrovich, Attorney for the applicant. Letter questions the staff review letter dated August 12, 1997. In particular, Mr. Petrovich questions the number of comments generated by the staff review. October 1, 1997 Staff replies to Mr. Petrovich's letter, reaffirming that each staff comment is necessary and is required of site plans submitted to Frederick County. Offers to meet with Mr. Petrovich and Mr. Walsh, PHR&A, to further discuss concerns. October 29, 1997 Staff receives revised site plan (submission #2) and DEQ permit information. DEQ information is not a permit for operation, but states that N this site qualifies for coverage under the General Permit for Small Sewage Discharges. Property owner is required to obtain authorization from the Virginia Department of Health for the construction and operation of the sewage treatment facility. November 13, 1997 Staff reviews site plan submission #2. This review identifies numerous items from review letter #1, dated August 12, 1997, that have not been addressed. Further concerns are identified that have resulted from the applicant's revisions. These new concerns include: Property Zoning. Previously the preliminary site plan indicated that the site was Zoned B 1. Preliminary site plan submission #2 indicates that the property is zoned B2. Staff has researched the zoning for this site; official zoning is B 1. Proposed Use. Previously the preliminary site plan indicated that the proposed use would be "Video Store". Preliminary site plan submission #2 indicates that the proposed use is "Seniors Consignment Store." Staff requests that a "Seniors Consignment Store" be defined so that staff may confirm that such a use is permitted in the B 1 zoning district. Landscape Plan. The landscaping plan has been modified; does not comply with ordinance requirements. This site is required to provide parking lot landscaping, and buffer and screening to protect adjoining residential properties. The submitted site plan does not comply with either of these landscape requirements. December 5, 1997 Engineer faxed a revised landscape plan to the Planning Department for comment. December 10, 1997 Telephone conversation between Staff and Engineer. Staff stated that the landscape plan does not comply with the landscape buffer and screening requirements. Staff inquired into what use is actually proposed for this site; engineer stated "clothing sales". (Note: The proposed use has been changed for the third time.) Staff mails letter and diagram to PHR&A illustrating the necessary landscape buffer and screening requirements. This fax was in reference to the proposed landscape plan for this site. I spoke with you via telephone on December 10, 1997, and further discussed the landscape requirements. The landscape plan that I received identified the location of the required landscape buffers but this plan did not contain an adequate number and type of plantings to comply with zoning ordinance requirements. The Zoning Ordinance's buffer and screening section requires that screening and distance buffers be utilized to reduce the impact a proposed use may have on the surrounding properties. This site will be required to implement a Category `B" buffer to protect the adjoining properties. The submitted site plan indicates your intent to utilize a Full Screen and a Landscape Screen that will comply with the Category `B" requirements. G. Water pollution. Landscaping. A. All portions of developments requiring site plan approval shall be appropriately landscaped to enhance the appearance, character and value of development in the county. Landscaping shall be provided to reduce the visibility of paved areas from surrounding properties, to minimize noise and glare, to provide shade and to improve the general appearance of the lot to be developed. In any development requiring site plan approval, any part of a lot not used for buildings, structures, parking. loading, driveways or walkways shall contain a ground cover including grass, trees, flowers, shrubs or other landscaping materials which shall be maintained in a healthy condition. § 165-37. Buffer and screening requirements. [Amended 6-13-1990] It is the intent of the regulations of this section to encourage proper design of a site in order to protect adjacent existing uses and to protect proposed uses within the site. Certain types of uses must be buffered from other types in order to ensure a desirable living environment. Additionally, appropriate distances must be maintained between commercial, industrial and residential uses and roads. A. Distance buffers. Distance buffers are based on the nature of an activity and its proximity to an activity of a different nature. They are linear distances measured from property lines inward. The zoning for this property is B 1 (Neighborhood Business). This was properly labeled as B 1 on the July 23, 1997 submission. The most recent submission indicates that the property is zoned B2. If it is your intention to utilize B2, a rezoning of this property must be granted by the Board of Supervisors. Please let me know if you intend to submit a rezoning application to the County. Structural Stability The structural stability of any of the units or parts of the treatment works herein permitted is the sole responsibility of the permittee and the failure of such structural units or parts shall not relieve the permittee of the responsibility of complying with all terms and conditions of this permit. F. 13ypassirie Any bypass ("Bypass - mans intentional diversion of waste streams from any portoon of a treatment works") of the treatment works herein permitted is prohibited. G. Compliance With State and Federal Law Compliance with this permit during its term constitutes compliance with the State Water Control Law and the Clean Water Act. Nothing in this permit shall be construed to preclude the institution of any legal action under, or relieve the parnittee from any responsibilities, liabilities, or penalties established pursuant to any other State law or regulation or under authority preserved by Section 510 of the Clean Water Act. Permit No. VAG40 Pan Ill Page 3 of 7 H. 1roperty Rights The issuance of this permit does not convey any property rights in either real or personal properly, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any in- fringerment of federal, state, or local laws or regulations. Severabilicy The provisions of this permit are severable. • Duty To Reregister If the permittee. wishes to be eligible to discharge under a general permit after the expiration due of this permit, the patnittee must submit a new registration statement at least 60 days prior to the expiration date of this permit. K. Right of Entry The permittee shall allow authorized state and federal represottatives, upon the presentation of credentials: 1. To enter upon the permittee's. premises on which the. establishment, treatment works or discharge(s) is located or in which any records are required to be kept under the terms and conditions of this permit; 2. To have access to inspect and copy at reasonable times any records required to be kept under the terms and conditions of this permit; 3. To inspect at rusonable times any monitoring equipment or monitoring method required in this permit; 4. To sample at reasonable times any waste strvw discharge, process stream, raw material or by-product; and S. To inspect at reasonable times any collection, treatment or discharge facilities required under this permit. Permit No. VAG40 Part III Page 4 of 7 For purposes of this section, the time for inspection shall be deemed reasonable during regular business hours, and whenever the facility is discharging. Nothing contained herein shall make an inspection time unreasonable during an emergency. L. Transferability of Permits This permit may be transferred to another person by a permittee if: 1. The current owner notifies the Department of Environmental Quality Regional Office 30 days in advance of the proposed transfer of the title to the treatment works or property; 2. The notice includes a written agreement between the existing and proposed new owner containing a specific date of transfer of permit responsibilin•, coverage and liability between them; and 3. The Department does not within the 30-day time period notify the existing owner and the proposed owner of the State Water Control Board's intent to modify or revoke and reissue the permit. Such a transferred permit shall, as of the date of the transfer, be as fully effective as if it had been issued directly to the new pertnittee. M. Continuation of Expired General Permits An expired general permit continues in force and effect until a new general permit is issued. Only those treatment works authorized to discharge under the expiring -eeneral permit arc covered by the continued permit. N. Public Access to Information All information pertaining to permit processing or in reference to any source of discharge o:f any pollutant, shall be available to the public. O. Permit Modification The permit may be modified when any of the following developments occur. Permit No. VAG40 Part III Page S of 7 1. When a change is made in the promulgated standards or regulations on which the permit was based; 2. When an effluent standard or prohibition for a toxic pollutant must be incorporated in the permit in accordance with provisions of Section 307(a) of the Clean Water Act; or 3. When the level of discharge of a pollutant not limited in the permit exceeds applicable Water Quality Standards or Water Quality Criteria, or the level which can be achieved by technology -based treatment requirements appropriate to the pertnittec. P. Permit Termination After public notice and opportunity for a public hearing, the general permit may be terminated for cause. Q. When an Individual Permit May Be Required The Department may require any owner authorized to discharge under this permit to apply for and obtain an individual permit. Cases where an individual permit may be required include, but art; not limited to, the following: 1. The discharger(s) is a significant contributor of pollution. 2. Conditions at the operating facility change altering the • constituents and/or chamcteristics of the discharge such that the discharge no longer qualifies for a General Permit. 3. The discharge violates the terms or conditions of this permit. 4. A change has occurred in the availability oi'demonstrated technology or practices for the control or abatement of pollutants applicable to the point source. S. Monitoring and Maintenance Requirements § 3.11 Monitoring A. General. Discharging systems that discharge improperly treated effluent can endanger public health and threaten environmental resources. All discharging systems shall be routinely inspected and the effluent sampled to determine compliance with the effluent limitations set forth by the State Water Control Board in the General Permit All testing requirements contained in these regulations are the responsibility of the system owner to have collected, analyzed, and reported to the Department. B. Types of testing. There are two types of testing recognized by these regulations: Formal compliance testing and informal testing. Formal testing is conducted to determine either compliance or non-compliance with these regulations. Informal testing is conducted to determine compliance with these regulations and to determine when additional formal compliance testing is necessary. Informal _tes mg may support but. shall not be. the -soh basis for suspending an operation permit pursuant to § Z23 or to suspend or revoke the approval of the system pursuant to § 128 of these regulations. 1. Formal compliance testing. Effluent from all discharging systems shall be tested for the following parameters at a frequency specified in Table 3.4. Five day biochemical oxygen demand (BODE, total suspended solids, fecal coliform bacteria, dissolved oxygen and total chlorine residual (measured at the outfall and in the chlorine contact chamber if dechlorination is required). The tests shall be analyzed by a laboratory certified by the E.P.A. or the SWCB to =duct self monitoring analysis to determine compliance limits for VPDES permit discharge limits. Samples shall be collected, stored, transported and analyzed in acoordance with requirements set forth in Guidelines Establishing Test Procedures for the Analysis of Pollutants Under the Clean Water Act as published in 40 CFR Part 136 (July 1, 1991). Z. Informal tcadn, The following tests will be conducted on the effluent, except as noted, at a frequency spedfied In Table 3.4; 30 minute settleable solids (conducted on the mixed liquor suspended solids), odor, color, pH, and chlorine (after the chlorine contact chamber). The owner of each system is responsible for ensuring that the collection, analysis, and reporting of all effluent sample tests are completed in a timely fashion and in accordance with §§ 3.11 and 3.13. At a minimum each maintenance contract shall provide for the following: I. Any deductible provision in a maintenance agreement shall not exceed $500 in any given year for repairs (including parts and labor). 3. Twenty-four months of consecutive coverage shall be the minimum time period a maintenance contract may be valid. D. Public utility. In localities where a public service authority, sanitary district, or other public utility exists which monitors and/or maintains the systems permitted under these regulations, the requirements for the monitoring and/or maintenance contract may be waived by the Division provided the owner of the system subscribes to the service and the utility meets the minimum elements described in §§ 3.11 and 3.11 E. In order to competerrHy-evaluate system performance, collect and Interpret sample results, as well as repair and maintain discharging systems, an individual must be knowledgeable in sewage treatment processes. Therefore, after July 1, 1994 all individuals who perform maintenance on discharging systems pursuant to § 3.1Z are required to hold a valid Class IV wastewater works operator license issued by the Board For Waterworks and Wastewater Works Operators. Until July 1, 1994, individuals that can demonstrate two years of practical experience with discharging systems, with flows under 1,000 GPD, may conduct maintenance on all systems. Provide stormwater calculations for the proposed stormwater/sediment basin. The stormwater pond should be designed to release ten-year post - developed storm flows at a two-year pre -developed rate. We recommend revising the design to reflect the use of a different inlet structure to prevent the occurrence of clogging. Also, it will be necessary to provide a detail and cross-section of the stormwater pond. 6. Indicate the finished floor elevation for the existing structure. 7. Revise the site plan to reflect the location of the construction entrance. In addition, it will be necessary to include an erosion and sediment control narrative for the subject site. Sheet 2 of 2 Revise the site plan to include a note indicating that a land disturbance permit will be required by the Frederick County Public Works Department prior to initiating any site work. 9. This statement should be placed near the Zoning Administrator approval block. 7) Building Setbacks: correct the setbacks. The required side and rear setbacks for B 1 District sites is 0 feet. 8) Details pertaining to the accessible parking space and ramp to building (dimensions, signage, ramp materials, etc.). (A copy of the Route 522 plan is attached.) 3. A typical section should be provided to illustrate the 12' additional pavement at the proposed entrance end of the deceleration taper as well as the shoulder and roadway ditch along the 150' taper. The taper pavement structure should be 8" of 21-B Aggregate, 3" BM-2, and 1 '/z" SM-2A. This pavement structure should also be used on the section of proposed site entrance within VDOT right-of-way. Shoulder should be 6 '/z" of 21-B Aggregate. 4. The proposed CG-11 entrance should have 40' wide pavement, 25' radius face of curb on the north and south side. Tapers should be 150' long and 12' wide on the north side and 36' long and 12' wide on the south side. The CG-7 could be ended at the right-of-way line on both sides.
