application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned

Thank you for meeting with John Trenary, Steve Melnikoff and me at the above site on January 10,
2002. I believe this site meeting certainly assists us in better understanding the various required site
improvements illustrated on the site plan from 1998, as well as the improvements associated with the
proposed addition of two storage buildings.
For simplicity purposes, I'd like to briefly touch on the various agency requirements surfaced at this
meeting. First, I'll briefly identify the improvements included on the site plan approved in 1998 that
were required when the three storage buildings were constructed on the site's easternmost quadrant.
These three additional storage buildings have been constructed but the other improvements identified
on the site plan have not been addressed.
1. Complete the building Nnnit requirements for the three storage buildings. Records in the
Building Inspections' office indicate that final inspections, as well as Certificate of
Occupancies, have not been conducted/issued for these three structures.
2. Installation of the landscape buffer. This buffer was included on the approved site plan but
the landscape buffer appears to have not been installed on the site. The buffer is to be
installed along the road frontage and along the eastern property line.
3. Entrance improvements. The Department of Transportation does not have record that the
necessary entrance permits were obtained, nor have the necessary entrance improvements
been implemented.
4. Installation of the parking area. This parking was included on the site plan, but the
improvement has not been completed on the site.

Secondly, in order to construct two additional storage buildings at the rear of the site, a revised site
plan must be approved by the county. Initial discussions indicate that a revised site plan should
include the following improvements (in addition to all improvements identified on the 1998 approved
site plan):
1. Extension of the landscape buffer along the eastern property line to fully screen the storage
buildings located at the rear of the property.
2. Obtain the necessary Building Inspections permits for construction of the storage buildings.
Construct a commercial entrance for the facility. All design and permitting shall comply with
VDOT requirements.
The site is currently in violation of the 1998 approved site plan. Therefore, as a minimum, those
improvements identified on the approved plan should be installed. If the two additional storage
buildings continue to be sought, a revised site plan must be submitted, addressing as a minimum the
above mentioned issues.

Dear Mr. Ellis:
The Frederick County Planning Department administratively approved Site Plan 9024-97 for the above
referenced site plan on April 15, 1998. This site plan, for the construction of an additional 10,425 square feet
of self-service storage space, meets all County requirements for the development of a self-service storage
facility within the M1 (Light Industrial) zoning district. The development of this property also includes the
provision of ten parking spaces and storage facility screening which includes the planting of 78 white pines
that are a minimum of 6' in height at the time of planting.
I have provided you with several copies of the approved site plan. Please keep an approved copy for your files
and maintain an approved copy on the construction site. Once the site development has been completed, you
should contact this office to schedule an on -site inspection and obtain a Certificate of Occupancy.

Upon review of the subject site plan dated October 30, 1997, we offer the following
comments:
1.) The proposed 15 inch CMP culvert and the proposed dam need to be
analyzed for a (10) year design storm. The 10-year storm needs to flow
through the culvert without flooding the driveway and be contained
within the proposed channel.
2.) We will need a copy of the signed drainage easement plat across Mr.
Anderson's property. This needs to be on file at the time of the final site
walk -over when the site work has been updated.
3.) At this time, stormwater management will not be required. However, at
the time of further development, a stormwater management facility will
be required. During that review, the pre -developed site conditions need
to be analyzed as if no development has occurred on -site. Also, the 10-
year post developed storm will need to be released at a two (2) year pre -
developed rate.
However, since these comments are minor in nature, we recommend approval of the
subject site plan. We request that the additional information be submitted to this office as soon
as possible.

Dear Mr. Pease:
P,, �1 f� have had the opportunity to review the above referenced site plan resubmitted to our department on November
4, 1997. The following comments need to be addressed during the final revision of this site plan:
1) The plat showing the lot consolidation has been forwarded to Mr. Andrew Evans, Frederick County
Zoning Administrator. Please contact him regarding its status. As you are aware, this consolidation must
occur prior to approval of the site plan.
/ 2) Please provide the dimensions of the relocated sign and revise its new location. All freestanding signs shall
be set back at least ten (10) feet from any property line.
3) Please revise the parking calculations. Ten spaces are required. This has been provided with the nine
regular and one handicap space. The three parking spaces located in the driving aisle should be removed
from the main driving aisle. It may, be appropriate to recess them within the grassed area that they
currentiv abut.
Please note that the proposed plantings are required to be a minimum of sir feet in height at the time of
planting.
.15) Please revise the detail of the proposed six-foot high opaque fence. A wooden stockade or board -on-
board fence that is six -feet in height would be acceptable.
Please revise your site plan to reflect the comments specified in this letter and resubmit one copy for my review
Once I have verified the information contained on the revised site plan, I will need all approved review agency
comment sheets and five copies of the final site plan for approval. Comment sheets are required from the
following agencies: the Virginia Department of Transportation, the Frederick County Health Department. the
Inspections Department. the Frederick County Engineer. and the Frederick Count, Fire Marshal.

We have received your preliminary site plan dated November 25, 1996 for the referenced
project. A review has been completed and we have the following comments shown in red on
the plan sheet.
1. The VDOT General Notes should be a part of your plan assembly. Also, trip generation
traffic volumes and source, i.e. I.T.E. Trip Generation Manual 51h Edition, is needed.
2. The existing entrance is substandard. It will need to be upgraded to current standards,
copy attached. Also the entrance near the west property line and pipe culvert should be
removed.
3. The existing topography should include the Route 664 and 761 pavement edges as shown.
VDOT signs adjacent to the site should be shown. Also the current use of the existing
cinder block building with I.T.E. data is needed.
4. Sight distance and distance to the nearest intersection should be shown.
All notes shown in red on the site plan sheet should be addressed. Any changes in design
features should meet or exceed the design standard.

THIS AGREEMENT , dated this day of
between LEONARD C. ELLIS., (the "Lessor"), and
(the "Lessee", whether one or more) provides as follows;

LESSEE hereby agrees to rent from LESSOR , located
at Stephenson Industrial Park, Frederick County, Virginia (the "Premises"),
on a month -to -month basis beginning The rent shall
be $ per month payable in advance and due by the first day of each
month. This agreement is made on the following terms and conditions.
1. DEPOSITS. Lessee shall pay in advance a security, cleaning and damage deposit
in amount of lVienty-five dollars ($25.00). The deposit shall be refunded, less reasonable
charges for cleaning or repairing the Premises and less any other sums due Lessor under
this agreement, after Lessee vacates the Premises.
2. USE OF PREMISES. The Premises shall be used only for the storage of personal
property. Lessee shall not use the Premises for automobile repair or the operation of
any business or for human or animal occupancy. Lessee shall not store any hazardous,
explosive or flammable materials, including fuel drivcn vchicics or equipment unless the
fuel tanks are empty. Lessee shall not use the Premises in violation of any order or
requirement imposed by any sanitation, police or other governmental agency or government
or in a way which may create a nuisance.
3. EXTENSION AND TERMINATION. Unless terminated, this agreement shall be
automatically renewed each month. This agreement may be terminated by either party
upon thirty (30) days written notice of such party's intention to terminate the tenancy.
If Lessee vacates prior to the end of the thirty (30) day period, Lessee must nevertheless
pay for the entire thirty (30) day rent.
4. DEFAULT. If Lessee is in default under the terms of this agreement, Lessor shall
notify Lessee of such default. If such default is not cured within ten (10) days, then
Lessor shal..l have the inarediate right to terminate the lease, to re-enter the Premises,
either by summary proceedings, force or otherwise, to remove and dispose of all property
therein and to relet the Premises, all with or without further notice to Lessee and with
or without resort to legal process.
5. ENTRY OF PREMISES BY LESSOR. Lessor may enter the Premises, remove the
contents and store the same in times of emergency, when the Premises have been damaged by
fire or other casualty, or when Lessee has abandoned the Premises or is in default of the
terms of this agreement. Lessee shall indemnify and hold Lessor harmless for any loss
or expense in connection with such removal and storage.
6. CONDITION, ALTERATION AND SURRENDER OF PREMISES. Lessee hereby accepts
the Premises in "as in" condition suitable for the purposes for which they are rented.
Lessee agrees to keep the Premises in good order and condition and to promptly pay Lessor
for any rep -airs neceS7,ltatd by L 3see'5 negligence, m13usc -,r neglect. Lessee agrees to
i.frediately notify Lessor of any defects, dilapidations or danagerous conditions in or on
the Premises. Lessee shall make no alterations or improvements to the Premises without
Lessor's prior written consent. Upon termination, Lessee shall surrender the Premises
broom clean and in as good condition as when accepted, reasonable wear and tear exce;ted.
7. LIMITATION OF LIABILITIES. Lessee hereby acknowledges that Lessor does not
have custody, control, possession or dominion over the contents of the Premises. Lessor
shall not be responsible to Lessee, his invitees, guests, licensees, agent or employees
for damage to person or property caused by water, fire, or any other casualty, actions of
other tenants, thefts, vandalism or any other causes, and Lessee expressly agrees to
indemnify and hold Lessor harmless for such damage, loss, cost or expense.

8 . INSURANCE. Lessee ac*ledges that insurance is availoe from independent
insurance- companies for personal injury and damage to Lessee's property. Lessee assumes
sole responsibility for fire and extended coverage on the contents of the Premises and
for insurance covering personal injury.
9. ASSIGNMENT OR SUBLETTING. Lessee shall not sublet or assign all or any
portion of Lessee's interest in the Premises without Lessor's prior written consent,
which consent Lessor shall have no obligation to give.
10. RULES AND REGULATIONS. Lessee hereby acknowledges receipt of rules and
regulations posted by Lessor governing the Premises. Lessee agrees to abid,
by these rules and regulations as they exist now and may exist from time to
time. The rules and regulations governing the Premises are hereby incorporated by refer-
ence and any breach thereof by Lessee shall constitute a default under this agreement.
11. ADMINISTRATIVE CHARGES. Lessee agrees to pay a Ten Dollar ($10.00) fee for
each payment more than ten 10) days late and for each dishonored bank check.
12. ATTORNEY' S FEES. If legal action is brought by Lessor for unlawful detainer,
to recover any sums due under this agreement, or for the breach of any covenant or con-
dition under this agreement, Lessee shall pay Lessor all costs, expenses and reasonable
attorney's fees incurred in such action. Lessee shall also pay all costs, expenses and
reasonably attorney's fees incurred by Lessor in selling the property pursuant to
paragraph 13.
13. LESSOR'S LIEN. LESSOR SHALL HAVE A LIEN ON ALL PERSONAL PROPERTY
STORED ON THE PREMISES FOR RENT AND ALL OTHER SUMS DUE UNDER THIS AGREEMENT.
IF LESSEE IS IN DEFAULT OF THIS AGREMENT, LESSOR SHALL NOTIFY LESSEE OF SUCI
DEFAULT. IF SUCH DEFAULT IS NOT CURED WITHIN TEN (10) DAYS, THEN LESSOR,
after giving such notice as may be required by law, may proceed to enforce
SUCH LIEN BY SELLING ALL OR SO MUCH AS MAY BE NECESSARY OF LESSEE'S PERSONAI
PROPERTY. LESSEE SHALL BE LIABLE FOR ANY DEFICIENCY REMAINING AFTER THE
SALE OF THE PROPERTY.
14. NOTICES. Notices hereunder shall be in writing and shall be deemed to be dated
and delivered whether actually received -or not, upon deposit in the U.S. mail, addressed
to the party's last known address.
15. APPLICABLE LAW. This agreement shall be construed in accordance with the Virginia
Self -Storage Act and any other applicable law of the Commonwealth of Virginia.
16. REK} DIES ARE CUMULATIVE. The rights and remedies herein reserved by
or granted to Lessor are distinct, separate and cumulative, and the exercise of any one
of them shall not be deemed to preclude, waive or prejudice Lessor's right to exercise
any or all others.

fuel tanks are empty. Lessee shall not use the Premises in violation of any order or
requireirent- imposed by any sanitation, police or other governmental agency or government
or in a way which may create a nuisance.
3. EXTENSION AND TERMINATION. Unless terminated, this agreement shall be
autorrtirtically renewed each month. This agreement may be terminated by either party
upon thirty (30) days written notice of such party's intention to terminate the tenancy.
If Lessee vacates prior to the end of the thirty (30) day period, Lessee must nevertheless
pay for the entire thirty (30) day rent.
4. DEFAULT. If Lessee is in default under the terms of this agreement, Lessor shall
notify Lcssee of such default. If such default is not cured within ten (10) days, then
Lessor shall have the immediate right to terminate the lease, to re-enter the Premises,
either by sumTo ry proceedings, force or otherwise, to remove and dispose of all property
therein and to relet the Premises, all with or without further notice to Lessee and with

or without resort to legal process.
5. ENTRY OF PREMISES BY LESSOR. Lessor may enter the Premises, remove the
contents and store the same in times of emergency, when the Premises have been damaged by
fire or other casualty, or when Lesseehas abandoned the Premises or is in default of the
terms of this agreement. Lessee shall indemnify and hold Lessor harmless for any loss
or expense in connection with such removal and storage.
6. CONDITION, ALTERATION AND SURRENDER OF PREMISES. Lessee hereby accepts
the Premises in as in condition suitable for the purposes for which they are rented.
Lessee agrees to keep the Premises in good order and condition and to promptly pay Lessor

inn-ediately notify Lessor of any defects, dilapidations or danagerous conditions in or on
the Premises. Lessee shall make no alterations or improvements to the Premises without

broom clean and in as good condition as when accepted, reasonable wear and tear excezted.
7. LIMITATION OF LIABILITIES. Lessee hereby acknowledges that Lessor does not
have custody, control, possession or dominion over the contents of the Premises. Lessor
shall not be responsible to Lessee, his invitees, guests, licensees, agent or employees
for damage to person or property caused by water, fire, or any other casualty, actions of
other tenants, thefts, vandalism or any other causes, and Lessee expressly agrees to
indemnify and hold Lessor harmless for such damage, loss, cost or expense.

8. INSURANCE. Lessee ackiledges that insurance is availlse from independent

by these rules and regulations as they exist now and may exist from time to
time. The rules and regulations governing the Premises are hereby incorporated by refer-
ence and any breach thereof by Lessee shall constitute a default under this agreement.
11. ADMINISTRATIVE CHARGES. Lessee agrees to pay a Ten Dollar ($10.00) fee for
each payment more than ten 10 days late and for each dishonored bank check.
12. ATTORNEY' S FEES. If legal action is brought by Lessor for unlawful detainer,
to recover any suns due under this agreement, or for the breach of any covenant or con-
dition under this agreement, Lessee shall pay Lessor all costs, expenses and reasonable
attorney's fees incurred in such action. Lessee shall also pay all costs, expenses and
reasonably attorney's fees incurred by Lessor in selling the property pursuant to
paragraph 13.
13. LESSOR'S LIEN. LESSOR SHALL HAVE A LIEN ON ALL PERSONAL PROPERTY
STORED ON THE PREMISES FOR RENT AND ALL OTHER SUMS DUE UNDER THIS AGREEMENT.
IF LESSEE IS IN DEFAULT OF THIS AGREMENT, LESSOR SHALL NOTIFY LESSEE OF SUCK
DEFAULT. IF SUCH DEFAULT IS NOT CURED WITHIN TEN (10) DAYS, THEN LESSOR,
after giving such notice as may be required by law, may proceed to enforce
SUCH LIEN BY SELLING ALL OR SO MUCH AS MAY BE NECESSARY OF LESSEE'S PERSONAI
PROPERTY. LESSEE SHALL BE LIABLE FOR ANY DEFICIENCY REMAINING AFTER THE
SALE OF THE PROPERTY.

15. APPLICABLE LAW. This agreement shall be construed in accordance with the Virginia
Self -Storage Act and any other applicable law of the Commonwealth of Virginia.

RE: Review of Ellis Self -Storage Site Development Plan
Dear Mr. Pease:
I have had the opportunity to review the above referenced site plan received by our department on July 2,
1997. The following comments, in addition to those marked on the plan, need to be addressed during the
revision of this site plan:
1) Please include a statement to the effect that the approved site development plan shall be valid for five
years from the official approval date of the plan, adjacent to the approval block.
2) Please specify the distance of the approved variance and the resulting front setback.
3) Please show the use of the adjoining properties and the property information for the properties
located across the Route 664/761 right-of-way.
4) Please identify the surveyed boundaries for parcels 44-A-172 and 44-A-173. These two lots should
be consolidated to accommodate the development of this property. This consolidation must occur
prior to approval of the site plan.
5) Please show the separate acreage of each of the lots and the acreage for the consolidated lot.
6) Please show the location of the required setbacks and yard areas on the site plan. The end unit appears
to be located too close to the adjoining property line.
7) Please provide the dimensions of the existing sign and show where its new location will be.
8) Please show the location and nature of any outdoor lighting and all outdoor storage areas. If none are
planned, please make a statement to that effect on the site plan.
9) Please provide the height of the proposed buildings.
10) Please show the location of Route 761 in addition to Route 664. The intersection of these two roads
should be clearly show on the plan.

11) The location and nature of all facilities necessary to meet Fire Code requirements shall be approved
by the Fire Marshal.
12) Please show the calculations describing the required number of parking spaces, their location, and
the location a9d dimensions of the disabled parking spaces. The parking requirement for self service
stdrage facilities is one space per 5,000 square feet of floor area.
13) Please ensure that all driving aisles are a minimum of twenty-two (22) feet in width. In addition, a
thirty (30) foot distance between storage units must be maintained.
v' 14) All parking areas, travel aisles and maneuvering areas associated with the self-service storage facility
operations should be paved with asphalt. We would be willing to waive this requirement if the
landscaped strip is extended and embellished into the southeastern corner of the property as marked
on the enclosed plan. In addition, the proposed plantings are required to be a minimum of six feet in
height at the time of planting. Please provide a count on the number of plantings that will be used.
15) Please provide a detail of the proposed six-foot high opaque fence.
16) The stormwater management plan, and the soil erosion and sedimentation control plan, shall be
approved by the Department of Public Works.
Please revise your site plan to reflect the comments specified in this letter and resubmit one copy for my
review. Once I have verified the information contained on the revised site plan, I will need all approved
review agency comment sheets and five copies of the final site plan for approval. Comment sheets are
required from the following agencies: the Virginia Department of Transportation, the Frederick County
Health Department, the Inspections Department, the Frederick County Engineer, and the Frederick County
Fire Marshal.

Stormwater management for this site will be provided at the
northeast corner of the site in an above ground pond. These
computations are based upon the total amount of post -developed
impervious area on the site.
The routing computations were performed utilizing Pond-2
software by Haestad Methods, Inc. of Waterbury, CT.
