The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

RE: Appeal of Interpretation of Chapter 90 of the County Code, Fire Prevention

Attached please find a copy of a letter from Mr. Ron Mislowski, of G. W. Clifford & Associates, Inc.
regarding the present lack of an appeals process for interpretations of the above -mentioned chapter of
the County code.
As you may be aware, Section 90-2 of the County Code names the Planning Director, or his designee,
as the individual charged with administration and interpretation of the Fire Prevention chapter. It is my
belief that the Fire Marshal is the logical individual to be administering this code section and, therefore,
when questions arise, I defer to the Fire Marshal's judgement. In effect, the Fire Marshal is my designee.
With this as background, Mr. Mislowski has objected to the measurement of a maximum 300-foot
distance from a structure (proposed on a client's site plan) to the nearest fire hydrant being measured
along the "centerline of roadway surfaces or along surfaces meeting the requirements of a fire lane" as
stated in 90-4,E. (2) of the Code. I have been unwilling to overrule the Fire Marshal (and, in fact, feel
there is no justification for doing so in this instance). In light of this, Mr. Mislowski further objects to
the fact that the Code allows no avenue for appeal.
While I am unsympathetic with regard to the particular nature of this appeal, I do question whether it
might not be appropriate to establish an appeals process for this or other sections of Chapter 90. In
discussing the matter with Mr. Riley, the question arose as to whether or not it would be permissible to
designate the County's Building Appeals Board as the body to which an appeal would be made.
Your opinion regarding this proposal would be much appreciated.

Recently we've been trying to get a site plan approved for a funeral home on U.S. Route 522, south of
Winchester. All agencies, except for the Fire Marshal, reviewed and approved the plan quickly. Even though
there was an existing fire hydrant located directly across the street from the proposed building site, the Fire
Marshal insisted that we extend a public water line across Route 522 and place a hydrant closer to the building.
I've attached a copy of his marked up plan. We believe this interpretation of the ordinance, in this instance,
should have been reviewed. Though the ordinance does allow the Frederick County Director of Planning final
interpretation of its requirements, you've relinquished this role back to the Fire Marshal. As with the zoning
ordinance and building code, there should be some avenue for review of the Fire Marshal's interpretations and
requirements.

Dear Ron:
The Frederick County Department of Planning and Development administratively approved the revised
version of the above -referenced site plan on March 13, 2000. This site plan, for the development of a
7,098-square-foot funeral home, was revised to eliminate seventeen (17) parking spaces in order to
provide a vehicle stacking area for funeral processions. Furthermore, the revised site plan delineates the
removal of approximately 82.92 feet of curb and gutter along the canopy -covered loading/service areas
directly adjacent to the side and rear building entrances. Such revisions were deemed to be consistent with
all County requirements for development within the B2 (General Business) Zoning District.
Following the aforementioned revisions, the proposed facility will be served by forty-nine (49) parking
spaces, of which three (3) will be designed for handicapped accessibility. Additionally, a zoning district
buffer (Category B) will be provided along the front of the subject parcel adjacent to the Route 522 (Front
Royal Pike) right-of-way.
I have provided you with several copies of the approved site plan. Please forward these approved plans
to the owner and advise the owner to keep an approved copy for their files. Furthermore, the owner
should ensure that an approved copy is maintained on the constriction site throughout the development
process. Once site development has been completed, the owner should contact this office to schedule an
on -site inspection.

Over the past couple months we've requested site plan revisions regarding curb changes around the building
and monument sign locations. We appreciate your quick review and approval of those requests. We've
delayed issuing the complete revised plan in hopes that the fire hydrant location issue could be resolved.

The owner has re -considered the parking lot layout at The Omps Funeral Home on U.S. Route 522. The site
previously has excess parking. The new layout would delete 17 spaces along the rear property line. This
parking area would be used to stack cars in preparation for the procession to the burial site. The required
parking space total is still exceeded as is the open space area. This layout would allow two rows of stacked
vehicles and maintain a 22 foot access aisle for the access to the remaining parking spaces.

It appears all of our earlier review comments have been satisfactorily addressed.
Please advise the owner of our approval.
The appropriate land use permit may now be applied for to cover work within the
Route 522 right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector. A copy of any/all plats of dedication for drainage easements or additional
right-of-way required for implementation of this proposed project should be provided to
VDOT prior to issuance of any land use permits. Dedication should be made to the
Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue. Should you have any questions, do not hesitate to
call.

I've attached a copy of the revised site plan for a funeral home on U.S. Route 522, south of Winchester.
We've provided a 12 foot driveway along the south side of the building, as you required. We've also shown
the landscape buffer required along Route 522 to screen the RA zoned residential use from B2. We believe
this buffer will satisfy the screening required to reduce the impact of headlights on Route 522.
We continue to work with the Fire Marshal on Hydrant locations. I've attached a copy of my latest letter to
him.

We are proposing a 7,098 sq . ft. funeral home on the west side of U.S. Route 522, approximately 700 ft. south
of VA Route 850. In the site plan review process two ordinance interpretation issues have arisen. The first has
to do with the loading space requirement. The Frederick County ordinance would not require a loading space
be provided for a building of our size. The owner has, to meet his needs, proposed a loading area, for his
vehicles only, along the southern wall of the funeral home. We believe that this loading space is not "required"
and therefore does not need to meet the minimum dimensional requirements specified in the ordinance.
Typically, this situation arises with parking spaces. Once the required number of parking spaces which meet
the ordinance dimensional requirements are provided, the developer may provide smaller "compact car" or
motorcycle parking if lot area and open space requirements allow. We believe the same situation apples to the
loading spaces provided at the Omi- FuI}erNl Homes e - 0 v s
The other issue at the Omps Funeral Home involves fire by rant locations. The Fire Marshal is asking that we
provide a fire hydrant at the western property line, behind the proposed facility. Since a hydrant currently
exists, directly across Route 522 from our site, we've questioned him on this issue. He insists that the
additional hydrant is required because the ordinance requires the 300 ft. distance requirement from the hydrant
to all building walls be measured along centerline of roads. While we understand the applicability of that
requirement when dealing with a dense commercial or residential development, where structures placed along
the property line could impede hose runs, this situation does not exist here. There would be nothing to impede
access from the hydrant directly to all points on the building.
I'd appreciate your thoughts on these two issues as soon as possible.

following:
l . Your comment 8, the 2 foot extension beyond the BRL is part of the canopy's support structure.
2. Your comment 13, no drainage from off site is being conveyed through this site, therefore no easements are
required. The same situation existing concerning utility easements. Only the utilities to serve this building
are proposed.
3. Your comment 14, the Fire Marshal did not delineate any fire lanes. He did comment on the hydrant
location and we've responded to him on that.
4. Your comment 15, the drive area on the south side of the building is intended as a. loading and service area
for employees only. This is not a parking or public driveway area.
If these comments and the plan revisions adequately address your comments, please let me know and we will

A VDOT review has been completed on the preliminary site plan dated May 25, 1999 for
the referenced project. Our comments are as follow and as shown in red on the
enclosed plan sheets:

1. It is permissible on this site plan to expel site storm water into existing VDOT storm
drainage system due to the relatively low cfs volume being carried/added to the
existing 21" culvert.
2. The standard entrance type proposed should be CG-9D. CG-12, ADA access ramps
should be illustrated to support placement if necessary.
3. Care should be exercised in proximity to curb and gutter during the placement of
sanitary sewer under VDOT roadway using jack and bore method. A conduit should
be placed from right-of-way to right-of-way.
4. The water service should be provided by way of extending from the south of Route
644 (Pleasant Valley Road). If water service is located south of Route 644, then
crossing Route 644 should be accomplished by jack and bore method. Casing
should be placed from right-of-way to right-of-way.
5. For the traffic volumes it appears Code 566, Page 941 (Cemetery) is more
appropriate for intended use. Please recheck and provide comment.
A north arrow should be provided.
• With no VDOT sidewalk in place, the section of proposed sidewalk shown
could/should be deleted.

1) Please ensure that the engineer's certificate is signed.
2) Please state the proffered conditions associated with Rezoning Application #001-97, of Sunset
Memorial, Inc. and Omps Funeral Home, Inc., on the site plan.
3) The subject property is located within the Shawnee Magisterial District. Please state the
correct Magisterial District on the cover sheet of the site plan.
4) Please provide a north arrow on the site plan.
5) Please provide the correct Property Identification Number (PIN) and owner information
associated with the adjoining property located immediately north of the subject parcel.
6) Please delineate the surveyed coordinates for the rear boundary of the subject parcel. The
coordinates and distances should correspond with those delineated on the plat approved with

8) Please note that Route 522 (Front Royal Pike) is classified as a minor arterial road. It is
therefore necessary to correct the required front yard setback stated in the Project Summary
to reflect this designation. Please ensure that this setback is clearly delineated on the site plan.
Furthermore, the respective setbacks applicable to parking areas and protective entrance
canopies should be stated in the Project Summary and shown on the site plan. It has been
noted that the main entrance to the building extends into the front setback area. Please identify
the use of this portion of the building to enable a determination regarding the permissibility of
such an encroachment.
9) Please state the maximum height permitted in the B2 Zoning District as well as the maximum
height proposed for the facility. This information should be included with the Project Summary
and correspond with the height shown on the site plan.
10) Please ensure that the information provided in the Project Summary regarding developed and
disturbed lot area is accurate.

17) Please clarify the location of all drainage ways that either exist or are proposed for the subject
property.
18) The minimum landscaped area required for development in the B2 District is 15%. Please
correct the requirement stated in the Project Summary to reflect this standard and further state
the landscaped area provided. The quantities stated in the Planting Schedule for the proposed
Red Maple and Pin Oak plantings do not correspond with the landscaping shown on the site
plan. Please add the seven (7) missing Pin Oak plantings along the row of parking adjacent to
the rear property line. The provision of such plantings will ensure adequate shading of the
proposed parking area. Please modify the landscaping information in the Project Summary
accordingly.
Please modify the heading in the title block of the Planting Schedule regarding size to state "at
time of planting." Furthermore, the minimum height at time of planting of all shade trees
proposed for the site should also be indicated. The maximum spacing proposed for the
Japanese Holly plantings should be reduced to 3.5' or 4.0' to ensure provision of an adequate
screen of headlight glare. Additionally, please extend the evergreen hedgerow along the front
property line as recommended on the enclosed marked -up plan.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need all approved review agency comment sheets and five copies of

Preliminary Matters
Pursuant to Section 15.1 - 491.1 et• se4•, of the code of Virginia, 1950, as
amended, and the provisions of the Frederick County Zoning Ordinance with
respect to conditional zoning, the undersigned applicant hereby proffers that in the
event the Board of Supervisors of Frederick County, Virginia, shall approve
Rezoning Application #GO -97 for the rezoning of 1.3976 acres from RA, Rural Area
zoning to B-2 Business General zoning, development of the subject property shall be
done in conformity with the terms and conditions set forth herein, except to the
extent that such terms and conditions may be subsequently amended or revised by
the applicant and such be approved by the Frederick County Board of Supervisors in
accordance with Virginia law. In the event that such rezoning is not granted, then
these proffers shall be deemed withdrawn and of no effect whatsoever. These
proffers shall be binding upon the applicant and their legal successors or assigns.
Planning Issues and Uses
The rezoned property shall be used for a funeral home. The funeral home
shall be 15,000 square feet or less in size.
The rezoned property shall have direct vehicular access via a single
commercial entrance constructed to VDOT standards to US Route 522.
Monetary Contribution of Development
The undersigned hereby voluntarily proffers that if the Board of Supervisors
for the County of Frederick, Virginia approves the rezoning for the 1.3976 acre tract,
more or less lying on the west side of Route 522 South (Front Royal Pike) just north
of the intersection of Route 644 (Papermill Road) in the Shawnee Magisterial
District of Frederick Countv, Virginia from RA to B2, the owner will pay to
Frederick County, prior to a building permit being issued, the sum of Seven
hundred fourteen dollars and sixty-two cents ($714,62) for Fire and Rescue
Emergency Services costs.

Upon review of the subject site plan, we offer the following comments:
1. The storm sewer calculations indicate that a run-off coefficient "C" value of 0.15
was used for the analysis of the existing 21 inch and 15 inch RCP culverts and
inlets. This valve is not applicable to this area because the grass is heavily
maintained. The actual "C" value should be 0.30 to 0.35. Provide calculations to
ensure that the existing storm sewer is adequate to carry the increased stormwater
run-off.
2. Revise the construction entrance detail to indicate that the wash rack is required.
Once these comments have been addressed, submit two (2) copies of the plan for further
review. If you have any questions, do not hesitate to contact me.
