The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Develcpment will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

the Department of Planning and Development to determine which review agencies

A certified statement signed by the Zoning/Subdivision Administrator or an authorized
representative, stating that Winchester -Frederick County Chapter of the American Red Cross has
not satisfactorily completed the construction of , and/or satisfactorily maintained, all physical
improvements that include, is not limited to , streets, curbing, gutter, sidewalks, above ground
facilities, underground utilities and facilities, recreational facilities, drainage systems, designated
open space and other required improvements located in or on 2.0213 acres on the North side of
Route 522, the approved subdivision or site plan.
A statement signed by the Zoning/Subdivision Administrator or his representative that: "The
drawing is for the explicit purpose of providing for the completion or maintenance of a required
facility or function pursuant to the requirements of Chapter 144, Subdivision Ordinance, and/or
Chapter 165, Zoning Ordinance, of the Frederick County Code and pursuant to the agreement of
the Subdivider, Developer, or his agent to comply with said ordinance as a condition of the
approval of the subdivision or site plan to the satisfaction of the Zoning/Subdivision Administrator."

We hereby engage with drawers, endorsees and bona fide holders that all drafts drawn in
compliance with the terms of this credit shall be duly honored upon presentation and delivery of the
above documents. This Irrevocable Letter of Credit shall remain in full force and effect for a
minimum of one (1) year from the date hereof and shall be automatically extended for additional
terms of six (6) months from the present or future expiration dates, unless sixty (60) days prior to
such date or dates, the above named bank or financial institution issuing the instrument, notifies
the County in writing by certified mail, that they elect not to renew the instrument for such
additional period. During the last thirty (30) days while this Letter of Credit ,is in force and effect
after notice of termination has been given, the County may draw up to the full amount of the sum
when accompanied by a document stating that Winchester -Frederick County Chapter of the
American Red Cross has failed to provide an acceptable substitute Irrevocable Letter of Credit or
deposit in escrow, and a document stating that "The drawing will be held by the County for the sole
purpose of providing for the completion and/or maintenance of the site plan and/or subdivision
requirements to the satisfaction of the Zoning/Subdivision Administrator or his authorized
representative". This credit shall be terminated upon the Zoning/Subdivision Administrator or his
authorized representative giving written release to Winchester -Frederick County Chapter of the
American Red Cross stating that they have satisfactorily performed and fulfilled the obligations and
requirements of the subject site plan or subdivision.

couple estimates for all required work. Staff will then evaluate the required bond amount.

3. Rear buffer & screening
4. VDOT type III barricade at the end of Fortress Drive
5. Road surface improvements to the segment of Fortress Drive shown on the site plan.

8. Placement of all required signs
9. Stabilization of the soil around the newly constructed building
10. Removal of all topsoil piles
11. Removal of all construction materials and equipment

Site Plan 23-99, 561 Fortress Drive, PIN 54 - A - 1.
Dear Ms. Rinker:
On February 12, 2001, I conducted a site plan inspection of the American Red Cross building, located at
Fortress Drive, because of a request made by Mr. Mike Renner of Howard Shockey & Sons. During my
inspection, I noted that several improvements are needed before staff can consider final site plan approval.
I have enclosed a copy of the inspection report for your information. The report lists 14 needed improvements
to the site. Since the time of my inspection, it has come to my attention that prior approval for the location of
the stones on the embankment was obtained. Therefore, please omit number 14 from the list of required
improvements.
Frederick County may allow a bond for these improvements, if requested. In order to request a bond, you must
first submit an estimate(s) for the total cost of completion. Once staff has received your estimate(s), you will
be informed what the required bond amount will be. At that point, it would be appropriate to formally submit
your bond. I have enclosed a sample copy of a bond with this letter. The wording and format of all bonds
should match that of the sample form enclosed.

facilities, underground utilities and facilities, recreational facilities, drainage systems, designated

A statement signed by the Zoning/Subdivision Administrator or his representative that: "The drawing
is for the explicit purpose of providing for the completion or maintenance of a required facility or
function pursuant to the requirements of Chapter 144, Subdivision Ordinance, and/or Chapter 165,
Zoning Ordinance, of the Frederick County Code and pursuant to the agreement of the Subdivider,
Developer, or his agent to comply with said ordinance as a condition of the approval of the
subdivision or site plan to the satisfaction of the Zoning/Subdivision Administrator."
We hereby engage with drawers, endorsees and bona fide holders that all drafts drawn in compliance
with the terms of this credit shall be duly honored upon presentation and delivery of the above
documents. This Irrevocable Letter of Credit shall remain in full force and effect for a minimum
of one (1) year from the date hereof and shall be automatically extended for additional terms of six
(6) months from the present or future expiration dates, unless sixty (60) days prior to such date or
dates, the above named bank or financial institution issuing the instrument, notifies the County in
writing by certified mail, that they elect not to renew the instrument for such additional period.
During the last thirty (30) days while this Letter of Credit is in force and effect after notice of
termination has been given, the County may draw up to the full amount of the sum when
accompanied by a document stating that

failed to provide an acceptable substitute Irrevocable Letter of Credit or deposit in escrow, and a
document stating that "The drawing will be held by the County for the sole purpose of providing for
the completion and/or. maintenance of the site plan and/or subdivision requirements to the satisfaction

Dear Ron:
Frederick County administratively approved Site Plan #23-99 for the referenced project on April 12,
2000. The approved site plan calls for the development of a 16,160-square-foot facility, the provision
of a paved parking lot to contain 64 regular parking spaces, three handicap parking spaces with
appropriate ramps and signage, curb and gutter, sidewalks, and interior and perimeter landscaping;
the construction of Fortress Drive from North Frederick Pike to the project entrance; the installation
of all appropriate erosion and sedimentation control measures; and the installation of a buffer and
screening area along the rear property line. It should be noted that a common shared buffer and
screening easement agreement has been executed between the American Red Cross, Star Fort
Developers, and Middlesex Artillery Fleet's Battery,.Inc., to accomplish this required buffer and
screening element.
Please find attached one copy of the final site plan with appropriate signatures for your files. I have
provided the remaining copies of the approved site plan to Mrs. Rinker for distribution to all
appropriate parties. Please note that our department will need to receive a copy of the plat for the
new drainage easements for our files. Please contact me if I may answer any questions regarding the

GRANT OF EASEMENT
THIS AGREEMENT to provide Buffers and Screening made and dated this'1�ay of
2000, by and between WINCH ESTER-FREDERICK COUNTY CHAPTER of the
AMERICAN NATIONAL RED CROSS, a Corporation existing under the laws of the United States of
America, its successors and assigns (hereinafter "Red Cross"), and SELDON, INC. a Virginia Corporation,
RICHARD G HARDISON, INC. a Virginia Corporation, and RICHARD & BYRON, INC. a Virginia
Corporation, t/a STAR FORT DEVELOPERS, its successors and assigns (hereinafter "Star Fort
Developers' and MIDDLESEX ARTILLERY FLEET'S BATTERY, INC., (HEREINAFTER "Middlesex
Artillery'.
WITNESSETH:
WHEREAS, Red Cross owns certain property located in Frederick County, Virginia, Tax Map No.
54-A-11), Zoned B-2, more fully described as
All that certain piece or parcel of land, situate in Gainesboro Magisterial District, Frederick
County, Virginia, more particularly described as follows:
That certain Parcel containing 2.0213 acres as shown on the plat of survey drawn by P.
Duane Brown, L. S., dated August 3, 1998, entitled "Final Plat A Portion of Star Fort" and
attached to the Deed of Dedication dated September 22, 1998, recorded October 7, 1998, in
Deed Book 917, at Page 849.
TOGETHER WITH a non-exclusive fifty -foot easement for ingress and egress to and from
Route 522 as shown on the aforesaid plat.
AND BEING the same property conveyed to The American National Red Cross, a
non-profit charitable entity, existing under the laws of the United States of America, by Deed
from Seldon, Inc., a Virginia Corporation, Richard G. Hardison, Inc., a Virginia Corporation
and Richard & Byron, Inc., a Virginia Corporation, t/a Star Fort Developers, dated December
18, 1998 and recorded January 7, 1999 in Deed Book 926 at Page 202 among the Land
Records of Frederick County, Virginia.
WHEREAS, Star Fort Developers own certain property adjacent to the Red Cross Property, being
part of Frederick County, Tax Map Number 54-A-1, Zoned RP, and more fully described as a portion of
the property conveyed to Richard G. Hardison, Inc., Richard & Byron, Inc., and Seldon, Inc., by Deeds
recorded in the aforesaid Clerk's Office in Deed Book 845 at Page 895, Deed Book 845 at Page 904 and
Deed Book 853 at Page 1; and

WHEREAS, Middlesex Artillery owns certain property adjacent to the Red Cross Property, being
part of Frederick County, Tax Map Number 54-A-1B and IC, Zoned RP, and more fully described as the
same property conveyed to Middlesex Artillery Fleet's Battery Inc., C.S.A., by Deeds of record in the
aforesaid Clerk's Office in Deed Book 531 at Page 266 and Deed Book 544 at Page 418; and
WHEREAS, Section 165-37 of the Zoning Ordinance as contained in the Code of Frederick
County, Virginia, ("the Zoning Ordinance', establishes certain requirements for zoning district distance
buffers and screening; and
WHEREAS, Section 165-37D(8) of the Zoning Ordinance, adopted by Frederick County on June
12, 1996, permits adjoining owners of properties in different zoning districts to establish common shared
zoning district buffer and screening easements; and
WHEREAS, the parties have agreed to cooperate in establishing such a common shared zoning
district buffer and screen easement for the mutual benefits of their properties, and desire to memorialize
that agreement herein;
NOW THEREFORE, for and in consideration of the mutual promises herein exchanged, and the
sum of ten dollars ($10.00) by each party paid, to the other, receipt of which each party hereby
acknowledges, the parties agree and take action as follows:
1. The Red Cross hereby grants and conveys to Star Fort Developers, Middlesex Artillery and
Frederick County an easement twenty-five feet (25 ft.) in width as shown on that certain plat of
record in the office of the Clerk of the Circuit Court for Frederick County, Virginia in Deed Book
917 at Page 849, the location of said easement being more fully described as "25' Common
Shared Landscaped Screening Easement (Inactive Buffer)" on that certain plat of P. Duane
Brown, dated August 3, 1998, a copy of which is attached as "Exhibit A" hereto and incorporated
herein.
2. The purpose of the easement herein created is to create a zoning district buffer as that term
is used in Section 165-37 of the Zoning ordinance. In addition to granting the easement above,
the parties undertake as follows:

a: Red Cross agrees to provide, construct, plant and maintain on the 25 ft. Common Shared
Landscaped Screening Easement herein conveyed at its sole expense, all such berms,
plantings and other improvements as may be required on said 25 ft. screening easement
for the creation of such screening buffer as those terms are used and understood in
Section 165-37 of the Zoning Ordinance.
3. Red Cross covenants that it has the right to convey the land to Star Fort Developers,
Middlesex Artillery and Frederick County; the individuals executing this Agreement on behalf of
Red Cross, Star Fort Developers and Middlesex Artillery have the authority to bind those
respective parties; that Star Fort Developers have done no act to encumber said land; that Red
Cross shall have quiet possession of the land, free from all encumbrances, and that it will
execute such further assurances of the land as may be requisite.
4. Should the Zoning Ordinance, or the zoning of either parcel, change so that a common
shared buffer becomes unnecessary or so that the burden thereof may be reduced without harm
to either owner, the parties agree in good faith to meet and consider a modification agreement
for that purpose.
5. The obligations contained herein shall be binding on the Red Cross, Star Fort Developers and
Middlesex Artillery, their successors and assigns. The burden herein created shall run with the
parcel, in perpetuity.
Red Cross represents that nothing in the organizational documents of Red Cross requires
membership or other approval of this transaction. Star Fort Developers represent that nothing in the
corporate documents of Star Fort Developers requires shareholder or other approval of this transaction.
Middlesex Artillery represents that nothing in the corporate documents of Middlesex Artillery requires
shareholder or other approval of this transaction.

This is to acknowledge receipt of your revised plans dated 09/28/99 for the
referenced project. The plans appear satisfactory and are approved. Please
advise the developer accordingly. Please provide seven (7) sets of approved
construction plans with signed seal for VDOT distribution.
I offer the following comments:
* A preconstruction conference be held by the engineer and/or
developer with the attendance of the contractor, various County agencies and
VDOT prior to initiation of work.
* Materials used and method of construction shall apply to current
observed VDOT Road & Bridge Specifications applicable during construction of
this development.
* Our review and comments are general in nature. Should conditions in
the field exist such that additional measures are warranted, such measures
shall be completed to the satisfaction of the Department prior to inclusion

into the Secondary Road System.
* All drainage is to be carried within the right-of-way in ditch lines
or gutters along the street to a pipe or drainage easement.
* The contractor shall notify VDOT when work is to begin or cease for
any undetermined length of time. VDOT will also require 48 hours notice for
inspections.
* The appropriate land use permits shall be obtained before any work
is performed on the State's right-of-way. The permit is issued by this
office and will require a minimum processing fee, surety bond coverage, and
the salary & expenses of a State assigned Inspector.
* Any entrances constructed from the referenced street(s) shall meet
VDOT minimum standards. This is the developer's responsibility.
* I suggest any utilities and/or storm sewer placed within the
proposed right-of-way be backfilled completely with C. R. Type 21-B Stone.
This will greatly reduce the possibility of any pavement settlement.
* A copy of any/all plats of dedication for drainage easements or
additional right-of-way required for implementation of this proposed project
should be provided to VDOT prior to issuance of any land use permit.
Dedication should be made to the Commonwealth of Virginia.
* It is permissible to lay the base aggregate and base asphalt as a
first phase, leaving the surface course for later application.

A VDOT review has been completed on the preliminary site plan dated May 4, 1999
(received May 18, 1999) for the referenced project. Our comments are as follows and
as shown in red on the enclosed plan sheets.
Plan Sheet C2
1. A minimum 100' taper should be provided at the Route 522 intersection with
Fortress Drive. It is recommended a 100' right turn lane with a 150' taper as
required and approved by VDOT on June 1, 1998 Route 522 Improvement Plan be
put in place concurrently with this Red Cross site plan to avoid two disturbances for
construction at one location.
2. The proposed use of the Fortress Drive intersection as an access to the Red Cross
site should be accomplished by building the ultimate typical section from Route 522
to the radius returns as shown. 40' should be provided from face of curb to face of
curb. A Type III barricade should be provided as shown. A paint striping plan
should be presented marking the proposed lane lines. The pavement structure
within the Route 522 right-of-way should match the existing Route 522 pavement.
3. The minimum 30' commercial entrance width at the Red Cross should be increased
to 34' face of curb to face of curb.
4. The proposed commercial entrance as shown to the vacant lot on the west side of
Fortress Drive and the north side of Route 522 should be relocated onto Fortress
Drive with a 50' minimum space as VDOT requirement. Any other entrance as may
be desired within the full width area should be constructed opposite the proposed
entrance at Red Cross.

5. Standard CG-11 entrances should be shown at the intersection of Route 522 with
Fortress Drive with 50' radii and at the commercial entrance to the Red Cross. Also
you'll need to address what you would do with existing culvert at Route 522,
Fortress Drive.
Please consider all comments shown in red on the plan sheets. When all the above
comments have been addressed, please provide one copy of the revised plan to VDOT
for further review.

In October 1998, the County approved a subdivision which created the Red Cross Property at Star Fort. At the
time, to limit entrances on Route 522, an access easement was provided through Star Fort. This easement is
located over the existing entrance to the gas station site. Red Cross intends to use this easement and entrance
to access its site. I've attached a copy of the plat. I've also attached the ITE trip generation estimated for the
former gas station and the future Red Cross offices. At 187 trips per day, the new office trips at the entrance
will be well below the 1011 trips estimated for the gas station.
It is the developers intention that the portions of driveway which lie in the Fortress Drive Right-of-Wa.v will be
constructed to meet VDOT requirements. The developer will provide inspection and testing as required to
allow VDOT to accept the roadway when Fortress Drive and the median improvements are complete.
It is my understanding that Star Fort will be entering into a signlization agreement with VDOT for 50% of
those costs. We also believe that the Star Fort developers are committed to building Fortress Drive and the
associated Route 522 improvements upon development of residential section four as required by the master
plan or their development of another commercial lot.

Dear Ron:
I have reviewed the proposed phase plan for the American Red Cross facility located at the intersection
of North Frederick Pike (Route 522 North) and Fortress Drive. I would like to discuss the following
issues with you prior to my approval of this phase plan:
1) What is the significance of delineating the Fortress Drive right-of-way limits and the American
Red Cross project limits? It is my understanding that the improvements to Fortress Drive are
required to be constructed as part of this site plan project.
2) My discussions with Tim Machado and Beth Reader of Reader & Swartz Architects indicated
that the phase plan would only be applicable to the American Red Cross building. The proposed
phase plan depicts a section of the parking lot and the common shared buffer and screening
easement in the northeastern portion of this site as being within phase two. The common shared
buffer and screening easement will be required in phase one. If the applicant desires to phase
the development of the parking lot, they will be required to provide a bond which accounts for
the provision of curb and gutter, parking lot landscaping and associated work between the phase
one and phase two transition line. The amount and time limit associated with this bond will need
to be acceptable to the County.
3) The phase one and phase two description appears to be reversed as described along North
Frederick Pike (Route 522 North).
4) The parking lot totals will need to be amended to account for the additional disabled spaces that
have been provided by the phase one structure.
5) What is the status of the common shared buffer and screening easement?
6) What is the status of the various review agency comments?

11) The development of this site will necessitate the vacation and relocation of the drainage easement
for this property and the adjoining property to the northwest. Please provide a copy of the
recorded easement plat which establishes this new easement on each property and incorporate
the Deed Book and Page Number onto the site plan for reference. (Sheet C2)
V12) Please provide information within the Project Summary which states the allowed building height
for this zoning district, and the height for the proposed structure. It is my understanding that the
illuminated tower which will have the Red Cross symbol has been interpreted as a spire which

Pike and Fortress Drive will be done by others. This narrative appears to be in conflict with the
narrative which describes improvements between station 47+95 and 50+15. If this narrative is
to remain on the plan, you will need to be more specific to specify the location of the proposed
/ improvements by others and identify who is responsible for the improvements. (Sheet C2)
17) Please provide the size of the water line that traverses the front of this site and provide
/ information delineating the easement for this utility. (Sheet C2)

which states the number of perimeter and interior trees that have been provided. (Sheet C2)
19) The site plan indicates that the applicant will utilize a common shared buffer with the adjoining

you with an example of this information from another site plan project which utilized this
concept.
20) The landscape architect has prepared a Plan A and Plan B for the required buffer element on this
project. It is my understanding that the landscape architect believes that Plan B will provide
better results in the long term based on the overall survival rate of the plant material. Our
department will allow for the implementation of Plan B provided that the American Red Cross
is willing to submit a bond or letter of credit that will cover all costs associated with Plan A. This
bond or letter of credit would be released by Frederick County once the landscaping proposed
in Plan B matured to a condition that meets the requirements of Plan A.

✓ 21) Fortress Drive is designed to intersect North Frederick Pike with a curb and gutter radius that
is similar to a commercial entrance standard. Fortress Drive is the primary road that will serve
the Star Fort residential subdivision, and will most likely be the primary access for future
commercial and office uses in this area, and for the Star Fort historic resource. It appears that
a right turn lane should be designed for safe access to this street from North Frederick Pike in
lieu of a curb and gutter radius entrance. (Sheet C2)
I have provided you with a copy of the red -lined site plan which identifies the necessary revisions for this
project. Please revise your plan to reflect the comments specified in this letter and submit one copy of
the revised site plan to my attention for review. Once I have received this information, I will advise you
of the status of approval by our department. In order to receive final approval of this site plan, our
department will need to receive verification of approval by the following agencies and departments:

Thank you for your comments of 22 September 1999. Since we investigated a phased approach on the site
improvements, Red Cross has now indicated that they believe, the entire site will be developed as part of the
first phase. The building may continue to be constructed as funds become available.
Fortress Drive will also be developed, as shown, in the first phase. The delineation is provided for use by
bidders so that the cost can be divided appropriately.
We've reviewed the common shared buffer agreement you provided with the Red Cross's attorney. He had no
problem with preparing a similar agreement for Red Cross. That agreement will reference the existing
easement shown on the subdivision plat.
Once we get the final approval from VDOT we will forward all comment sheets to you.
We continue to work with Red Cross on developing an affordable plan. We will keep you informed in the
meantime, please call if you have questions or comments.

I've attached a copy of the revised landscaping plan for your review. We've added a note requiring that a bond
or letter of credit be posted with the County to cover the cost of installing the buffer screening Plan A if the
Plan B alternative is not successful. I understand now that this surety will need to be provided prior to
issuance of the occupancy permit, and will not hold up Site Plan approval.
As far as I know, the only remaining item required to satisfy the County's concerns is the shared landscape
buffer easement. We will have that item to you next week.

As you know I drafted an Easement Agreement and circulated it for signature by Red Cross,
Star Fort Developers and Middlesex Artillery. That Easement Agreement made reference to a
certain plat dated October, 1999. My client has asked that if the plat of Mr. Duane Brown dated
August 3, 1998 can be replaced for the existing plat. 1 have no objection to it but because the
Easement was prepared with the County and Clifford & Associates' guidance and input, I thought
it best to get your approval of the same.
Additionally, my client has inquired as to whether the October 4, 1999 plat making a
dedication to the State has been recorded. I have not recorded any plats and thus, with this letter, I
am asking if either of you have any knowledge of the same.

THIS AGREEMENT to provide Buffers and Screening made and dated this _ day of
2000, by and between WINCH ESTER-FREDERICK COUNTY CHAPTER of the
AMERICAN NATIONAL RED CROSS, a Corporation existing under the laws of the United States of
America, it successors and assigns (hereinafter "Red Cross', and SELDON, INC. a Virginia Corporation,
RICHARD G HARDISON, INC. a Virginia Corporation, and RICHARD & BYRON, INC. a Virginia Corporation,
t/a STAR FORT DEVELOPERS, its successors and assigns (hereinafter "Star Fort Developers') and
MIDDLESEX ARTILLERY FLEET'S BATTERY, INC., (HEREINAFTER "Middlesex Artillery'.
WHEREAS, Red Cross owns certain property located in Frederick County, Virginia, Tax Map No.
54-A-ID, Zoned B-2, more fully described as
All that certain piece or parcel of land, situate in Gainesboro Magisterial District, Frederick
County, Virginia, more particularly described as follows:
That certain Parcel containing 2.0213 acres as shown on the plat of survey drawn by P.
Duane Brown, L. S., dated August 3, 1998, entitled Final Plat A Portion of Star Fort" and
attached to the Deed of Dedication dated, September 22, 1998, recorded October 7, 1998, in
Deed Book 917, at Page 849.
TOGETHER WITH a non-exclusive fifty -foot easement for ingress and egress to and from
Route 522 as shown on the aforesaid plat.
AND BEING the same property conveyed to The American National Red Cross, a
non-profit charitable entity, existing under the laws of the United States of America, by Deed
from Seldon, Inc., a Virginia Corporation, Richard G. Hardison, Inc., a Virginia Corporation
and Richard & Byron, Inc., a Virginia Corporation, t/a Star Fort Developers, dated December
18, 1998 and recorded January 7, 1999 in Deed Book 926 at Page 202 among the Land
Records of Frederick County, Virginia.
WHEREAS, Star Fort Developers own certain property adjacent to the Red Cross Property, being
part of Frederick County, Tax Map Number 54-A-1, Zoned RP, and more fully described as a portion of
the property conveyed to Richard G. Hardison, Inc., Richard & Byron, Inc., and Seldon, Inc., by Deeds
recorded in the aforesaid Clerk's Office in Deed Book 845 at Page 895, Deed Book 845 at Page 904 and
Deed Book 853 at Page 1; and
WHEREAS, Middlesex Artillery owns certain property adjacent to the Red Cross Property, being
part of Frederick County, Tax Map Number 54-A-1B and 1C, Zoned RP, and more fully described as the
same property conveyed to Middlesex Artillery Fleet's Battery Inc., C.S.A., by Deeds of record in the
aforesaid Clerks Office in Deed Book 531 at Page 266 and Deed Book 544 at Page 418; and
WHEREAS, Section 165-37 of the Zoning Ordinance as contained in the Code of Frederick County,
Virginia, ("the Zoning Ordinance', establishes certain requirements for zoning district distance buffers
and screening; and
WHEREAS, Section 165-37D(8) of the Zoning Ordinance, adopted by Frederick County on June
12, 1996, permits adjoining owners of properties in different zoning districts to establish common shared
zoning district buffer and screening easements; and

WHEREAS, the parties have agreed to cooperate in establishing such a common shared zoning
district buffer and screen easement for the mutual benefits of their properties, and desire to memorialize
that agreement herein;
NOW, THEREFORE, for and in consideration of the mutual promises herein exchanged, and the
sum of ten dollars (s10.00) by each party paid to the other, receipt of which each party hereby
acknowledges, the parties agree and take action as follows:
1. The Red Cross hereby grants and conveys to Star Fort Developers, Middlesex Artillery and
Frederick County an easement twenty-five feet (25 ft.) in width as shown on that certain plat of
record in the office of the Clerk of the Circuit Court for Frederick County, Virginia in Deed Book
917 at Page 849, the location of said easement being more fully described as Egi�t "25 1k.
Common Shared Landscaped Screening Easement (Inactive Buffer)" on that certain plat of P.
Duane Brown, dated August 3, 1998 a copy of which is attached as "Exhibit A", hereto and
incorporated herein.
2. The purpose of the easement herein created is to create a zoning district buffer as that term
is used in Section 165-37 of the Zoning ordinance. In addition to granting the easement above,
the parties undertake as follows:
a. Red Cross agrees to provide, construct, plant and maintain the 25 ft. Common Shared
Landscaped Screening Easement herein conveyed at its sole expense, all such berms,
plantings and other improvements as may be required on said 25 ft. easement screening for
the creation of such screening buffer as those terms are used and understood in Section 165-
37 of the Zoning Ordinance.
3. The parties further agree that there shall be no requirement of payment by Frederick County
to acquire said easement and that the construction of the easement shall not be the
responsibility of Frederick County.
4. Red Cross covenants that it has the right to convey the land to Star Fort Developers,
Middlesex Artillery and Frederick County; the individuals executing this Agreement on behalf of
Red Cross, Star Fort Developers and Middlesex Artillery have the authority to bind those
respective parties; that Star Fort Developers have done no act to encumber said land; that Red
Cross shall have quiet possession of the land, free from all encumbrances, and that it will execute
such further assurances of the land as may be requisite.
5. In the event that the Zoning Ordinance, or the zoning of any parcel herein affected, changes
so that a common shared buffer becomes unnecessary or so that the burden thereof maybe
reduced without harm to any of the other owners, the parties agree in good faith to meet and
consider a modification agreement for that purpose.

6. The obligations contained herein shall be binding on the Red Cross, Star Fort Developers and
Middlesex Artillery, their successors and assigns. The burden herein created shall run with the
parcel, in perpetuity.
7. It is understood and agreed that this Agreement, once executed by all parties, shall be
provided to the Department of Planning and Development of Frederick County, Virginia and shall
be maintained with the approved site design plan, all of which is described in Section 165-37
(D)(8) of the Zoning Ordinance.
Red Cross represents that nothing in the organizational documents of Red Cross requires
membership or other approval of this transaction. Star Fort Developers represent that nothing in the
corporate documents of Star Fort Developers requires shareholder or other approval of this transaction.
Middlesex Artillery represents that nothing in the corporate documents of Middlesex Artillery requires
shareholder or other approval of this transaction.

Erosion and Sediment Control Narrative
April 19, 1999
Project Description
The purpose of this project is the development of the Red Cross facility on approximately 1.8
acres. The site is located off U.S. Route 522 in the adjacent to Star Fort commercial
development. The construction will consist of the building, about 275 ft of the proposed
Fortress Drive, adjacent parking, storm sewer system, extension of water and sewerage
utilities, and required culverts and ditches. It is estimated that approximately 2 acres will be
disturbed during construction.
Existing Site Conditions
The proposed site is located on the southern side of a small ridge with slopes ranging from 8
to 20 percent. The site is vacant and covered with brush and grass mixture. A site location
map is provided in Attachment A.
Adjacent Areas
The property is bordered by the Star Fort development to the north, east, and west, and Route
522 to the south.
Offsite Areas
The offsite area west of the site will be disturbed to tie into the existing storm channel from
Star Fort Section II and to construct a portion of Fortress Drive.
Soils
The onsite soils are in the Frederick-Poplimento soil association. Offsite soils consist of both
loams and rock outcrop complex from this association and are deep, steep, and well -drained.
There is a high shrink -swell potential and severe soils erosion hazard .
Critical Areas
The critical area has been defined as the upstream area where tie-in to the existing storm
channel will occur. Work in this area should be accomplished as quickly as possible. Care
shall be exercised to ensure all erosion control measures are correctly installed and maintained.

Erosion and Sediment Control Measures
1.0 General
1.1 Description:
A. Work Included: Erosion and sediment control operations and devices required for this
work are indicated on the drawings and include, but are not necessarily limited to:
1. Installation of control devices;
2. Maintenance of control devices;
3. Temporary forms of stabilization;
4. Removal of devices and site restoration.
1.2 Standards:
A. The following codes and standards, latest editions form a part of this specification, to the
extent of all provisions applicable to the work required for this project, and as specifically
referenced herein.
1. All work shall comply with the Virginia Erosion and Sediment Control Handbook and
as amended by local codes and regulations.
2. VDOT Specifications are those contained in the latest edition of the Virginia
Department of Transportation, Road and Bridge Specifications.
1.3 Protection:
A. Use all means necessary to protect all materials incorporated into the work of this section
before, during and after installation. In the event of damage, immediately make all repairs
and replacements necessary to the approval of the Owner's Representatives and at no
additional cost to the Owner.
B. Maintain and protect all benchmarks, monuments and similar reference points and, if they
are displaced or destroyed by these operations, replace same as directed at no additional
cost to the Owner.
1.4 Permits:
A. The Owner will secure certificates and permits and pay for all fees required by local codes
and regulations. The contractor shall ensure that value of the erosion and sediment
control work to include maintenance and all seeding of disturbed areas shall be included in
the overall project performance bond.
2.0 Execution
2.1 General Requirements:
A. Limit grading to only those areas involved in current constriction activities. Limit length
of time for exposure of unprotected graded areas. Permanent stabilization of graded areas
shall be done within seven days after construction. If permanent stabilization cannot be
provided, temporary seeding, mulching or other forms of stabilization shall be provided.

B. The temporary construction entrance and diverted storm channel shall be constructed as
part of the initial phase of construction and shall be made functional as soon as possible.
Other sedimentation control devices will be constructed as rough grading allows.
Construction of the devices shall agree with the details shown on the plan subject to
modifications that the Frederick County Public Works Inspector may deem advisable.
Regardless, the sediment control devices shall comply with all requirements of the Virginia
Erosion and Sediment Control Handbook. They shall remain in place until all surfaces
within the project are stabilized such that siltation will not occur; i.e., all upstream areas
from the control devices have vegetation established, mulch in place or furnished
pavement completed.
C. The Contractor agrees to hold the Owner or any of its agents harmless from any and all
liability or damage that may arise of a violation of the siltation ordinance and agrees to
indemnify them against any loss.
D. Underground utility lines shall be installed in accordance with the following standards in
addition to other applicable criteria:
1. No more than 500 linear feet of trench may be opened at one time.
2. Excavated material shall be placed on the uphill side of trenches.
3. Effluent from dewatering operations shall be filtered or passed through an
approved sediment trapping device, or both, and discharged in a manner that does
not adversely affect flowing streams or off -site property.
4. Restabilization shall be accomplished in accordance with these regulations.
5. Applicable safety regulations shall be complied with.
E. Soil Stabilization
Permanent or temporary soil stabilization shall be applied to denuded areas within seven
days after final grade is reached on any portion of the site. Temporary soil stabilization
shall be applied within seven days to denuded areas that may not be a final grade but will
remain dormant (undisturbed) for longer than 30 days.
Permanent Stabilization: All disturbed areas not paved will receive at a minimum 6" of topsoil
and be seeded as follows:
200 lbs Tall Fescue per ac.
12 lb. Annual Rye per ac.
1000 lbs. 10-20-20 Fertilizer per ac.
2 tons agricultural limestone per ac
2 tons straw mulch per ac.
Permanent seeding will occur as a final phase of construction.

Temporary Stabilization: Seeding to stabilize areas left denuded for more than seven days,
but not yet at final grade shall be as follows:
60 lbs German Millet per ac. (May through September)
60 lb. Annual Rye per ac. (October through April)
450 lbs 10-20-20 Fertilizer per ac.
2 tons agricultural limestone per ac
2 tons straw mulch per ac.
Seeded areas to be cared for as necessary to ensure grass emergence.
F. Description of Controls
Control will be exercised through sequence of land disturbing operations, limiting duration
of exposure of unstabilized areas and installation and maintenance of physical control
devices coordinated with sequence of construction. Devices used on the site are shown on
the drawings and include the following:
1. Construction entrances - There is a high potential for tracking mud on to Route
522 during wet site conditions. The construction entrance is needed to clean the
tires of vehicles and equipment exiting the job site.
2. Sediment Basin — During the construction of Star Fort Section II, all drainage
entered a marl pit located downstream of the site. It was proposed by Frederick
County Department of Public Works during the review of Star Fort Section II to
use this depression as a temporary sediment basin, provided that a stone outlet
filter be installed and the sediment be periodically removed. It is proposed that the
existing depression be used as a temporary sediment basin during the construction
of Red Cross. Once construction is complete and vegetation is established,
accumulated sediment shall be removed and permanent vegetation established in
the basin.
3. Inlet and outlet protection - All culvert and storm drain inlets must be protected to
prevent sediment from clogging the storm sewer piping. All inlets shall be cleaned
out once the disturbed area has been stabilized. VDOT EC-1 outlet protection
must be installed at all culvert outlets to slow velocities and prevent scour at the
pipe outlet. Dimensions are provided on the Plans.
4. Silt Fence - Silt fencing shall be placed in locations shown on the plans
immediately following grading in a given area. The silt fence will intercept and
detain small amounts of sediment before runoff exits the site and also decrease
velocities in low to moderate flow channels.
5. Diversion Ditches - Diversion ditches shall be constructed as shown on the plans
to divert runoff from steeply sloped disturbed areas.
6. Rock Fill Check Dams - Rock Fill Check Dams shall be placed in locations shown
on the plans immediately following grading of a ditch to trap sediment and
decrease flow velocities.

G. Sequence of Land Disturbing Activities:
1. General: All applicable mechanical controls are to be constructed as the first item
of work. Following their completion, rough grade, finish grade and install appropriate
erosion and sedimentation aids. Retain control devices until final stabilization of all
areas or as directed by the County Inspector.
2. Schedule:
a. First Phase:
(1) construction entrance;
(2) storm channel diversion;
b. Second Phase:
(1) strip topsoil and stockpile;
(2) silt fence where applicable;
(3) provide vegetative cover if over 7 days.
c. Third Phase:
(1) rough grade;
(2) silt fence where applicable;
(3) rock fill check dams;
(4) diversion ditches;
(5) install storm drainage facilities, utilities, and roadway stone base;
(6) inlet/outlet protection.
d. Fourth Phase:
(1) finish grade, install curb and gutter, and roadway paving;
(2) provide vegetative cover on unpaved areas, including stockpiled surplus
soils.
e. Fifth Phase:
(1) remove rock check dams, clean out sediment, and fill to finished
grades;
(2) provide vegetative cover at former rock check dams.
H. Maintenance Program: All control measures are to be inspected daily or immediately
after each rain by the site superintendent or his representative. Any damaged structure
should be repaired at the close of the day. All sediment barriers (including inlet
protection devices) and the temporary basin, should be cleaned at 50% wet storage
capacity and accumulated sediments spread on -site where practical. Control structures
shall not be removed until all areas above have been finally stabilized and seeded areas

established. No control shall be removed without the County inspector's prior
approval. The daily control measure inspections by the contractor shall be
documented to indicate findings and corrective action taken. These reports shall be
submitted to the County on a biweekly basis.
3.0 Stormwater Management
Runoff from the site will be routed by the proposed ditch and culvert system to an existing
storm conveyance channel located south of the site. The Shockey Detention Pond located to
the south will serve the site as well as adjacent off site areas. A total of 11.5 commercial acres
at the Star Fort development was modeled for the pond design. Refer to the Erosion and
Sediment Control Narrative (revised June 4, 1998) for the Shockey Brothers Detention Pond
prepared by Gilbert W. Clifford & Associates, Inc.
The storm sewer and all structures were sized to pass the 10-year storm. calculations are
provided in Attachment B.
