application. All required information must be submitted priorto the final approval of any site plan. The
Department of Planning and Development will review the application to ensure that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and returned to
the applicant(s)_

Dear Candice,
Attached please find a substitute list of plantings that our landscaper would like to utilize
at the above referenced site. All substitute plantings are of the same sue and quantity as
specified on the approved site plans. We are being told by the installer that this selection
will provide more variety and curb appeal, and will be more suited to this climate.
Please review this list and advise if we may make these substitutions. If you have any
questions, please do not hesitate calling Ed Elvira at Elvis Landscapes. They are the
contractor handling this portion of the project for us. He may be reached at 974-1761.
We are hoping to begin these plantings within the next couple of weeks if we can get a
resolution to this matter.

Dear Craig:
The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on April 8, 2003. The site plan is approved for an office/warehouse facility, consisting
of 34,200 square feet of office space and 32,650 square feet of warehouse space. The development will
be located in the Westview Business Center, at the corner of Muskoka Court and Airport Road. Below
is a list of the primary improvements associated with this development:
• The planting of 74 deciduous shade trees for the interior and perimeter of the parking areas.
• An additional five deciduous trees and nine white pines to be planted for the required buffer
in the southwest corner of the property.
• Construction of 214 striped parking spaces, including eight handicap parking spaces.
• Planting of a continuous evergreen hedge at the end of all parking bays which face Muskoka
Court and Airport Road.
• Construction of curb and gutter and sidewalks throughout the entire development.
• Installation of appropriate stormwater management and fire code safety improvements.

appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also please provide seven (7) sets of approved construction plans
with signed seal for VDOT distribution.
Also, please make corrections to plans as discussed by phone with Mr. Craig Richardson on
January 3, 2003.
The appropriate land use permit may now be applied for to cover work within the Route 645
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all
recorded plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of any
land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

Dear Sir/Madam:
After review of the site plan for the above referenced project, the following comments are provided on behalf of the
Winchester Regional Airport Authority:
The proposed site plan does not indicate that future buildings would appear to penetrate the airport's FAR
Part 77 surface based on the information provided therefore airport operations should not be impacted by
this proposal. Due to the proximity of the proposed buildings within the established flight pattern, we are
requesting that all outdoor lighting at this site be of a shielded type to minimize possible light pollution on
aircraft entering the pattern for Runway 32. FAA form 7460-1 must be submitted to the FAA for review and
comment with a copy of the form sent to this office for record along with a copy of the completed
determination by the FAA.
2. Controlled burning should be prohibited due to the close proximity to the runway and since the property is
within the flight pattern of the airport. Unsuitable materials should be hauled away from the construction site
appropriately.
3. During the construction phase of the buildings, all cranes will be required to have an aviation
obstruction flag and/or obstruction light visible during operations and must be lowered at night
unless lit. Intended hours and dates of operation need to be coordinated with Airport staff no less
than twenty-four hours prior to start.
If these conditions are met, the Winchester Regional Airport Authority poses no objections to the proposed site plan for
the Airport Business Center Lot 4.

Dear Mr. Camp:
We are in receipt of the comments dated January 6, 2003 and offer the following responses:
Comments from Frederick County Department of planning and Development
Comment 1: Flex -Tech. 1t is unclear Khether or not the proposed development is intended to be a flex -tech
development. There are many design elements incorporated in the site plan tvitich are generally associated with
flex -tech in Frederick County. HoK ver, flex -tech would not be an option with the proposed development because
the rear separation of the two structures does not comply with Section 165-48.7 of the Frederick County Zoning
Ordinance. Please consult with staff to clarify the intent regarding flex -tech.
Response: "The development is not intended to be Ilex -tech. It is intended to be office/warehouse as stated.
Comment 2: Muskoka Court. Muskoka Court appears to be constructed as required by the Master Development;
however, the associated road sign for the road is not present. Please provide the required road sign for Muskoka
Court as part of this site plan. Also, verification from the Virginia Department of Transportation and rite County
Engineer is required to ensure that the subject road is constructed per state and county requirements. The master
development plan indicates that the road should have been constructed to meet the "Rural Local " geometric design
standards of VDOT.
Response: The road sign is the responsibility of the Ihveloper of the overall business center, not our client's. The
acceptance of the road "Muskoka Court" is a VDOT issue and the verification of such is not our responsibility. It
should have been handled with the overall development. If you are concerned with these issues, please consult with
VDOT and/or the County Engineer.
Comment 3: Perimeter Landscaping. Based on staffs calculations, the perimeter of the entire parking area is at
least 2,007 feet in length. At this distance, 52 perimeter trees are required. Please provide the appropriate number
of trees on the site plan. Also, the change in the number of trees wall require modification of the landscape plan on
Page 4 of the site plan.
Response: We have re -checked the perimeter of the parking areas and found it to be 1,317 linear feet. 'Ile
appropriate changes have been made to the cover sheet and landscape sheet.
Comment 4: Loading Spaces. Please show the location of all proposed loading .spaces. Based on the layout of the
facility, it appears that there should be at least four additional loading spaces.
Response: We have shown four additional loading spaces.

Comment 5: Dumpster Site. Please provide a parking lot island to the north of the proposed clumpster site. "Phis
would reduce the munbe'r- of parking spaces provided by one (1).
Response: We have provided the island and reduced the parking tabulation by one space.
Continent 6: Dumpster Enclositre. Please add the words "opaque screed " to the description of the proposed
enclosure around the proposed dumpster pad.
Response: We have added "opaque screen" to the note.
Comment 7: Category C Buffer. A Category C buffer, with a width oJ100 feet, requires a fidl screen. Please
provide the appropriate screening as part oJ'tlte proposed Categoi y C buffer•. Since stor'nttvater nualageiilent
improvements are proposed within the buffer area, you will treed to work around these J,atitres to provide the
required screening.
Response: We have shown a 6' fence and the required plantings within the Category "C" buffer area. The
landscape tabulations on the cover sheet and landscape sheet have been revised accordingly.
Contliteril S: Construction & Grading Easettient. Please provide staff with a copy of the approved plat, or other
legal instrument, ivhich legalized the 20' construction and grading easement.
Response: The staff will be provided with an approved plat or legal instrument for the offsilc construction and
grading casement prior to the beginning of any construction.
Comment 9: Maximum Height. Please change the inavimtan height to 60 Jeet on Page I of the site plats. The site
plan should also indicate what the proposed height will be.
Response: The note has been revised to 60 feet.
Comment 10: Signage. Please provide /he location of all proposed bitsille.ss• sigtrs.
Response: A proposed sign location has been shown at the northwest corner of the property along Airport Road.
Comment 11: Title. Please be more descriptive with the title of the site plan - doing so will avoid conf lsioll in the
future when the other parcels along Muskoka Conrl are developed.
Response: The title states "Lot 4" and the name of the development is not determined at this time. 'Therefore, we
have left the title as is.
Continent 12: Percentage of Interior Landscaped Area of Pai•Icing Lot. Please provide the percentage of interior
landscaped area provided.
Response: The percentage of interior landscaped area has been included ou the cover sheet.

Dear Craig:
I have reviewed the preliminary site plan for the above -referenced project and there are several concerns
which need to be addressed prior to final site plan approval. Please review the list of review comments
shown below, and then prepare a revised site plan for my review. I am also providing you with a red -lined
copy of the site plan for your assistance.
REVIEW COMMENTS:
1) Flex -Tech. It is unclear whether or not the proposed development is intended to be a flex -tech

final site plan for approval. Review comments are required from the following agencies: the Virginia
Department of Transportation, the Frederick County Sanitation Authority, the Frederick County Inspections
Department, the Frederick County Airport Authority, the Frederick County Department of Pub] is Works,
and the Frederick County Fire Marshal.
