The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is
complete. If any portion is not included or complete, the site plan application will not be accepted
and returned to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Dear Pat:
The Frederick County Planning Department administratively approved a revision to Site Plan #
014-95 for Hoss's Steak and Sea House Restaurant on August 27, 1996. This site plan was
revised to relocate the required disabled parking spaces and the painted crosswalk, as well as
finalize the design for the proposed access road, storm water management facility, and
landscaping. All other site improvements that were reflected on the approved site plan dated June
6, 1995 still apply to this project.
I have provided you with two copies of the approved revised site development plan and
forwarded an approved copy to Greenway Engineering. Please ensure that Mr. Ken Miller
receives a copy of this approved plan when the final site work improvements commence, and
advise Mr. Miller to contact this office to schedule an on -site inspection once all improvements
are complete. Please contact me if I may answer any questions regarding this letter.

RE: Hoss's Steak and Sea House Site Plan Approval
Dear Mr. Young:
The Frederick County Planning Department administratively approved Site Plan ##0014-95 for
Hoss's Steak and Sea House June 7, 1995. The approved site plan calls for the construction of
a new restaurant that will be 9,269 square feet, the creation of a new asphalt parking lot that
will contain curb and gutter and landscaping around the perimeter, 135 regular parking spaces,
six disabled parking spaces that are van accessible with appropriate ramps and signage, and
raised islands that will contain light poles and landscaping, the striping of one loading space, the
provision of a concrete sidewalks to provide access from the parking lot to three sides of the
building, a concrete dumpster pad that will be 288 square feet and completely enclosed with a
six foot high board on board fence with a latched gate, the provision of a freestanding business
sign that will be 22 feet in height and 96 square feet in area, the creation of a storm water
management basin, and all appropriate erosion and sedimentation control measures.
I have provided you with two copies of the approved site plan. This will allow you to provide
the contractor with an on -site copy and keep a copy for your records. Please contact this office
to schedule an on -site inspection once all improvements are complete. Please contact me if I

Of two (2) culverts and one concrete private entrance in conjunction with the
referenced project.
Please ensure a copy of the approved permit assembly is kept at the job site
whenever working within the Route 17/50 right-of-way. I would also like to
remind you of the need to erect and maintain proper traffic control in
accordance with our Virginia Work Area Protection Manual.

application has been made.

As requested, we have reviewed the above referenced project's site plan dated
February, 1995. Our comments may be found marked on the enclosed plans in red and
as follows:
1. The existing 16' wide CG-9D entrance gutter will need to be removed and replaced
with standard CG-6 curb & gutter.
2. We suggest a closer review of the existing curb along the south side of Route 17/50.
The pavement "taper" as shown just east of the existing CG-9D entrance gutter is no
longer in existence.
3. Other miscellaneous comments as marked will need to be addressed.
Please revise and resubmit six copies for final approval. Should any changes be deemed
necessary, please design them to meet or exceed the above recommendations.

This letter is in reference to the parking arrangement at Hoss's
Steak & Sea House located on Millwood Pike in Frederick County.
On May 17, 1996, there was an on -site meeting with the site design
engineer to discuss adjustments to the handicap parking situation.
I have extended the temporary certificate of occupancy on the
restaurant until June 23, 1996. The parking area and other
remaining site items are to be brought into compliance, inspected
and approved by this date.

Dear Keith:
We reviewed the revised site plan dated June 29, 1995, and offer
the following comments:
1) All stormwater run-off resulting from the new access road
needs to be diverted to the stormwater management basin.
A curb inlet or drop inlet would be necessary to divert the
stormwater flows from the pavement into the pond. Provide
a detail showing the proposed structure, contours, culvert
size and stormwater calculations.
2) Provide inlet and outlet protection for the proposed
structure in accordance with the 1992 Virginia Erosion and
Sediment Control Regulations.
Please provide two (2) copies of the revised site plan to this
office for review.
If you have any questions, do not hesitate to contact me.

Your revised site plan dated May 8, 1995, has adequately
addressed our previous review comments. Therefore, we grant approval
for the development of the site for the subject restaurant.
One of our previous comments addressed the need for an erosion
and sediment control plan. We understand that this plan will be
provided by others. Consequently, we request that you inform your
client that the site development cannot proceed until we receive and
approve the erosion and sediment control plan. At that time we will
issue a land disturbance permit.

The accompanying plat represents a boundary line
adjustment survey between two parcels of land (#101 - "Tract
Two" & 101A - "Tract One") conveyed to Miriam N. Rosen by
deed dated November 4, 1994 of record in the Frederick County
Circuit Court Clerk's Office in Deed Book 830 at Page 300.
The said land fronts the southern boundary of Millwood
Pike - U.S. Route 50/17 about 0.35 mile east of the City of
Winchester, in Shawnee District, Frederick County, Virginia
and is bounded as follows:
ADJUSTED PARCEL IOTA
Beginning at an iron pin found in the southern boundary
of Millwood Pike (U.S. Route 50/17) corner to Delco
Development Co. of Winchester; thence with the southern
boundary of Millwood Pike S63°16'53"E - 289.00' to an iron
pin set, a new corner to Parcel 101; thence along new division
lines through Parcel 101 for the following two courses:
S26043107"W - 279.72' to an iron pin set; thence N63°16'53"W
- 262.27' to an iron pin set in a line of Delco Development
Co. of Winchester.; thence with Delco Development Co. of
Winchester N21°15'36"E- 280.99' to the beginning.
Containing. . . . . . . 1.770 acres
Also shown on the accompanying plat are the following
easements reserved to benefit the adjusted parcel IOTA
described above and running through the remaining portion of

20' DRAINAGE EASEMENT
A Drainage Easement, to be 20 feet in width, is hereby

side of the following described centerline:

side of the following described centerline:
Beginning at a point in the southwestern boundary of the
adjusted parcel 101A, said point being S63016'53"E - 10.05'
of the southwestern corner of said lot; thence over parcel 101
S21015'36"E - 86.10' to a point approximately in the center
of an existing 25' drainage easementgranted to Delco Develop-
ment Co. of Winchester by agreement dated September121, 1973
of record in the Frederick County Circuit Court Clerk's Office
in Deed Book 423 at Page 695.
25' DRAINAGE EASEMENT
A Drainage Easement, to be 25 feet in width, is hereby
reserved to benefit the adjusted parcel IOTA and encompasses
an area measuring 12.5' to each side of the following
described centerline (said centerline approximately follows
the center of a portion of that existing 25' drainage easement
granted to Delco Development Co. of Winchester and referenced
above).
Beginning at the end point of the previously described
20' drainage easement, said point being N55027'11"E - 17.79'
of the southwest corner of Parcel 101; thence over Parcel 101
for the following three courses: S64016'14"E - 655.19' to a
point; thencO N31"08'38"E - 172.82' to a point; thence
S68013'02"E - 37.17' to a point in the southeastern boundary
of Parcel 101 (said point being S20°52'06"W - 179.56' of the
northeast corner of said lot).
30' PRIVATE WATER AND SEWER EASEMENT
A Private Water and Sewer Easement, to be 30 feet in
width, is hereby reserved to benefit'Parcel IOTA over a
portion of an existing 30' private water and sewer easement
which was reserved to benefit the former Parcel IOTA by deed
dated December 13, 1991 of record in the Frederick County
Circuit Court Clerk's -Office in Deed Book 769 at Page 1463.
The remainder of said existing easement is hereby vacated. The
portion of said easement to remain benefitting the adjusted
Parcel IOTA is bounded as follows:
Beginning at a point in the southeastern boundary of the
adjusted Parcel IOTA, said point being S26°43'07"W - 129.84'
of the northeast corner of said lot; thence over Parcel 101
for the following three courses: S64031'45"E - 186.90' to a
point; thence S25028'15"W - 30.00' to a point (joining the
corner of an existing 20' public sewer easement (see Deed Book
769, Page 1459) at 10.00' and continuing with said easement
20.00' for a total of 30.00' in all); thence N64°31'45"W -
261.14' to a point in the southeastern boundary of the
adjusted Parcel IOTA; thence with said boundary N21015'36"E -
30.08' to the beginning.
