The Department of Planning and Development will review the application to ensure that it is

Dear Mr. and Mrs. Madigan:
This letter is to inform you that the Frederick County Planning Department administratively
approved site plan #027-96 on October 23, 1996. This site plan consists of a 1,232 square foot
addition to the existing 2,315 square foot building, a split rail fence along Wardensville Pike, 28
stripped parking spaces, I handicap accessible space, and a trash dumpster with enclosure screening.
Please note that this proposed addition maximizes the legal nonconformity of this property, as
provided for in the Frederick County Zoning Ordinance.
Attached are two copies of the approved plan. This will enable you to provide your contractor with
an approved copy, and maintain a copy for your records. Please have the contractor contact this
office to schedule an on -site inspection once all improvements are complete.

Dear Keith:
We have received your revised site plans dated September 30, 1996 for the referenced
project. It appears all of our earlier review comments have been satisfactorily
addressed. The plan is therefore approved with the understanding the proposed split
rail fence along Route 55 will be extended all the way to the eastern property corner.
Please advise the owner of our approval and that a land use permit may now be
applied for to cover work within the Routes 55 and 600 rights -of -way. The permit will
require a minimal processing fee and surety bond coverage. Once satisfactory
application has been made, a permit of this nature will take approximately thirty days
to process and issue.

As requested, we have reviewed the above referenced projects site plan dated
May 31, 1996. Our comments may be found on the enclosed plans marked in red and
as follows:
1. An adequate barrier, either Standard CG-2 curb or permanent fence, will be needed
along the right-of-way line to prevent access across the shoulder. If the owner elects
to use CG-2 curb the entrance radii will have to be reconfigured.
2. The proposed 50' tapers on the advanced side of the entrances will need to be
maintained. However, the opposite side tapers should reduced to standard 36'.
3. The proposed entrance curb Standard CG-6 on Route 55 will need to be changed to
Standard CG-7 due to the posted speed limit.
4. Elevations need to be provided on the top of the proposed curb.
5. Typical sections of the entrances will need to be provided.
6. Due to wash and erosion caused from on site drainage flows, the existing shoulder
and side ditch along Route 55 will need to be reconstructed in accordance with the
typical section we have shown on the plan.
7. The Route 55 entrance culvert and culvert extension along Route 600 will need to be
asphalt coated. The ends of the pipes will need to be mitered to conform to the
adjacent slope.
8. Drainage calculations will need to be provided to support the proposed pipe sizes.

Dear Keith:
I have reviewed the above referenced site plan, received by this office June 10,1996. The following
comments will need to be addressed in order to proceed with approval of this site plan. Please
provide:
1) The owner's and developer's telephone numbers.
2) A space labeled "Approved by the Zoning Administrator" for the approval signature and
date of approval.
3) The location, height, and dimensions of all signs.
4) The location and specifications of outdoor lighting fixtures.
5) A detail of the dumpster enclosure, including a latched gate system.
6) The height of all buildings.
7) The posted speed limits for Route 55 and 600.
8) A barrier between the parking facility and the adjoining state roads. This barrier is
necessary to control vehicular access from this property to the state roads.
9) The property identification numbers (PIN) for the adjoining properties.
10) A handicapped parking space that complies with ADA requirements.
11) A statement that reflects the original building square footage and the proposed
percentage increase. Also state that the property is maximizing its legal
nonconformity expansion rights.
